Inventory every system that scores, ranks, recommends, schedules, evaluates, or otherwise influences people at work; measure outcomes for relevant groups at each decision stage; verify that the procedure measures skills required for the job; test disability access and accommodation; document human overrides; and keep evidence of remediation and retesting.
The legal answer depends on where and how the tool is used. New York City’s Local Law 144 has specific requirements for automated employment decision tools (AEDTs) used to screen city candidates or employees for hiring or promotion. Federal anti-discrimination law can apply to algorithmic selection procedures nationwide, while the European Union’s AI Act treats many recruitment and work-management systems as potentially high-risk. A disparity metric is an important warning signal, not a universal legal safe harbor or a complete finding of discrimination.

What an AI employment audit must establish
An employment audit should answer five practical questions:
- What system, model version, data, score, classification, or recommendation affects the decision?
- Which people are affected, at what stage, and in which location or legal jurisdiction?
- Do outcomes differ across relevant groups, and are the differences produced by the tool, earlier screening, later human decisions, or the entire process?
- Does the procedure measure qualifications or skills that are genuinely related to the job and justified by business necessity?
- Can people with disabilities use the process or request a reasonable accommodation without being screened out by an irrelevant feature?
The system’s practical influence matters even when a person formally makes the final decision. A recruiter who routinely accepts a ranking, a manager who follows a recommended performance score, or a scheduler who rarely overrides an allocation is allowing the tool to shape access to work. The New York City code defines a covered AEDT as a computational process derived from machine learning, statistical modeling, data analytics, or artificial intelligence that produces a simplified output such as a score, classification, or recommendation and substantially assists or replaces discretionary decision-making. Its covered employment decisions include screening candidates or employees in New York City for hiring or promotion. Read the statutory definition directly at New York City Code §20-871.

Use a broader inventory than any single statute. Include recruitment, promotion, performance evaluation, scheduling, work allocation, retention, pay-related recommendations, and other systems that can change a person’s opportunity or working conditions. Then classify which uses are actually covered by each applicable law.
Step 1: Build a complete system and decision inventory
Start with a register owned jointly by human resources, legal or compliance, information technology, accessibility staff, and the business users who operate the tools. Do not rely solely on procurement records: a spreadsheet, assessment platform, scheduling feature, or manager dashboard can contain an algorithmic function without being labelled “AI.”
Record the minimum facts for every tool
- Vendor, product, model or ruleset version, deployment date, and material update history.
- Intended use and actual use, including pilots, local workarounds, and spreadsheet exports.
- Users, decision owners, reviewers, and people who can override or ignore an output.
- Affected applicant, employee, contractor, job, location, and demographic groups.
- Input data, data sources, labels, missing-value treatment, and retention period.
- Output type, thresholds, ranking logic, confidence information, and downstream actions.
- The precise decision stage: sourcing, application screening, assessment, interview, hiring, promotion, scheduling, evaluation, discipline, retention, or pay.
- Where the human reviewer sees the output, what explanation is available, and what evidence is retained.
Preserve enough detail to distinguish an administrative tool from one that meaningfully changes access to jobs, shifts, pay, or advancement. A scheduling system that merely displays availability is different from one that allocates desirable shifts according to a score. A pattern-detection report reviewed after a decision is different from a ranking that determines who gets an interview.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteMap the real decision path
Draw the flow from data collection to outcome. For each stage, show who is included, who is removed, what score or recommendation is generated, whether a person sees it, and what happens next. Capture human screening before the model and discretionary decisions after it. This prevents a common error: attributing the final selection rate entirely to the model when an earlier filter or later manager decision created the disparity.
| Decision use | Questions to answer | Evidence to retain |
|---|---|---|
| Hiring and promotion | Who is ranked, screened out, or advanced? Is the output a recommendation or an automatic gate? | Job requisition, criteria, thresholds, scores, overrides, and final decisions |
| Assessments and interviews | What behavior or answer is scored, and is it required for the job? | Assessment specification, validation evidence, administration conditions, and accommodation process |
| Scheduling and work allocation | Does the allocation affect hours, income, progression, or working conditions? | Eligibility rules, allocation outputs, shift or task records, and override history |
| Performance and retention | Does a rating trigger discipline, promotion, compensation, or termination? | Rating inputs, manager actions, appeals, and downstream outcomes |
Step 2: Establish a baseline and measure outcomes
For every decision stage, preserve the population evaluated, the number selected or advanced, and the time period. Define groups consistently and document who is included in each denominator. Review both the tool’s output and the complete process.
Measures to calculate and inspect
- Selection or advancement rates by relevant group and stage.
- Score distributions, cutoffs, exclusions, and missing-data rates.
- Differences between people who receive a recommendation and those who are ultimately selected.
- Downstream outcomes such as assignment, hours, promotion, evaluation, or retention when those records are available.
- Override rates and override outcomes by group.
- Small-group counts, confidence or uncertainty information, and reasons a group was omitted from a calculation.
Use statistical analysis appropriate to the population and decision. The Equal Employment Opportunity Commission (EEOC) explains that disparate-impact analysis ordinarily requires statistical evidence. Its framework asks whether a challenged selection procedure disproportionately excludes a protected group, whether the procedure is job-related and consistent with business necessity, and whether an equally effective less discriminatory alternative exists. The agency’s selection-procedure guidance is available at EEOC, Employment Tests and Selection Procedures.
Do not present one ratio, cutoff, or sample-size rule as a universal pass. The appropriate analysis depends on the decision, population, jurisdiction, and data quality. Explain uncertainty and limitations rather than hiding small numbers or combining unlike jobs merely to produce a stable-looking statistic.
Separate a warning signal from a legal conclusion
A disparity can indicate a problem, but it does not by itself establish unlawful discrimination. Conversely, a balanced overall result can conceal harm at a particular stage or for a subgroup. Investigate the mechanism: which input, threshold, reviewer action, or missing-data rule changes the outcome? Compare the result with job requirements and available alternatives before deciding whether the procedure is defensible.

Step 3: Test job relevance, validity, and alternatives
For each input and scoring criterion, write down the job skill or qualification it is supposed to measure. Then ask whether the relationship is supported for that role and purpose, whether administration and scoring are consistent, and whether the tool has changed since the supporting evidence was produced.
Questions for a validity review
- Is the measured behavior necessary or meaningfully related to actual job performance?
- Was the tool validated for this job family, level, language, location, and decision purpose?
- Are instructions, time limits, interfaces, and scoring conditions consistent for all participants?
- Could a proxy, historical label, or convenience feature reflect past bias rather than job skill?
- What happens when job requirements, workflows, or the model version change?
Ask the developer for technical, validation, and data documentation, but do not outsource the employer’s responsibility. EEOC guidance says vendor materials can assist an employer while the employer remains responsible for ensuring that tests comply with the Uniform Guidelines on Employee Selection Procedures. Record what was reviewed, what was accepted, and what remains uncertain.
Evaluate a less discriminatory alternative
If a procedure screens out a protected group, identify another method that could predict the same job outcome with less adverse impact. Compare effectiveness using the same job criteria and document why the organization retained, changed, or removed the original process. Historical hiring success is not proof that a model is fair or job-related; the relevant question is whether it measures the skills needed for this role and is legally justified.

Step 4: Audit disability access and accommodation
Disability review is a functional test of the whole process, not a checkbox added after statistical analysis. Determine whether the tool depends on speech, vision, motor behavior, facial movement, response speed, or another ability that is not essential to the job. A system can measure an impairment instead of the intended qualification and screen out a qualified person who could perform the job with an accommodation.
Test the experience and the safeguard
- Try the process with assistive technology and alternative input methods relevant to the affected population.
- Identify whether timing, speech analysis, eye tracking, facial analysis, or motor signals are essential to the job or merely design choices.
- Publish a private, workable route for requesting a reasonable accommodation or alternative process.
- Set a response owner and deadline; do not require a person to disclose sensitive information to an untrained manager or public forum.
- Record requests, decisions, alternate assessments, and any difference in outcomes.
The EEOC and Department of Justice warn that algorithmic tools can screen out qualified people with disabilities and can create improper disability-related inquiry or medical-examination concerns, depending on design and use. Build safeguards before deployment and reassess them when the interface, assessment, or job changes.
Charlotte A. Burrows, then EEOC chair, stated: “New technologies should not become new ways to discriminate.” Assistant Attorney General Kristen Clarke similarly warned: “Algorithmic tools should not stand as a barrier for people with disabilities seeking access to jobs.” Treat those statements as the practical purpose of an accessibility audit: ensure the tool evaluates the job, not an irrelevant impairment.
Step 5: Examine human oversight and process effects
“Human in the loop” is not a sufficient control by itself. Document whether the reviewer sees the score before deciding, how much weight it carries, whether an override is realistically available, what reasons must be recorded, and whether managers routinely follow the recommendation.
Look for automation bias
- Compare recommendation acceptance rates across teams and managers.
- Review whether overrides are more common for one group and whether they improve or worsen outcomes.
- Check whether reviewers receive explanations, uncertainty information, or only a rank.
- Sample decisions where the reviewer disagreed and inspect the documented reason.
- Verify that an appeal or second review can occur before an irreversible action.
European Commission employment examples describe rankings as materially influential even when recruiters can review or override them. That principle applies beyond recruitment: a nominal override that is rarely used or carries a career penalty may not reduce the tool’s practical influence.

New York City Local Law 144: operational requirements
For a covered AEDT used to screen a candidate or employee in New York City for hiring or promotion, Local Law 144 requires a bias audit no more than one year before use. Before use, the employer or employment agency must make the latest audit summary and the tool’s distribution date publicly available on its website. Covered New York City-resident candidates and employees must receive specified notice at least ten business days before use.
What the notice must do
- State that the AEDT will be used.
- Explain the job qualifications and characteristics the tool will use.
- Allow the person to request an alternative selection process or a reasonable accommodation.
If certain information about data sources, data types, or retention is not already posted, the law requires it to be made available on written request. Keep proof of the notice’s content, delivery date, recipient population, and any requests or responses.
Coordinate the audit with the publication deadline
- Confirm that the actual use fits the city’s AEDT and covered-employment definitions.
- Complete the required bias audit within the one-year window before use.
- Prepare a public summary that explains scope, method, results, and limitations without exposing personal information.
- Post the summary and distribution date before deployment or the next covered use.
- Send the required notice at least ten business days before use to covered city residents.
- Maintain an accommodation and alternative-process channel and document its operation.
The New York City Department of Consumer and Worker Protection says enforcement began July 5, 2023 and identifies missing audits, unpublished summaries, and missing notices as complaint grounds. The hosted city code warns that its database may not reflect the most current legislation or rules, so confirm the current statute, rule, and agency FAQ before making a live compliance decision.
Federal United States principles
Federal employment-discrimination laws apply to selection procedures, including algorithmic processes. Under disparate-impact analysis, a neutral procedure that disproportionately excludes a protected group can create legal risk unless the employer satisfies the applicable job-relatedness and business-necessity requirements and addresses an equally effective less discriminatory alternative. The same principles apply whether the procedure is marketed as artificial intelligence, statistical scoring, a test, or a workflow rule.
EEOC’s 2007 technical-assistance page is guidance, not legislation. Use it to understand selection-procedure principles, then verify current statutes, regulations, agency materials, and controlling case law for the employer, location, and decision at issue. It records 304 employment-testing and screening-related discrimination charges in fiscal year 2007; that historical figure is context for that year, not a current prevalence estimate.
European Union scoping under the AI Act
The European Commission AI Act Service Desk describes AI used for recruitment or selection—including candidate matching, ranking, sourcing, and assessment scoring—as potentially high-risk. Its employment examples also include worker scheduling and work allocation when they affect working conditions or progression.
The same examples distinguish limited procedural tasks and some retrospective pattern-detection audits from systems that materially influence selection. Use those examples to identify questions for classification, not as a substitute for applying the regulation to the actual system, provider role, deployment location, and applicable dates. A tool used across jurisdictions may require separate documentation of the EU classification and the requirements that apply in each deployment.

Minimum audit record
| Record area | What to capture |
|---|---|
| Scope | System and version, use case, locations, job groups, decision stages, and covered populations |
| Data and method | Data sources, time periods, inclusion rules, group definitions, metrics, statistical methods, and small-sample treatment |
| Validity | Job analysis, validation evidence, administration conditions, assumptions, and known limitations |
| Accessibility | Interface review, accommodation route, requests, alternate processes, and outcomes |
| Human process | Reviewer access, override rules, acceptance rates, reasons, appeals, and downstream decisions |
| Findings and action | Disparities, root causes, legal questions, remediation owner, deadline, and approval |
| Follow-up | Retest results, material changes, notices, publication dates, and deployment decision |
When to retest
Run an appropriate review after a material change to training or input data, model version, threshold, job requirements, assessment interface, decision workflow, or deployment population. Also retest when monitoring shows a new disparity or when an accommodation failure reveals that the original scope was too narrow. The NYC requirement for a recent audit and the EEOC’s emphasis on validity do not create one universal retest interval for every use; set a risk-based schedule and document the rationale.
Choosing an independent audit approach
If internal staff or an outside consultant performs the work, compare the engagement on substance rather than a certification label. The relevant criteria are:
- Independence from the tool developer and the employer’s decision owners, including disclosed conflicts of interest.
- Coverage of the jurisdictions and decision types in scope.
- Statistical design, treatment of small samples, uncertainty, and reproducibility.
- Job-analysis and selection-procedure validation expertise.
- Accessibility, disability, and accommodation testing.
- Data provenance, privacy, security, and retention controls.
- Model and version coverage, including updates and locally configured thresholds.
- Transparent methods, assumptions, limitations, and explainable findings.
- Practical remediation and retest support rather than a one-time report.
- A clear distinction between legal compliance, broader fairness, predictive performance, and business evaluation.
Do not assume a provider is independent or qualified without examining its methodology, conflicts, and evidence. No single audit report can replace the employer’s responsibility for the decision process.

Common failure modes and corrective actions
Auditing only the vendor’s model
Why it fails: Earlier human filters, local configurations, thresholds, and later manager decisions can create the observed disparity.
Correction: Measure each decision stage and the end-to-end process, and preserve the actual version and configuration used.
Treating a single disparity ratio as a verdict
Why it fails: A ratio does not establish job-relatedness, business necessity, causation, uncertainty, or a less discriminatory alternative.
Correction: Combine statistical results with job analysis, validity evidence, process review, and alternative-method testing.

A practical go/no-go checklist
Before allowing a tool to influence a covered employment decision, confirm that:
- The inventory identifies the real system, version, inputs, outputs, users, and decision stage.
- The affected locations and legal regimes are documented.
- Baseline populations, denominators, outcomes, missing data, and uncertainty are reproducible.
- Disparities have been investigated rather than labelled automatically lawful or unlawful.
- Inputs and scores are tied to documented job requirements and validation evidence.
- A less discriminatory alternative has been considered where adverse impact appears.
- Accessibility testing and a workable accommodation or alternative-process route are in place.
- Human oversight is measured in practice, including overrides and appeals.
- Required NYC audit, publication, distribution-date, and ten-business-day notice steps are complete when applicable.
- Findings, limitations, remediation, approvals, and retest triggers are recorded.
That evidence-based sequence turns “AI fairness” from a vendor promise into a reviewable employment decision process. It also makes clear where the organization has a compliance obligation, where it has a risk signal requiring investigation, and where the tool should not be used until the underlying problem is fixed.
