There is no single, nationwide appeal procedure for academic misconduct in India. Your university’s current examination, academic-integrity or disciplinary rules—and the allegation or decision notice—control the first response, the appeal authority and the deadline. Act on that university deadline first. Separately, the University Grants Commission (UGC) University Grants Commission (Redressal of Grievances of Students) Regulations, 2023 provide a student-grievance route for issues such as unfair or non-transparent evaluation and institutional action contrary to applicable rules. That route normally starts with the institution’s Student Grievance Redressal Committee (SGRC), with an appeal to the university Ombudsperson within 15 days of receiving the SGRC decision.
The UGC route does not automatically replace a disciplinary appeal, suspend a sanction, or create one national deadline for every cheating, impersonation, fabrication, examination-malpractice or plagiarism case.

First, identify which decision you are challenging
An “academic misconduct” notice can describe very different situations: an allegation before a hearing, a provisional examination result, a committee finding, or a final punishment. The correct next step depends on which of these you received.

A notice usually gives you an opportunity to answer before a final finding or penalty. It may identify the conduct alleged, the examination or assignment involved, the rule said to have been breached, a hearing date and a deadline for your written response. Treat the deadline as operative unless the issuing authority formally changes it.

A committee or examination finding
A university may issue a finding after an unfair-means committee, examination board, academic-integrity panel or another designated body has considered the matter. The finding may be accompanied by a penalty or may invite a separate submission on the proposed penalty. Check the notice for the authority that can review it and whether a further representation is allowed.
A final sanction
Examples include cancellation of an examination or course, a zero mark, withholding of results, suspension, rustication, expulsion or a notation on the academic record. The institution’s rules should state whether the sanction can be appealed, to whom, in what form and by when. The cited UGC materials do not establish a universal response period, evidence entitlement or automatic stay for every category of misconduct.
What to do in the first 24–48 hours
- Save every document. Download the allegation, decision, attachments and portal messages. Preserve emails with their full headers where possible, and record when each document was received.
- Mark every date. Note the response deadline, hearing date, date of the alleged incident, date of the decision and any appeal deadline. If the notice is unclear, ask the issuing office in writing to confirm the deadline without waiting to file your response.
- Read the cited rule. Find the current examination regulations, unfair-means procedure, academic-integrity policy, ordinance, statute or student code named in the notice. Use the version in force when the alleged conduct occurred unless the rules specify otherwise.
- Keep the original evidence unchanged. Retain the submitted file, version history, laboratory notebook, answer-script details, exam instructions, messages with staff and any accessibility or technical records. Do not delete, edit or overwrite material that may later be relevant.
- Ask how to inspect relied-on material. Write to the designated university office asking how to view or obtain the material on which the allegation relies and how to submit a timely response. This is practical case management; a right to every category of evidence must be checked in the applicable university rule.
- Calendar a safe filing date. Aim to submit before the stated deadline, allowing time for portal failures or a request for an acknowledgment.
The two routes you must keep separate
Most students need to understand two different processes. They can overlap, but one should not be used as a reason to ignore the other.
| Route | What it addresses | First destination | Timing established by the cited material | Key limit |
|---|---|---|---|---|
| University disciplinary response or appeal | The particular misconduct allegation, finding and sanction | The authority named in the university policy or notice | Check the institution’s current rules and decision notice | No single national authority or deadline is established |
| UGC student-grievance process | Covered grievances, including unfair or non-transparent evaluation and institutional action contrary to applicable rules | Chair of the institution’s SGRC | The SGRC should preferably report within 15 working days | It does not, on the cited evidence, automatically replace or stay a disciplinary appeal |
| Ombudsperson appeal | An appeal from an SGRC decision after the other remedies under the regulations have been used | The university-appointed Ombudsperson | File within 15 days of receiving the SGRC decision; efforts to resolve within 30 days of the appeal | Routine revaluation or re-totalling is excluded unless a specific material irregularity or discrimination is indicated |
How to file the university-level response or appeal
1. Address the named authority, not a generic inbox
Use the body identified in the notice or the current university rule: for example, an unfair-means committee, controller of examinations, dean, academic-integrity committee, registrar or designated appellate authority. If the notice gives two destinations, follow both instructions and retain proof. Do not assume that sending a complaint to a general grievance portal extends a disciplinary deadline.
2. Use a clear subject and opening
State the notice number, examination or course, date received and the relief you seek. A useful subject line is: “Response and appeal against academic-misconduct notice [reference number] dated [date].” In the first paragraph, say whether you deny the allegation, accept a particular fact but dispute the rule or penalty, or need clarification before a hearing.

3. Give a short chronology
List events in date order: when the assessment occurred, what instructions you received, what you submitted or wrote, when you were contacted, and when the university issued its notice. Keep facts separate from conclusions. If a technical failure, accommodation, collaboration instruction or invigilator direction matters, identify it precisely and attach the available record.
4. Answer each alleged act separately
Use numbered headings matching the notice. For every allegation, state your answer, the supporting evidence and any rule or procedural problem. Do not submit a broad denial that leaves one allegation unanswered. If the allegation is ambiguous, say exactly what information is missing and request a reasonable opportunity to respond once it is supplied.
5. Identify procedural defects without overstating them
Possible issues include a notice sent to the wrong student, an incorrect date or course, a decision by an authority not named in the rule, failure to consider a timely explanation, or a penalty that does not match the prescribed range. State the rule and explain the practical effect. Avoid claiming a universal right to cross-examine, disclosure or a particular standard of proof unless your institution’s rules provide it.
6. Request a specific remedy
Ask for the result that follows from your position: withdrawal of the allegation, a fresh inquiry by the competent body, correction of an identity or factual error, permission to inspect material, removal or reduction of a penalty, or restoration of a result. If you ask for an interim measure—such as permission to sit a later examination—say so separately and explain the academic harm caused by delay. A request for an interim measure is not an assurance that the university will pause the sanction.
7. File and prove filing
Follow the permitted method: portal upload, official email, physical submission or a combination specified by the rules. Save the portal receipt, sent email, delivery acknowledgment, postal tracking and a PDF of the exact submission. If the portal fails, take a screenshot showing the error and send the response through the official alternative channel before the deadline, explaining the failure.

What a persuasive submission contains
- Identification: name, enrollment or roll number, programme, semester, contact details and notice reference.
- Position: a direct statement of what you contest and what you do not contest.
- Chronology: only events relevant to the allegation and the decision.
- Grounds: factual inaccuracies, misapplied rules, missing context, unreliable identification, unequal treatment or procedural non-compliance supported by the applicable text.
- Evidence index: a numbered list of each attachment with a one-sentence explanation of what it proves.
- Relief: the decision or procedural step you want.
- Signature and verification: date the submission and retain the final version exactly as filed.
Write in a calm, factual tone. Do not accuse staff of criminal conduct or discrimination unless you can identify the facts and the rule that support the assertion. Do not contact or pressure witnesses, invigilators or other students to change records.
When the UGC student-grievance route is relevant
The UGC’s 2023 regulations define student grievances to include non-transparent or unfair practices in evaluating students and institutional actions initiated or taken contrary to the institution’s statutes, ordinances, rules, regulations or guidelines. This can be relevant when the complaint is about how the university handled evaluation or applied its rules. It is not a substitute for answering the underlying misconduct notice.
Step 1: submit to the SGRC
Address the grievance to the chair of the institution’s Student Grievance Redressal Committee (SGRC). Universities are expected to publish relevant SGRC and Ombudsperson information on their website and in the prospectus. Describe the institutional act you challenge, the rule involved, the dates, the documents attached and the remedy sought. Include proof that you have used, or are using, the university’s own disciplinary route when that route is available.
The regulations state that, in considering grievances, “the SGRC shall follow principles of natural justice.” The SGRC should preferably send its report and recommendations to the competent institutional authority, with a copy to the student, within 15 working days of receiving the complaint. “Preferably” means this is a stated target in the regulation, not an unconditional guarantee that every case will be completed in that period.
Step 2: follow the institution’s comments and hearing process
The online process described in the regulations allows the complaint to be referred to the appropriate SGRC for institutional comments. The institution is to provide its comments within 15 days in that process. The committee may set a hearing date. Keep responding to requests, attend when directed and ask for written confirmation if a date changes.

Step 3: appeal an adverse SGRC decision
If you are aggrieved by the SGRC decision, file an appeal to the university Ombudsperson within 15 days of receiving that decision. Count from actual receipt and preserve the email, portal timestamp or other record showing when it arrived. The regulations contemplate that the Ombudsperson hears the appeal after the other remedies provided by the regulations have been used; explain those steps and attach the SGRC decision.
The Ombudsperson may give the student an opportunity to appear personally or through an authorised representative, provide reasonable opportunities to be heard, and issue a reasoned order with a copy to the institution and student. The regulations say the Ombudsperson should make efforts to resolve the grievance within 30 days after receiving the appeal.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Limits of the Ombudsperson route
It is not an automatic stay
Filing with the SGRC or Ombudsperson does not, on the cited material, automatically suspend a disciplinary finding, examination cancellation or other sanction. Ask the university’s designated authority for an interim stay or permission to continue studies where the rules allow it, and comply with any separate appeal deadline while that request is pending.
It is not routine revaluation
Examination-malpractice or evaluation issues may be referred to the Ombudsperson. However, a routine request to have marks rechecked, re-totalled or revalued is not entertained unless the student points to a specific irregularity that materially affected the outcome or a specific instance of discrimination. Explain the concrete irregularity rather than simply asserting that the mark is low.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteIt does not erase other remedies
The Ombudsperson route follows the other remedies under the regulations. If a university appeal, review or representation is available, use it as required and disclose it accurately. Do not present the SGRC complaint as proof that the university’s disciplinary process is finished.

Special considerations for plagiarism allegations
Plagiarism procedures have safeguards that should not automatically be extended to every type of misconduct. The UGC plagiarism provisions reproduced in its compendium state that the relevant inquiry panel follows natural justice, provides the inquiry report to the person against whom it is submitted, and imposes covered penalties only after misconduct is established, appeal avenues are exhausted and the person has had a fair or transparent opportunity to defend.
When responding to a plagiarism allegation, identify the work, submission version, citation or collaboration rule involved and any similarity report or panel material supplied. Explain legitimate quotation, common terminology, referenced sources, permitted collaboration or drafting history where relevant. Ask the university which plagiarism procedure applies to your programme and whether a report or panel decision will be provided under that procedure. Do not assume that a plagiarism panel’s exact composition or safeguards govern cheating, impersonation or other examination offences.
Common mistakes and how to avoid them
- Waiting for the UGC process before filing the university appeal: submit the university response within its stated period, then pursue a covered grievance in parallel if appropriate.
- Assuming a 15-day period applies to the original allegation: the 15-day period in the 2023 regulations is for appealing an SGRC decision to the Ombudsperson, not a universal deadline for answering a misconduct notice.
- Sending an emotional, unstructured narrative: use numbered allegations, evidence references and a precise remedy.
- Relying on an old policy: confirm the current rule and the version applicable to the relevant examination or submission.
- Failing to request access to relied-on material: ask in writing how to inspect it, while still filing the response you can make by the deadline.
- Assuming an appeal pauses the penalty: seek an express interim order and plan for academic deadlines unless the university confirms a stay.
- Making unsupported accusations: distinguish an error, an irregularity, discrimination and deliberate misconduct, and identify evidence for each.
- Leaving no proof of delivery: retain receipts, timestamps, acknowledgments and the final attachment set.
If the sanction affects graduation, enrolment or immigration
Escalate promptly when the outcome could delay graduation, cancel a visa-related document, end a scholarship, affect professional registration or create a serious disciplinary record. Ask the university in writing for the effective date of the sanction, the consequences during appeal and any interim academic arrangement. Consider independent legal advice from a qualified professional familiar with education or administrative law; no particular adviser is endorsed here. Continue meeting unrelated academic and administrative deadlines unless the university confirms otherwise.

A practical filing checklist
- Copy the allegation or decision notice and the rule it cites.
- Write down every response, hearing and appeal date.
- Download and preserve your submission, answer-script information and relevant correspondence.
- Request instructions for inspecting relied-on material.
- Prepare a numbered response matching each allegation.
- Attach an evidence index and identify the requested remedy.
- Submit to the authority named in the university rule or notice.
- Keep delivery proof and the exact filed version.
- If the institutional handling itself is unfair, submit a separate SGRC grievance without abandoning the disciplinary route.
- If the SGRC decision is adverse, calculate 15 days from receipt and file the Ombudsperson appeal.
What the deadlines mean in practice
| Event | Period | How to use it |
|---|---|---|
| University response to a misconduct notice | Not established nationally | Use the date in your notice and current university rules |
| Institutional comments in the UGC online grievance process | 15 days in the described process | Track the referral and ask for the comments or hearing status if delayed |
| Preferred SGRC report | 15 working days from receipt of the complaint | Keep proof of receipt; the wording is a preference, not an unconditional guarantee |
| Appeal from SGRC decision to Ombudsperson | 15 days from receiving the decision | File promptly and attach the SGRC decision and receipt date |
| Ombudsperson resolution effort | Within 30 days of receiving the appeal | Ask for a status update if the period passes; it is an effort to resolve, not a promised result |
Bottom line for a student who has just received a notice
Read the notice and the university’s current rules, preserve the record, and file the designated university response before its deadline. Then assess whether the university’s evaluation or rule application also presents a covered student grievance. Use the SGRC first and, if necessary, appeal its decision to the Ombudsperson within 15 days of receipt. Keep the routes and their deadlines separate, request any interim protection expressly, and treat plagiarism safeguards as specific to the applicable plagiarism procedure rather than a universal code for every misconduct case.
