To challenge an Indian GST penalty, usually file FORM GST APL-01 with the Appellate Authority through the GST portal. The ordinary filing period is three months from the date the order was communicated to you, not simply the date printed on the order. A penalty-only order has a specific 10% pre-deposit rule, while an order that also demands tax uses a different disputed-tax calculation. After submission, the appeal is not treated as finally filed until the portal issues FORM GST APL-02 with an appeal number.
This guide covers the first appeal, the documents and payments to prepare, the portal workflow, common filing problems, and how to track the case. A later appeal to the Goods and Services Tax Appellate Tribunal (GSTAT) is a separate proceeding on a separate portal.

First decide which GST appeal you are filing
The correct procedure depends on the order you received and the stage your dispute has reached. A first appeal challenges an adjudicating authority’s decision before the Appellate Authority. A GSTAT appeal is a later challenge to an eligible order, with its own filing system and requirements.
| Issue | First appeal to Appellate Authority | Further appeal to GSTAT |
|---|---|---|
| Typical order challenged | An adjudicating authority’s demand or penalty order | An order eligible for tribunal appeal after the first stage |
| Primary filing system | GST portal, Services > User Services > My Applications > Appeal to Appellate Authority | GSTAT electronic filing portal: https://efiling.gstat.gov.in/mainPage.drt |
| Form or case reference | FORM GST APL-01; final acknowledgment FORM GST APL-02 and an appeal number | Tribunal electronic case filing and the case number issued by GSTAT |
| Ordinary time rule | Three months from communication of the order; the GST portal FAQ describes up to one additional month for condonation where sufficient cause is shown | Section 112 and current tribunal notices govern the deadline; check the live GSTAT portal for the applicable case and transition rules |
| Pre-deposit basis | Penalty-only order: 10% of the penalty under Section 107; an order also demanding tax follows the disputed-tax rule described in the GST portal FAQ | The GSTAT help page describes a further 20% of the tax in dispute for a taxpayer appeal, in addition to the first-stage deposit; verify the live rule and notice |
| Tracking | GST portal My Applications, with a From and To date search | GSTAT case-status, notifications and document tools, not the first-appeal My Applications screen |
Do not treat the two stages as one continuous portal workflow. Your order, the date it was communicated, the amounts demanded and the stage already completed determine what you can file next.
Record the order details and communication date
Before opening the appeal form, read the complete order and create a one-page record. The APL-01 form asks for particulars that must match the order, and an error can make later verification harder.
- Date on which the order was communicated to you, including how it was delivered or made available.
- Date shown on the order itself, which may be different from the communication date.
- Issuing authority, order number and tax period.
- Whether the order demands only a penalty or also tax, interest, fees or another charge.
- Amount in each category: tax, interest, penalty, fees and other charges.
- GSTIN, legal name and the authorized signatory who will submit the application.
Keep the communication email, portal message, downloadable order and any delivery record together. The statutory clock is tied to communication, so relying only on the printed order date can produce a late filing.
Calculate the correct pre-deposit before filing
Penalty-only order
Section 107(6), as presented by the CBIC Tax Information Portal, states that an order demanding a penalty without a tax demand cannot be appealed unless the appellant has paid an amount equal to 10% of that penalty. The amendment containing this penalty-only rule took effect on 1 February 2019.
For example, if the order demands a penalty of ₹100,000 and no tax, the statutory basis described above is ₹10,000. Confirm that the order is genuinely penalty-only: a demand for even a separate tax amount changes the calculation framework.
Order that also demands tax
The GST portal’s APL-01 FAQ describes a minimum pre-deposit of 10% of the disputed tax for an appeal against an order containing a tax demand. Do not substitute this disputed-tax description for the penalty-only rule. Identify the amount actually disputed and check the payment calculation against the order, current portal instructions and the applicable law before paying.
Rank #2
The pre-deposit is a filing requirement; it does not decide whether your grounds are correct. Save the electronic cash ledger entry, challan, payment reference and any portal receipt so the amount can be matched to the appeal.
Prepare the APL-01 application
APL-01 requires more than an uploaded objection. Assemble a coherent application before starting the portal session.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesDocuments and information checklist
- Complete order and proof of communication.
- Payment proof for the applicable pre-deposit.
- Statement of facts, in date order and limited to facts relevant to the disputed findings.
- Grounds of appeal, each linked to a particular finding, calculation or legal issue in the order.
- Prayer, stating precisely what relief you ask the Appellate Authority to grant.
- Reconciliations, invoices, returns, contracts, ledgers or correspondence needed to support each ground.
- Authorization and signatory details, where an authorized representative or company officer files.
- Readable file names and copies in the formats and size limits accepted by the portal.
Separate facts from arguments. The statement of facts explains what happened; the grounds explain why the order is said to be wrong; the prayer states the requested result. Do not assume that attaching a large document bundle without an indexed explanation will cure an incomplete ground.
File FORM GST APL-01 on the GST portal
- Sign in to the GST portal. Use the taxpayer account associated with the order and confirm that the correct GSTIN and legal name appear before beginning.
- Open the appeal service. Go to Services > User Services > My Applications. Select Appeal to Appellate Authority, choose New Application, and select Demand Order.
- Enter the order particulars. Supply the issuing authority, order number, order date, communication date, tax period and the separate tax, interest, penalty, fees and other-charge figures requested by APL-01.
- State the dispute. Complete the statement of facts, grounds of appeal and prayer. Make the grounds correspond to the findings and amounts in the order rather than using a generic paragraph.
- Attach supporting files. Upload the order, payment evidence and documents supporting each ground. Open the uploaded files after attaching them to check that they are legible and complete.
- Review the declaration. Check names, amounts, dates, contact details, attachments and the selected order before submission. Correcting a wrong order number or amount after final filing may require a separate procedural request.
- Sign the application. The FAQ permits signing with a digital signature certificate (DSC) or electronic verification code (EVC). A DSC is mandatory for companies and limited liability partnerships.
- Submit and save every receipt. Download or print the submission acknowledgment, payment reference and any provisional reference shown by the portal.
The GST portal’s detailed instructions are in “FAQs: Filing an Appeal against Demand Order (FORM GST APL-01)”. Portal labels and validation screens can change, so follow the current screen while retaining the official FAQ for the documented route.
What happens if the order is not uploaded?
The APL-01 FAQ provides a specific process where the demand order is not available on the portal. Submit a self-certified copy within seven days of the relevant portal instruction or filing step. A late copy can affect the filing date.

Watch for the final acknowledgment, FORM GST APL-02. The FAQ states that the appeal is considered filed only when APL-02 with an appeal number is issued. A provisional submission screen, ARN or payment receipt is not a substitute for that final acknowledgment. Download APL-02, note the appeal number in your records and preserve the complete submission package.
Track a first appeal on the GST portal
- Sign in to the GST portal.
- Go to Services > User Services > My Applications.
- Choose Appeal to Appellate Authority.
- Enter a relevant From date and To date.
- Select Search and open the appeal entry using the APL-02 appeal number or the displayed reference.
The FAQ’s status examples include Appeal Submitted and order-passed outcomes, including remand and manual-order cases. “Appeal Submitted” indicates that the form was successfully filed according to the FAQ’s status table; it is not a decision on the merits.
Check the page regularly for notices, requests for information, hearing communications and the order. Save each downloaded notice and acknowledgment with the date received. If a status or document does not appear, first widen the date range and verify the GSTIN, appeal number and selected application type before treating it as a portal failure.
Common filing problems and practical fixes
The filing window is nearly over
Use the communication date to calculate the ordinary period immediately. If circumstances prevented timely filing, document the cause and seek condonation within the additional period described by the FAQ. Do not assume that a late filing will be accepted merely because the order was legally disputed.
The order date and communication date differ
Enter both dates exactly as requested in APL-01 and retain evidence of communication. Explain the chronology in the application if the difference affects the limitation calculation.

The portal shows a submission but no APL-02
Do not discard the provisional receipt. Check the application details, outstanding validation messages and uploaded order copy. If the order was not uploaded, provide the self-certified copy within the stated seven-day period. Continue checking until the final acknowledgment and appeal number are issued, because the FAQ uses that issuance to identify when the appeal is filed.
The pre-deposit amount looks wrong
Reclassify the order: penalty-only, or tax plus penalty. Recalculate from the amount actually disputed, not automatically from the total demand. Compare the result with the order, the current portal calculation and the statutory text. Keep proof of any corrected payment and avoid filing with an amount chosen solely from a generic online example.
DSC or EVC signing fails
Confirm that the signatory is authorized, the DSC is valid and registered where required, and the GST portal’s signing utility or browser requirements are met. Companies and LLPs cannot replace the mandatory DSC with EVC. Capture the error message and retry before the filing period expires.
Attachments are rejected or unreadable
Use clear scans, sensible file names and the file type and size permitted by the portal. Open each file locally before upload. If a document cannot be uploaded, explain its relevance in the application and preserve evidence of the attempted submission while seeking the portal’s available correction route.

If the first appeal is decided and you remain aggrieved, Section 112 provides a further appeal route to GSTAT, subject to its deadline and notified filing provisions. The statutory text is available through the CBIC Tax Information Portal’s Section 112 page.
GSTAT proceedings are separate from the GST portal APL-01 workflow. The tribunal’s electronic filing portal provides e-filing, case tracking, case-status access, notifications and document access at https://efiling.gstat.gov.in/mainPage.drt. Use the case-status tools for a tribunal appeal rather than assuming the first-appeal My Applications page will display it.
Tribunal pre-deposit guidance
The GSTAT Help Center describes a taxpayer’s tribunal appeal as requiring a further 20% of the amount of tax in dispute, in addition to the first-appeal pre-deposit. This is current portal guidance, not a universal calculation for every possible case. Check the live GSTAT notices, the case type and the applicable rule before paying or filing; transitional dates, eligibility and procedural requirements are not resolved by the first-appeal FAQ.
The tribunal also has a separate Track Your Issue page at https://efiling.gstat.gov.in/trackyourIssue.drt, which asks for an Incident ID and captcha. Use the tracking facility that corresponds to the record you filed, and keep the tribunal case number, filing receipt and every notification.

A qualified GST tax practitioner or tax-litigation professional can help where the order involves several tax periods, classification disputes, reconciliations, large amounts, authorization questions or a difficult limitation issue. Professional assistance does not replace the need to verify the communication date, pre-deposit, APL-02 and appeal number yourself.
An appeal is a procedural challenge, not a guaranteed cancellation of the penalty. The material available for this guide does not establish that filing automatically suspends every recovery action or removes the demand. Follow any separate recovery, payment or stay direction applicable to your order and obtain case-specific advice when the financial or legal consequences are significant.
