To challenge an Indian GST input tax credit (ITC) rejection, identify the exact order and denial ground, file a first appeal under section 107 within the applicable deadline, pay admitted dues and the required pre-deposit, and connect each challenged finding to transaction-level evidence. The first Appellate Authority can confirm, modify or annul the order, but section 107(11) does not let it send the case back to the original adjudicating authority. Preparing “for remand” therefore means preparing for a remand actually ordered by a competent higher forum, or for other further proceedings the law permits—not assuming the first appeal authority can remand the case.

This is a general guide to the central CGST Act and corresponding State or Union Territory GST law. The rules applicable to a particular dispute depend on its jurisdiction and tax period; check the version then in force and obtain qualified advice for a live matter.

First identify which proceeding you are in

“Appeal” and “remand” are not interchangeable stages. A section 107 appeal is the ordinary first appellate route from an adjudication decision or order. A remand is a direction from a competent higher forum returning specified issues for further consideration. The steps, scope and deadlines differ, so first identify the order you have and who issued it.

Question First appeal under section 107 Proceedings after an actual higher-forum remand
What starts it? Communication of the decision or order being challenged. The remand order, which identifies the issues returned and any directions or limits.
What should you prepare? Appeal grounds, required payment, and evidence supporting each challenge to the original findings. A response to each remand direction, with the relevant evidence and submissions organized for fresh consideration.
Can the first Appellate Authority return the case to the original adjudicator? No. Section 107(11) permits it to confirm, modify or annul the decision, but bars referring the case back. The procedure depends on the higher forum’s order and the applicable law; follow the order’s scope and directions.
What happens after a new order? Not applicable to the original appeal. Check whether that new order is appealable, when it was communicated and what fresh filing requirements apply.

The statutory text is in CGST Act section 107. The GST Portal’s appeal FAQ also lists orders against remanded cases among demand orders for which an appeal option is available on the portal. That does not mean an earlier appeal automatically preserves a deadline arising from a later order.

Start with the order and the exact reason for denial

Before choosing a legal argument or calculating time, assemble the adjudication order, demand summary, show-cause notice, hearing notices and records of replies or submissions. Note the order’s communication date, the tax period, the jurisdiction, each amount at issue, and the legal provisions the officer relied on. Preserve the annexures: the reasoning or calculations that matter may appear outside the main order.

Make an issue list that connects every disputed credit to the reason it was rejected. For each invoice or other document, record the period, amount, relevant finding and evidence cited by the authority. Classify the reason accurately: a portal or return mismatch is different from a dispute about whether goods or services were received, whether they were used in business, whether a statutory restriction or apportionment applies, or whether a time limit or procedure was followed. A denial can involve more than one ground.

This distinction controls the appeal. A supplier-data mismatch may call for a return-by-return reconciliation and relevant supplier communications. A dispute about receipt may call for delivery, service-completion, inventory or project records. A blocked-credit or apportionment issue requires analysis of the applicable statutory rule and the particular use of the purchase. Do not rely on a generic assertion that the purchase was genuine if the order’s actual finding concerns a different condition.

Section 16 describes basic entitlement and conditions, including business use and tax documentation; Rule 36 lists documentary bases such as supplier invoices, debit notes, import bills of entry and Input Service Distributor documents. Both provisions have been amended, so use the versions applicable to the relevant tax period rather than treating today’s wording as timeless. Consult CGST Act section 16 and CGST Rules, Rule 36.

Calendar the section 107 deadline from communication

Section 107(1) ordinarily allows three months from communication of the decision or order to file the first appeal. Under section 107(4), the Appellate Authority may allow a further period of one month if sufficient cause prevented filing within the ordinary period. This is a limited statutory extension, not a reason to wait until the deadline is near. The GST Portal FAQ describes the same three-month period and possible additional month.

  1. Record the communication date. Keep the notice or portal record that shows when the order was communicated. Do not substitute the order’s date for its communication date without checking the record.
  2. Calculate the ordinary filing period. Use the three-month period in section 107(1), applying the relevant statutory rules to the actual dates and circumstances.
  3. If necessary, prepare a condonation request. If you cannot file within three months, explain the sufficient cause and support it with records. The further period under section 107(4) is only one month; acceptance is not automatic.
  4. File promptly and retain proof. Keep the submission, attachments, payment evidence, acknowledgments, appeal number and later notices or orders together.

Read the current section 107 text and GST Portal appeal FAQ for the applicable process. Portal instructions can change; check them immediately before filing.

File the appeal and preserve portal evidence

The GST Portal FAQ says FORM GST APL-01 is used to appeal a demand order. It also says the appeal is treated as filed only when the final acknowledgment, APL-02, and an appeal number issue. A saved draft or a submission that has not reached that stage is not the same as proof of completed filing.

The FAQ gives a specific instruction for an order that is not uploaded: submit a self-certified copy within seven days. It says that if the copy is supplied after that period, the date on which it is submitted is treated as the filing date. Because this can affect timeliness, check the portal’s current instructions and retain proof of when the copy was submitted.

Keep a complete filing record, not just a screenshot of the final page. Preserve the filed APL-01, every attachment, the admitted-dues and pre-deposit payment records, APL-02, appeal number, notices, hearing submissions and all orders. Make sure the copy you retain matches what was actually filed.

Work out admitted dues and disputed-tax pre-deposit

Section 107(6) requires payment of the amount admitted from the impugned order and a pre-deposit linked to disputed tax. The GST Portal FAQ describes a minimum pre-deposit of 10% of disputed tax before filing. That figure should not be applied to the entire demand without first separating its components. The statutory calculation, any applicable cap and the permissible payment method must be checked against current law and the particular type of demand.

  • Separate tax from interest, fine, fee and penalty in the order’s calculation.
  • Identify the amount, if any, that you admit and the tax amount you actually dispute.
  • Check the current statutory text and portal instructions for how the required amount is calculated, any cap and how payment must be made.
  • Retain the payment proof and reconcile it to the amount stated in the appeal.

Payment method can be fact-sensitive. A February 2026 Telangana government compilation summarizes a decision concerning payment through the Electronic Credit Ledger where the demand related to output tax and a CBIC circular applied. That summary does not establish that every section 107 pre-deposit can be paid from the credit ledger; verify the full decision, applicable circular and current law for the facts at hand. See the Telangana Commercial Taxes Department compilation, February 2026, alongside section 107 and the portal FAQ.

Build an invoice-level record for each appeal ground

An appeal is easier to assess when the authority can trace the disputed amount from the order to the underlying transaction and then to the evidence. Create a schedule for each disputed invoice or other credit document. Useful columns include invoice number and date, supplier GSTIN, tax amount, return period, credit claimed, credit disputed, the authority’s reason and the exhibit or page supporting your response.

Use records that answer the actual finding. Depending on the issue and applicable law, the working bundle may include:

  • The show-cause notice, adjudication order, demand summary, hearing notices, replies and any written submissions already made.
  • Tax invoices or debit notes, import bills of entry, or relevant Input Service Distributor documents.
  • Purchase orders, contracts, delivery challans, goods-receipt records, service-completion evidence, and inventory or project records.
  • GSTR returns, relevant supplier statement or portal data, electronic ledgers, and reconciliations explaining differences across documents or periods.
  • Bank or other payment records, supplier correspondence, and internal records that support the claimed business use or address the particular denial reason.

For a mismatch, show the figures side by side and explain the reason for each variance rather than relying on a total that cannot be traced. For goods or services receipt, link the invoice to delivery or completion evidence. For a business-use issue, identify the relevant business activity and supporting records. For a statutory restriction, show why the credit does or does not fall within the rule applicable to that period. The records that matter depend on the denial ground; this list is an organizing aid, not a guarantee that any single document establishes entitlement.

Keep an index, paginate the bundle consistently and label exhibits so the appeal’s written grounds can point to an exact document and page. If a record is new or was not considered at the original stage, identify it and explain its relevance and procedural basis for placing it before the appellate authority. Do not assume that an appeal will cure an incomplete evidentiary record automatically.

Write grounds that lead to a reasoned merits decision

For each issue, make the argument traceable: state the finding challenged, identify the rule applicable to the tax period, cite the relevant evidence, explain why the finding or calculation is wrong, and state the precise relief sought. Keep distinct grounds separate where they turn on different facts or legal rules. A broad request to “allow the ITC” is less useful than a ground that identifies the invoice, amount, reason for rejection and evidence that addresses it.

Where the order relies on a factual inference, confront the inference directly. For example, identify what the order treated as missing or inconsistent, then point to the corresponding record and explain how it answers that concern. If you dispute a calculation, show the figures and method in a reconciliation. If you raise a procedural objection such as inadequate notice or hearing, anchor it in the actual notices, dates and submissions; do not include a boilerplate objection unsupported by the record.

Section 107(12) requires a written appellate order stating the points for determination, the decisions on those points and the reasons. Organizing the appeal around discrete issues and cited evidence gives the authority a clear route to decide them and preserves a record of what was argued.

What the first Appellate Authority can—and cannot—do

Section 107(11) says the Appellate Authority may confirm, modify or annul the decision or order appealed against and “shall not refer the case back to the adjudicating authority that passed the said decision or order.” The text therefore does not give the section 107 first Appellate Authority a general power to remand the case to the original adjudicator. Frame your requested relief around a decision on the merits and support it with a complete record.

A January 2026 Karnataka Commercial Tax Department newsletter summarizes an Allahabad High Court decision that set aside an appellate remand concerning place of supply and directed a merits decision, relying on section 107(11) and a prior Division Bench decision. The newsletter reports that the writ was entertained directly because the GST Tribunal was not functional in that case. It is a case summary, not a substitute for reviewing the full judgment, subsequent developments or whether the decision applies in another jurisdiction. See the Karnataka Commercial Tax Department GST Newsletter, January 2026 and the statutory text of section 107.

If a higher forum has actually remanded the matter

Do not treat “remand” as a fresh chance to reopen every issue without limits. The remand order controls what must be reconsidered and may set boundaries on evidence, findings, timing or procedure. Read the operative directions as well as the reasons for the order, and prepare to show how each direction has been met.

  1. Extract the directions. List every question returned for fresh consideration, any issue expressly left undisturbed, and any limits on further findings or evidence.
  2. Calendar the required steps. Note deadlines, hearing dates and directions for notices or submissions. If the order is unclear about procedure, seek appropriate clarification rather than assuming a timetable.
  3. Rebuild the transaction record. Submit an indexed, paginated bundle with a chronology and invoice-level reconciliation tied to the remand issues.
  4. Answer each direction expressly. Use headings that track the order, identify supporting documents and explain the requested finding for each returned issue.
  5. Request a speaking order. Ask for findings and reasons that address the remand directions and your material evidence, and keep proof of service and hearing participation.

There is no single remand procedure established for every court, tribunal, State GST law or case in the cited material. The particular order and governing law determine the process. After a fresh order is communicated, assess appealability, the new deadline and filing requirements on their own terms; do not assume that the original appeal protects a later challenge.

Rectification and later appeals need separate deadline checks

Section 161 rectification may be relevant to an apparent clerical or computational error. Do not assume that requesting rectification pauses or extends the section 107 appeal period. A February 2026 Telangana Commercial Taxes Department compilation summarizes a Punjab and Haryana High Court ruling that, on the facts before it, excluded time spent bona fide pursuing rectification. That is a fact-specific reported position, not a universal guarantee. Check the full judgment and the law applicable in the relevant jurisdiction before relying on it. The summary appears in the February 2026 compilation.

Section 112 provides for a further appeal to the GST Appellate Tribunal (GSTAT) from specified section 107 or 108 orders, but its commencement and deadline language is tied to notified dates and has been subject to extensions. The GSTAT homepage had stated an extended last date of 31 July 2026. That date had passed by 13 October 2026, so it is not a future deadline to rely on. Check the live GSTAT portal, latest notifications and section 112 for current tribunal services and any applicable filing date.
