In U.S. federal cases, cryptocurrency seizure is a legal and custody process—not an automatic transfer of ownership. Investigators first need authority to seize the asset; agencies then secure and track it while the forfeiture case proceeds. Only after final forfeiture can the government dispose of it under applicable law. Victims or other claimants may have rights, but recovery is not automatic.
The details below describe the federal process. Other countries, and U.S. state and local cases, may follow different laws and procedures.

How does the government get authority to seize cryptocurrency?
The U.S. Department of Justice’s 2025 Asset Forfeiture Policy Manual says an agency should obtain a seizure warrant unless it already has warrant authority or the owner consents. The route to the asset depends in part on whether it is held by an individual or a service provider.
| Where the cryptocurrency is held | Federal process described by DOJ |
|---|---|
| Self-custodial wallet | Obtain the necessary authority to seize the asset, then secure control of it. A prompt transfer matters because another person may have a copy of the private key. |
| U.S.-based virtual asset service provider (VASP) | Obtain and serve a warrant on the provider in a manner DOJ describes as similar to seizing funds in a bank account. |
| Foreign-located VASP | Consult DOJ’s Office of International Affairs. Restraint abroad may require mutual legal assistance or comparable process; the manual cautions against accepting a transfer from a foreign provider without required process or OIA permission. |
Before seeking a seizure, prosecutors and agents are also advised to check with the U.S. Marshals Service (USMS) that it can process the particular asset. The manual notes that thousands of cryptocurrency types exist and that USMS may not be able to store or liquidate every one. A seizure plan therefore cannot assume every token can be handled through the same channel.

What happens to cryptocurrency after seizure?
Secure the keys and move the asset
Once authorized, the seizing agency should move cryptocurrency to a government-controlled self-custodial or cold-storage wallet. The DOJ manual directs agencies to keep each cryptocurrency type in its own wallet, so a seizure involving different types may require multiple wallets. The reason for acting promptly is practical: someone else with a copy of a private key may otherwise be able to move the asset.
Register and arrange custody
The agency processes the seizure through its forfeiture department and assigns it a Consolidated Asset Tracking System (CATS) identification number. For eligible cryptocurrency, it may transfer the asset to a receiving wallet provided by USMS or its contractor for pre-forfeiture storage, following current USMS Complex Assets Unit procedures. The manual gives enhanced-anonymity cryptocurrencies separate handling instructions, so readers should not assume they follow the ordinary transfer path.
For most DOJ-enforcement assets in USMS custody, USMS has primary management and disposal authority. Treasury-related assets may have different custodians under the Justice Manual; the seizing agency is not necessarily the asset’s long-term custodian.

How are seized assets tracked and valued?
Control of private-key access is only one part of custody: agencies also need records of what they hold, where it is held, and its value. CATS is DOJ’s asset-tracking system. However, a DOJ Office of the Inspector General (OIG) audit published in June 2022 found that, during its FY2017–FY2021 review period, USMS used supplemental spreadsheets because CATS did not support daily cryptocurrency inventory management. The audit identified inaccurate spreadsheet records, gaps in written procedures and edit controls, a lack of periodic reconciliation, shortcomings in recording custody and valuation, and no established process for recording assets created after a cryptocurrency fork.
Those are historical findings tied to the audit period, not proof that the same weaknesses persist today. The OIG also found that USMS had adequate safeguards over storage and access to cryptocurrency in its custody.
- As of June 2021, DOJ had nearly 200 cryptocurrency seizures under management, according to the OIG’s 2022 report.
- The report put the value of those assets at about $466 million in September 2021.
These are dated figures, not a current government-wide inventory. A separate DOJ release in June 2025 described a complaint against more than $225.3 million in cryptocurrency in one case; that case amount was not a national total or a final forfeiture judgment.

Does seizure mean the government has forfeited the cryptocurrency?
No. Seizure puts an asset under government control while the legal process continues; it does not by itself establish final forfeiture. DOJ policy generally bars Department personnel from using property held pending forfeiture, including for official purposes, until a final forfeiture order issues.

DOJ guidance says orders generally direct forfeiture to the United States for disposition according to law, while recognized third-party claims are addressed. The Justice Manual describes disposition of property forfeited to the United States as an executive-branch decision.
Can the government keep or sell forfeited cryptocurrency?
After final forfeiture, the Attorney General may dispose of assets under applicable statutes. DOJ guidance describes sale and other legally available methods. Proceeds go into the Assets Forfeiture Fund under the governing statutory framework, which pays specified program expenses, including authorized asset management and disposal costs and victim compensation.

That does not mean every forfeited token is sold, or that proceeds in a particular case go to a single recipient. DOJ’s Attorney General Guidelines describe possible payments and transfers, including to eligible victims and through equitable sharing with participating state, local, and tribal law-enforcement agencies. Distributions to owners, lienholders, certain regulators, and victims take precedence over federal official use and equitable sharing. The applicable law, recognized claims, and case-specific decisions shape the final disposition.

Not simply because an asset was seized. DOJ describes remission as a discretionary process under 28 C.F.R. Part 9 through which the Department may compensate qualifying victims using assets forfeited from perpetrators. Eligibility depends on the crime connected to the forfeiture, and DOJ says the Assets Forfeiture Fund is not a general victim fund.
A June 18, 2025 DOJ release, updated July 30, 2025, illustrates the distinction between a recovery objective and a completed payment. It announced a civil forfeiture complaint against more than $225.3 million connected, according to the complaint, to cryptocurrency investment-fraud laundering. The release said more than 400 suspected victims were believed to have lost funds and quoted officials describing an intention to return funds. The filing was a complaint: its account was alleged, and the release did not establish a final forfeiture judgment or completed victim compensation.

Why can one case’s process differ from another’s?
Federal policy offers a framework, not a guarantee that every seized asset will follow an identical path. The factors that can change the procedure or outcome include:
- Jurisdiction and legal route: the applicable forfeiture law and court process depend on the case and government authority involved.
- Custody arrangement: a self-custodial wallet, a domestic provider, and a foreign provider raise different access and legal-process questions.
- Asset type: USMS storage or liquidation support is not established for every token, and enhanced-anonymity assets have separate handling instructions.
- Stage of the case: seizure, a pending forfeiture action, a final forfeiture order, and a completed distribution are distinct events.
- Claims and disposition: recognized third-party claims and eligibility for victim compensation can affect what happens after forfeiture.
The controlling sources for the federal process include DOJ’s 2025 Asset Forfeiture Policy Manual, the Justice Manual provisions on asset management and disposition (including management guidance updated January 2026), and the governing statutes and regulations. DOJ’s OIG Report 22-082 documents historical audit findings; DOJ’s program materials explain forfeiture and remission; and its June 2025 release describes the pending civil complaint above.
