A site may require verification, restrict access, or choose not to serve Texas; the law does not mean every adult website is blocked statewide.
Why some adult websites restrict access in Texas
HB 1181 applies to a commercial entity publishing or distributing website material when more than one-third of that material is sexual material harmful to minors. A covered site must verify that users accessing the material are at least 18. The statute includes exemptions for search engines, internet service providers, and cloud service providers in specified circumstances; those exemptions do not automatically extend to an adult-content publisher or every intermediary.

On June 27, 2025, the Texas Attorney General reported that Aylo, Pornhub’s operator, had chosen to shut the site down in Texas rather than implement the required verification. That is a dated report about one operator’s decision, not confirmation of every site’s status then or now. The sources cited here do not establish which named sites are available in Texas in October 2026.
What the Supreme Court decided
In Free Speech Coalition, Inc. v. Paxton, the Supreme Court affirmed the Fifth Circuit judgment sustaining HB 1181’s age-verification requirement on June 27, 2025. The Court applied intermediate scrutiny and concluded that the requirement survived the facial First Amendment challenge before it. The majority reasoned that the law advances Texas’s interest in shielding children and allows more than one verification method.

The majority addressed the objection that verification could chill adult users because of privacy concerns and the stigma associated with pornography. Justice Clarence Thomas wrote that users “only have to submit verification to the covered website itself or the third-party service with which the website contracts.” That describes the majority’s reasoning; it is not an independent finding that every service is equally private or that verification carries no security risk.
What age verification can involve
The statute describes two broad categories of verification: providing digital identification, or using a commercial system based on government-issued identification or commercially reasonable methods that rely on public or private transactional data. These are permitted categories, not a single standardized process. The legal record does not compare current vendors or establish the practices of a particular provider.

Before submitting information, check the site’s explanation of its verification flow and the provider’s own privacy and security policies. Useful questions include:
- What information will you submit, and which entity receives it?
- Does verification happen on the website or through a third-party service?
- What does the provider say it retains, and for how long?
- What independent security or privacy commitments are documented?
What the law’s retention rule does—and does not—promise
HB 1181 prohibits covered entities and third-party verification providers from retaining identifying information. That is a specific retention rule, not a guarantee that information is never processed, transmitted, or disclosed, or that no security incident can occur. It also does not establish that every implementation handles data identically. Read the relevant site and provider policies rather than treating the statute as a blanket privacy guarantee.

The Texas Attorney General’s June 27, 2025 release described civil penalties of up to $10,000 per day for violations, an additional $10,000 per day for illegal retention of identifying information, and up to $250,000 if a violation results in a minor’s exposure to harmful material. These are figures stated by the agency in that release; consult the current codified statute for the law in force at the time you read this.
Does a VPN unblock adult websites or make browsing totally private?
The cited legal sources do not establish that a VPN, proxy, router, or other consumer product lawfully bypasses HB 1181, reliably restores access to a covered site, or guarantees anonymity. A VPN should not be presented as a proven legal workaround on that basis. “Total privacy” is not a supported promise: the available evidence does not assess specific VPN services, verification vendors, or their current data practices.

Whether a site requests verification or serves Texas can change. Check the site’s current notice and terms directly, and make your decision using the actual verification provider’s documented practices rather than assuming a particular tool removes the legal requirement or eliminates privacy risk.
