You can’t reliably tell from one price whether a seller used your personal data, and no consumer trick is proven to force a lower quote. Your best defense is to compare the exact same item and purchase terms across sellers, check the final total, and treat private browsing or a VPN as optional comparison experiments—not guaranteed fixes.
What surveillance pricing is—and what a price change does not prove
Surveillance pricing uses personal data and algorithms to tailor prices, discounts, offers, or the products shown to a shopper. It can overlap with dynamic pricing, where prices change with factors such as time, supply, demand, or sales channel. A price changing—or two shoppers seeing different prices—does not by itself establish that a company used an individual profile to set the price. The FTC staff’s 2025 issue spotlight explains the distinction and the possible role of personal data.

Data that could inform a tailored offer include location, demographics, browsing and shopping history, online behavior, and information collected by a business or obtained through advertising and analytics services, data brokers, or credit providers. Algorithms can use those signals to infer preferences or likely willingness to pay. The resulting change might be a different price, a discount, a product recommendation, or which items appear in a storefront.

It identified possible signals such as precise location, browser history, demographics, shopping patterns, mouse movements, and products left in an online cart. The agency said intermediaries it examined worked with at least 250 clients selling goods and services including groceries and apparel. That is a count of intermediary clients—not 250 retailers proven to have charged shoppers personalized prices. One example in the announcement, a new parent being shown higher-priced baby thermometers, was explicitly hypothetical.

The public findings establish that tools and intermediary services can support tailored prices and offers; they do not establish that a named retailer charged you more because of your personal profile. The FTC staff also said more research is needed to determine when the practice raises prices and what its overall effects are. Risks discussed include privacy, misleading promotions, steering toward particular products, discrimination, and competition concerns; the cited materials do not establish a settled economy-wide price impact or universal harm.
How to compare prices without being misled by the headline number
- Match the item. Compare the same model, size, quantity, and condition. A similar-looking product or different bundle is not a like-for-like comparison.
- Match the purchase terms. Check delivery timing, shipping, fees, return terms, and any membership or account requirement. A lower displayed price may produce a higher final cost.
- Compare the final total. Take the price through checkout far enough to see taxes, shipping, and fees before deciding. Compare the total for the same item under the same terms, not just the listing price.
- Check promotions separately. A personalized coupon, discount, or product ranking can change the effective deal even if the listed price is unchanged. Read eligibility, quantity limits, and other conditions before counting a promotion as savings.
- Record high-stakes or recurring purchases. For an expensive item or a purchase you make regularly, note the date, seller, item, and final total. A record can show that an offer changed, but it cannot reveal why it changed.
Do incognito mode or a VPN lower prices?
They may be useful for a comparison, but neither is a dependable way to beat personalized pricing. In its August 2026 announcement, the FTC suggested that informed consumers might try a VPN or private browsing session. The agency did not establish that either method reliably lowers a particular shopper’s price or prevents a seller from recognizing them.

- Find the exact item and terms you want to compare.
- Check the offer in a private browsing session or, if you already use one, through a VPN. Compare the same product without logging in, then compare it with your usual session.
- Compare the final checkout totals. If they differ, record the date and terms, but do not assume the difference proves profiling or that the experiment will produce the same result later.
Private browsing and a VPN have limits: they are not guarantees that a seller cannot recognize a shopper, and they may not change the offer. Repeated searches, cookie clearing, or incognito mode should not be treated as proven ways to make prices fall. The official materials cited here provide no reliable consumer-side test for identifying whether a particular observed price was set using an individual profile.
Which practical steps are worth trying?
| Step | What it can help you do | What it cannot establish |
|---|---|---|
| Compare the identical item and final total across sellers or channels | Find a lower available offer while accounting for fees and terms. | Whether a price difference was caused by personal data. |
| Keep dated price notes, screenshots, and receipts | Document what was offered and what you paid, especially for a costly or recurring purchase. | Why the price or promotion changed. |
| Use a private session or VPN for a comparison | Check whether the same offer appears in a different browsing context. | That the seller cannot recognize you, or that the price will be lower. |
| Review optional data sharing | Reduce unnecessary exposure by checking app permissions and optional account or loyalty-program settings. | A specific reduction in the price you are shown; the cited materials do not demonstrate that outcome. |
What to do if a price or promotion seems deceptive
Keep screenshots of the offer and its conditions, along with receipts or other records showing what you were charged. If a seller’s price or promotion appears inconsistent with what it represented, report the concrete facts through ReportFraud.gov, which the FTC announcement identifies as a consumer reporting channel. A documented discrepancy can support a complaint; it does not by itself prove surveillance pricing.

What the FTC’s personalized-pricing proposal means
On August 19, 2026, the FTC announced that it was seeking public comment on a draft enforcement policy statement about personalized pricing. The announcement, updated August 31 to correct an earlier error, defined the practice as using personal data to set prices according to what a company believes an individual is willing to spend. It said undisclosed collection or use of personal data for pricing could violate the FTC Act and other laws the agency enforces.
The announcement quoted FTC Chairman Andrew Ferguson: “The FTC does not have the legal authority to ban personalized pricing in all circumstances, but businesses that fail to tell consumers how their personal data is being used to set a price may be in violation of the FTC Act and other laws we enforce.” The comment deadline was September 18, 2026, which had passed by October 7, 2026. The cited announcement does not establish what final action, if any, followed. The proposal is not a final rule or a blanket prohibition, and it does not make all dynamic pricing unlawful. See the FTC announcement for its stated position and procedural details.
