Short answer: the EU AI Act has no separate legal category for an “AI agent.” An agent is regulated as the AI system, general-purpose AI (GPAI) model and use context it implements. The obligations depend on who develops and markets it, its intended purpose, where it is placed on the EU market or put into service, and the risks created by its use. A company can become the legal provider even when another company supplied the underlying model.
For an agent business, compliance starts with role mapping and risk classification, not with the word “autonomous” in product marketing. The practical sequence is to identify the system and its operators, check prohibited practices, map transparency duties, determine whether GPAI obligations apply, and then assess any high-risk category and its evidence requirements.

What the AI Act actually regulates
Regulation (EU) 2024/1689 uses a risk-based framework for AI systems and GPAI models. “AI agent” is a product and engineering description, not a standalone legal tier. An agent that plans tasks, calls tools, retrieves information or takes actions is assessed according to the AI system it implements, its intended purpose and deployment context.
The same commercial product can involve several regulated operators. One organization may provide an agent under its own brand, another may deploy it internally, a third may import or distribute it, and a model company may be the GPAI provider. Assigning these roles in writing is essential because duties attach to the operator and activity, not simply to the software architecture.

Provider
Article 3(3) defines a provider as a natural or legal person, public authority, agency or other body that develops an AI system, or has it developed, and places it on the EU market or puts it into service under its own name or trademark. The European Commission’s Article 50 FAQ uses that definition directly.
You can therefore become a provider without training the foundation model. Rebranding an existing agent, substantially modifying it, or changing its intended purpose so that it becomes high-risk can move an organization into the provider role. Keep records showing who controls the model connection, orchestration and prompts, tools and permissions, user interface, deployment decisions and post-market changes.
Deployer
A deployer uses an AI system under its authority. For example, a company that installs an external scheduling agent for its human-resources team may be a deployer, while the branded vendor remains the provider. Deployers still need to follow the system’s instructions, apply required human oversight and manage their own use context. A deployer that changes the system or markets it as its own should reassess whether it has taken on provider duties.

Importer and distributor
An importer places on the EU market an AI system from a provider established outside the Union. A distributor makes a system available in the supply chain. Their checks and cooperation duties differ from those of the provider, so contracts should identify which party handles conformity information, documentation, incident communication and corrective action.

GPAI model provider
The GPAI provider is the actor that places a general-purpose model on the EU market. Building an agent on another company’s model does not automatically make the agent company the GPAI provider. Downstream builders should obtain the information and documentation needed to meet their own AI-system obligations. If an agent company develops or markets its own general-purpose model, it must assess the GPAI chapter itself, including systemic-risk triggers and notification to the AI Office where applicable.
When the rules apply: the implementation timetable
The Act entered into force on 1 August 2024, but its obligations have staged application dates. Dates below are the current implementation snapshot; transition rules and official interpretations can change, so verify the applicable date for a release before shipping.
| Milestone | Date | What it means for agent teams |
|---|---|---|
| Regulation enters into force | 1 August 2024 | The legal framework exists; obligations phase in over time. |
| GPAI-model obligations apply | 2 August 2025 | GPAI providers must address the applicable documentation, downstream information, copyright-transparency and, for systemic-risk models, evaluation and mitigation duties. |
| Article 50 transparency applies | 2 August 2026 | Applicable systems must make AI interaction and certain generated or manipulated content recognizable under the relevant transparency provision. |
| Annex III high-risk rules apply | 2 December 2027 | High-risk systems in the listed use areas reach the stated application date. |
| High-risk AI embedded in regulated products | 2 August 2028 | High-risk systems embedded in products covered by the Act receive the extended date stated by the AI Act Service Desk. |
Do not treat a future date as a reason to postpone preparation. Documentation, ownership records and change controls are difficult to reconstruct after an agent is in production.

- Inventory the system. List models, prompts, retrieval components, tools, APIs, connected business systems, data flows, users, affected people, action permissions, fallback behavior and human review points. Distinguish the base model from the agent layer that plans and executes tasks.
- Map every operator role. Identify provider, deployer, importer, distributor and, where relevant, GPAI provider. State which entity controls branding, intended purpose, configuration, monitoring and updates.
- Freeze the intended purpose. Capture the product description, instructions, sales claims and actual workflow. A change from “drafts interview questions” to “ranks candidates” can alter the legal analysis even if the underlying model is unchanged.
- Check prohibited practices first. Remove or redesign uses that fall within the Act’s prohibited-practice rules before considering a lower-risk classification.
- Map Article 50 transparency. Determine whether people interact directly with the system, whether the agent generates or alters content, who can be affected and what disclosure or marking is required in that context. A generic “AI agent” label is not a substitute for the applicable notice or detectability measure.
- Assess GPAI dependencies. Obtain model documentation and downstream information from the GPAI provider. If your organization supplies its own general-purpose model, perform the full GPAI assessment, including systemic-risk obligations where the legal triggers are met.
- Test Annex III and product rules. Examine the intended purpose and sector, including employment, access to essential private or public services, biometrics, critical infrastructure and education. Also check whether the agent is a safety component or embedded in a regulated product.
- Build the evidence file. For a high-risk determination, plan risk management, data governance, technical documentation, automatic logging, instructions for use, human oversight, accuracy, robustness and cybersecurity evidence, plus conformity and post-market obligations.
- Operate a lifecycle record. Preserve version history, change approvals, incidents, corrective actions, monitoring results and communications with authorities. Reclassify when the model, tools, users, geography or intended purpose changes.
When an agent is high-risk
Autonomy alone does not make an agent high-risk. The decisive questions are what the system is intended to do and where it is used. An agent that books internal meeting rooms is analyzed differently from one that recommends candidates, determines eligibility for an essential service, controls critical infrastructure or performs a biometric function.
High-risk categories to screen
- Employment and worker-management uses, such as recruitment, selection, evaluation or decisions affecting working conditions.
- Access to essential private or public services and benefits.
- Biometric identification, categorization or emotion-related uses covered by the Act.
- Safety-related functions in critical infrastructure.
- Education and vocational-training decisions listed in the high-risk framework.
- AI systems embedded in products subject to the Union’s product-safety legislation.
The classification must follow the system’s legally relevant purpose and context, not a marketing claim that the agent is merely an assistant. Keep the reasoning and supporting documents so a reviewer can see why a category was included or excluded.
What the high-risk evidence program contains
High-risk compliance is an ongoing control system, not a one-time model test. The provider should be prepared to demonstrate a documented risk-management process; appropriate data and data-governance practices; technical documentation; automatic event logging; clear instructions; effective human oversight; and suitable levels of accuracy, robustness and cybersecurity. Conformity assessment, quality controls, incident handling and post-market monitoring then continue through the product lifecycle.

Disclosing an AI interaction
Where the applicable Article 50 provision requires it, tell a person that the conversational interface is an AI system. Put the notice where the interaction begins and keep it understandable in the language and channel used. Do not assume that a brand name, an avatar or a small footer automatically meets the requirement.
Marking or making content detectable
For systems that generate or manipulate text, images, audio or video, determine whether the output falls within a marking or detectability obligation. The technical and presentation method depends on the content and deployment. Document how the marker survives ordinary processing and how recipients can recognize the origin where the rule applies.
Agents that take actions
A tool-using agent may both converse and change records, send messages or execute transactions. Map transparency to the exact interaction and affected person: identify when the user is dealing with AI, when an output is generated or altered, and when a human must approve a consequential action. Keep an audit trail linking the disclosure, output and action.
GPAI providers and downstream agent builders
GPAI obligations and agent obligations overlap but are not interchangeable. The model provider handles duties attached to placing the general-purpose model on the EU market. A downstream agent provider remains responsible for the AI system it markets or puts into service and needs enough model information to perform that responsibility.
Best Value
Information to obtain from the model provider
- Technical information describing capabilities, limitations and intended use boundaries.
- Documentation needed to integrate the model safely and to complete the downstream system’s technical file.
- Information about copyright-related policies and transparency required for the GPAI model.
- Details relevant to evaluation, mitigation and systemic-risk controls when those obligations apply.
Contractual access is not the same as legal transfer. Assign named owners for reviewing model updates, validating changed behavior, recording incidents and deciding whether a new version changes the agent’s classification.
When the agent company is also a GPAI provider
If the company trains, substantially develops or markets its own general-purpose model, it should assess the full GPAI chapter rather than treating the model as an internal component. Models with systemic risk can trigger additional evaluation and mitigation duties and notification to the AI Office where applicable.
Comparing two agent architectures
Architecture choices affect compliance workload. Compare designs using the same legal questions rather than assuming that a more autonomous design is automatically more regulated.

Enforcement and practical governance
Enforcement is shared. The European Commission AI Office has a central role for GPAI-model obligations, while the European Commission and the European Data Protection Supervisor act at EU level for their respective responsibilities. Member States designate national competent authorities. An agent provider should therefore monitor both Commission materials and the guidance of the Member State authorities relevant to its operations.
A governance file that survives an authority question
- System description, architecture diagram and version inventory.
- Named provider, deployer, importer and distributor roles with contractual boundaries.
- Intended-purpose statement, marketing claims and change log.
- Tool permissions, data-flow map, user groups and affected-person analysis.
- Prohibited-practice screening and Article 50 transparency decision.
- GPAI provider documentation and records of downstream information received.
- Risk assessment, testing results, human-oversight design and cybersecurity controls.
- Logging, incident response, corrective-action and post-market-monitoring records.
Review this file whenever you add a tool, connect a new data source, expand into a new Member State, change the user group or alter what the agent is allowed to decide or execute.
What organizations should do now
- Assign an accountable owner for each production agent and model dependency.
- Create a register that separates the AI system, the GPAI model and the deployment context.
- Collect provider documentation before integrating a model into a customer-facing workflow.
- Write the intended purpose in operational terms and align product claims with it.
- Implement transparency notices and content-marking controls ahead of 2 August 2026 where applicable.
- Start the high-risk evidence program well before the stated 2 December 2027 and 2 August 2028 dates.
- Set monitoring and reclassification triggers for model updates, new tools, incidents and changed users.
- Track Commission AI Office publications and national authority guidance as interpretations develop.
The central lesson is simple: an AI agent is not exempt because it is called an agent, and it is not automatically high-risk because it is autonomous. The legal result follows the system, operator role, intended purpose, deployment context and applicable timetable. Organizations that document those facts and maintain evidence throughout the lifecycle can make a defensible classification and respond when obligations or guidance change.
