How Staking Rewards Are Taxed in a Trust: Income, Timing, and Records

For U.S. federal income tax purposes, staking rewards generally enter income when the taxpayer gains dominion and control over them—not necessarily when a protocol first calculates or displays them. For a trust, the next question is who is treated as the taxpayer: the grantor, the trust, or—in some cases—both for different portions. A limited IRS safe harbor issued October 6, 2026 applies only to certain exchange-traded trusts; it is not a general rule for family or private trusts.

When do staking rewards count as income?

IRS Revenue Ruling 2023-14 addresses a cash-method taxpayer who stakes cryptocurrency and receives additional units as validation rewards. It says the fair market value of those units is included in gross income for the tax year in which the taxpayer gains dominion and control, measured at the date and time control is obtained. The ruling says the same treatment applies when staking is done through an exchange.

The practical question is when the taxpayer can sell, exchange, or otherwise dispose of the reward. A protocol’s calculation or display of a reward does not, by itself, establish that the taxpayer already has control. A lockup, custodian restriction, or trust agreement may affect the facts, but Revenue Ruling 2023-14 does not decide every such arrangement or resolve every trust-accounting question.

This is a federal income-tax rule described for the taxpayer and facts in the ruling. State and non-U.S. tax treatment is outside this guidance.

Who reports the income: grantor or trust?

Identify the trust’s tax classification before deciding where a reward belongs. Under the 2025 Instructions for Form 1041, a grantor trust is generally disregarded for income-tax purposes: its income, deductions, and credits are treated as belonging directly to the grantor or other deemed owner. A trust that is partly grantor and partly non-grantor applies the relevant rules to each portion.

Trust portion General federal reporting treatment
Grantor Income is generally treated as belonging to the grantor or other deemed owner, rather than reported as the trust’s own income under ordinary non-grantor trust rules. The 2025 Form 1041 instructions describe reporting grantor-owned portions to the owner through an attachment.
Non-grantor Follows normal trust income-tax reporting rules. Form 1041 and, where applicable, Schedule K-1 report income and distributions according to the trust’s return facts.
Partly grantor, partly non-grantor Separate the portions and apply the corresponding reporting treatment to each; do not assume all rewards belong on the same return.

The answer can depend on the trust instrument, ownership rules, distributions, and how the staking activity is conducted. The fact that a trust wallet receives tokens does not by itself settle whether the grantor or the trust reports the income.

How do Form 1041 and later sales fit in?

The 2025 Form 1041 digital-assets question includes receiving new digital assets through staking. A fiduciary preparing a return should answer the applicable question for that tax year and follow that year’s instructions. For a capital asset later sold or otherwise disposed of, IRS instructions direct taxpayers to report the disposition using Form 8949 and Schedule D (Form 1041), as applicable.

Keep the reward event and a later sale as separate tax events in the records. The amount included when control is obtained and the later disposition calculation are not the same entry: the latter requires transaction details and basis records. Reporting depends on the trust’s classification and the facts of the return, so a staking reward should not automatically be treated as identically reported on every Form 1041.

What Revenue Procedure 2026-20 does—and does not do

Revenue Procedure 2026-20, dated October 6, 2026, creates a limited safe harbor for qualifying exchange-traded investment trusts and grantor trusts. If its requirements are met, authorization and resulting staking do not prevent a trust within its scope from qualifying for federal income-tax purposes as an investment trust and a grantor trust. It does not establish a safe harbor open to any trust that stakes digital assets.

The procedure’s conditions are cumulative and detailed. Among other requirements, the trust interests must trade on a national securities exchange; the trust must satisfy applicable SEC and exchange conditions; it may hold only cash and one type of digital asset on a permissionless proof-of-stake network; a custodian controls the private keys while the trust retains tax ownership; and the trust’s purposes and activities are restricted. Additional conditions concern custody, liquidity, staking providers, slashing, and distribution of rewards. Meeting only some of these features does not establish eligibility.

The 60-day reward-distribution condition

For a qualifying trust relying on the safe harbor, net rewards must be distributed proportionately, in kind, for cash, or both, no more than 60 days after the end of the calendar quarter in which the trust gains dominion and control over them. This is a condition of that specific safe harbor. It does not replace Revenue Ruling 2023-14’s general control-based income timing rule for other taxpayers or trusts.

Consequences the procedure leaves open

The procedure expressly limits what it addresses. It cautions that no inference should be drawn about federal tax consequences outside its scope, including whether staking income is effectively connected with a U.S. trade or business or is unrelated business taxable income. A trust’s qualification under this procedure therefore does not answer every tax question raised by its staking activity.

What records should a trustee keep?

IRS digital-asset guidance calls for records of receipts and dispositions, including the U.S.-dollar fair market value of digital assets received as income. For disposition calculations, it identifies asset type, date and time, units, value, and basis. A transaction-level record for each reward and later disposal makes those items easier to substantiate.

  • For each reward: asset and network, units, date and time control was obtained, evidence of when and how the trust could dispose of it, U.S.-dollar value at that moment, valuation source, custodian or staking-provider statement, and the receiving trust account or wallet.
  • For each later disposition: asset, units, transaction date and time, proceeds or other value received, and basis support.
  • For trust allocation: the workpaper showing which portion is grantor-owned or non-grantor and how rewards and related expenses were allocated.
  • For reconciliation: compare on-chain activity with custodian statements, exchange reports, and the trust ledger before preparing the return. This is a practical way to organize and check the records, not a specific IRS-prescribed software process.

Use the valuation at the control date and time for the income-inclusion record; retain the underlying source rather than only a year-end total. If a provider’s statement does not show when the reward became available for disposal, preserve other documentation that helps establish that point.

A practical sequence for trustees

  1. Classify the trust. Determine whether it is grantor, non-grantor, or divided into both kinds of portions under the applicable trust and tax rules.
  2. Establish control for each reward. Record when the relevant taxpayer could sell, exchange, or otherwise dispose of the units; do not rely solely on a displayed accrual.
  3. Value the receipt at that moment. Preserve the unit count, date and time, U.S.-dollar fair market value, and valuation evidence.
  4. Allocate and report by tax owner. Apply the grantor or non-grantor treatment to the correct portion and use the applicable year’s Form 1041 instructions and schedules.
  5. Track any later disposition separately. Preserve the proceeds and basis information needed for Form 8949 and Schedule D (Form 1041), when applicable.
  6. Evaluate the special safe harbor separately. Do not assume it applies unless the trust satisfies the procedure’s full scope and all conditions.

Trust classification, control, and allocation can turn on governing documents and operational details. Where those facts are uncertain, a fiduciary tax professional experienced with digital assets can help determine the reporting position.
