How to Assess Whether an AI Service Will Remain Available If Its Provider Shuts It Down

You cannot prove that a hosted AI service will survive its provider. You can, however, estimate how exposed your work is, find the provider’s actual exit promises, test whether your data and configuration can leave, and maintain a fallback that has been tested on real tasks. Treat continued availability as a continuity and portability problem—not as a consequence of an uptime percentage.

Start with the distinction that matters: uptime is not survival

An availability or service-level agreement (SLA) measures whether a service is reachable and functioning during defined measurement intervals. It does not promise that the provider will keep the product in its portfolio, continue the API, preserve a particular model, or operate the company indefinitely.

For perspective, the National Institute of Standards and Technology (NIST) gives an arithmetic example of 4.38 hours of expected downtime in a year at 99.95% availability in its 2011 guidance. That is a calculation under a stated definition of “up,” not a forecast of an AI product’s life or a shutdown probability. NIST SP 800-146, published in 2012, describes historical provider availability promises ranging from 99.5% to 100.0% and warns that intervals and definitions differ. Neither publication is a current survey of AI providers.

A provider can meet its SLA until the day it announces a retirement, sells a product, changes an API, enters bankruptcy, loses a facility, or stops supporting a model. Your assessment therefore needs two separate questions:

#1 Best Overall
Sandisk 1TB Portable SSD, Up to 800MB/s Read Speeds, Black (Old Model) | External Solid State Drive, Compatible with Laptops & Tablets, Up to 2M Drop Protection, USB 3.2 Gen 2, USB-C to USB-A Cable
  • Solid state performance with up to 800MB/s read speeds in a portable drive. (Based on internal testing; performance may be lower depending on host device, interface, usage conditions and other factors. 1MB=1,000,000 bytes.)
  • Back up your content and memories on a storage solution that fits seamlessly into your mobile lifestyle.
  • Take it with you on your adventures—up to two-meter drop protection means this durable drive can take a beating. (Based on internal testing.)
  • Secure it to your belt loop or backpack for extra peace of mind thanks to the tough rubber hook.
  • From Sandisk, a brand professional photographers trust to take on assignments.
  • Operational availability: How often is the service usable under the contract?
  • Continuity: If access ends permanently, can you keep the essential work running elsewhere?

No current statistic establishes the probability that a particular AI provider will shut down. The useful evidence is provider-specific: contractual exit terms, documented lifecycle behavior, technical portability, and the effort required to switch.

Read the agreement for exit rights, not just the SLA

Collect the service agreement, acceptable-use terms, privacy and retention language, API terms, export documentation, and product-lifecycle notices that apply to your edition and country. NIST SP 800-146 says provider agreements contain promises, limitations, and customer obligations and advises customers to analyze termination and data-retention policies.

Record the answers in a register that someone other than the original purchaser can understand.

Question What to record Why it changes your risk
Who may terminate? Provider, customer, either party, or an automated suspension process A provider termination right can end access even when the service is meeting its uptime target.
What triggers termination or suspension? Nonpayment, acceptable-use violations, legal demands, security events, insolvency, product retirement, or discretionary convenience termination Different triggers give you different warning and recovery options.
How much notice is promised? Notice period, delivery method, exceptions for urgent or risk-based action An email-only notice and a 12-month migration window have very different operational value.
How long can you retrieve data? Export window after cancellation, account closure, or suspension; time zone and deadline rules A short or ambiguous window can make a theoretically portable service practically nonportable.
What does export cost? Fees, minimum plans, support charges, rate limits, or prerequisites for a bulk export Unexpected charges or throttling can delay a migration.
What happens after termination? Deletion schedule, backups, legal holds, residual copies, and whether read-only access remains You need to know both when to retrieve records and when deletion becomes irreversible.
What does the provider promise to preserve? Only submitted data, or also prompts, outputs, embeddings, fine-tuning files, logs, settings, and workflow metadata A “data export” that omits configuration may leave you unable to reproduce the workflow.
Are lifecycle terms product-specific? Separate language for models, APIs, hosted applications, add-ons, and preview features A provider can retire one model or endpoint while keeping the broader service online.

Save a dated copy of the terms and note the version or effective date. A marketing statement about “easy migration” is not a substitute for an enforceable notice period, an export procedure, or a deletion commitment. If a term is silent, record it as unknown and ask the provider in writing; do not treat silence as a guarantee.

Measure the consequence of losing the service

Resilience requirements depend on what the AI does, not on how impressive the model is. Make an inventory of every workflow that calls the service, the people who rely on it, and the systems on either side of it. NIST’s AI Risk Management Framework Playbook asks organizations to consider upstream and downstream consequences of deactivation and contingency options. Australian National AI Centre guidance similarly calls for assessing impacts on users and integrated systems.

Classify each workflow by criticality

  • Mission-critical: A prolonged outage can stop a regulated, safety-sensitive, revenue-critical, or time-bound operation.
  • Important: Work can continue manually for a limited period, but delays, quality loss, or staff overload are material.
  • Convenience: The function is useful but can be removed without significant operational harm.

Write the outage consequences at three horizons

Horizon Questions to answer
Hours Which queues, customers, or deadlines are immediately affected? Is there a manual procedure for today’s work?
Days Can staff handle the volume, and will backlogs or service-level penalties accumulate? Which integrations need rerouting?
Permanent loss Can another tool, a local model, conventional software, or a human process perform the required task? How much retraining, reconfiguration, validation, and data conversion is needed?

Map dependency depth

List more than the API call. Capture identity and permissions, prompt templates, system instructions, retrieval indexes, embeddings, model-specific parameters, evaluation sets, fine-tuning artifacts, webhooks, batch jobs, downstream parsers, human approvals, audit records, and billing or quota controls. A workflow may appear portable because its source documents are downloadable while its prompt format, tool-calling behavior, or output parser is not.

Test portability before you need it

“We can export our data” is not enough. Portability means that the records and artifacts you can extract are complete, understandable, and useful in another operating environment. Australian guidance on decommissioning recommends determining extraction methods and the records that must be retained; NIST continuity guidance recommends planning alternate services, equipment, or locations for essential functions.

  1. Define the preservation set. List user inputs, prompts, generated outputs, source files, annotations, feedback, metadata, timestamps, access records, model and version identifiers, configuration, evaluation data, indexes, and fine-tuning or adapter files that your workflow needs.
  2. Run the documented export. Use the provider’s current interface or API, not an assumption based on a screenshot or a sales response. Record account roles, rate limits, pagination, file-size limits, and any prerequisite plan.
  3. Check completeness. Compare exported counts and date ranges with the live account. Verify that relationships—such as a prompt linked to its source document and output—survive the export.
  4. Inspect the formats. Confirm that files are readable and, where automation matters, machine-processable. Check character encoding, timestamps, attachments, schema documentation, and whether proprietary identifiers can be mapped elsewhere.
  5. Attempt a restore or reconstruction. Import a sample into a separate environment or rebuild the workflow from the export. An archive that can be downloaded but not interpreted is not a usable backup.
  6. Measure the work. Time the export, validation, transfer, conversion, and reconfiguration. Record staff skills and any provider support required.
  7. Store an independent copy. When your contract, privacy obligations, and security controls allow it, keep a copy in storage you control. Encrypt it, restrict access, and test that it can be retrieved. Local storage preserves files; it does not keep a hosted model or API operating.
  8. Repeat after material changes. Re-test when the provider changes its API, model family, account tier, retention rules, or export format.

Ask specifically whether the export includes model weights or only your content. For a hosted model, you usually cannot assume that the provider will give you the model itself, its serving stack, or identical behavior elsewhere. Preserve representative inputs, expected outputs, safety rules, and acceptance tests so a replacement can be evaluated even when the original model is unavailable.

Build a fallback that matches the actual job

A fallback is a functioning alternate pathway, not a name on a procurement list. NIST recommends redundant or backup systems for continuity; the AI RMF Playbook calls for contingency processes for high-risk third-party AI failures. The appropriate alternative may be another hosted provider, a model operated on your own equipment, conventional software, a human review queue, or a deliberately slower manual method.

Compare alternatives against the same workload

Dimension Test
Capability Can it perform the required tasks, languages, document types, tool calls, and safety checks?
Data controls Where are inputs and outputs processed and retained? Can the alternative meet your privacy, security, residency, and records obligations?
Portability Can the new system ingest your preserved data, prompts, indexes, and evaluation set without a proprietary dead end?
Integration effort What changes are needed for authentication, SDKs, schemas, webhooks, queues, monitoring, and downstream parsers?
Switching time How long from an approved trigger to a working service, including validation and user training?
Cost and capacity What recurring, migration, storage, hardware, and surge costs apply, and can the alternative handle peak volume?
Quality and control Which outputs change, and how will humans detect errors or unsafe behavior during the transition?

Test representative cases, not a demo

Create a small, governed test set containing ordinary, difficult, and failure-prone cases. Include long documents, malformed inputs, multilingual material, tool errors, refusal cases, and the outputs that downstream systems expect. Run the same set through the primary and fallback paths. Compare task success, review burden, latency, cost, and error modes. A replacement that is cheaper but breaks a required parser or produces unverifiable records is not an equivalent fallback.

Document the switch

Write an operator runbook with the trigger, approver, credentials, DNS or endpoint changes, data synchronization step, configuration values, validation tests, rollback decision, user notice, and support contacts. Keep a versioned copy outside the primary provider’s account. Schedule a tabletop exercise and, for critical workflows, a controlled live failover. Record the time to activate and every step that required specialist knowledge.

Use lifecycle behavior as evidence, not as a prediction

Published lifecycle policies can show whether a provider has a process for announcing change, but they cannot bind a different provider or guarantee that the process will be followed in every circumstance.

A documented multi-stage model

AWS describes three lifecycle states—maintenance, sunset, and full shutdown—and says sunset timelines are “typically 12 months.” Treat that as AWS’s general description, not an industry norm or a promise for every service. When evaluating any provider, look for equivalent stages, definitions, notice channels, replacement guidance, and support during migration.

An example deprecation calendar

Cloud.gov publishes one example in which an announcement occurs on day zero, new instances stop on day 30 or later, reminders are sent every 14 days from day 30, and shutdown occurs on day 150 or later. The policy allows risk-based accelerated exceptions and places responsibility on customers to monitor notifications and plan migrations. This is an example for Cloud.gov, not a prediction about a commercial AI provider.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Signals worth recording

  • Named deprecation stages with dates and definitions.
  • A documented replacement path and compatibility notes.
  • Export instructions that are tested and maintained with the product.
  • Notice delivered through more than one channel, with an account-level contact you control.
  • Published support boundaries for old models, API versions, and preview features.
  • Evidence that prior retirements included usable migration guidance rather than only a final shutdown notice.

These signals improve preparedness; they do not reveal a provider’s financial condition or guarantee that an unannounced failure will provide the same lead time.

Score exposure without pretending the score is a forecast

A simple internal score helps prioritize work. It should rank your exposure and recovery readiness, not assign a made-up probability to provider failure.

Factor Low exposure High exposure
Workflow criticality Convenience function with a workable manual process Essential function with regulatory, safety, or severe revenue consequences
Exit rights Clear notice, retrieval period, and deletion terms Broad suspension or termination rights and unclear deadlines
Portability Complete, documented export restored successfully Missing configuration, proprietary formats, or no tested export
Dependency depth Single, replaceable call with independent records Model-specific behavior, indexes, integrations, and downstream automation
Fallback readiness Alternative tested, staffed, and documented Alternative named but untested or unavailable at required scale
Detection and ownership Named owner, monitored notices, and an approved trigger No inventory, owner, contact, or migration authority

Set an action threshold for each high-exposure cell. For example, a critical workflow with an untested export should not enter production until the export and restore test pass, regardless of the provider’s advertised availability.

Set shutdown triggers and assign ownership

Someone must be responsible before an announcement arrives. The AI RMF Playbook recommends inventories and documentation for third-party systems, including contingency processes for high-risk third-party AI failures.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Monitoring owner: watches provider status pages, lifecycle notices, contract communications, model deprecation feeds, and billing changes.
  • Technical owner: maintains integrations, exports, evaluation tests, credentials, and the fallback runbook.
  • Business owner: decides how much service degradation is acceptable and approves a migration or manual mode.
  • Security and legal reviewers: assess data handling, retention, regulatory duties, and evidence preservation.
  • Incident lead: coordinates the response when access is suspended or the provider is unreachable.

Define triggers such as a formal retirement notice, a model end-of-life date, repeated severe incidents, a material contract change, loss of required compliance status, or an outage that exceeds your recovery objective. For each trigger, specify who can activate the fallback, what information must be preserved, and when customers and staff are notified.

Common assumptions that fail

“The SLA means the product cannot disappear.”

An SLA measures service performance under its definitions. It does not create a product-longevity guarantee. Read termination, suspension, deprecation, and retention clauses separately.

“Our files are downloadable, so we are portable.”

Files may omit prompts, indexes, metadata, permissions, model settings, or relationships. Complete an export-and-restore test and preserve the configuration that gives the files meaning.

“Another model is automatically interchangeable.”

Different models can change classifications, citations, tool calls, formatting, latency, and error patterns. Use a representative evaluation set and update downstream validation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“A backup drive is the fallback.”

Independent storage helps preserve records, but it cannot serve requests or run a hosted API. Pair backups with an alternate operating path and a practiced activation procedure.

  • SPACE TO OWN YOUR AI CONTENT – speed and capacity to download your high-res clips and photo edits.
  • 256-BIT AES ENCRYPTION(4) – helps keep private files secure with password protection.

“We will migrate when a notice arrives.”

A notice may provide less time than your export, procurement, security review, and retraining require. Measure those tasks now and keep a current runbook outside the provider account.

“A published lifecycle policy guarantees our outcome.”

Policies are evidence of a process, not a universal rule. AWS’s typical 12-month sunset description and Cloud.gov’s example calendar illustrate possible practices only; they do not predict another provider’s notice period or an emergency shutdown.

A practical review cadence

At onboarding, complete the contract register, dependency inventory, export test, evaluation set, fallback design, and ownership assignments. Review them at every major model, API, integration, or contract change. At least annually—and more often for critical systems—repeat the export-and-restore test, run the fallback exercise, verify contact details, and recalculate the time and cost to switch.

Keep the following artifacts together in a location independent of the AI provider:

  • Current agreements, lifecycle notices, and dated provider contacts.
  • Data maps, retention decisions, export files, schemas, and restore instructions.
  • Prompt templates, system instructions, evaluation cases, safety rules, and expected-output examples.
  • Integration diagrams, configuration, dependency owners, and credential-rotation procedures.
  • Fallback runbook, activation authority, training notes, test results, and rollback criteria.

Review whether each artifact is both legally retainable and technically usable. Delete or restrict copies that you no longer need, particularly where personal, confidential, or regulated data is involved.

What a defensible conclusion looks like

You can say an AI dependency is comparatively resilient when its agreement gives workable notice and retrieval rights, its important artifacts have been exported and restored successfully, its upstream and downstream dependencies are documented, and a tested alternative can perform the required work within the organization’s recovery objective. You cannot honestly say that an uptime percentage proves the provider will remain in business or keep a particular model available.

The assessment should end with a dated decision: accept the remaining exposure, reduce it by redesigning the workflow, or move the critical function to a pathway you can operate and replace. Revisit that decision whenever the provider changes the product or your workflow becomes more important.
