A high earner’s income-tax burden is not one national percentage: it depends on federal and state rules, any local income tax, filing status, taxable income, the kind of income, residency and income sourcing, and available deductions or credits. For tax year 2026, the federal top marginal rate is 37% only on taxable income above a filing-status-specific threshold; it is not the rate on all income.
How federal tax brackets affect high earners
Federal individual income tax is progressive. Each marginal rate applies to a layer of taxable income, so reaching a higher bracket does not make all income subject to that higher rate. The Internal Revenue Service puts it this way: “When your income jumps to a higher tax bracket, you don’t pay the higher rate on your entire income. You pay the higher rate only on the part that’s in the new tax bracket.”

For tax year 2026, the seven federal individual income-tax rates are 10%, 12%, 22%, 24%, 32%, 35% and 37%. The IRS announced the 2026 rates and thresholds in 2025. The top rate applies to taxable income above $640,600 for a single filer and above $768,700 for a married couple filing jointly. The 35% bracket applies above $256,225 for single filers and above $512,450 for joint filers. These are taxable-income thresholds, not gross salary figures.
Marginal rate is not effective rate
A marginal rate is the rate on the next dollar of taxable income within the applicable bracket. An effective rate requires a defined numerator and denominator—for example, total income tax divided by taxable income. Because the tax base, income mix, deductions and credits vary by person, there is no single effective rate that describes all high earners. Adding the federal and state top marginal rates does not calculate an individual’s effective rate.

Why state and local income taxes change the picture
States do not all use the same income-tax structure. The Tax Foundation’s compilation of state individual income-tax systems, as of January 1, 2026, groups states into those with no broad individual income tax, flat-rate systems and graduated-rate systems. A state’s headline rate is only one part of the calculation: thresholds, deductions, exclusions and special taxes can affect how much a particular person owes.
| Layer | What determines the tax | What a headline rate leaves out |
|---|---|---|
| Federal | Federal taxable income, filing status and the applicable progressive brackets | Income type, deductions, credits and the difference between marginal and effective rates |
| State | The state’s tax structure, rules for the taxpayer’s residency and the source of income | State-specific thresholds, deductions, exclusions, credits and special taxes |
| Local, where applicable | County- or city-level rules and the taxpayer’s connection to that jurisdiction | Local tax bases, rates and rules that may not be reflected in a state’s headline rate |
The Tax Foundation’s 2026 table identifies county- or city-level income taxes in ten states. Its accompanying comparison of average effective local rates uses 2023 data, the latest available for that comparison; those averages should not be described as 2026 rates. The table also identifies Washington’s 7% and 9% rates as applying to high-earner capital-gains income, not as a broad tax on wage income.

A state classified as having no broad individual income tax is not necessarily a low-tax place overall: sales, property, payroll and other taxes are outside a state income-tax comparison. Likewise, a flat-rate label does not guarantee that every dollar or income type is treated identically. State rules may include thresholds, exclusions, deductions or special provisions. The Tax Foundation compilation is a national overview, not a substitute for current state revenue department guidance; it also notes that some 2026 state standard-deduction or exemption adjustments were unavailable when its table was prepared.

What happens if you live or work in more than one state?
A move, a second home or work across state lines can affect both where income is taxed and whether more than one state return is required. States set their own residency tests and income-sourcing rules. Do not assume that your home state is the only state with a claim on your income, or that changing your address automatically changes your tax residency.

Residency and source income are different questions
Residency rules determine whether a state treats you as a resident for tax purposes. Source rules determine whether income is connected to that state—for example, because work was performed there or another state-specific sourcing rule applies. Pennsylvania’s official guidance, for example, says nonresidents are taxed on Pennsylvania-source income and distinguishes the rules for residents and nonresidents. That is a Pennsylvania example, not a nationwide rule.
Credits for tax paid to another state may be limited
Some states allow residents, in certain circumstances, to claim a credit for qualifying income taxes paid to another state on the same income. Eligibility and the amount of the credit are governed by state law. Pennsylvania describes a resident credit with limitations; other states have their own credit rules, sourcing methods, reciprocity arrangements and documentation requirements.

Remote-work outcomes can be especially dependent on the states involved and the specific work arrangement. The applicable state authorities’ current guidance is needed to determine residency, sourcing and filing obligations for an individual case.

For tax year 2026, an IRS correction to Form 1040-ES states that the overall federal deduction limit for state and local income, sales and property taxes (SALT) is generally $40,400. For married filing separately, the limit is $20,200. The limit is reduced when modified adjusted gross income exceeds $505,000, or $252,500 for married filing separately, but it cannot fall below $10,000, or $5,000 for married filing separately.

The SALT deduction can reduce federal taxable income for an eligible taxpayer who itemizes deductions; it does not reimburse state taxes dollar for dollar. Whether someone can use the deduction, and how much, depends on filing status, itemization, eligible taxes paid and the high-income phase-down. The stated limit is not a guaranteed deduction for every high earner.
How to estimate a combined tax burden for a real situation
A useful estimate starts with the full set of facts, not a comparison of two top rates. Use the same assumptions when comparing two locations or scenarios, and apply rules for the relevant tax year.
- Set the filing facts. Identify filing status, federal taxable income and the income measures needed for state calculations.
- Separate income by type. Distinguish wages, business income, dividends, capital gains and other income because jurisdictions may treat them differently.
- Identify every relevant jurisdiction. Establish residency, work locations, income sources and any local jurisdiction that may impose an income tax.
- Apply each jurisdiction’s rules. Use current federal, state and local brackets, tax bases, thresholds, deductions and special taxes—not just headline top rates.
- Account for offsets and deductions. Check state credits for taxes paid elsewhere and their limits, as well as eligibility for the federal SALT deduction and any phase-down.
- Compare like with like. State the tax year and assumptions, and define any effective-rate calculation by naming the taxes included and the income denominator used.
A personalized calculation requires current official rules for the states and income types involved. The general figures above cannot determine a particular taxpayer’s combined bill.
