A written policy tells you what should happen; logs and review records help show what did happen. Start with the law and rules for the jurisdiction you are examining: California provides useful examples, but its requirements are not universal.
What an ALPR access audit needs to establish
An ALPR system can collect images of passing vehicles and associated plate-read data. An audit of police access should answer four separate questions: who could use the system, who actually searched it, whether each search was authorized and justified, and whether anyone checked for violations and acted on the results.

- Access: Which people, agencies, administrators, vendors, or network users had the ability to view or query records?
- Use: What was searched, when, by whom, and for what stated purpose?
- Authority: Did the user have an approved role, and did the search fit a permitted purpose and a real assignment or case?
- Oversight: Did a supervisor or auditor review query activity, investigate exceptions, document decisions, and track corrective actions?
A username and a purpose field are not, by themselves, proof that the access was appropriate. They are starting points to test against identity records, training and approval documents, case files, system configuration, and audit workpapers.

Before requesting logs, define the agency and system, the period under review, the vendor or shared network involved, the applicable policy version, and the official records custodian. Determine whether the agency operates the database, uses another operator’s system, or does both. The legal duties can depend on that role and on the jurisdiction.

California is a concrete example, not a nationwide rule. California SB 34 requires covered ALPR operators and end-users to adopt written, publicly available usage and privacy policies. The statute identifies policy subjects including authorized purposes, eligible job roles and training, monitoring, sharing or transfer, custodianship, accuracy and correction, and retention and destruction. For covered operator access, its required record includes the date and time, query data, username and affiliation as applicable, and purpose. It also requires reasonable operational, administrative, technical, and physical safeguards. The statute states: “The record shall include the date and time the information is accessed.”
California DOJ’s 2023 guidance distinguishes an operator from an end-user and explains that the access-log duties apply when an operator accesses or provides access, including by allowing another agency to query its database. It also describes limits on sharing by California law enforcement agencies with private entities, out-of-state agencies, and federal agencies. The application of those limits can turn on operational details—for example, whether a service is data hosting or towing—so assess the actual arrangement and obtain legal review rather than treating every vendor or service relationship alike.
Collect the current usage and privacy policy, applicable laws and regulations, user and data-sharing agreements, retention schedule, training rules, vendor contract and security addenda, audit procedures, relevant public-meeting records, and prior audit findings. The California State Auditor has also discussed vendor-contract safeguards. Do not assume a vendor could see raw or identifiable data just because it hosts or supports the system; verify access rights through contract terms, configuration, and logs.

Run the audit from source records to findings
- Set and document the scope. Record the agency, system and vendor, review dates, system role, connected networks, jurisdiction, policy version, and records custodian. Identify which data classes and access routes are in scope.
- Obtain native records and preserve their context. Request or inspect original access-log exports, user and role rosters, account approvals and terminations, case or incident references, query-result and export logs, external-agency access lists, administrator changes, audit workpapers, and remediation records. Preserve export metadata, date range, time zone, field definitions, and any explanation of vendor-side logging. These are recommended audit records; not every jurisdiction mandates each item.
- Reconcile usernames to people and permissions. Sample across users, dates, agencies, shifts, and query types. Verify each person’s identity, employment status, training, approved role, access approval, and continuing need. Check dormant, shared, administrator, and terminated-user accounts. California DOJ General Order 2023-05, for example, limits access to people with an authorized need and approval, with approvals reviewed annually.
- Test the reason for each sampled query. Compare the logged purpose and query with the case or incident record, the user’s assignment, and the policy’s permitted uses. Check whether a required case reference exists and whether the scope of the query makes sense for the stated purpose. California law requires the purpose to be recorded and restricts use to purposes authorized by policy.
- Map sharing and vendor pathways. Identify how another agency, contractor, vendor, or shared-network user could access ALPR data. Compare approved agency lists and agreements with actual access logs. Examine exports and emailed records, and establish whether vendor personnel can access raw or identifiable data, for which support purpose, under what authorization, and with what monitoring. California DOJ guidance addresses sharing limits and user agreements; the State Auditor has discussed vendor protections, including contract provisions related to CJIS.
- Verify that oversight happened. Compare required or promised audit schedules with completed reports. Determine whether reviewers examined actual searches rather than only account lists, who performed and approved the work, how exceptions were investigated, and whether corrective actions were tracked to closure.
- Test retention and accuracy controls. Inventory raw reads and images, hot lists, query logs, exported records, audit workpapers, and investigative evidence separately. Compare deletion settings and exceptions with applicable law, policy, contracts, and evidence or litigation holds. Check whether plate-read accuracy is tested and whether identified errors are corrected.
- Write findings that distinguish evidence from inference. For each finding, state the expected control, records examined, sample and period, exception, risk, and agency response. A missing or incomplete log is a control failure, but it does not alone prove that a particular search was unauthorized or establish a user’s motive. Recommend proportionate remediation, such as disabling unjustified access, preserving records, reviewing affected searches, correcting permissions, retraining users, updating agreements, or scheduling a follow-up test.
Judge query purpose and suspicious patterns carefully
For each sampled search, look for a traceable connection between the user’s job, the stated purpose, and a contemporaneous case or incident record. A valid case number can help establish that connection, but its presence does not prove the search was necessary or properly scoped. Conversely, a sparse log may leave the auditor unable to confirm a search even when other records later provide an explanation.
Potential red flags include vague boilerplate purposes, repeated searches with no evident case or operational basis, unusually broad date ranges, missing required references, or searches involving sensitive people or locations when those categories are within scope. Treat these as leads for follow-up, not proof of misconduct by themselves. Ask for supporting records and the user’s assignment context, and document what remains unverified.
Test whether the log records unsuccessful as well as successful searches. NCRIC’s 2024 regional policy is one example that calls for recording the queried plate whether or not a match was found, alongside the user, agency, date and time, and a valid case number. A system that records only hits could leave an incomplete picture of search activity.

Audit sharing separately from individual searches
Access by another agency or vendor is not merely an extension of one officer’s query. Build a map of every route through which data can be viewed, queried, exported, or received, then reconcile those routes with technical permissions, agreements, approved-user or agency lists, and actual access records.
- Compare the agencies and users in system logs with current sharing agreements and approvals.
- Review downloads, exports, email transfers, and other off-system copies for authorization, purpose, recipients, and handling controls.
- Establish what vendor support staff can access, under which circumstances, and whether that access is logged and reviewed.
- Check whether agreements cover permissible use, onward sharing, security, retention, deletion, incident reporting, and audit rights as required by local rules and policy.
California DOJ’s guidance describes state-specific limits involving private entities and out-of-state and federal agencies. Do not apply those limits as if they govern every jurisdiction, and do not infer vendor access from hosting alone. Confirm the law and the actual technical and contractual arrangement.
Compare oversight cadence and the records it produces
Stated frequency matters less than what reviewers examine and what happens after they find an exception. A quarterly report limited to account lists may reveal less about actual use than a less frequent review that tests queries against cases, sharing rules, and follow-up records.
| Example | What it calls for or describes | How to use it in an audit | Scope and caveat |
|---|---|---|---|
| California SB 34 | Written, publicly available usage and privacy policies; specified access-log fields for covered operator access; policy requirements that include monitoring and audit provisions. | Use it as a California statutory baseline for policy coverage and query-level records. | California-specific. It does not set a general ALPR-data retention period. |
| California DOJ General Order 2023-05 | Annual audits of access, use, and sharing; administrator review and approval; audit information retained for three years. | Compare the actual audit reports, approval trail, and audit-record schedule with the order. | Applies to that DOJ program, not all agencies. |
| NCRIC 2024 policy | Quarterly reports to supervisory personnel; log fields include user, agency, date and time, queried plate whether matched or not, and a valid case number. | Use as a regional example of more frequent reporting and explicit case linkage. | Regional policy. Its vendor-retention statements are time-sensitive: it described a then-current vendor maximum of 30 days, while the policy discussed a 365-day maximum subject to shorter law or vendor limits. |
| NIJ-hosted policy guidance | A broader framework recommends retained records that facilitate audit and prosecutor or attorney-general review; the framework states five-year periods. | Use as a documentation and external-oversight model, not as a binding retention rule. | The report is older, says it was not published by DOJ, and says it does not necessarily reflect DOJ’s official position. |
For any model, inspect whether the review covers query events, purpose and sharing; whether a supervisor or independent reviewer signs off; how exceptions are resolved; how long audit evidence is retained; and whether findings are made public where required. A policy’s cadence is not evidence that the audits were completed or effective.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Keep ALPR-data retention distinct from audit-evidence retention
Raw plate reads and images, query logs, exported copies, audit workpapers, and records preserved as investigative evidence are different record classes. They can have different retention schedules and different exceptions. Record the schedule and actual system setting for each class, including the handling of legal holds or evidence designations; do not substitute one retention figure for another.

California SB 34 does not set a universal retention period for ALPR data. The California State Auditor’s 2020 report said the statute did not establish a general period. That report described then-applicable California law as limiting California Highway Patrol retention of ALPR images to no more than 60 days, subject to exceptions for felony investigations or evidence. This was a CHP-specific rule as described in a 2020 report, not a statewide period for every agency; check current law before relying on it.

The State Auditor recommended setting a maximum retention period and periodically evaluating whether ALPR-image retention is as short as practicable, with attention to hot lists as well. California DOJ General Order 2023-05’s three-year period applies to audit information, not to ALPR images. NCRIC’s 2024 policy illustrates why dated vendor details should not be generalized: it described a then-current 30-day vendor maximum while discussing a 365-day policy maximum subject to shorter legal or vendor limits.
Retention has practical consequences for an audit. If query logs are deleted before the review period ends, the agency may be unable to demonstrate who searched or whether searches were reviewed. If ALPR images are kept longer than policy allows, that raises a different control question. Document which record is missing or over-retained rather than describing both as a single data-retention issue.
Include accuracy in the access audit
A search can be authorized and still produce a misleading result if the plate was misread or associated with the wrong vehicle. Review the agency’s process for validating reads, correcting identified errors, and communicating corrections to users or recipients of exported data. BAR’s policy provides one example: periodic spot-checks compare captured plate readings with manually reviewed images, with identified errors corrected. Treat this as an example of a control, not a universal requirement.

The audit should distinguish a data-quality problem from an access-authorization problem, while noting when both affect the same event.
Use historical scale figures only with their dates
The California State Auditor’s 2020 report described Sacramento’s system collecting 1.7 million ALPR images in one week during the period it reviewed, and Los Angeles having accumulated more than 320 million images over several years. Those figures illustrate the potential volume of records in that historical review; they are not current system counts.
Large volumes make it especially important to define the audit period, preserve complete exports, understand which events the logs include, and state the sample limitations. The reviewed policies do not establish a universal sample size, a current vendor’s exact log-export features, or one audit cadence for all agencies. Obtain the local system documentation and applicable requirements before drawing system-specific conclusions.
