Audit a recruitment chatbot as an employment selection procedure, not merely as a messaging tool. If it asks screening questions, scores answers, ranks applicants, filters applications, or materially influences who advances, map its decisions, test outcomes at every hiring stage, validate each criterion against the actual job, check accessibility and accommodations, and document corrective action. In New York City, additional audit, public-summary and notice rules apply to covered automated employment decision tools (AEDTs).
The procedure below is designed for employers, HR teams, internal auditors and candidates who need an evidence-based way to identify discriminatory screening. It separates broadly applicable U.S. principles from the specific New York City requirements and flags where local law must be checked before deployment.

What makes a recruitment chatbot a selection procedure?
A conversational interface does not determine the legal or practical impact of a hiring system. Treat the chatbot as part of the selection procedure when it performs any of these functions:
- asks questions used to screen out applicants;
- assigns scores, classifications or rankings;
- recommends who should proceed to a test, interview or offer stage; or
- substantially influences a human decision, even when a recruiter technically makes the final decision.
The chatbot may combine several familiar selection tools. Its flow can contain cognitive or job-knowledge questions, work samples, personality-style questions, language testing, background questions or medical and disability-related inquiries. The U.S. Equal Employment Opportunity Commission (EEOC) guidance treats these as selection procedures that must be examined for discriminatory effects. Audit the complete deployed flow, including prompts, branching logic, scoring, thresholds, recruiter dashboards, integrations and overrides—not just the vendor’s product description.

Start by mapping the real decision
Inventory every stage and handoff
Draw the candidate journey from job advertisement to disposition. For each stage, record the chatbot version, dates in service, job family, location, language, questions shown, data collected, score or label produced, threshold applied, downstream action and person or system receiving the result. Include applicants who abandon the conversation and those who never reach a later stage; excluding them can hide where unequal attrition begins.
Document whether a recruiter can override an output and what “review” means in practice. A human who only sees a red, yellow or green label may not be exercising meaningful independent judgment. Preserve examples of overrides, the reasons entered, and whether overrides are available consistently across groups.
Record inputs and inferred attributes
List every input used directly or indirectly: free-text responses, speech or video, response time, typing or mouse behavior, résumé fields, location, language, device, prior applications and data imported from other systems. Ask what the model infers, such as personality, health, age or disability, and whether those inferences affect a score. A field that is not displayed to recruiters can still influence the decision and belongs in the audit scope.
Recommended Free Tools
Test production, not a demonstration
Run the exact configuration used by applicants, including current prompts, model version, integrations, fallback rules and recruiter settings. A sandbox or sales demonstration may omit a threshold, a data feed or a manual shortcut that changes outcomes in production. Capture timestamps and configuration identifiers so a later reviewer can reproduce each result.
Define what the chatbot is supposed to measure
Write the job requirements first
For every question, feature and score, state the specific task or qualification it is intended to assess. “Culture fit,” enthusiasm or conversational polish is not a sufficiently precise purpose by itself. Link a criterion to duties of the particular position, such as troubleshooting a defined system, following a safety procedure or communicating information in a specified setting.
Keep a purpose-to-feature register with four fields: job task, evidence the chatbot collects, scoring rule and decision that uses the score. If a feature cannot be tied to an actual requirement, flag it for removal or separate validation. Revisit the register when duties, technology, schedules or minimum qualifications change.
Separate capability from convenience
Ask whether the chatbot is measuring the capability needed for the job or an unrelated characteristic of the interaction. A timed response can test prioritization when speed is an essential duty, but it can also measure typing speed, processing differences or an unreliable connection. A speech-recognition score may reflect accent or disability rather than the communication skill required. These are hypotheses for testing, not automatic findings of illegality.

Measure outcomes at every stage
Build a stage-by-stage dataset
Create one row per applicant (or a documented, privacy-preserving key) and columns for entry, completion, score or classification, advancement, rejection, accommodation request and final disposition. Calculate rates separately for each stage:
- who was invited to the chatbot;
- who started and completed it;
- who received each score band or recommendation;
- who passed the threshold or advanced; and
- who reached interview, offer and hire.
Compare relevant demographic groups and intersections where data and applicable law permit. For example, an overall sex comparison can conceal an outcome affecting women of a particular race. State the time period, job, location, sample size and denominator for every rate. Small samples may be unstable; report the limitation instead of treating an apparently equal percentage as proof of fairness.
Do not erase unknown demographic data
Show the number and proportion of applicants whose demographic information is unknown, declined or unavailable. Investigate how data became missing and whether missingness differs by stage or group. Do not silently assign an unknown person to a category, and do not infer or impute demographics for a New York City AEDT bias audit. If lawful collection is impossible, explain how that limitation affects interpretation and use other evidence, such as process testing and accessibility review.
Use outcome measures carefully
| Measure | What it tells you | Required qualification |
|---|---|---|
| Completion rate | Where applicants stop or fail to finish the interaction | Separate technical abandonment, voluntary withdrawal and chatbot disposition; report the invitation denominator. |
| Selection rate | Share of a group advancing or receiving a selected classification | Name the stage, job, period and denominator; do not combine unlike stages. |
| Scoring-rate distribution | How scores or labels are distributed across groups | Describe the scale, threshold, missing scores and any human adjustment. |
| Impact ratio | Compares a group’s selection or scoring rate with a defined reference rate | Identify the reference category, calculation method and uncertainty; one ratio is not a complete fairness assessment. |
| Accommodation outcome | Whether applicants who requested an adjustment could complete and be considered | Protect medical privacy and compare the actual path and result, not merely request counts. |
Analyze changes over time and by recruiter, location, language and model version. A neutral aggregate can mask a problem in one job family or a threshold change. Conversely, a disparity is a signal to investigate, not by itself proof of unlawful discrimination; review the job purpose, validity evidence, data quality and alternatives.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsValidate the procedure for its intended purpose
Ask for evidence tied to this job
The EEOC advises employers to ensure tests are properly validated for the positions and purposes for which they are used. Request the technical documentation supporting each question, feature, score and cutoff, including the population studied, criterion used, sample, date, limitations and conditions of administration. Evidence for a different occupation, seniority level or language does not automatically validate this chatbot.
Vendor documentation can inform the review, but the employer remains responsible for validity under the Uniform Guidelines on Employee Selection Procedures. Keep a decision record explaining why evidence is adequate, incomplete or rejected. Update the analysis when job requirements or the chatbot changes; the EEOC cautions against adopting tests casually without understanding their effectiveness, limitations, appropriateness, administration and scoring.
Investigate less discriminatory alternatives
If a procedure disproportionately excludes a protected group, identify another method that measures the same job requirement. Compare a structured work sample, a human-reviewed response, an untimed option or a different question set only if it is equally effective for the stated purpose. Record the alternative’s validity evidence, expected operational cost, accessibility and outcome data. Choosing a convenient tool is not a substitute for examining an effective option with less adverse impact.

Audit accessibility and accommodation
Test each interaction mode
The EEOC and U.S. Department of Justice warn that software and AI used to select applicants can disadvantage people with disabilities. Test keyboard-only navigation, screen-reader use, captions and transcripts, color and contrast, alternative input, mobile access, language options, speech and video requirements, and timed or repeated-response tasks. Check whether an outage, browser restriction or inaccessible CAPTCHA prevents completion.

A speech, video or timed feature is not automatically unlawful, but it requires a documented reason and an accessible path where appropriate.
Make accommodation access visible
Provide a clear way to request reasonable accommodation before or during the chatbot interaction, with a human contact and an alternative channel if the chatbot itself is inaccessible. Test the request process with realistic scenarios and verify that a request does not lower a score, trigger an adverse label or reveal medical information to unnecessary staff.
Review prompts, logs and scoring rationale for prohibited disability-related inquiries or medical examinations. The EEOC and DOJ identify two core risks: screening out an applicant who could perform the job with or without accommodation, and eliciting disability or medical information improperly. Preserve only the information needed to arrange the accommodation and restrict access.
“New technologies should not become new ways to discriminate. If employers are aware of the ways AI and other technologies can discriminate against persons with disabilities, they can take steps to prevent it,” said EEOC Chair Charlotte A. Burrows in the agency’s announcement.

Apply U.S. employment-selection principles
Under Title VII, a neutral selection procedure that disproportionately excludes a protected group must be job-related and consistent with business necessity. The EEOC’s selection-procedure guidance also describes the need to consider an equally effective, less discriminatory alternative. Intentional discrimination is a separate risk; a neutral design does not eliminate it.
Assess the chatbot as a complete procedure, including questions, scoring, data sources, administration and human use. Keep records showing the job analysis, validation evidence, adverse-outcome review, alternative analysis, accessibility testing, decisions and remediation owners. Requirements can differ under federal, state and local law, so involve qualified employment counsel for a specific deployment.

The EEOC guidance reports 304 charges in fiscal year 2007 involving employment-testing issues and exclusions based on criminal background checks, credit reports and other selection procedures. That is a historical agency figure, not a current estimate of chatbot discrimination or prevalence.

Determine whether the tool is an AEDT
NYC’s Department of Consumer and Worker Protection (DCWP) says Local Law 144 covers a computer-based tool that uses machine learning, statistical modeling, data analytics or artificial intelligence and substantially assists or replaces discretionary decision-making. Using a tool to substantially help assess or screen applicants during hiring or promotion can be covered even when it does not make the final decision.

The NYC connection can include a job located in New York City, a fully remote job associated with an NYC office, or an employment agency located in the city. Read the current rule and agency guidance for the specific facts. DCWP says enforcement began July 5, 2023, and its FAQ is dated June 29, 2023; both should be rechecked before relying on operational details.
Complete the independent bias audit
Before using a covered AEDT, the employer or employment agency must ensure that an independent auditor has conducted a bias audit within one year of use, audit information is publicly available and required notices are provided. The FAQ places responsibility on the employer or agency, not the vendor.
The minimum audit described by DCWP includes:
- selection or scoring rates for sex categories;
- selection or scoring rates for race and ethnicity categories;
- intersectional categories;
- impact ratios for all categories;
- the audit date and the source and explanation of data;
- applicant or candidate counts;
- the number of people in an unknown category; and
- an explanation when data is limited by region or time period.
Historical data may be used. If there is insufficient historical data for a statistically significant audit, the FAQ says test data can be used. Inferred or imputed demographic data cannot be used. Publish the required summary and retain the underlying methodology and limitations so an affected person can understand what was measured.
Give the required notice
A covered employer or agency must notify NYC-resident candidates or employees about AEDT use and the qualifications or characteristics assessed, provide instructions for requesting reasonable accommodation under other laws, and give notice 10 business days before use. DCWP’s FAQ describes permitted notice channels and alternatives; select a channel that actually reaches the person and retain proof of delivery.
An audit, public summary and notice are not a safe harbor. DCWP states that federal, state and NYC anti-discrimination laws still govern what must be done when an audit identifies a problem.

Compare the chatbot with replacement designs
When deciding whether to keep, change or replace a screening chatbot, score each option against the same criteria rather than relying on one impact ratio.
| Comparison axis | Questions to answer |
|---|---|
| Job relevance and validity | Does the method assess a documented task for this position, with evidence supporting its purpose and cutoff? |
| Outcomes by group and stage | What happens to entry, completion, scores, advancement and accommodation paths for relevant groups and intersections? |
| Accessibility | Can applicants use the method with assistive technology and request an effective accommodation without penalty? |
| Explainability and records | Can an auditor reconstruct the questions, data, score, threshold, override and reason for disposition? |
| Less discriminatory alternative | Is another procedure equally effective for the job requirement with less adverse impact? |
| Jurisdictional burden | What audit, notice, retention and reporting duties apply where the job and applicant are located? |
Remediate findings and monitor after launch
Use a documented action plan
For each finding, record the affected stage, evidence, risk, owner, deadline and verification test. Possible actions include removing an unrelated feature, changing a question, replacing a threshold, adding an accessible route, pausing automated rejection, conducting human review, retraining staff or switching to a validated alternative. Do not describe a model as “fixed” until the revised production workflow has been retested.
Monitor drift and changes
Set review dates tied to model updates, new job requirements, changes in applicant population, language expansion, threshold changes and material shifts in completion or advancement rates. Compare the new period with a defined baseline and investigate sudden changes in unknown-demographic counts, accommodation requests, score distributions or override rates. Keep versioned records so a later audit can distinguish a model change from a change in recruiting volume.

If evidence suggests discriminatory screening, suspend automated rejection or add qualified human review while the issue is investigated. A practical audit is not complete until the organization verifies that corrective action reached the applicants affected by the original process.
Audit checklist
- Map every chatbot stage, input, output, threshold, human override and downstream decision.
- Write the job tasks and qualifications each criterion is intended to assess.
- Test the deployed configuration, model version, integrations and fallback paths.
- Collect stage-level entry, completion, scoring, advancement and accommodation data.
- Compare relevant demographic groups and intersections; report unknown data and denominators.
- Review validation evidence for this job and purpose, not merely a vendor’s general claim.
- Investigate equally effective alternatives when disproportionate exclusion appears.
- Test accessibility, accommodation requests, interaction modes and disability-related inquiries.
- For NYC-covered AEDTs, arrange the independent audit, public summary and 10-business-day notice.
- Document findings, owners, remediation, verification tests and the next monitoring date.
What this audit can and cannot establish
A well-run audit can show where candidates drop out, which groups receive different scores or advancement rates, whether criteria map to job duties, and whether an accessible or less discriminatory alternative is available. It cannot turn a single impact ratio into a universal fairness verdict, replace legal analysis for a particular jurisdiction, or transfer the employer’s responsibility to a software vendor. Treat results as evidence for decisions, then act on the evidence and continue monitoring.
For European deployments, the EU AI Act text identifies recruitment and selection systems among employment-related high-risk systems. Exact operative dates, exceptions and duties should be verified against the current consolidated regulation and official Commission guidance before issuing EU-specific instructions.
