The ordinary appeal period stated in the GST Portal FAQ is three months from communication of the order. The FAQ also says a pre-deposit is required and that the appeal is treated as filed only when FORM GST APL-02 bearing an appeal number is issued.
The practical checkpoints are to confirm the communication date and amounts, check whether the order is uploaded, ensure the applicable payment is recorded against the demand, complete APL-01, and obtain the APL-02 appeal number. Then use My Applications to follow the appeal through submission, admission, notices, and the appellate order.

What this appeal is—and what the portal filing does
This guide covers a first appeal against a GST demand order to the Appellate Authority under section 107. The GST Portal FAQ says an aggrieved taxpayer or an unregistered person may use this route. The taxpayer’s appeal form is FORM GST APL-01.
Submitting an application is not the same as having the appeal admitted. The portal uses separate status labels for submission and admission, and its FAQ identifies issuance of APL-02 with an appeal number as the filing checkpoint. An appeal challenges an order; it does not by itself establish that the demand is wrong. Whether an order can be appealed, what grounds apply, and what evidence supports them depend on the actual order and case record.

Think of the process as several linked tasks rather than one online form: work out the limitation date, determine what is disputed, meet the applicable pre-deposit condition, submit the appeal, complete any order-copy requirement, and monitor the case. A problem at one stage can leave you without the acknowledgment or status you expect. In particular, do not treat the first portal submission or an SMS as proof that every filing requirement is complete.
Check the order, amounts, and limitation period first
Start by identifying the order you intend to challenge and the date it was communicated to you. The GST Portal FAQ states an ordinary period of three months from communication of the decision or order. It also says the authority may condone a delay of up to one additional month where sufficient cause is shown. That additional month is discretionary, not an automatic extension.
Record these particulars before starting the portal application:

- Date the order was communicated to you. Use this date when checking the ordinary limitation period.
- Amounts in the order, separating disputed tax from any admitted liability, interest, penalty, or other component shown.
- Whether the order is available or uploaded in the GST Portal.
- Any payments already made and how each payment appears in the relevant portal records.
Keep the order and the communication record together. The limitation period in the FAQ runs from communication, not simply from the date printed on the order. The FAQ does not calculate a particular person’s deadline, so establish the relevant communication date from your own record and verify how the period applies to your facts.
Calendar the deadline conservatively. The FAQ gives the general period, but does not calculate a particular taxpayer’s last date. Limitation can depend on the applicable law, notifications, and the facts of communication, so confirm the calculation for your case rather than assuming the portal will accept a late filing. If the deadline is close, do not wait for the possible condonation period: it is a discretionary safeguard for sufficient cause, not additional time that every appellant automatically receives.
Work out the pre-deposit and reconcile prior payments
The GST Portal FAQ states that at least 10% of the disputed tax must be paid as a pre-deposit before filing, subject to the law. Do not treat this as 10% of every amount printed in the demand. The relevant calculation depends on the order and the amounts in dispute. Section 107 also addresses orders demanding a penalty without tax, so the FAQ’s simplified description should not be applied mechanically to every kind of order.
A demand summary may be represented by forms such as DRC-07. Review the particular order and its demand details to determine the disputed and admitted amounts. If some liability is not being challenged, distinguish that amount from the amount in dispute when working through the legal pre-deposit requirement. The precise amount for a case cannot be determined from a general portal guide.

Before paying, compare the demand details with the parts of the order you intend to contest. Do not assume that the total demand, disputed tax, admitted liability, interest, and penalty are interchangeable figures. The portal FAQ’s 10% figure is expressed by reference to disputed tax, while the legal treatment can differ for particular orders, including penalty-only orders. Check the current statutory requirement and portal calculation for your case instead of relying on a percentage applied to the total demand.
Check whether a payment is linked to the Demand ID
The GSTN advisory distinguishes payments made through the portal’s Payment towards Demand functionality from payments made using DRC-03. A Payment towards Demand transaction is associated with the relevant Demand ID. A DRC-03 payment is not linked to that Demand ID and therefore may not appear as adjusted against it in the electronic liability register. The appeal process checks payments already recorded against the Demand ID.
If you have already paid but the payment does not appear against the demand, reconcile the electronic records and follow the current GST Portal instructions before treating the payment as satisfying the appeal requirement. Do not assume that a payment made by a different route has been matched to the particular demand. Check the Demand ID and the payment entries, and make sure you understand whether the portal has recorded the relevant amount against it before proceeding.
| Payment route | How the GSTN advisory describes its demand linkage | What to check |
|---|---|---|
| Payment towards Demand | Associated with the Demand ID | Confirm that the amount is recorded against the relevant Demand ID. |
| DRC-03 | Not linked to the Demand ID; it may not show as adjusted against that demand in the electronic liability register | Reconcile the records and follow current portal instructions rather than assuming the appeal payment check will recognize it. |
Prepare the appeal grounds and supporting record
Before opening APL-01, read the full order and identify the specific findings you dispute. The form filing is procedural; the strength and completeness of the appeal depend on explaining why the order should be challenged and supporting that explanation with the relevant record. A generic statement that the demand is incorrect does not address the issues decided by the authority.
Recommended Free Tools
Organize the materials that relate to your case, such as the order and demand details, relevant returns or transaction records, prior submissions, notices and replies, and evidence addressing the findings in the order. What is relevant will vary by dispute. Make sure any dates, figures, and references in your grounds correspond to the actual documents. The general portal instructions do not decide what grounds or evidence are appropriate for an individual case.
A useful preparation check is to match each proposed ground to the portion of the order it addresses and to the document or record that supports it. Check that the order reference, amounts, and dates in the application agree with the underlying documents. This is not a substitute for legal analysis; it helps avoid submitting an application whose factual references conflict with the record.
For a high-value, complex, or deadline-sensitive dispute, consider getting advice from a qualified GST tax adviser or litigation professional who can review the order and record. A portal walkthrough cannot substitute for that case-specific assessment.

File FORM GST APL-01 on the GST Portal
- Open My Applications. Sign in to the GST Portal and go to Services > User Services > My Applications.
- Start an appeal. Select Appeal to Appellate Authority, then choose New Application.
- Select the order type. Choose Demand Order and proceed with FORM GST APL-01.
- Complete the application. Enter the order and case details, grounds, and other information requested by the live portal form. Check the entries against the order and the documents you have prepared.
- Complete payment and authentication requirements. Ensure the applicable pre-deposit is recorded as required, then submit using the authentication method accepted for your account.
- Save the submission evidence. Retain the application details, any acknowledgment, and the appeal number once issued. The GST Portal FAQ says filing triggers email and SMS notifications.
The FAQ says filing can use DSC or EVC and that DSC is mandatory for companies and LLPs. Follow the live instructions shown for your entity and account, because portal requirements may change.

Before final submission, do a short consistency review: confirm that you selected Demand Order, that the order reference belongs to the decision being challenged, that the grounds address that order, and that payment information is not being confused with a different Demand ID. The exact fields and prompts are those displayed in the live APL-01 application. If a field or workflow differs from a general description, follow the current portal directions for the account rather than forcing the application into an outdated sequence.
After submission, retain the confirmation details and monitor the registered email and mobile number as well as My Applications. These notifications are useful alerts, but keep the portal acknowledgment and appeal number as the key records for identifying the filed appeal.
Complete the APL-02 and order-copy step
After submitting APL-01, check whether the demand order was uploaded to the portal. This affects the document step and the filing acknowledgment:
- If the order was uploaded: the FAQ says the portal issues FORM GST APL-02 and the provisional acknowledgment date equals the filing date.
- If the order was not uploaded: submit a self-certified copy within seven days, as instructed by the portal. The FAQ says that if the copy is submitted later, the later submission date becomes the filing date.
The FAQ treats the appeal as filed only when FORM GST APL-02 bearing an appeal number is issued. Do not rely solely on having entered information in APL-01 or received an initial notification: verify the final acknowledgment and keep a copy with the appeal number. If the portal has not issued it, check the application for pending document or submission requirements and follow the portal’s current instructions.
The seven-day copy requirement matters particularly where the order is not uploaded. Check the upload status before filing, and, if a copy is required, note the submission deadline immediately. Keep evidence of the self-certified copy submission with the application record. Under the FAQ’s description, a late copy can shift the filing date to the later submission date, so it is not a minor administrative detail to leave until convenient.
There are therefore two different dates worth recording: the date you submit APL-01 and the filing date reflected through the acknowledgment process. Where the order is not uploaded and the copy is supplied later, those dates may differ. Use the final APL-02 and the portal record to confirm the appeal number and filing checkpoint.

Track the appeal and interpret its status
- Return to Services > User Services > My Applications.
- Choose Appeal to Appellate Authority as the application type.
- Enter a From and To date covering the submission, then select Search.
- Open the relevant application and review its status, notices, replies, and orders. Check the portal and the registered email and mobile number for updates.
The GST Portal FAQ lists status labels including Appeal Submitted, Appeal admitted, Appeal Rejected, Hearing Notice Issued, Reply Submitted, Adjournment Granted, Show Cause Notice Issued, Appeal Order Passed, rectification-related statuses, and remand statuses. Labels and portal functions can change, so use the wording and instructions displayed in your application.
If the search does not show the case, first confirm that you selected the appeal application type and that your date range includes the application. A narrow date range can exclude the relevant submission. Search again with a wider range if necessary, then open the matching application rather than relying only on a list label. The application record is where to check for communications and procedural steps associated with that status.
| Status or distinction | What it tells you | What to do next |
|---|---|---|
| Appeal Submitted | The application has reached a submission stage; it is not the same status as admission. | Check for the APL-02 appeal number and any outstanding document or portal requirement. |
| Appeal admitted | The portal identifies the appeal as admitted, a separate stage from submission. | Monitor notices and further procedural steps in the application. |
| Appeal Rejected | The portal shows a rejection status. | Read the order or notice and assess the next available response with reference to the applicable law and facts. |
| Hearing Notice Issued | A hearing notice has been issued. | Read the notice carefully and act on its date and instructions. |
| Reply Submitted or Adjournment Granted | The record reflects a reply or an adjournment-related step. | Check the application for the associated communication and any resulting directions. |
| Appeal Order Passed | An appellate order is shown in the portal. | Open and retain the order, then review its findings and directions. |
Other labels identified by the FAQ include Show Cause Notice Issued, rectification-related steps, and remand statuses. Treat a label as a prompt to inspect the associated communication, not as a complete explanation of what you must do. A notice or order may contain a date, direction, or response requirement that cannot be inferred from the status name alone.
Make checking the portal and registered contact details part of the follow-up routine until the appeal order is available. Keep copies of notices, replies, adjournment communications, and the final order together with the original demand order and APL-02. This makes it easier to follow the sequence of events and respond to the specific instruction shown in the case record.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Submission and admission have different recovery implications
The GST Portal FAQ says that when an appeal is admitted, the balance disputed amount is flagged as non-recoverable in the portal. The stated consequence is tied to admission, not merely to starting or submitting an appeal. Do not infer from an “Appeal Submitted” status that the appeal has been admitted or that the balance has already been flagged non-recoverable.
For this reason, check the status distinction directly. A submitted appeal and an admitted appeal are separate steps in the portal’s terminology. The FAQ’s recovery statement is about the balance disputed amount once admission occurs; it should not be expanded into a claim that filing alone automatically stops every recovery action or resolves every amount in the demand.
Common filing problems and practical checks
- No APL-02 appeal number: Review My Applications and the portal notifications for an incomplete step, including a missing self-certified order copy if the order was not uploaded. APL-01 submission alone is not the FAQ’s completion checkpoint.
- Prior payment is not reflected against the demand: Check whether it was made using Payment towards Demand or DRC-03 and reconcile its treatment against the Demand ID before proceeding on the assumption that the portal has recognized it.
- Deadline is close or may have passed: Confirm the communication date and the limitation calculation promptly. Possible condonation for sufficient cause is discretionary and limited as described in the FAQ; it should not be treated as extra time automatically available to every applicant.
- Search returns no application: Confirm that Appeal to Appellate Authority is selected and that the From and To dates include the relevant submission date, then search again.
- Portal labels or steps differ: Follow the live application instructions. The FAQ provides a general route and examples of statuses, but labels and functionality may change.
- The order copy is not on the portal: Do not overlook the self-certified-copy step. The FAQ gives seven days and says that a later copy submission can affect the filing date.
- Confusion about the amount to pay: Separate disputed tax from other demand components and admitted liability, then verify the applicable requirement for the particular order. A single percentage of the full demand may not reflect the rule for the case.
What this guide cannot determine
A general procedure cannot establish whether a particular order is appealable, compute a taxpayer’s exact limitation deadline or pre-deposit, confirm that a payment has been adjusted, or assess the merits of proposed grounds. Those questions turn on the order, record, current legislation and notifications, and the state of the GST Portal. The official GST Portal FAQ and GSTN advisory are useful for the stated workflow, but case-specific decisions should be checked against the applicable law and current portal directions.
Best Value
The GST Portal FAQ gives the general figures of three months, possible condonation of up to one additional month for sufficient cause, a 10% disputed-tax pre-deposit description, and seven days to provide a self-certified copy where the order is not uploaded. These are procedural thresholds, not a guarantee that a particular appeal will be accepted or decided by a particular date. Confirm the current legal and portal position for your order before relying on them.
Frequently Asked Questions
How long do I have to appeal a GST demand order?
The GST Portal FAQ states an ordinary period of three months from communication of the decision or order. It says the authority may condone up to one additional month for sufficient cause, but that is discretionary, not an automatic extension. Confirm how the period applies to your order and communication record.
Where do I file an appeal against a GST demand order?
On the GST Portal, go to Services > User Services > My Applications, choose Appeal to Appellate Authority, select New Application, and choose Demand Order. The taxpayer form is FORM GST APL-01.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
How much pre-deposit is required?
The GST Portal FAQ describes a minimum pre-deposit of 10% of disputed tax, subject to law. The applicable calculation depends on the order and the amounts in dispute; section 107 also addresses orders demanding a penalty without tax. Do not automatically calculate 10% of every component in the demand.
When is the appeal treated as filed?
The FAQ says the appeal is considered filed when FORM GST APL-02 bearing an appeal number is issued. If the order was not uploaded, provide a self-certified copy within seven days; the FAQ says a later copy submission date becomes the filing date.
What if my payment does not appear against the demand?
The GSTN advisory says Payment towards Demand is associated with the Demand ID, while DRC-03 payments are not linked to that Demand ID and may not appear as adjusted against it in the electronic liability register. Reconcile the portal records and follow current GST Portal instructions before assuming the payment satisfies the demand-linked check.
How do I track my GST appeal?
Go to Services > User Services > My Applications, choose Appeal to Appellate Authority, enter a From and To date covering the application, and select Search. Open the application to review its status, notices, replies, and orders.

The GST Portal FAQ ties its non-recoverable flag for the balance disputed amount to the appeal being admitted. Appeal Submitted and Appeal admitted are distinct statuses, so submission alone should not be treated as proof of admission or as an automatic stop to all recovery.
What authentication method can I use to file APL-01?
The FAQ says filing can use DSC or EVC and that DSC is mandatory for companies and LLPs. Follow the live portal instructions for the account and entity.
The Bottom Line
For a first appeal against a GST demand order, check the communication date and disputed amounts, verify the applicable pre-deposit and payment linkage, then file FORM GST APL-01 through My Applications. If the order is missing from the portal, submit its self-certified copy within seven days. Confirm that FORM GST APL-02 with an appeal number is issued, and continue tracking the case in My Applications—especially the difference between Appeal Submitted and Appeal admitted.
