It should identify who may use which data, for what model and purpose, under which rights and safeguards, and preserve evidence from intake through training, evaluation, reuse and deployment.
Build it in this order: define scope and accountable owners; create a provenance and rights record for every dataset; test purpose fit, quality, representativeness and bias; apply privacy and security controls; record approval conditions; and monitor data, models and downstream uses for change. The exact legal duties depend on your jurisdiction, sector, organizational role, data and AI-system classification.

What a data-use governance policy must control
AI data governance covers more than the moment a training run starts. Controls should follow data through collection or acquisition, curation, annotation, cleaning, transformation, training, fine-tuning, validation, testing, evaluation, release, maintenance and any secondary or downstream use. The OECD recommendation on access to and sharing of data treats data access and sharing as relevant to AI build and use phases, while its AI recommendation calls for traceability and systematic, ongoing risk management. See the OECD Recommendation on Enhancing Access to and Sharing of Data and the OECD Recommendation of the Council on Artificial Intelligence.

Your policy should answer five operational questions for each proposed use:
#1 Best Overall
- [Ultra-Lightweight Ear Buds Designed for Small Ears] Each earbud weighs only 3.7g and features a compact, ergonomic in-ear design made especially for small ears. - [Deep Bass with Clear Vocals] High-performance drivers produce punchy bass while keeping vocals clean and detailed for everyday listening.
- What is the data, where did it come from, and what transformations has it undergone?
- Is the proposed AI purpose compatible with the original collection purpose, contracts and applicable rights?
- Is the data suitable, sufficiently complete and representative for the context in which the system will operate?
- What privacy, confidentiality, security, intellectual-property and fundamental-rights risks remain, and which controls address them?
- Who approved the use, what restrictions apply, and what event requires the decision to be revisited?
A policy should require evidence for each answer. A verbal assurance from a provider or a dataset name in a spreadsheet is not a durable audit trail.
1. Define scope and accountability before accepting data
Start with a scope statement that is specific enough to route a decision. Identify the legal entities, business units, jurisdictions, sectors, teams, data classes, model types and lifecycle stages covered. State whether the policy applies to internally collected data, licensed or purchased data, public web material, customer content, employee information, third-party annotations, synthetic data and data received through partnerships.
Separate the stages that are often incorrectly bundled together. Collection, curation, labeling, training, validation, testing, fine-tuning, evaluation, monitoring and downstream access can have different purposes, people and legal constraints. A permission to evaluate a model does not automatically authorize training it, and an approval for one deployment context does not automatically authorize a materially different audience or geography.

Assign named decision owners
Give each decision a person or committee with authority to approve, condition, reject and suspend use. At minimum, assign accountable owners for:
- Data stewardship and provenance: the person who can explain the source, lineage, quality and retention of the dataset.
- Privacy: the person responsible for personal-data analysis, minimization, individual-rights handling and privacy controls.
- Security: the person who sets access, encryption, environment, logging and incident-response requirements.
- Legal and intellectual property: the person who interprets contracts, confidentiality, copyright, trade secrets, licenses and rights reservations.
- AI risk and product accountability: the person who assesses system impact, intended use, performance limits, human oversight and deployment conditions.
Record a policy owner, an approval quorum, an escalation route and a substitute for each role. Define who can impose a temporary stop when a serious issue is discovered. Keep an exception process with an expiry date; an exception without an owner and sunset condition becomes an informal policy bypass.
Set review and record rules
Specify where decisions are stored, the minimum record fields, access permissions, retention period and versioning method. Require a review when the model, audience, geography, purpose, data combination, contractual terms or legal classification changes. The OECD AI recommendation describes traceability and ongoing risk management as continuing responsibilities rather than a single pre-launch check.

2. Create a dataset intake and provenance record
No dataset should enter a training environment until its identity and history are documented. Preserve lineage through annotation, labeling, cleaning, deduplication, updating, enrichment, aggregation and sampling. The European Commission’s guidance for general-purpose AI providers points to data type, provenance and curation methodology; Article 10 of the EU AI Act lists comparable governance matters for covered high-risk systems. Use the consolidated Article 10 text as a reference for the categories, not as a universal template for every organization.
Minimum intake fields
| Record area | What to capture | Why it matters |
|---|---|---|
| Identity | Dataset name, stable identifier, version, format, size or record count, checksum where practical, and steward | Prevents an approval from silently covering a different file or later revision. |
| Origin | Source or provider, acquisition method, acquisition date, collection period, owner and chain of custody | Allows provenance checks and later reconstruction of how the data entered the organization. |
| Collection purpose | Original purpose, notice or consent context where personal data is involved, and expected users | Supports a purpose-compatibility decision instead of assuming that possession equals permission. |
| Rights and restrictions | License, contract, confidentiality terms, trade-secret indicators, intellectual-property notices, rights reservations, deletion or withdrawal terms and geographic limits | Turns legal and contractual conditions into testable use rules. |
| Content profile | Personal, sensitive, confidential, regulated, copyrighted, proprietary or public material; languages, regions, time periods and populations represented | Determines privacy, security, bias and contextual risks. |
| Processing history | Cleaning, filtering, deduplication, annotation, label instructions, transformations, enrichment, aggregation and responsible tools or vendors | Preserves lineage and makes quality findings reproducible. |
| Assumptions and gaps | What each field is believed to measure, missingness, known errors, sampling limits, stale periods and unrepresented groups | Prevents users from treating an imperfect proxy as a complete account of reality. |
| Proposed use | Model or system, training or evaluation stage, intended users, deployment context, prohibited uses and retention need | Connects the data decision to a concrete risk and purpose. |
Attach supporting evidence rather than merely naming it: contracts, license text, collection notices, provider attestations, sampling documentation, annotation instructions, quality reports and transformation code or manifests. If a field cannot be established, record “not established” with an owner and a decision about whether that uncertainty blocks use.
Maintain lineage after approval
Assign identifiers to source datasets, derived datasets and model versions. A training manifest should show exactly which approved versions, filters and transformations were used. Link evaluation data and known exclusions to the model or system record. If a source is later withdrawn, corrected or found to contain restricted material, you should be able to locate affected derivatives and training runs without reconstructing the history from personal memory.
3. Apply a purpose, rights and reuse gate
Approval should compare the proposed use with the original collection or acquisition purpose, particularly when personal data is involved. Ask what authority supports the new use and whether it covers model training, validation, testing, fine-tuning, evaluation, retention and downstream access. Depending on the facts, relevant constraints can include consent or another lawful basis, contract terms, confidentiality, trade secrets, intellectual-property rights, data-holder permissions, deletion commitments and sector rules.
Use a written decision with conditions
For every dataset and proposed purpose, record one of three outcomes: approved, approved with conditions, or rejected. The decision should state:
Quick wins for a faster PC:
Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →- the exact dataset versions and model or system covered;
- permitted stages, users, environments, geographies and retention period;
- prohibited purposes, prohibited combinations and onward-sharing limits;
- required privacy, security, access, redaction, filtering or human-review controls;
- how individual, customer, provider or rights-holder requests will be handled;
- the evidence reviewed and unresolved uncertainties; and
- the event or date that triggers re-review.
Re-review when the model changes from an internal experiment to a public service, when a new population or geography is added, when the data is combined with another source, when downstream users receive outputs or training artifacts, or when a contract or legal interpretation changes.

EU-specific obligations are role- and system-dependent
The EU Data Governance Act explanation notes that some protected public-sector data may be reusable only under conditions and that consent or data-holder permission may be relevant. Read the European Commission’s Data Governance Act explanation for that framework. It does not answer the rights question for every private dataset or national-law scenario.
For providers of covered general-purpose AI models, Article 53 of Regulation (EU) 2024/1689 includes obligations concerning a copyright policy and a public summary of training content, subject to the Act’s scope and specified exceptions. The Commission’s Article 53 text and guidelines on obligations for general-purpose AI providers explain those role-specific duties. They are not a blanket declaration that every dataset may lawfully be used for every training purpose, and the Commission states that the AI Act does not replace other Union laws. Obtain jurisdiction-specific advice for a real use decision.
4. Test quality, suitability, representativeness and bias
Define acceptance criteria in relation to the intended use. A dataset can be adequate for one task and unsafe for another because the relevant population, geography, behavior, time period or operating conditions differ. Review relevance, quantity, suitability, label accuracy, completeness, consistency, freshness and contextual coverage. Record the method, threshold, reviewer and result; do not reduce quality to a single score that hides material gaps.
Questions for the quality review
- Does each field measure the concept the model needs, or is it a proxy with predictable blind spots?
- Are labels defined consistently, and what is the measured or sampled error rate?
- Which records, languages, regions, time periods, devices or user groups are missing?
- Do collection practices change over time or differ between sources?
- Are duplicates, leakage between training and test sets, corrupted records or incompatible formats present?
- Does the deployment context include conditions absent from the dataset, such as low connectivity, unusual lighting, atypical language or crisis situations?
For covered high-risk AI systems, Article 10 expressly addresses data governance and management, including relevant design choices, collection processes, preparation operations, assumptions, examination of availability and suitability, and assessment of possible biases. Article 10(2) states: “Training, validation and testing data sets shall be subject to data governance and management practices appropriate for the intended purpose of the high-risk AI system.” See Article 10 and Recital 67.
Document mitigation and residual risk
When you find imbalance or error, choose a proportionate response: obtain better coverage, relabel samples, change the task, stratify evaluation, reweight or filter data, add human review, narrow the intended use, or reject the dataset. Record what changed and what remains unresolved. A mitigation is not proof that the underlying limitation disappeared; disclose residual gaps to the people who approve deployment and to downstream users when relevant.
5. Select privacy and security safeguards for the actual risk
Apply minimisation and privacy-by-design and by-default principles throughout the lifecycle. Collect, retain and expose only what the approved purpose requires. Separate raw data from transformed or approved derivatives, restrict access by role, log material actions, and define retention and deletion procedures that can be executed across copies and derivatives where feasible.

Technical and organizational options
- Anonymisation or de-identification: remove or transform identifiers, then test re-identification risk in the context of available auxiliary data. Do not describe a dataset as anonymous merely because names were deleted.
- Encryption: protect data in transit and at rest, with controlled key access and rotation appropriate to the sensitivity.
- Environment and access controls: use approved workspaces, least privilege, separation of duties, export controls and auditable access logs.
- On-device processing: keep data on the device when the task and hardware permit it, reducing transfer of raw material.
- Federated learning: train across participating locations without centralizing raw records, while separately addressing update leakage, membership inference and participant governance.
- Bring computation to the data: run approved algorithms where the data resides instead of copying raw or structured data. The Commission describes this approach in Recital 69.
- Redaction, filtering and retention limits: remove unnecessary sensitive content, block restricted categories and delete working copies when the approved period ends.
A technical safeguard does not itself create a legal or contractual permission. Keep the purpose-and-rights decision separate from the security design, then verify that both are satisfied before training.

Plan for requests and incidents
Define how to respond to correction, deletion, access, objection, confidentiality, license withdrawal and provider-notice requests. Your incident process should cover unauthorized access, accidental inclusion of restricted material, poisoned or manipulated data, data leakage through outputs, and discovery of a material labeling or provenance error. Assign severity levels, notification duties, containment authority and a process for identifying affected model versions and downstream recipients.
6. Control training, validation, testing and reuse
Make the approved data decision enforceable in the engineering workflow. A training job should consume a versioned manifest that lists only approved datasets and transformations. Require separate declarations for training, validation, testing, fine-tuning, retrieval, prompt evaluation and other uses; “used by the model” is too vague to audit.
Evidence to retain for each run
- dataset and derivative identifiers, checksums or immutable references;
- filter, sampling, deduplication, annotation and transformation versions;
- model, code, configuration and environment identifiers;
- operator, date, purpose and approval reference;
- evaluation datasets, exclusions and known limitations;
- access records, exports, incidents and corrective actions; and
- links to the released model, system, interface or downstream consumer.
For pre-trained models, review the data quality and restrictions you inherit rather than treating the model as provenance-free. OECD due-diligence guidance recommends monitoring pre-trained models and conducting data-quality reviews; see the responsible sourcing and training component.
Make downstream reuse explicit
State whether outputs, embeddings, labels, checkpoints, fine-tuned weights, prompts, logs and evaluation artifacts may be shared or reused. A downstream team should receive the restrictions and known gaps with the artifact, not just a model file. Require a new review when a downstream user combines the artifact with new personal, confidential or protected data or uses it in a higher-impact context.
7. Compare datasets and reuse proposals consistently
When choosing between two sources or two proposed uses, use the same decision axes. A cheaper or larger dataset is not automatically the better governed option.
Best Value
| Axis | Questions to compare | Evidence to require |
|---|---|---|
| Provenance and permission strength | Can the source, collection purpose, chain of custody and restrictions be demonstrated? | Contracts, notices, licenses, provider records and lineage manifest. |
| Fit to intended use | Does the population, geography, behavior, time period and context match deployment? | Coverage analysis, sampling description and intended-use statement. |
| Quality and representativeness | How complete, accurate, current and consistently labeled is it? | Error review, missingness analysis, label guidance and bias assessment. |
| Privacy and confidentiality exposure | What personal, sensitive, proprietary or secret material is present, and can exposure be minimized? | Data inventory, risk assessment, access design and retention plan. |
| Bias and rights risk | Could use affect safety, health, fundamental rights or discrimination, and are mitigations feasible? | Impact analysis, subgroup evaluation, mitigation plan and residual-risk sign-off. |
| Lineage and control | Can restrictions, corrections and withdrawal requests reach derivatives and future users? | Versioning, model linkage, audit logs, deletion procedure and downstream terms. |
Reject a proposal when a material uncertainty cannot be bounded by narrowing the purpose, adding controls or obtaining better evidence. Record why the rejected option was not used so it is not resubmitted as an apparently new request without addressing the original defect.
8. Put the policy into an approval workflow
The following sequence turns the policy into a repeatable operating process.
- Register the request. Capture requester, business purpose, model or system, lifecycle stage, intended users, geography, urgency and requested retention.
- Classify the data. Mark personal, sensitive, confidential, regulated, copyrighted, proprietary and public elements, including mixed datasets.
- Collect provenance evidence. Complete the intake record, attach source and contract material, document transformations and identify gaps.
- Run the purpose-and-rights review. Compare the proposed use with the original purpose and applicable permissions. Write permitted and prohibited uses.
- Run quality and impact reviews. Test suitability, representativeness, label quality, bias, safety and rights effects for the intended context.
- Design safeguards. Choose minimisation, redaction, anonymisation, encryption, access, environment, retention and monitoring controls proportionate to risk.
- Obtain accountable approval. Route the record to data, privacy, security, legal/IP and AI-risk owners as required. Record conditions, unresolved limitations and expiry or re-review triggers.
- Enforce the decision technically. Issue an approved dataset manifest, permissions and environment controls. Block unapproved versions and exports.
- Record execution. Link training and evaluation runs, model versions, incidents, access and transformations to the approval.
- Monitor and re-evaluate. Review changed data, newly discovered errors or bias, altered deployment context, new downstream access and changed legal or contractual terms.
Automating routing or manifest checks can reduce human error, but automation should enforce a documented decision rather than silently decide that rights, purpose or social impact are acceptable.
9. Monitor the policy after deployment
Set a review cadence that matches data volatility and impact. High-change sources, sensitive data and high-impact systems need more frequent checks than a stable, low-risk internal experiment. At each review, examine whether the source changed, labels or schemas drifted, coverage shifted, new errors or bias appeared, access expanded, retention was exceeded, or the system moved into a new context.
Mandatory re-review triggers
- a new dataset version, source, provider or transformation;
- newly discovered personal, confidential, copyrighted or restricted material;
- a correction, deletion, withdrawal or rights-holder request;
- material quality, drift, bias, safety or security findings;
- a changed model architecture, capability, audience, geography or use case;
- new downstream access, fine-tuning, export or combination with another dataset; or
- changed law, regulation, contract or provider terms.
Use review records to show not only that a decision was made, but that it remained appropriate. Preserve the old decision and its evidence when issuing a new one; overwriting history destroys the ability to explain what was known at the time of training.
Common policy failures and practical fixes
| Failure | Why it fails | Fix |
|---|---|---|
| “Public” is treated as “free to train on.” | Public availability does not settle personal-data purpose, copyright, contract, confidentiality or rights-reservation questions. | Record source, purpose, rights, restrictions and a use-specific decision. |
| One approval covers every future model. | Purpose, audience, geography, data combinations and risk can change. | Bind approval to versions, stages, purposes and re-review triggers. |
| Only names and emails are removed. | Indirect identifiers, rare attributes, free text and auxiliary data can still expose people. | Assess contextual re-identification risk and limit access, retention and exports. |
| A single quality score hides gaps. | Overall accuracy can conceal missing populations, label disagreement or deployment mismatch. | Report coverage, errors, missingness and subgroup results with residual limitations. |
| Lineage ends at the source file. | Cleaning, annotation, aggregation and fine-tuning can change the risk and meaning. | Version every derivative and link it to runs, models and downstream artifacts. |
| Technical controls are used as legal proof. | Encryption or federated processing reduces exposure but does not grant permission. | Complete a separate purpose-and-rights decision, then document safeguards. |
| Exceptions have no expiry. | Temporary experiments become permanent undocumented practice. | Give every exception an owner, scope, compensating controls and end date. |
How EU AI Act references fit into your policy
The EU AI Act is not a universal data-governance template. Article 10 duties discussed here concern data governance for high-risk AI systems, while Article 53 duties concern providers of general-purpose AI models and include specified exceptions. Applicability depends on the Act’s scope, the organization’s role and the system classification. The Commission’s overview is available at AI Act.
Use Article 10’s categories—data choices and collection, preparation operations, assumptions, suitability, availability, examination, bias and governance—as a strong checklist when they apply. Use Article 53 and the Commission’s GPAI guidance when the organization is a covered provider, especially for copyright-policy and training-content-summary duties. Do not infer from either provision that a particular national-law, contractual, privacy or intellectual-property question has been resolved.
A compact policy contents checklist
- Purpose, scope, definitions and covered jurisdictions.
- Roles, decision rights, escalation, exceptions and review authority.
- Dataset classification and mandatory provenance record.
- Purpose compatibility, rights, contracts, confidentiality and reuse rules.
- Quality, representativeness, bias, safety and fundamental-rights review.
- Privacy-by-design, minimisation, security, retention and deletion controls.
- Approved environments, access, export and logging requirements.
- Training, validation, testing, fine-tuning, evaluation and downstream-use records.
- Incident response, correction, withdrawal and affected-model analysis.
- Monitoring, re-review triggers, evidence retention and policy update cadence.
The final approval should be understandable to an engineer implementing a manifest, a privacy specialist assessing a request, a lawyer checking rights, an auditor reconstructing lineage and a product owner deciding whether the intended use is still within bounds. If any of those people cannot tell what is allowed, what is forbidden and what evidence supports the decision, the policy is not yet operational.
