The FCC’s former national TV ownership cap limited an owner’s attributed audience reach across commercial television stations to 39% of U.S. TV households. It was not a limit on the number of stations or a measure of actual viewership: the calculation counted VHF stations at 100% and UHF stations at 50% of the households in their markets. On August 6, 2026, the FCC announced a vote to repeal that fixed cap and use transaction-by-transaction public-interest review instead. The order’s effective date and its status in court are not established by the available official materials, so the vote should not be treated as proof that the change is already operative or judicially settled.
What the FCC’s 39% TV ownership cap limited
The former National Television Multiple Ownership Rule set an aggregate national audience-reach ceiling for an entity’s cognizable interests in commercial television stations. The FCC described the ceiling as 39% of U.S. television households. It applied across stations in the owner’s portfolio, not separately to each station.

That distinction matters: 39% was a regulatory calculation of households attributed to an owner’s stations, not a claim that the owner captured 39% of viewers, and not a cap on the number of stations it could own. The rule also did not simply count households in every station’s market equally.
How the old cap was calculated
The FCC calculated reach using the households in the Nielsen Designated Market Areas (DMAs) where the relevant stations were located, divided by total U.S. television households. The applicable DMA data were those in effect at the time of a license grant, transfer, or assignment. A station’s band determined how much of its market’s households counted toward the cap.

| Station band | Households attributed in its DMA | Effect on the calculation |
|---|---|---|
| VHF | 100% | All households in the station’s DMA counted. |
| UHF | 50% | Half of the households in the station’s DMA counted under the UHF discount. |
For example, a portfolio containing UHF stations in several large markets would not be assessed as though every household in those markets counted in full. The UHF discount reduced the attributed reach; it did not mean the stations actually reached or served only half of those households.
Attribution can go beyond station title
The calculation covered cognizable interests under the FCC’s ownership-attribution rules. As a result, checking only which company holds a station’s license may not identify every interest the FCC counts. Licensees must account for stations in which they are deemed to hold attributable interests.
What the FCC voted to change in 2026
On August 6, 2026, the FCC announced that it had voted in Report and Order FCC 26-53 to repeal the 39% national cap and replace it with case-by-case public-interest review. The announcement described a framework in which the agency could approve deals that satisfy the public-interest standard and reject those that do not. It did not announce a new national percentage threshold.

| Feature | Former rule | Approach announced in FCC 26-53 |
|---|---|---|
| Decision rule | Fixed 39% attributed-reach ceiling | Transaction-specific public-interest review; no replacement percentage stated in the announcement |
| What is assessed | Attributed household reach across commercial TV stations | The public interest in an individual transaction |
| Review focus | Uniform threshold applied across qualifying ownership interests | The FCC said review could consider localism, viewpoint diversity, and competition in the particular deal |
| Status described by available official materials | Established rule parameters | FCC vote and order announced; effective date and court disposition not established |
The FCC’s majority said changing video distribution and competition—including the nationwide reach of digital platforms—supported a case-specific approach. That is the Commission’s rationale, not an independently established finding here. The FCC also asserted that streaming services reach more than 80% of U.S. adults, but the underlying study, measurement date, and methodology are not established in the announcement materials summarized here; the figure should not be treated as a verified market statistic.
Can a company own stations reaching more than 39%?
Under the former rule, an entity whose attributed reach exceeded 39% would have exceeded the cap. Under the approach the FCC announced, a deal exceeding that former threshold would not be automatically approved: the Commission said each transaction would remain subject to public-interest review. The announcement therefore describes a shift away from a fixed percentage test, not a blanket permission for every deal above 39%.

No conclusion about operative status or judicial resolution follows from the FCC’s vote alone. The available official materials establish the August 6, 2026 vote and the order, but do not establish its effective date, Federal Register publication status, a judicial stay, or a final court ruling. Those procedural facts determine whether and when the new approach takes effect and whether it remains in force.

The commissioners also disagreed about the FCC’s authority. Commissioner Anna M. Gomez dissented, saying, “Congress set this cap in federal law, and only Congress can change it,” and arguing that the FCC exceeded its authority. The majority maintained that the Commission retained authority under the Communications Act to revise ownership limits. These are competing positions within the agency, not a court’s resolution of the legal question.
