Map exactly how the tool influences a decision, validate that it measures a skill required for the specific job, compare outcomes for relevant groups, test decision-specific errors, check disability access and accommodation, and monitor the system after deployment. In the United States, ordinary employment-discrimination law still applies when software scores, ranks, filters, recommends, or substantially assists a human decision. New York City adds specific audit, publication, and notice duties for covered automated employment decision tools (AEDTs).
What an AI employment audit can—and cannot—establish
A sound audit answers separate questions that are often incorrectly collapsed into one “fairness score”:
As an Amazon Associate I earn from qualifying purchases.
- Statistical disparity: Do selection, ranking, scoring, or recommendation outcomes differ materially among relevant groups?
- Job-related validity: Does the procedure measure a construct or skill connected to successful performance in the particular role?
- Technical accuracy and reliability: How often does the system produce the wrong result, and are results stable under realistic conditions?
- Accessibility: Can applicants and employees with disabilities use the process or obtain reasonable accommodation?
- Legal compliance: Does the employer’s complete practice satisfy the laws that apply to the location, job, population, and decision?
A favorable impact ratio does not prove that a system is accurate, valid, accessible, or lawful. Conversely, an error finding does not by itself establish disparate impact. Keep these findings separate, document the evidence for each, and have qualified employment counsel, industrial-organizational psychologists, statisticians, and accessibility specialists review decisions that will affect real people.
The U.S. Equal Employment Opportunity Commission (EEOC) has long treated tests and other neutral selection procedures as subject to Title VII. Procedures that disproportionately exclude a protected group may violate Title VII unless they are job-related and consistent with business necessity. The EEOC says determining disparate impact ordinarily requires statistical analysis. Its guidance also makes clear that an employer remains responsible for validating a vendor-supplied procedure. A vendor’s technical report can inform your assessment; it does not transfer the employer’s legal duty.

Historical context matters but should not be misrepresented as an AI statistic. The EEOC reported 304 discrimination charges involving employment testing and exclusions based on criminal-background checks, credit reports, and other selection procedures in fiscal year 2007, a high point for that category at the time. That figure is not a prevalence rate for modern AI hiring tools.
Step 1: Scope the decision and map the complete system
Start with the employment decision, not the product name. Write down the job family, work location, applicant or employee population, and the point at which software affects a hiring, promotion, transfer, or termination decision. Include every component: an application parser, assessment, video or speech feature, ranking model, interview aid, rules engine, and human dashboard.
Document inputs, transformations, and outputs
For each component, create a data-flow record that answers:
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errors- What information enters the system (resume text, application answers, test responses, work samples, video, audio, keystrokes, assessments, or prior employment data)?
- What preprocessing, feature extraction, normalization, or imputation occurs?
- What model, configuration, threshold, or rule version is used?
- Does the output take the form of a score, label, classification, recommendation, ranking, or pass/fail result?
- Who sees the output, and what action can that person take?
- Can a recruiter override the result, and is the override recorded?
- What is the final outcome used for analysis: interview invitation, advancement, offer, promotion, or another decision?
NYC rules describe simplified AEDT outputs that can include a score, tag or categorization, recommendation, or ranking. A human somewhere in the workflow does not automatically remove a tool from scrutiny. Determine how much discretion the reviewer actually has, whether the software substantially assists the decision, and which legal definition applies in the jurisdiction.
Set the audit population and comparison groups
Specify the time period, requisitions, job levels, locations, and stages included. Define which demographic groups can be analyzed lawfully and reliably, how self-identification will be handled, and what denominator represents the people genuinely considered at that stage. Preserve a record of missing demographic data and small-cell suppression. Do not infer protected characteristics casually from names, photographs, voice, or other proxies; consult privacy and employment counsel about any lawful analysis method.
Step 2: Define the job-related purpose before testing the model
Write a plain-language purpose statement such as, “This structured work-sample assessment estimates the ability to reconcile customer-account records for the first-year service-representative role.” Avoid descriptions such as “identifies high potential” unless you can define the construct and show how it relates to the job.

Establish the construct and evidence
Ask the vendor and internal subject-matter experts to identify:
Free tools Windows power users keep installed
One-click scans. No signup required.
- The knowledge, skill, ability, trait, or behavior the procedure is intended to measure.
- The job analysis or other evidence connecting that construct to duties and successful performance.
- The roles, seniority levels, locations, languages, and working conditions for which the evidence applies.
- The validation design, criterion measures, sample characteristics, test version, scoring method, and confidence limits.
- Known limitations, excluded populations, accessibility constraints, and the system’s change history.
Check whether a generic measure has been substituted for the actual skill. A language-heavy assessment may be inappropriate where the job requires technical reasoning but little writing; a facial or voice signal may reflect an impairment, culture, equipment, or environment rather than job capability. The EEOC advises employers to validate procedures for the positions and purposes in which they are used. Evidence from a different occupation, population, or deployment condition may be informative but is not automatically transferable.
Review vendor claims without outsourcing responsibility
Request technical documentation, data definitions, test instructions, scoring logic at an appropriate level of detail, validation studies, version identifiers, monitoring reports, and a description of material updates. Compare those materials with your actual configuration. Record what was accepted, rejected, or left unresolved. A contract clause saying that a vendor’s tool is “bias-free” is not validation and does not excuse an employer’s own assessment.
Step 3: Measure selection outcomes and investigate disparate impact
Calculate selection rates or other decision outcomes for each relevant group using a documented population and denominator. Depending on the stage, the outcome may be an invitation to interview, a pass score, advancement to the next round, an offer, or a promotion recommendation. Analyze intersectional groups when sample size and sound methods permit—for example, groups defined by both race and sex—rather than assuming every group experiences the same pattern.
Use an impact ratio as a screening indicator
An impact ratio compares a group’s selection or scoring rate with the comparison rate specified by the applicable rule or analysis plan. NYC’s rule defines an impact ratio using selection or scoring rates. State exactly which rate is the numerator, which comparison group or reference rate is the denominator, the stage being measured, and the date and population used. A ratio is a signal for investigation, not a universal safe harbor or a complete fairness test.

| Audit item | What to record |
|---|---|
| Outcome | Exact decision, score band, ranking cutoff, or recommendation being analyzed |
| Population | Requisitions, locations, job levels, dates, and people eligible for that decision |
| Group definitions | Protected or otherwise relevant groups, intersectional categories, and lawful data source |
| Denominator | Who was actually considered at the stage, with exclusions explained |
| Uncertainty | Sample sizes, confidence intervals or other uncertainty measures, missingness, and suppression rules |
| Interpretation | Whether the result triggers investigation; it is not, by itself, a validity or compliance conclusion |
Investigate the reason for a difference
Check whether the disparity comes from the model, an upstream eligibility rule, unequal access to the assessment, different completion rates, a threshold, recruiter behavior, or a later human stage. Compare rates before and after each transformation. Review distributions, not only pass/fail counts: two groups can have similar pass rates while receiving materially different rankings or score volatility.

Use statistical methods suited to the sample and design. Explain why groups were selected, how small samples affect precision, how missing demographic information was handled, and what privacy safeguards were used. Avoid treating a single p-value or ratio cutoff as a complete answer. If an employment practice has disparate impact, examine whether it is job-related and consistent with business necessity, then assess whether an equally effective alternative with less adverse impact is available. Document the employer’s decision and rationale.
Step 4: Test accuracy, reliability, and failure modes
There is no single universal AI-hiring accuracy threshold prescribed by the official guidance summarized here. Define “correct” in relation to the actual decision and test the conditions in which the tool will operate.
Define errors that matter for the decision
- False exclusion: a qualified applicant is screened out or ranked below a meaningful opportunity threshold.
- False positive: a person is advanced or recommended despite lacking the job-related capability the procedure is meant to assess.
- Unstable result: materially different scores or rankings arise from equivalent inputs, reasonable retesting, or minor non-job-related changes.
- Input failure: the system misreads a resume, transcript, accent, assistive technology output, video, audio, or work sample.
- Decision mismatch: the score does not correspond to the defined construct or to an appropriate measure of later job performance.
Design a defensible test set
Record data provenance, sample size, job and population scope, model or configuration version, missing values, exclusions, and uncertainty. Include realistic variations in devices, browsers, network conditions, language, formatting, and permitted assistive technology. Where a performance criterion is available, predefine the outcome window and the criterion’s limitations; “success” must not simply mean that a manager liked the person who was hired.
Inspect calibration and reliability where scores are used, but do not mistake a stable score for a valid measure. A system can be highly consistent and consistently measure the wrong thing. Test subgroup error patterns and intersectional patterns when feasible. Investigate outliers manually under a documented protocol, and preserve the original input and output so an incident can be reproduced.
Retest after material change
Repeat checks after a model update, new training data, threshold change, new job family, changed assessment instructions, new vendor component, or material shift in the candidate population. Set written triggers for escalation, such as an unexplained outcome shift, a new accessibility complaint, a rise in overrides, or evidence that the tool is being used outside its validated purpose.
Step 5: Check disability access and accommodation
The ADA can be implicated when an assessment screens out people with disabilities, measures an impairment rather than the skill it claims to assess, or is administered without reasonable accommodation. The EEOC and the U.S. Department of Justice identify accommodation processes, screening-out risk, and prohibited disability-related questions or medical examinations as central concerns.

Test whether the modality measures the intended skill
Examine timed tasks, video interviews, speech analysis, eye tracking, typing, drag-and-drop controls, color or audio cues, and any requirement to use a particular device. Ask whether each feature is essential to the job-related construct. A speech signal may be affected by a disability or assistive device; a timed response may measure motor speed rather than reasoning; a video requirement may create a barrier unrelated to the work.

Do not collect disability or health information outside the legally permitted context. Have qualified accessibility and legal professionals evaluate the deployed interface, not merely a vendor’s conformance statement.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Step 6: Build governance, records, and monitoring
Assign accountable owners across HR or talent acquisition, legal, procurement, data science, accessibility, information security, and the vendor. A practical governance record should preserve:
- Tool, model, prompt, rule, and configuration versions.
- Input definitions, data lineage, retention periods, and access controls.
- Validation plans, test data, analysis code or reproducible procedures, and results.
- Group definitions, denominators, uncertainty measures, and explanations for missing data.
- Complaints, accommodation requests, incidents, overrides, appeals, and corrective actions.
- Approval dates, deployment scope, known limitations, and the person authorized to suspend use.
Monitor outcomes after launch rather than treating a predeployment audit as permanent. Establish a cadence appropriate to volume and risk, plus event-driven reviews after material changes. Define thresholds that trigger investigation, remediation, pause, or retirement. Possible responses include changing a threshold, removing a feature, adding an accommodation route, retraining or recalibrating, narrowing the tool’s job scope, or returning a decision to a documented human process.
The National Institute of Standards and Technology’s voluntary AI Risk Management Framework (AI RMF) provides a lifecycle risk-management structure that addresses validity, reliability, transparency, explainability, privacy, and fairness while managing harmful bias. It is not a hiring-law certification and cannot by itself establish compliance.
Step 7: Apply New York City Local Law 144 when it covers the tool
New York City Local Law 144 applies to an automated employment decision tool used to screen candidates for employment or employees for promotion in the city, as defined by the law and its rules. Coverage depends on the actual tool, decision, and use; do not assume that a human review or a vendor label determines the answer.

Core duties described by NYC guidance
- Ensure a bias audit has been conducted within one year before using a covered AEDT.
- Make the required summary of the most recent audit and the tool’s distribution date publicly available before use.
- Provide the required notices to candidates or employees.
The Department of Consumer and Worker Protection (DCWP) states that enforcement began July 5, 2023, and clarifies that notice is to be provided at least 10 business days before use. Confirm the current law, rules, frequently asked questions, and agency guidance for exact publication, distribution, and notice details; the code publisher warns that its text may not reflect the latest changes.
A NYC-compliant audit is a minimum obligation for covered tools, not a general guarantee of accuracy, accessibility, validity, or federal-law compliance. Keep evidence showing the audit’s scope, auditor qualifications and independence, population, methodology, findings, remediation, publication, and notice dates. Recheck coverage when the job location, decision stage, tool configuration, or law changes.
How to compare audit approaches and providers
Whether you use an internal team, an independent auditor, or a blended review, compare the engagement on the same axes. A polished report with a narrow sample may be less useful than a modest report that matches the actual deployment.
| Comparison axis | Questions to ask |
|---|---|
| Job-related validity | What construct is measured, what job analysis supports it, and does evidence apply to these roles and conditions? |
| Outcomes and groups | Which decisions, stages, groups, intersections, denominators, and time periods are included? |
| Error and reliability | How are false exclusions, false positives, instability, input failures, and criterion mismatch defined and tested? |
| Disability access | Are modalities reviewed, accommodation pathways tested, and unnecessary medical data excluded? |
| Transparency | Are methods, limitations, versions, data sources, and unresolved questions documented clearly? |
| Change control | What triggers a retest after a model, threshold, job, vendor, or population change? |
| Privacy and security | Are demographic, applicant, and assessment data minimized, protected, retained, and deleted appropriately? |
| Independence | Does the auditor have relevant statistical, employment-testing, legal, and accessibility expertise, and are conflicts disclosed? |
| Scope | Does the analysis cover the actual geography, job family, edition, workflow, and human overrides? |
| Monitoring | Will the engagement define post-launch measures, escalation thresholds, and corrective-action ownership? |
A practical audit worksheet
Use the following sequence as a working checklist, adapting it to the applicable law and risk:
- Describe the decision: name the role, location, stage, decision maker, and employment consequence.
- Inventory the system: list vendors, components, inputs, transformations, outputs, thresholds, reviewers, overrides, and versions.
- Define the construct: state the job-related skill and the evidence connecting it to performance in this role.
- Freeze the scope: identify the population, dates, requisitions, denominator, groups, intersections, and missing-data rules.
- Analyze outcomes: calculate selection or scoring rates and impact ratios where appropriate; quantify uncertainty and investigate differences.
- Test errors: predefine false exclusions, false positives, instability, input failures, and criterion mismatch; test realistic conditions.
- Test accessibility: review modalities, assistive technology, accommodation requests, alternatives, response times, and complaint handling.
- Apply the law: evaluate Title VII, ADA, NYC Local Law 144 where applicable, and other state or local requirements with counsel.
- Decide and document: approve, restrict, remediate, suspend, or retire the tool, stating evidence, uncertainty, owner, and review date.
- Monitor in use: preserve versions and outcomes, investigate triggers, and repeat the audit after material changes.
What a defensible final report contains
The report should let a reviewer reproduce the reasoning without exposing unnecessary personal data. Include an executive decision, system and job scope, legal jurisdictions considered, data and denominator definitions, methods, subgroup results, error results, accessibility findings, validation evidence, limitations, vendor materials relied upon, conflicts of interest, remediation options, and monitoring commitments. Distinguish observed facts from assumptions and unresolved questions. State whether evidence supports continued use, restricted use, additional validation, or suspension; do not convert uncertainty into a claim of safety.
Employment selection law applies to technology-assisted decisions because the employer’s process—not the marketing label on the software—determines the risk. Audit the complete process, make the job connection explicit, investigate both outcomes and errors, accommodate disability, preserve evidence, and revisit the decision whenever the tool or its use changes.
