For an Indian employer, employee payments or salary deductions for workplace meals may be outside GST when the canteen is a contractual employment perquisite. That does not automatically make the GST on the caterer’s invoice eligible for input tax credit (ITC): food and outdoor catering credits are generally restricted unless a law obliges the employer to provide the facility. In the Tamil Nadu KION India ruling, ITC was limited to the employer-funded portion. Treat recovery GST and ITC as separate questions, and check the employment terms, applicable law, state, and facts before booking or claiming credit.

First separate the employee recovery from the canteen invoice

There are two distinct GST questions:

  • Employee recovery: Is the amount collected from employees for meals subject to GST?
  • Input tax credit: Can the employer claim credit for GST charged by the canteen service provider?

A conclusion on one does not decide the other. A recovery may be outside GST while ITC on the provider’s invoice remains blocked or only partly available.

When may employee canteen recoveries be outside GST?

CBIC Circular No. 172/04/2022-GST, issued 6 July 2022, says contractual perquisites provided by an employer to employees under their employer–employee agreement are not subject to GST. The circular’s reasoning is that such perquisites are in lieu of services the employee provides in relation to employment. See the CBIC circular.

This is not a blanket rule for every meal payment or every person using a workplace canteen. The employment terms or policy should establish the benefit, and the actual arrangement should match those terms. Schedule III of the CGST Act treats services by an employee to an employer in the course of or in relation to employment as neither a supply of goods nor a supply of services; that provision addresses the employee-to-employer relationship. The treatment of meals supplied by an employer relies separately on CBIC’s contractual-perquisite clarification. Consult the CGST Act text and the circular.

Official advance-ruling analyses are fact-specific and not uniform. The Tamil Nadu AAR in KION India concluded that the nominal canteen recovery in that applicant’s circumstances was not subject to GST, while the Federal-Mogul Goetze AAR records a contrary approach, including treating deductions as consideration and examining the employer’s activity as business. These rulings are not a universal nationwide resolution. An advance ruling applies within its statutory scope to the applicant and the concerned or jurisdictional officers; its usefulness to another employer depends on matching the facts and applicable authority. Review the KION India order and Federal-Mogul Goetze ruling.

When can the employer claim ITC on the caterer’s invoice?

Section 17(5)(b) of the CGST Act generally restricts ITC on food and beverages and outdoor catering. Its proviso permits credit where the employer is obliged under a law in force to provide the relevant supply to employees. The employer must establish that the legal obligation applies to the actual workforce and facility; a voluntary or subsidized canteen should not be assumed to qualify. Check the current consolidated CGST Act and the applicable law governing the workplace.

In KION India, the Tamil Nadu AAR applied the legal-obligation exception to a mandatory factory canteen but limited ITC to the cost borne by the employer, excluding the employee-recovered share. That result is tied to the applicant’s facts and is not a universal allocation rule for every employer. Do not extend it automatically to contractor personnel, visitors, or other groups without checking the applicable legal obligation and ruling.

CBIC’s older GST Sectoral FAQs state that tax paid to canteen providers is not creditable. Read that general answer alongside the later statutory exception and CBIC’s interpretation of contractual perquisites; do not treat the FAQ as eliminating the exception in section 17(5)(b).

Book the invoice and recoveries with a traceable split

The GST sources do not prescribe ledger names or journal entries. The following is a practical bookkeeping presentation, not a statutory GST format. Apply the entity’s consistent accounting policy and ensure the amounts reconcile to the provider invoice, meal records, and payroll.

  1. Post the provider invoice. Record the gross invoice to canteen or employee-welfare expense, separating the GST charged. Identify the portion of input GST that is eligible, if any, under the blocked-credit rule and legal-obligation exception.
  2. Record employee collections. Track salary deductions or other collections in a separate employee-recovery or clearing account, or reduce canteen expense under the entity’s consistent policy. Keep the recovery amount identifiable.
  3. Allocate ITC. If relying on the legal-obligation exception, document the law requiring the facility and the workers it covers. In a fact pattern comparable to KION, separate the employer-funded amount from the amount recovered from employees and do not claim credit on the recovered share based solely on that ruling.
  4. Retain support. Keep the canteen contract, relevant employment terms or HR policy, the statutory-applicability analysis, provider tax invoices, employee recovery records, and the calculation of eligible and ineligible credit. This is practical evidence management, not a document list prescribed by the circular.
  5. Reassess when circumstances change. Revisit the treatment if the law, employment or canteen contract, covered worker group, or relevant jurisdictional authority changes.

Illustrative entries

At invoice booking, an employer might debit canteen expense for its funded share, debit an employee-recovery receivable or clearing account for the recoverable share, debit only supportable eligible input GST, and credit the provider payable for the invoice total. When payroll deducts an employee’s share, debit payroll payable and credit the recovery clearing account. The exact mapping depends on how the invoice and collections are structured and on the entity’s accounting policy.

Compare your facts with the rulings before relying on them

When assessing whether an AAR is relevant, compare the features that can change the GST analysis:

  • Whether the users are direct employees, contractor personnel, or visitors.
  • Whether a law requires the employer to provide the canteen facility to those workers.
  • Whether the meal benefit is set out in employment terms or an HR policy.
  • How much employees recover and how much the employer funds.
  • The state, the applicable advance ruling, and any binding court decision relevant to the employer.

The GST Council’s AAR index records applicant questions about whether nominal salary deductions for factory food amount to a supply of service and whether ITC is available on catering services. Those questions show the issues considered in particular proceedings, not a representative survey of employer practice. See the GST Council AAR index.

What to verify before closing the accounting treatment

  • Confirm the current consolidated wording of section 17(5)(b) and the law, if any, that makes the facility compulsory for the relevant workplace and workers.
  • Check that the canteen benefit is genuinely provided under the employer–employee arrangement described in CBIC Circular 172/04/2022-GST.
  • Keep the recovery and employer-funded portions distinguishable in the accounting records.
  • Check state-specific and jurisdictional authority rather than treating another taxpayer’s AAR as a universal decision.
