Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteTo challenge an AI-assisted firing, promptly send HR a dated written request disputing the decision and asking for a review by a person who can change the outcome. Ask what reasons, records, and automated scores or recommendations influenced the decision; identify any specific errors or missing context; and keep copies of your request and supporting documents. Whether you have a legal right to human intervention depends on where you work, your circumstances, and whether a person genuinely made the decision or software did so on its own.
What to do first
- Check the termination notice and workplace rules. Note the date of termination, any stated reason, the appeal process and deadline, and the contact named for questions. Identify your country and, if you are in the United States, your state. Check whether a union agreement, employment contract, or public-sector procedure applies.
- Write to HR and the designated contact promptly. Say that you dispute the termination and request review by a human decision-maker with authority to change it. Ask the employer to pause or reconsider the decision while the review is pending. This is a request, not an automatic right to a pause.
- Ask what role software played. Ask whether a system scored, ranked, flagged, or recommended your termination; what information it used; which reasons and performance measures the employer relied on; and who reviewed the output. A decision can be AI-assisted even if a manager formally delivered or approved it.
- Point out concrete errors and context. Identify incorrect dates, mistaken identity matches, missing performance records, accommodation requests, or circumstances the system may not have considered. Attach concise supporting documents and ask for them to be included in the review.
- Keep a record and preserve relevant documents. Save the termination notice, applicable policies, schedules, reviews, warnings, relevant messages, accommodation requests, and notes of meetings. Record when and how you sent each request and any response. Do not access or copy employer systems without authorization.
Request the reasons and information you need to explain your challenge, but do not assume an employer must provide every record, algorithm detail, or system artifact you ask for. The scope of any disclosure right depends on applicable law and the facts.

Request template
Subject: Request for human review of termination decision
I am writing to dispute the termination decision communicated on [date] and request a review by a human decision-maker with authority to change the outcome. Please explain the reasons for the decision and identify the records and performance information relied on. Please also tell me whether an automated system, score, ranking, or recommendation influenced the decision; what information it used; and who reviewed its output.

I believe the following information may be inaccurate or incomplete: [briefly describe the issue]. Please include the attached information in the review and tell me the process and deadline for submitting additional materials. Please confirm receipt and identify the person handling this request. Please preserve records related to the decision and my employment, including relevant system outputs and review records, to the extent required by applicable law and policy.
Adapt the request to your circumstances and local rules. The template is a practical drafting aid, not a guarantee that the employer must disclose or preserve every item listed.

What meaningful human review should involve
A human review is more than a person clicking approve. In its employment guidance, the UK Information Commissioner’s Office (ICO) describes meaningful oversight as a reviewer who checks and interprets the recommendation, considers relevant information and other factors, and has the competence and authority to disagree with the system. A reviewer who routinely accepts a score without examining the underlying case may not provide that kind of oversight.

Ask who made the decision, what they considered, and whether they could change the result. The legal consequences depend on the actual process, not just the label attached to the software.

Which formal route may apply?
Internal review, discrimination complaints, data-protection rights, and consumer-report disputes address different issues. They are not interchangeable, and one route may not preserve the deadline for another.
| Route | When it may fit | Who handles it and what to ask for | Important qualification |
|---|---|---|---|
| Employer appeal or grievance | You want the employer to reconsider its decision, whatever role software played. | HR, the designated reviewer, or the person named in the policy; ask for reasons, relevant records, and an empowered human review. | Follow the process and deadline in the termination notice, policy, contract, or union agreement. An internal appeal should not be assumed to extend an agency or court deadline. |
| U.S. employment-discrimination complaint | You suspect the firing involved discrimination based on a legally protected ground, including disability-related concerns. | The U.S. Equal Employment Opportunity Commission (EEOC); its worker factsheet directs workers to the EEOC Public Portal and phone support. | AI use alone does not establish discrimination. Explain the facts connecting the tool, its inputs, or the employer’s decision to your concern, and promptly confirm the deadline that applies to your location and claim. |
| EU data-protection rights | The decision may have been made solely by automated means and produced legal or similarly significant effects. | Contact the employer or other relevant data controller, including its data-protection officer (DPO) where appropriate; a national data-protection authority may be a complaint route. | GDPR protections have conditions, exceptions, and safeguards; they do not automatically cover every software-supported decision. The European Commission says controllers generally respond to rights requests without undue delay and at the latest within one month. |
| UK data-protection rights | The dismissal may have been a qualifying decision made solely by automated means with a similarly significant effect. | Contact the controller or its DPO to seek applicable information, human intervention, or a way to challenge the decision. | Whether UK GDPR rules apply depends on the conditions and the facts. Meaningful human involvement may change the analysis; verify current law and your circumstances. |
| U.S. consumer-report dispute | The employer relied on a background or other consumer report supplied by a company that compiles reports. | Check the notices from the employer and the reporting company; dispute inaccurate report information with the reporting company. | Under the FTC/EEOC guidance, applicable Fair Credit Reporting Act procedures include a pre-adverse-action copy of the report and Summary of Rights, followed by an adverse-action notice with the reporting company’s details and dispute information. AI use by itself does not trigger this route. |
Protections and options in the United States
Discrimination, including disability-related concerns
Federal employment-discrimination laws still apply when an employer uses AI. The EEOC’s April 29, 2024 worker factsheet includes tools that influence or decide who is laid off or terminated. It identifies protections concerning race, color, religion, sex (including gender, sexual orientation, and pregnancy), national origin, age 40 or older, disability, and genetic information. If you suspect discrimination, explain the specific facts that support the concern; the use of a system, without more, does not prove that a protected ground affected the decision.
Disability may raise a separate issue if an automated tool screened you out or evaluated you without accounting for a disability or a reasonable accommodation. The EEOC and Department of Justice have warned that employment algorithms and software can screen out a person who could do the job with or without reasonable accommodation, and that an accommodation process may be needed. If this applies, identify the accommodation, request, or disability-related limitation the employer or tool failed to consider.

Timing and agency contact
If you suspect unlawful discrimination, contact the EEOC promptly through its Public Portal or phone support and confirm the filing deadline for your facts and location. The deadline can depend on where you work and the claim involved. Do not wait for an internal appeal to finish on the assumption that it pauses a deadline.

When EU or UK automated-decision safeguards may matter
In both the EU and UK, special rules concern certain decisions made solely by automated means that have legal effects or similarly significant effects. The existence of an AI recommendation does not by itself establish that the decision was “solely automated.” A human who meaningfully reviews the information and makes a genuine decision may affect whether those additional rules apply.
European Union
The European Commission explains that GDPR rights may apply to qualifying solely automated decisions, subject to exceptions, including certain decisions necessary for a contract, authorized by law, or based on consent. Relevant safeguards may include being informed, expressing your point of view, obtaining human intervention, and contesting the decision. You can contact the controller or its DPO, complain to your national data-protection authority, or take legal action. Check how the rules apply to your employment circumstances and current national law.
United Kingdom
The ICO says a dismissal may have a similarly significant effect for UK GDPR purposes when the applicable conditions for a solely automated decision are met. Its guidance describes seeking meaningful information about the logic involved, the significance and envisaged consequences, and a straightforward way to ask for human intervention or challenge the decision. If a person genuinely reviewed the inputs and discussed the matter with you before deciding, the additional rules for solely automated decisions may not apply.

Check deadlines and keep routes distinct
There is no responsible universal appeal deadline for an AI-assisted firing. The applicable period depends on the country, claim, worker status, and termination date, among other facts. Check the internal policy and relevant agency or legal deadlines immediately; an employer’s review process does not necessarily stop an external clock. If you are unsure which route applies, a local employment lawyer, union representative, or worker legal-aid organization can help assess the issue.
The official sources behind these jurisdiction-specific points include the EEOC’s worker factsheet (April 29, 2024), European Commission information on GDPR rights, ICO employment guidance, EEOC/DOJ disability guidance (May 12, 2022), and FTC/EEOC background-check guidance. The laws and their application can change, so verify current rules with the relevant authority or a qualified adviser.
