Start by preserving the service date. A first appeal is normally due within 30 days, but the clock usually runs from service of the notice of demand for an assessment or penalty appeal, and from service of the order or intimation for other matters. The correct form and statute depend on the tax year: Form 35 generally applies to proceedings under the Income-tax Act, 1961, while Form 99 is prescribed for first appeals under the Income-tax Act, 2025. Filing an appeal does not automatically stop collection, so a separate request concerning the disputed demand may be necessary.
What a first income-tax appeal does
A first appeal asks the designated appellate authority to examine an adverse assessment, reassessment, penalty, intimation or another appealable order. It is different from replying to a notice before an assessment is completed: an appeal challenges an order that has already been issued.

The usual route is:
- Assessing Officer’s order or demand
- Joint Commissioner (Appeals) or Commissioner (Appeals), as applicable
- Income Tax Appellate Tribunal
- Higher courts where the law permits
This guide covers the first appeal. The order, its statutory section, issuing authority, tax year and service evidence determine whether an appeal is available and where it must be filed.

The filing date alone does not decide which Act applies. The Income Tax Department says the Income-tax Act, 1961 was repealed from 1 April 2026, but proceedings initiated on or after that date concerning a tax year beginning before 1 April 2026 continue under the repealed Act. Therefore, a filing after 1 April 2026 concerning AY 2026–27 or an earlier assessment year can still be a legacy-Act appeal.

| Case you are filing | Governing framework | First-appeal form | Relevant first authority |
|---|---|---|---|
| Proceeding governed by the Income-tax Act, 1961 | 1961 Act and its applicable rules | Form 35 | JCIT(A) or CIT(A), depending on jurisdiction and order |
| Proceeding governed by the Income-tax Act, 2025 | 2025 Act, including sections 356–360 | Form 99 under Rule 167 of the Income-tax Rules, 2026 | First appellate authority specified under the new framework |
Use the tax year and transition rule to classify the case before opening the portal form. If the classification is unclear, obtain advice based on the actual assessment year and order rather than choosing a form because it is the newer one.
Why the transition matters in practice
For example, a taxpayer who logs in after 1 April 2026 may see a newer form, but that does not by itself change the law governing an appeal for an earlier assessment year. Read the tax year stated in the order, check when the relevant proceeding began and match the form to that framework. Keep a copy or screenshot of the transition information used when making the selection in case the portal later displays a different label.
Identify the order, service date and appealable authority
Find the order being challenged
Keep the complete order, not only the demand summary. Note the section under which it was issued, the date shown on the order, the authority that issued it and the resulting demand or penalty. The old Act’s section 246A lists appealable orders, while section 246 addresses the JCIT(A) route. The order’s section and issuing authority therefore matter when deciding whether the first appeal goes to a Joint Commissioner (Appeals) or Commissioner (Appeals).

For an assessment or penalty appeal, the ordinary limitation period is measured from service of the notice of demand. For other matters, it is generally measured from service of the order or intimation. The date printed on an order is not necessarily the service date. Save the portal delivery record, email, electronic communication, download record or other evidence showing when you received it.
Check whether the decision is appealable
Not every communication is an appealable order. Match the document to the applicable statutory list and confirm that the proposed grounds challenge a decision actually made in that order. A demand generated from an order may be appealable with the order; a preliminary notice may require a response through the assessment proceedings instead.
Separate an order from the amount demanded
The assessment order explains how income, deductions, loss, interest or penalty was determined. The demand notice states the amount sought. Read both together: an appeal should identify the disputed conclusion in the order, while the demand notice helps establish the amount, service event and payment information. If only part of the demand is disputed, state the disputed component clearly rather than describing the entire amount as contested.
What is the time period within which Appeal can be filed before CIT(A)?
The ordinary first-appeal period is 30 days. The Income Tax Department’s Form 35 FAQ states: “The assessee has to file Appeal within 30 days from the date of service of order or demand as the case may be.” For an assessment or penalty, use the service of the demand notice as the normal starting point; for another appeal, use service of the order or intimation.

Limitation provisions contain exclusions and calculation details that can affect the result. Determine the actual service date, apply the provisions of the governing Act and review the current official filing instructions. Do not rely only on the order date, a date typed into an email or an automatically generated demand date.
A simple limitation worksheet
- Write down the exact date and method of service.
- Identify whether the matter is an assessment or penalty, or another type of order.
- Mark the ordinary 30-day deadline under the applicable Act.
- Check statutory exclusions and any portal or rule instructions that affect counting.
- Submit before the deadline and retain the electronic acknowledgment.
This worksheet is for organizing records, not for replacing the governing limitation provision. If service occurred through more than one channel, retain every delivery record and explain which event you treated as service.

Can an Appeal be filed after 30 days?
Possibly. The first appellate authority may admit a late appeal when the taxpayer demonstrates sufficient cause for the delay. This is discretionary, not an entitlement. A condonation request should accompany Form 35 in a legacy case, and it should explain the delay candidly with supporting evidence.
What a condonation request should contain
- The date on which the order or demand was actually served.
- The date on which the limitation period therefore ended.
- A chronological explanation for each part of the delay.
- Documents supporting the explanation, such as delivery records, medical evidence or proof of an access problem where relevant.
- A clear request to admit the appeal despite delay.
Do not assume that filing a condonation request guarantees admission. The authority decides whether the explanation amounts to sufficient cause on the facts before it. Continue to comply with other payment and filing requirements while the request is pending unless the authority directs otherwise.

Tax-payment condition in legacy cases
Section 249 of the 1961 Act contains admission conditions. Where a return was filed, the taxpayer generally must have paid the tax due on the returned income. Where no return was filed, the specified advance-tax condition may apply. The authority can exempt a taxpayer for recorded sufficient reasons. Check the precise provision and your facts before filing; a payment issue can affect admission separately from the merits of the grounds.
Legacy Form 35 fee bands
| Assessed total income | Appeal fee |
|---|---|
| ₹1,00,000 or less | ₹250 |
| More than ₹1,00,000 and up to ₹2,00,000 | ₹500 |
| More than ₹2,00,000 | ₹1,000 |
| Matters not covered by the income bands | ₹250 |
Section 358 of the Income-tax Act, 2025 provides the same fee bands for appeals under that Act. Confirm the payment type and amount shown in the applicable portal flow, particularly when selecting Form 35 versus Form 99.
Prepare the appeal papers before opening the portal
The official Form 35 manual identifies the information and records ordinarily required. Assemble them in a folder with unambiguous file names and keep copies of everything submitted.
Order and demand notice
Include the complete order under appeal and the notice of demand. These establish the decision challenged, the statutory provision, the amount demanded and the service information used for limitation.
Statement of facts
Set out the material chronology and facts in a concise, ordered form. Distinguish facts appearing in the assessment record from facts asserted by the taxpayer. Identify the documents that prove each important factual proposition.
Grounds of appeal
Write separate, numbered grounds stating precisely what is challenged and why. Tie each ground to the relevant addition, disallowance, penalty, computation or procedural error and to the evidence supporting it. Avoid broad statements such as “the order is wrong” without identifying the decision that should be reversed or modified.
Evidence and payment details
Collect documentary evidence, tax-payment details, appeal-fee details and information about any pending appeals. Retain challans, acknowledgments and portal receipts. Include the DIN or order number exactly as shown.

Related proceedings and identifiers
Record any pending appeal or related proceeding requested by the form, together with the correct appeal identifier. A mismatch between the order number, DIN, assessment year and taxpayer details can create avoidable filing problems.
Organize evidence around each ground
Use a short index or schedule linking each ground to the page or file that supports it. Keep the order and demand notice first, followed by payment proof, prior replies, books or statements and other documentary evidence in a logical sequence. Do not upload duplicate or unreadable files. Preserve the original documents even after uploading scans.
How to file the first appeal online
The Income Tax Department’s Form 35 manual describes the following e-filing routes. Portal labels can change, so use the current labels displayed for your account while keeping the same sequence in mind.
- Sign in to the Income Tax e-Filing portal. Use the taxpayer account or authorized representative account permitted for the case.
- Select the appeal service. The manual describes either Pending Actions → E-Proceedings → For your Information → File Appeal or e-File → Income Tax Forms → File Income Tax Forms.
- Choose the correct form. Select Form 35 for the applicable 1961 Act proceeding or Form 99 for a first appeal under section 358 of the 2025 Act.
- Enter the order and service information. Use the exact assessment year or tax year, section, order number or DIN, issuing authority, demand information and service date supported by your records.
- Complete facts, grounds and payment fields. Upload the statement of facts, grounds, evidence, order, demand notice and other details requested by the form. Attach a condonation request where the appeal is late.
- Pay the applicable fee and satisfy admission fields. Use the amount and payment method required in the live portal flow, and enter tax-payment details accurately.
- Submit and verify electronically. The manual describes electronic verification using a Digital Signature Certificate (DSC) or Electronic Verification Code (EVC), as applicable.
- Save the acknowledgment. Download the submission acknowledgment, verification confirmation and uploaded documents. Record the appeal number or other identifier for later correspondence.
If a portal field conflicts with the order or the applicable statute, stop and resolve the discrepancy rather than submitting an incorrect tax year, form or authority.
After submission: monitor the record
Keep the acknowledgment, verification confirmation, appeal number, uploaded files and payment receipts together. Check the portal and registered communication channel for requests, hearing notices or defects. If the authority asks for clarification or additional documents, answer within the stated time and identify the appeal number on every response.
Recommended Free Tools
Do not assume that a successful upload means the appeal has been admitted on the merits. Filing, verification, condonation (if needed), admission conditions and the eventual decision are separate stages. Preserve evidence of each stage.
What to do when the demand remains payable during the appeal
Filing an appeal does not automatically stay collection. The Department’s appeals guidance says an Assessing Officer may, under section 220(6) of the 1961 Act, treat the assessee as not in default for the disputed demand while the appeal is pending.
Make a separate, reasoned request to the appropriate authority for treatment of the disputed amount. Identify the demand under challenge, the appeal acknowledgment, the amount disputed and the grounds supporting relief. Any stay or “not in default” treatment is discretionary and may carry conditions; neither filing the appeal nor making the request guarantees suspension of recovery.
Common mistakes and how to correct them
Using the wrong statute or form
A post-1 April 2026 filing is not automatically a Form 99 case. Recheck the tax year and the transition rule before selecting the form. A proceeding concerning a tax year beginning before 1 April 2026 can remain under the 1961 Act.

Counting from the order date instead of service
Preserve evidence of actual service and calculate limitation from the legally relevant event. If the period has expired, file the condonation explanation with supporting proof rather than silently ignoring the delay.
Appealing an unappealable communication
Confirm that the document is an appealable order under the governing Act and that the selected first authority has jurisdiction. A notice requiring a response is not necessarily a final appealable decision.
Submitting vague grounds
Separate factual disputes, legal errors, computation mistakes and procedural objections. Refer to the specific addition or conclusion and identify the evidence that addresses it.
Forgetting admission payments or the fee
Review the applicable tax-payment condition and fee band before submission. Keep proof of every payment entered in the form.

Frequently asked questions
What is Form 35?
Form 35 is the legacy first-appeal form for proceedings governed by the Income-tax Act, 1961. Use it only after checking the tax year, transition rule, order and applicable authority.
Best Value
Is Form 99 required for every appeal filed after 1 April 2026?
No. Form 99 is prescribed under Rule 167 for a first appeal under the Income-tax Act, 2025. A post-1 April 2026 filing concerning an earlier tax year may still be governed by the 1961 Act and require Form 35.
When does the 30-day period begin?
For an assessment or penalty appeal, it ordinarily runs from service of the notice of demand. For other matters, it generally runs from service of the order or intimation. Confirm the precise rule and preserve service evidence.
Can I appeal after 30 days?
You may request condonation by showing sufficient cause for the delay. The authority has discretion, and acceptance is not guaranteed. Include the request and supporting explanation with the legacy Form 35 appeal where applicable.
Does filing an appeal stop recovery?
No. Recovery does not stop automatically. Request appropriate treatment of the disputed demand, such as being treated as not in default under section 220(6) of the 1961 Act, and explain the basis for relief.
What documents should I keep?
Keep the complete order, demand notice, service records, statement of facts, numbered grounds, documentary evidence, payment and fee details, DIN or order number, verification confirmation, acknowledgment and any related appeal information.
Limits of this general guide
Appealability, limitation, admission payments, jurisdiction and recovery treatment depend on the actual order and the governing law. The 2026 transition makes the tax year especially important. Use the current official form and portal instructions, read the relevant statutory provision and obtain case-specific advice where the amount or legal issue is significant.
