Start by identifying the location, type of accommodation, worker category, and employer’s role; the rules can differ by country, state, city, and work program. The U.S. Department of Labor (DOL) and OSHA guidance discussed here applies only in specified U.S. contexts, not to every employer-provided home.
First, establish which rules and work relationship apply
Record the location, accommodation, and employer’s role
Write down the country, state and locality; your job or worker program, if known; who owns or operates the property; whether the employer requires or controls the housing; and whether you can realistically obtain other housing. Also note the distance to work and the cost and availability of transportation. These facts help identify the relevant housing code, labor rules, and enforcement agency.

OSHA’s Field Operations Manual lists factors such as required residence, employer ownership or control, housing cost, isolation, access to comparable alternatives, distance to work, and employer benefit when considering whether housing is a term or condition of employment. These are enforcement factors, not a conclusive test for every legal question.

Check whether a specific U.S. housing standard covers the property
For H-2A rental or public accommodation housing, DOL describes a concern-by-concern fallback: local standards apply; if they do not address a listed essential concern, state standards apply to that concern; and OSHA standards may apply if neither local nor state standards cover it. Covered employer-provided H-2A housing has its own applicable standards. The sequence does not make the same rule applicable to every employer-provided dwelling.

OSHA’s 1981 interpretation says 29 CFR 1910.142 applies to temporary job-related housing provided for workers away from a permanent location, citing agriculture and remote oil drilling as examples. OSHA’s Field Operations Manual also discusses temporary labor camps in agricultural and non-agricultural settings. Check the current code and local enforcement approach before relying on a particular standard.
What to inspect in the home
Walk through each room and record observable conditions
Use a dated, room-by-room checklist. Where it is safe and lawful, take photographs and keep copies of inspection reports and written notices. DOL’s OSHA housing checklist prompts reviewers in covered settings to examine:

- 10-Person, Bulk ANSI Class A First Aid Kit, Plastic Case
- Electrical Fuses
- Site and drainage: flooding, standing water, drainage, rubbish, refuse, and overcrowding.
- Sleeping and living space: usable floor area, beds and their spacing, storage, separation, floors, windows, and ventilation.
- Water, sanitation, and food: water and sanitary facilities needed for food storage and preparation. Check applicable local requirements separately for drinking water, bathing, laundry, and toilets.
- Heat and equipment: whether heating is adequate where needed and heating, cooking, and water-heating equipment is safely installed; check that cooking arrangements are suitable.
- Emergencies: fire alarms and other emergency measures required by the applicable program or local rules.
The DOL checklist and fact sheet cite figures for defined settings under OSHA’s temporary labor camp standard: 50 square feet of sleeping-room floor area per occupant and a seven-foot ceiling; the fact sheet also describes beds at least 36 inches apart and at least 12 inches above the floor. The checklist specifies at least 200 feet from certain standing-water features unless they are treated for mosquito control. These are standards-based thresholds for the contexts described, not universal housing requirements or a complete test of fairness. Confirm that the standard covers the dwelling before applying them.
Compare conditions with the applicable local standard
A room can look acceptable and still fail a requirement, or appear cramped without being subject to the particular federal figures above. For H-2A rental or public accommodation, DOL’s fallback is concern-specific: for example, a local rule may address most issues but omit minimum space per occupant, leaving a state rule and then a federal standard to fill that gap. Ask the relevant housing or health inspector which standard applies to the condition you observed.

How to judge whether the arrangement is fair
Read the housing and job terms together
Compare the written job offer, job order or contract, occupancy terms, pay statements, and actual conditions. Record rent, deposit, utilities, payroll deductions, transportation costs, who receives the housing payment, rules affecting privacy or guests, and what happens to your housing if the job ends. If a term is unclear, ask for it in writing before agreeing where possible.
Consider whether living there is mandatory in practice, whether you accepted freely, and whether an alternative is genuinely accessible by distance, cost, and transportation. Housing that is technically optional may still be difficult to refuse if nearby alternatives are unaffordable or unreachable; document the facts rather than assuming the label in a contract settles the issue.

Separate rent from a wage credit or deduction
For the limited U.S. Fair Labor Standards Act section 3(m) question of counting lodging toward wages, DOL says employees must accept the lodging voluntarily and without coercion for the employer to claim the credit. DOL also says lodging that violates federal, state, or local law cannot be included as wages under that credit, giving examples such as a missing required occupancy permit or lack of residential zoning. This guidance does not decide every rent charge, lease, payroll deduction, or housing dispute; those may depend on other laws and the specific arrangement.

Use international guidance as guidance, not automatic law
A DOL-hosted summary of ILO Workers’ Housing Recommendation No. 115 says employer-provided housing is generally not desirable unless needed—for example, when work is far from home—and that housing should be decent and reasonably priced relative to income, preserve fundamental rights including freedom of association, and not be provided as payment for work. It is a summary of an international recommendation, not automatically binding domestic law.

How to raise a concern and get help
Respond to immediate danger first
If a condition poses an immediate danger, contact emergency services or the appropriate local fire, health, or housing authority. Do not put yourself at greater risk to gather evidence.
Keep records and contact the right local support
For other concerns, preserve dated notes, relevant messages, housing terms, pay records, photographs taken safely and lawfully, and any inspection findings. Depending on your location and status, seek help from a labor agency, housing inspector, union, worker center, legal-aid provider, or another qualified local organization. The correct agency and remedy depend on applicable law and coverage.
For covered H-2A workers, DOL says employers may not threaten, coerce, discriminate against, or retaliate against workers for exercising rights or participating in an investigation. That protection is tied to the H-2A program context described by DOL; do not assume the same rule or process applies identically to every worker or housing arrangement.
How to compare two housing options
If you have a genuine choice, compare the options using the same evidence rather than relying on appearance or a single rent figure. Fill in the actual costs and findings for each property, and verify the applicable standard with the responsible local authority.
Quick Recap
| What to compare | Evidence to collect for each option |
|---|---|
| Applicable standard | Relevant code or program rule, plus inspection or certification records, if available. |
| Physical conditions | Water, sanitation, heat, ventilation, crowding, privacy, and emergency provisions observed during the walkthrough. |
| Total cost | Rent, deposits, utilities, payroll deductions, and transportation costs—not rent alone. |
| Connection to the job | Whether residence is required or controlled by the employer, distance to work, and practical access to alternatives. |
| Ability to report or leave | Written terms and the practical consequences of reporting a hazard, refusing the housing, or leaving it. |
