How to assess bias and accuracy in police AI systems

Police AI cannot be approved by one accuracy percentage or a single fairness score. A credible assessment ties evidence to the system’s exact task, operating conditions, affected communities and the decision influenced by its output. Before deployment, define the decision and ground truth, document data provenance, compare the system with a credible baseline, test it in realistic field conditions, measure errors for relevant and intersecting groups, obtain independent review, and establish monitoring and suspension rules.

The process below applies to event detection, facial or person identification, surveillance support, investigative tools, risk scoring, forensic analysis and geographic crime forecasting. Evidence for one application does not validate another.

What a police-AI assessment must establish

An assessment should answer five separate questions:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Validity: Does the system measure or predict what its stated purpose requires, using evidence appropriate to that purpose?
  • Reliability: How often does it produce correct, incorrect or indeterminate outputs under the conditions in which officers will use it?
  • Distribution of error: Who receives false alerts, missed detections, false matches or harmful scores, and how uncertain are those estimates?
  • Operational effect: How do officers, investigators, dispatchers and supervisors act differently when the system is present?
  • Governance: Can the agency audit, challenge, pause and correct the system throughout its life?

These questions are connected but not interchangeable. A model can be statistically well calibrated and still be unsuitable if its labels are enforcement records that reflect unequal policing, if officers treat an advisory score as a command, or if the agency cannot inspect a vendor update.

Start by classifying the application and decision

“Police AI” is an umbrella term. Write down the application before selecting a test. The Federal Register text of Executive Order 14110 identifies police surveillance, crime forecasting and predictive policing, prison-management tools and forensic analysis as criminal-justice AI areas for review. Each has different evidence requirements.

Application Typical output Decision affected Evidence that matters
Event or object detection Alert that a specified event or object may be present Dispatch, review or camera response Missed events, false alerts, latency and performance across lighting, weather, camera angles and locations
Person identification Candidate identity or match score Stop, detention, investigation or evidence review False matches, missed matches, quality of the reference set and human confirmation procedures
Surveillance or investigation support Link, lead, watch-list hit or ranked information Investigative attention and resource allocation Data provenance, analyst workflow, confirmation bias, auditability and downstream actions
Person-level risk scoring Risk category or probability over a stated period Supervision, detention, services or other adverse action Outcome definition, time horizon, calibration, threshold effects and unequal false-positive and false-negative burdens
Forensic analysis Comparison, classification or evidentiary opinion Evidence triage or courtroom presentation Validated reference material, laboratory conditions, error bounds, examiner independence and reporting limits
Geographic crime forecasting Predicted locations or time windows Patrol allocation and deployment intensity Independent geographic and time-based benchmark, area or patrol capacity allocated, baseline comparison and feedback effects

Record the system name, exact version, developer, intended purpose, inputs, outputs, users, decision point and action that may follow. Describe the geography, time period, staffing, hardware, network conditions and data feeds. State whether the output is advisory or effectively determinative. If an officer can override it, record how overrides and disagreements are logged.

Define “correct” for this decision

Agreement with historical police records is not automatically correctness about an underlying crime, identity, threat or future behavior. Distinguish the target you want to know from the proxy that happened to be recorded. For example, an arrest may be a recorded outcome, not independent proof that the suspected conduct occurred. Explain how the reference label was established, who established it and what remains unknown.

NIST describes validation as objective evidence that requirements for a particular intended use have been met. That wording matters: a result validated for one use, site or population cannot be transferred to another without supporting evidence.

Audit the data, labels and measurement process

Require a data inventory before looking at model scores. For training, validation and test data, request:

  • Data dictionaries, collection methods and labeling instructions.
  • Dates, geographic coverage, sampling rules and exclusions.
  • Missing-value handling, transformations, deduplication and filtering.
  • Provenance for images, reports, calls, stops, arrests, complaints and other records.
  • Changes made between development, testing and deployment.
  • Group counts and distributions, including intersections where lawful and statistically supportable.
  • Known measurement error, uncertain labels and cases removed as “ambiguous.”

Check completeness, representativeness and balance both overall and within groups. A location, language, name, neighborhood or prior-contact feature may act as a demographic proxy even when protected attributes are omitted. NIST’s Measure guidance specifically calls for reviewing distributions across and within groups and identifying proxy features.

Interrogate the labels

Ask whether police deployment, reporting, stops, arrests or enforcement intensity helped create the labels. A database can faithfully encode the process that generated records while failing to describe the underlying phenomenon. Document that limitation in the assessment rather than presenting the records as neutral ground truth.

For identification and forensic systems, define how a “known” identity was verified and whether the reference set resembles operational images, devices, samples or environmental conditions. For risk systems, specify the outcome and follow-up period before calculating a score. For forecasting, separate the prediction target from the patrol or reporting activity that later supplies new data.

Choose a baseline and test in realistic conditions

Select the comparator before reviewing results. Depending on the use, it can be current practice, a non-AI process, a simple benchmark or another validated approach. State whether the study is retrospective or prospective, how cases are sampled, which geography and dates are included, and whether operators and workflows match actual deployment.

Run a field test before normal use

Laboratory accuracy or another agency’s report may not predict local performance. The April 2024 NAIAC Law Enforcement Subcommittee field-testing checklist, labeled “DRAFT” and “PRE-DECISIONAL/DELIBERATIVE,” emphasizes that operational performance can differ from sterile testing. It is useful proposed guidance, not final government policy or a binding requirement.

  1. Write a test protocol with the intended task, population, operating conditions, sampling plan, baseline, metrics, thresholds and decision consequences.
  2. Run the system in the real workflow, preferably with safeguards that prevent unvalidated outputs from driving irreversible action.
  3. Capture every output, abstention, delay, human override, disagreement and downstream action.
  4. Analyze favorable, unfavorable and inconclusive findings; do not discard inconvenient cases.
  5. Have an independent reviewer inspect the protocol, code or model artifacts where access permits, data preparation and analysis.
  6. Decide in advance what evidence permits expansion, restricted use, retraining, a pause or rejection.

The NAIAC draft proposes public disclosure of field-test plans and results. Treat that as a recommendation in a draft document, not a universal legal mandate.

The Department of Justice’s final Artificial Intelligence and Criminal Justice report, dated December 3, 2024, recommends an impact assessment before predictive-policing deployment and objective third-party auditing. Preserve test plans and results so later reviewers can distinguish a change in the model from a change in the operating environment.

Measure accuracy and fairness together

Report counts, denominators and uncertainty with every rate. An aggregate accuracy number can conceal a high false-positive rate for one group or a high miss rate for another. Choose metrics that fit the task, threshold and consequences of errors.

Use Core measures Questions to report
Binary detection or alerting True positives, false positives, true negatives, false negatives, sensitivity and specificity where meaningful What is the denominator? What happens after an alert or a miss? Does performance change by environment or group?
Score or risk ranking Calibration, discrimination or ranking validity appropriate to the outcome, plus threshold-specific error rates Is a stated probability comparable across groups? What time horizon and threshold are used?
Identification or matching False-match and missed-match rates, abstention rate and quality-stratified performance How was the verified reference set built? Are operational image or sample conditions represented?
Geographic prediction Prespecified independent benchmark, Predictive Accuracy Index or Recapture Rate Index where appropriate, and comparison with baseline practice How much area or patrol capacity was allocated? Does a map-level measure say anything about an individual person? (It does not.)
Forensic analysis Validation error, repeatability, reproducibility and uncertainty appropriate to the method What can the result establish, and what cannot it establish?

NIST recommends examining error rates and context-specific fairness measures, including group and intersecting-group comparisons. Demographic parity, equal opportunity and equalized odds answer different questions and can conflict. State which metric was selected, why it fits the use, who set acceptable tolerances, what trade-offs remain and what action follows a breach. Metric and threshold choices require human judgment and context; they are not supplied by a universal formula.

Disaggregate by relevant and intersecting groups

Report results for groups that may experience different conditions or consequences, and for intersections when data and privacy rules permit. Depending on the task, that may include race or ethnicity, sex, age, disability, language, skin tone, geography or other operationally relevant characteristics. Explain small samples, confidence intervals or other uncertainty. Do not hide a group because its estimate is imprecise; mark the limitation and avoid claims of precision the data cannot support.

Include disability access and the experience of affected communities. A technically similar error can have very different consequences depending on whether it triggers a patrol visit, a stop, detention, denial of a service or merely a second human review.

Evaluate the human and community effects

Model outputs become consequential through people and institutions. Map the workflow from input to action:

  1. Identify who sees the alert, map, match, explanation or score.
  2. Record whether the output is advisory, required, or treated as determinative in practice.
  3. Document training, time pressure, escalation rules and available alternatives.
  4. Log overrides, disagreements, unanswered alerts and actions taken after each output.
  5. Track complaints, adverse incidents, searches, stops, arrests, referrals and other downstream effects.

NIST characterizes trustworthy AI as socio-technical and recommends involving interested parties and contextual experts. Consult affected communities, civil-rights and disability specialists, frontline users, supervisors, prosecutors, defenders, data stewards and independent technical reviewers. Their role is to identify harms and operational assumptions that a model report may omit, not to provide a symbolic sign-off.

Look for feedback loops

Predictive deployment can change where officers patrol, what residents report and which records enter the database. Those altered records then become future training or evaluation data. The DOJ recommends periodic reevaluation to promote fairness and equity, including minimizing feedback loops, and routine audits of databases used for person-based prediction.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a geographic system, compare deployment outcomes with public-safety priorities, reported crime and other independently defined indicators. Ask whether non-policing public-health or social-service interventions could address the identified need; the DOJ report discusses such resources as possible alternatives or complements.

Make oversight enforceable before purchase

Put assessment access and correction rights in the contract, not only in a policy memo. Require:

  • Documentation of intended use, known limits, training and evaluation data, and material changes.
  • Access sufficient for validation, including relevant model artifacts or source-code review under appropriate safeguards.
  • Independent evaluation rights and cooperation with objective third-party auditors.
  • Incident, error and security reporting within defined time limits.
  • Advance notice of model, data, interface and threshold updates.
  • Audit logs, retention periods and records of human decisions and overrides.
  • Recurring audits, recalibration and a process to suspend use.
  • Exit, deletion and transition provisions if the system fails or the vendor cannot cooperate.

The DOJ specifically recommends objective third-party audits of models and source code and regular evaluation and auditing as vendor-contract terms. Its report states: “Agencies should adopt a mechanism for objective third-party auditing of models and source code to proactively address concerns about model accuracy, reliability, and potential for bias and discrimination.”

Set continuous monitoring and stop rules

Define the monitoring plan before launch. Assign an accountable owner and specify:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Which metrics, groups, intersections and operational outcomes are reviewed.
  • How often data quality, labels, outcomes and performance are audited.
  • What disparity, drift, error or incident triggers investigation.
  • Who can pause or suspend the system, and how quickly that decision takes effect.
  • How affected people can challenge an output or request correction.
  • How remediation is tested and documented before resuming use.
  • When the system must be reassessed after a model, data, policy, staffing or operating-condition change.

NIST Measure guidance calls for monitoring outputs, periodic updates, testing and recalibration, with action when disparities exceed acceptable levels. Keep a public-facing record of purpose, version, evidence, limitations, assessment dates, lawful group-level results, complaints, incidents and corrective actions. Protect sensitive information, but do not use confidentiality as a reason to conceal the existence of the system or its material limitations.

Compare candidate systems or deployment choices

When choosing among tools, versions or a non-AI alternative, score each option on the same axes. A polished dashboard should not outrank a simpler process that has stronger evidence and enforceable controls.

Axis Questions
Task and decision severity What decision is affected, how reversible is it, and what rights or safety interests are at stake?
Local validity Was the system tested prospectively under local data, geography, staffing and workflow conditions?
Error distribution Are false positives, false negatives, abstentions and uncertainty reported for relevant and intersecting groups?
Data provenance Can the agency explain collection, labeling, exclusions, missingness, proxies and changes over time?
Explainability and audit access Can independent reviewers inspect evidence, logs, limitations, updates and, where necessary, model or source-code artifacts?
Human workflow Are users trained, overrides recorded and safeguards effective against automation bias?
Monitoring and remediation Are owners, review intervals, thresholds, complaints, pause powers and correction tests defined?
Community impact What burden falls on residents, and were affected communities and contextual experts involved?

Common assessment failures and how to correct them

Relying on one headline score

Failure: Publishing overall accuracy without denominators, uncertainty, thresholds or group results.

Correction: Report task-specific error rates, calibration or validity measures, subgroup and intersection results, and the action associated with each error.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Using a vendor benchmark as local proof

Failure: Treating a laboratory test, a selected dataset or another agency’s report as evidence of operational performance.

Correction: Predeclare a baseline and run a field test with local conditions, real operators and independent review.

Treating records as neutral ground truth

Failure: Assuming arrests, stops, reports or prior alerts directly represent underlying crime or risk.

Correction: Document how each label was produced, identify enforcement and reporting influences, and use a reference process appropriate to the intended claim.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Removing protected attributes and declaring fairness

Failure: Dropping demographic fields while retaining proxies such as location or prior contact, then reporting only aggregate results.

Correction: Test for proxy effects, retain lawful evaluation variables under controlled access, and analyze relevant groups and intersections.

Translating map metrics into person-level claims

Failure: Treating a hotspot measure as evidence that a named person is more likely to offend.

Correction: Keep geographic allocation metrics separate from person-level risk or identification validity.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Making an advisory score effectively mandatory

Failure: Policy says “human in the loop,” but workload, interface design or supervisory pressure makes disagreement impractical.

Correction: Observe real use, record overrides and disagreements, train supervisors, and require a documented reason before an output can drive a consequential action.

Ignoring change after launch

Failure: Treating the initial approval as permanent despite data drift, model updates, staffing changes or altered patrol patterns.

Correction: Set review intervals and event-triggered reassessment, with authority to pause use while evidence is rebuilt.

Standards and government guidance to situate the review

NIST AI RMF 1.0 is voluntary guidance published January 26, 2023. The NIST AI RMF page reviewed for this article says the framework is being revised, so verify the current version and status when adopting it. NIST’s Measure playbook provides practical, nonbinding suggestions for evaluating performance and bias. NIST SP 1270, published March 15, 2022, addresses identifying and managing bias across AI processes.

The DOJ’s Artificial Intelligence and Criminal Justice is a final report dated December 3, 2024. It recommends impact assessment before predictive-policing deployment, objective third-party audits, routine database audits, periodic reevaluation and audit requirements in vendor contracts. These are recommendations; agencies must separately determine which statutes, regulations, court orders, records obligations and procurement rules apply to their jurisdiction.

The NAIAC field-testing checklist from April 2024 is explicitly a draft and pre-decisional/deliberative document. Use its proposed questions to strengthen a test plan, but do not describe it as final policy or a binding requirement.

A practical approval checklist

  1. Identify the exact system version, purpose, inputs, outputs, users, geography and decision.
  2. Define the target outcome, reference labels, time horizon and consequences of errors.
  3. Inventory data provenance, missingness, exclusions, transformations and proxy features.
  4. Select a credible baseline and predeclare the sampling and analysis plan.
  5. Conduct a realistic field test before routine use where feasible.
  6. Report task-appropriate validity, error, calibration and uncertainty measures.
  7. Disaggregate results for relevant demographic and intersecting groups.
  8. Analyze human workflow, overrides, downstream actions, complaints and community effects.
  9. Obtain independent technical and contextual review, with access rights written into contracts.
  10. Set monitoring intervals, disparity and incident triggers, pause authority and remediation tests.
  11. Reassess after material changes and preserve unfavorable or inconclusive findings.
  12. Publish an understandable record of purpose, evidence, limitations, dates and corrective actions, subject to lawful privacy protections.

Bottom line

A police AI system is ready only when evidence supports its specific use in its actual environment and the agency can control what happens when evidence turns unfavorable. Accuracy, fairness metrics, data quality, field performance, human behavior, community impact and enforceable oversight must be evaluated together. If the system cannot be independently examined, locally tested, continuously monitored and paused when harms emerge, the responsible conclusion is to restrict or defer deployment rather than infer safety from a single score.
