How to Assess AI Vendors for Security, Privacy, and Compliance

Assess an AI vendor against your specific use case, data, users, and legal duties—not against a marketing badge. Map every model, API, tool, data source, subprocessor, and access path; test the vendor’s evidence of security, privacy, reliability, fairness, and intellectual-property controls; then contract for monitoring, incident response, fallback, and exit. NIST’s AI Risk Management Framework (AI RMF) provides a useful voluntary structure, but adopting it does not by itself make a deployment secure or legally compliant.

What a sound AI-vendor assessment must establish

A vendor review should answer five practical questions:

As an Amazon Associate I earn from qualifying purchases.

  • Is the system appropriate for the intended decision or workflow? Document the purpose, users, affected people, operating environment, expected benefits, and consequences of an incorrect or unavailable result.
  • What exactly are you buying? Identify models, APIs, retrieval or fine-tuning components, embedded tools, software libraries, data sources, subprocessors, hosting providers, and support channels.
  • How will your information and other people’s information be handled? Establish what enters the service, who can access it, whether it is retained or reused, where it is processed, and how it is deleted.
  • What evidence shows that controls work? Review test results, assessments, limitations, release practices, vulnerability handling, and incident records rather than accepting general assurances.
  • What happens after purchase? Define monitoring, change notification, reporting, response, continuity, recovery, and decommissioning before production use.

The right depth depends on risk. A tool that drafts internal meeting notes is not equivalent to a system that recommends medical treatment, determines eligibility for a service, or handles large volumes of sensitive personal information. Set your organization’s risk tolerance and requirements before comparing suppliers.

Use NIST guidance as a risk-management structure, not a compliance certificate

The National Institute of Standards and Technology’s AI RMF 1.0 organizes work around four functions: govern, map, measure, and manage AI risks. Those functions apply across development, procurement, deployment, use, and evaluation; they are continuous activities rather than a one-time procurement checklist. NIST describes the framework as voluntary, and its AI Resource Center says a revision is in progress.

NIST AI 600-1, the Artificial Intelligence Risk Management Framework: Generative Artificial Intelligence Profile, published July 26, 2024, adds generative-AI-specific procurement and operational actions. NIST SP 1326, finalized July 8, 2026, offers a separate information-and-communications-technology supplier cybersecurity due-diligence lens covering foreign ownership, control, or influence; supplier and product provenance; resilience; foundational cyber practices; and supply-chain tiers.

These publications help you ask better questions and organize evidence. They do not determine whether a particular deployment meets a sector rule, privacy statute, contract, or regulator’s expectation. Legal obligations depend on jurisdiction, industry, data, customer role, and the consequences of the use case.

Step 1: Define the use case, context, and risk tolerance

Write a one-page use-case record

Before sending a request for proposals, create a record that is specific enough for a reviewer to challenge assumptions. Include:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Intended purpose and business owner.
  • Primary users, administrators, support staff, and affected individuals or groups.
  • Deployment setting, such as an internal application, customer-facing feature, employee workflow, or automated decision support.
  • Inputs, outputs, connected systems, and human review points.
  • Whether the system generates, ranks, classifies, summarizes, recommends, or takes an action.
  • Expected volume, latency, availability, and geographic requirements.
  • Failure consequences, including confidentiality loss, financial harm, discrimination, safety risk, operational disruption, or legal exposure.
  • Required accuracy, explainability, retention, residency, accessibility, and recovery objectives.

Separate assistance from autonomy. A draft that a trained employee must verify has a different control profile from an output that is sent to a customer or triggers a transaction without review.

Set decision gates

Define in advance which findings stop procurement, which require remediation, and which can be accepted by a named risk owner. Examples of stop conditions include an inability to delete customer data, undisclosed subprocessors with access to sensitive content, no usable incident-notification commitment, or evaluation evidence that does not cover the intended operating conditions.

Weight requirements by impact. Availability may dominate for a real-time safety workflow; data-use restrictions may dominate for confidential legal records; fairness and contestability may dominate for decisions affecting people. A single universal score conceals those differences.

Step 2: Map the complete system and supply chain

Request an architecture and data-flow description

Ask the supplier to show, in plain language and a diagram, what happens from input to output. The description should identify:

What’s actually slowing this PC down?

Pick the symptom - the matching free tool is one click away.

  • Foundation, task-specific, and auxiliary models, including model versions and update practices.
  • Public and private APIs, orchestration layers, plug-ins, agents, and tools that can execute actions.
  • Retrieval stores, vector databases, fine-tuning jobs, prompts, logs, telemetry, and abuse-monitoring systems.
  • Training, evaluation, and operational data sources, including licensed, customer-provided, and synthetic data.
  • Cloud, hosting, support, and security-monitoring providers.
  • Every subprocessor or other third party that can access organizational content, credentials, metadata, or outputs.
  • Administrative access, tenant isolation, encryption boundaries, and locations where data is processed or stored.

NIST’s Generative AI Profile recommends a use-case-based supplier assessment, an inventory of third parties with access to organizational content, and acquisition due diligence that addresses AI-specific risks. Require the supplier to explain how this inventory is updated and how you will be notified of additions or material changes.

Trace data, privileges, and outputs

For each data class, record its path and permitted use. A useful register includes:

Item Questions to answer
Input content What personal, confidential, regulated, copyrighted, or security-sensitive information may be submitted? Is submission blocked or filtered?
Processing Which model and region process it? Is it used for training, fine-tuning, abuse detection, analytics, or human review?
Storage Are prompts, files, embeddings, outputs, and logs retained? For how long, and can retention be configured?
Access Which supplier personnel, subprocessors, administrators, or customer tenants can access content or metadata?
Output Where are results delivered, cached, exported, or used to trigger another system? What controls prevent unauthorized actions?
Deletion How are active data, backups, replicas, indexes, and derived artifacts deleted, and what evidence is supplied?

Do not assume that a vendor’s main product description covers an optional connector, support workflow, or “improvement” setting. Assess each enabled feature and integration.

Step 3: Assess security and resilience

Identity, isolation, and access control

  • Require strong administrator authentication, role separation, least privilege, and auditable access.
  • Confirm tenant isolation for prompts, files, embeddings, logs, and caches.
  • Ask how service accounts, API keys, secrets, and tool permissions are created, rotated, scoped, and revoked.
  • Establish whether customer administrators can enforce single sign-on, multifactor authentication, network restrictions, and session controls.

Confidentiality and integrity

Ask where encryption is applied in transit and at rest, who controls keys, and how backups are protected. Determine whether the supplier can detect prompt injection, malicious files, data exfiltration, unauthorized tool calls, model manipulation, and abuse of administrative interfaces. For retrieval systems, ask how untrusted documents are isolated and how citations or source boundaries are enforced.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Availability and recovery

Obtain service-level targets, maintenance practices, dependency maps, backup frequency, recovery-point and recovery-time objectives, and evidence from resilience exercises. Clarify what happens when a model endpoint, region, identity provider, retrieval store, or critical subprocessor fails. A high-risk workflow should have a tested manual or alternate-system procedure, not merely a status page.

Vulnerability and incident handling

Request the vulnerability-disclosure channel, severity definitions, patch timelines, penetration or security-test summaries, and processes for emergency fixes. Ask what constitutes a security, privacy, safety, or model-behavior incident; when you will be notified; what information the notice will contain; and how the supplier supports investigation and regulatory or customer reporting.

Evidence should cover the service you will use, not only a parent company or a different product edition. Check scope, assessment dates, exclusions, exceptions, and whether controls were tested in the relevant environment.

Step 4: Assess privacy and data governance

Define the data relationship

Determine who decides the purposes and means of processing and who acts on whose instructions. Your legal team should map that relationship to applicable privacy obligations and customer contracts. Do not accept a generic privacy statement as an answer to a use-case-specific question.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask precise data-use questions

  • Is customer content used to train, fine-tune, evaluate, or improve a shared model by default?
  • Can the vendor disable those uses contractually and technically for every relevant feature?
  • What data is collected in prompts, uploads, outputs, telemetry, safety logs, support tickets, and error reports?
  • How are data-subject requests, corrections, deletion, restriction, and access handled across copies and derived artifacts?
  • Which countries process or store data, and can the customer select or restrict regions?
  • How long are records retained, including backups, abuse-monitoring logs, and human-review queues?
  • What safeguards apply to children’s data, health information, financial information, credentials, or other sensitive categories?
  • Can the customer export data, configurations, prompts, evaluation sets, logs, and metadata in a usable format?

Test the answers with representative data classifications. A “no training” option does not necessarily mean no retention, no human access, or no processing by a subprocessor.

  • [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by

Minimize and control information before it reaches the service

Use redaction, tokenization, field-level filtering, purpose-specific accounts, and separate environments where appropriate. Restrict uploads by type and size, prevent secrets from entering prompts, and log policy decisions without unnecessarily copying sensitive content. Keep a clear owner for approving new data sources and integrations.

Step 5: Evaluate reliability, validity, safety, and fairness

Demand use-case-relevant evaluation

Ask for test design, datasets or data descriptions, metrics, confidence intervals or error ranges where available, tested languages and populations, and results under conditions that resemble your deployment. Require examples of known failure modes, out-of-distribution behavior, refusal errors, hallucinations, unsafe recommendations, and susceptibility to adversarial inputs.

Benchmark scores from unrelated tasks do not establish fitness for your workflow. Run a controlled pilot with representative, lawfully obtained data and pre-agreed acceptance criteria. Keep a holdout set so that tuning does not turn evaluation into a self-fulfilling exercise.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep humans accountable

Specify when a person must review, override, or escalate an output; what training that person needs; and how disagreements are recorded. For consequential uses, provide notice, explanation appropriate to the decision, correction channels, and a way to contest an outcome where required. Avoid presenting generated text as verified fact unless an accountable process verifies it.

Test fairness in context

Identify which groups could be affected and what disparate errors would matter. Evaluate performance, refusal behavior, language coverage, accessibility, and downstream effects for those groups. A vendor’s aggregate fairness claim may not transfer to your data, prompts, thresholds, human workflow, or jurisdiction. Record limitations and mitigation owners rather than treating a single fairness metric as a pass/fail answer.

Consider intellectual-property and legal exposure

Establish what rights you have to submit training or retrieval material, and what rights or restrictions apply to outputs. Ask how the supplier handles claims involving training sources, generated material, trademarks, confidential information, and third-party code. Define warranties, indemnities, customer responsibilities, and procedures for removing or replacing problematic content. These contractual questions do not replace legal analysis of the specific material or use.

Step 6: Verify evidence instead of collecting badges

NIST assessment guidance frames an assessment around three questions: are controls implemented correctly, do they operate as intended, and do they produce the desired security and privacy outcomes? Apply that standard to every artifact.

Evidence How to examine it Warning signs
Independent assessment or audit Check scope, control objectives, period covered, testing methods, exceptions, and product edition. Only corporate-level scope, stale dates, broad exclusions, or no explanation of exceptions.
Security and privacy test results Compare test conditions, threat model, metrics, severity handling, and remediation status with your use case. Marketing summaries without methods, datasets, limitations, or unresolved findings.
Architecture and subprocessor records Trace each data path and privilege to a named component and contractual commitment. “Proprietary” answers that prevent meaningful risk analysis or omit support and telemetry paths.
Policies and procedures Ask for operating records, exercise results, tickets, or samples that show the policy is followed. A policy is offered as proof that controls worked in production.
Change and release records Review versioning, notice periods, rollback, evaluation gates, and customer testing options. Silent model swaps, unbounded feature changes, or no rollback path.

Protect confidential evidence during review. Use a controlled repository, restrict access, record versions, and document which claims were verified, partially verified, or accepted as residual risk.

Step 7: Compare vendors on consistent, risk-weighted criteria

When several suppliers remain, use the same questions and scoring definitions. Weight high-consequence criteria more heavily than convenience features.

Decision axis What to compare Example evidence
Use-case fit Supported tasks, populations, languages, integrations, human review, and operating limits. Scenario tests, pilot results, documented limitations.
Data handling Training use, retention, residency, deletion, access, and export. Contract terms, configuration screens, deletion records.
Security and resilience Identity, isolation, encryption, vulnerability response, availability, recovery, and dependency risk. Technical documentation, test reports, exercise results, incident history.
Evaluation quality Relevance, independence, coverage, reproducibility, and unresolved findings. Methods, datasets, metrics, dates, remediation evidence.
Transparency and accountability Model documentation, limitations, explanations, support, reporting, and responsibility allocation. System cards, runbooks, escalation contacts, contractual duties.
Fairness, safety, and impact Context-specific tests, safeguards, contestability, accessibility, and misuse controls. Disaggregated results, red-team findings, mitigation plans.
Legal and intellectual property Data rights, output restrictions, third-party content, indemnity, and jurisdictional duties. Reviewed terms, licenses, provenance records, legal sign-off.
Supply-chain visibility Subprocessors, ownership and control, provenance, dependencies, and change notification. Current inventory, supplier attestations, SP 1326-style due diligence.
Continuity and exit Fallback, recovery, portability, termination assistance, deletion, and replacement feasibility. Exit test, export sample, recovery exercise, contract clauses.

Do not average away a critical failure. A low price or excellent benchmark cannot compensate for an unacceptable data-use practice in a sensitive deployment. Record the rationale for each weight and the person authorized to accept residual risk.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Support on Ko-Fi

Step 8: Put governance and evidence duties into the contract

Require notice and cooperation

Contract for advance notice of material model, data-use, subprocessor, hosting, ownership, security, and service changes. Define what counts as material, how much notice is practical, and what happens when an emergency change cannot wait. Require cooperation with investigations, audits, impact assessments, regulator inquiries, and customer requests to the extent appropriate.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Specify incident and vulnerability obligations

Set notification deadlines, communication channels, minimum incident details, preservation of evidence, containment support, root-cause reporting, corrective actions, and post-incident testing. Include model-behavior incidents and privacy or availability events, not only conventional network breaches.

Define monitoring and assessment rights

Agree on recurring reports, access to updated evaluation results, vulnerability notices, service metrics, subprocessor lists, and relevant assurance artifacts. Where direct audits are impractical, specify alternatives such as independent reports, targeted questionnaires, evidence reviews, or technical tests. Ensure the right is usable for the risk and product architecture you are buying.

Plan failure, substitution, and exit

For high-risk systems, require contingency processes for supplier failure or an incident involving third-party data or AI components. Define manual fallback, alternate providers or models, recovery priorities, data and configuration export, transition assistance, deletion certification, and verification that backups, indexes, and derived artifacts are removed. Test the exit path before the system becomes operationally indispensable.

Step 9: Monitor the vendor throughout the lifecycle

Procurement approval is a starting point. Assign owners for a recurring review that tracks:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Model, prompt, retrieval, tool, API, and subprocessor changes.
  • Security vulnerabilities, incidents, outages, abuse patterns, and dependency failures.
  • Drift in accuracy, refusal behavior, latency, cost, fairness, and safety under real operating conditions.
  • New data sources, expanded user groups, new jurisdictions, and changed business purposes.
  • Whether human review, access controls, redaction, and retention settings still operate as designed.
  • Open remediation items, exceptions, accepted residual risks, and expiration dates.

Use thresholds that trigger investigation or suspension. A model update that changes output behavior may require regression testing even when the vendor calls it a routine release. Keep versioned prompts, evaluation sets, configurations, logs, and decision records so an incident can be reconstructed.

Common assessment failures and how to correct them

“The vendor has a certification, so it is compliant.”

Why it fails: An assurance artifact has a defined scope and period; it does not prove that your data, workflow, jurisdiction, or risk profile is covered. Correction: examine scope, exceptions, operating evidence, and the controls specific to your deployment.

“The model is accurate on a public benchmark.”

Why it fails: Benchmark tasks may not represent your language, users, documents, edge cases, or consequences of error. Correction: run representative tests, preserve a holdout set, measure harmful errors, and define human escalation.

“The main service is secure, so integrations are covered.”

Why it fails: Connectors, agents, retrieval stores, support tools, and subprocessors create additional data paths and privileges. Correction: inventory every enabled component and test least privilege and failure behavior end to end.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“No training” means no privacy risk.

Why it fails: Retention, telemetry, abuse review, support access, backups, and derived indexes may still process the content. Correction: obtain a complete data-flow and deletion description, then verify configuration and contractual limits.

“We can deal with continuity later.”

Why it fails: A critical workflow can become dependent on one model, region, identity system, or subprocessor before a fallback exists. Correction: set recovery objectives, maintain a manual or alternate path, and exercise export and restoration before launch.

“The vendor’s policy answers the question.”

Why it fails: A policy describes intent; it does not show correct implementation, operation, or outcomes. Correction: request dated test results, exercise records, remediation evidence, and product-specific scope.

A practical assessment worksheet

Keep one living record with these sections:

  1. Use case and impact: purpose, users, affected groups, data classes, failure consequences, legal and contractual requirements, and risk owner.
  2. System map: models, versions, APIs, tools, stores, data sources, hosting regions, subprocessors, privileged roles, and data flows.
  3. Control requirements: identity, encryption, isolation, retention, deletion, vulnerability handling, availability, recovery, human review, fairness, accessibility, and intellectual-property safeguards.
  4. Evidence register: artifact, scope, date, evaluator, test method, finding, limitation, remediation status, and reviewer conclusion.
  5. Decision record: weighted criteria, disqualifiers, residual risks, compensating controls, approval authority, and review date.
  6. Operating plan: monitoring metrics, change triggers, incident contacts, fallback steps, reporting duties, and exit procedure.

Revisit the record when the purpose, data, users, model, integration, supplier, geography, or legal context changes. A vendor that was acceptable for low-risk drafting may not be acceptable when the same capability is connected to a customer database or an automated decision.

How to interpret the main NIST resources

  • AI RMF Core (2023): use the Govern, Map, Measure, and Manage functions to organize accountability, context, measurement, and treatment of risk.
  • AI RMF Resources page: use it for current framework materials and status information; NIST reports that a revision is in progress.
  • AI 600-1 Generative AI Profile (July 26, 2024): use its procurement-oriented actions for generative-AI supply-chain mapping, third-party access, testing, documentation, and contingency planning.
  • AI RMF Playbook: Manage: use it to connect vendor decisions to organizational risk tolerance and ongoing treatment actions; its actions are not necessarily an ordered checklist.
  • SP 1326 (final July 8, 2026): use its ICT supplier due-diligence perspective for provenance, foreign ownership or influence, resilience, foundational cybersecurity, and supply-chain tiers.
  • RMF Assess step: use its standard of checking correct implementation, intended operation, and desired outcomes when reviewing supplier evidence.

NIST reports that more than 240 organizations contributed to development of the AI RMF over an 18-month period. That figure describes collaborative framework development, not the effectiveness or compliance of any particular vendor.

Final decision rule

Approve an AI vendor only when the system fits the defined use case, data and dependency paths are understood, controls are supported by relevant evidence, known limitations are acceptable and mitigated, legal and intellectual-property responsibilities are allocated, and monitoring, incident response, fallback, and exit are operationally credible. If a critical answer remains unknown, treat the uncertainty as a risk requiring resolution or explicit acceptance—not as evidence that no problem exists.
