How Short-Term Rental Rules Affect Homeowners, Tenants, and Visitors

Short-term rental rules are local, not universal. Depending on the city, a homeowner may need a permit and may be allowed to rent only a principal residence; tenants may face both city rules and private lease or building restrictions; and visitors may need to check registration, safety information, and who to contact during a stay. Toronto, New York City, Alexandria, and Nashville illustrate how different those requirements can be.

How do short-term rental rules differ by location?

Rules may be set at national, regional or municipal level. The OECD’s Affordable Housing Database identifies permits, maximum rental days and tax treatment as useful comparison points, but its short-term rental regulation information has not been updated since the 2021 questionnaire edition, according to its 2024 documentation. It is not a live compliance directory.

Jurisdiction Definition and eligibility Registration, limits and other requirements
Toronto The city defines a short-term rental as all or part of a dwelling rented for payment for fewer than 28 consecutive days. Rentals are limited to the operator’s principal residence. Operators must register, and companies brokering reservations must be licensed. The city says this policy is intended to preserve other units for long-term rental housing. The City of Toronto visitor guidance was modified September 16, 2026.
New York City For covered rentals in permanent residential buildings, the city’s NYC311 guidance describes stays under 30 days. Hosts may not rent an entire apartment or home to visitors for such a stay. Hosts must register with the Mayor’s Office of Special Enforcement; booking platforms may not process transactions for unregistered rentals. The host must remain in the unit, may host no more than two guests, and must ensure guests can access all parts of the dwelling and its exits. NYCHA, rent-controlled, rent-stabilized and single-room-occupancy apartments are among the categories barred from registration; rental agreements can also make a building ineligible.
Alexandria, Virginia The city describes STRs as typically being rentals of fewer than 30 consecutive days. A permit is required when a property is used as an STR for more than 10 days per calendar year. The city’s page, updated September 24, 2026, lists an annual fee of $350 for an owner-unoccupied rental and $100 for an owner-occupied rental. Requirements include a local agent, documentation and a good-neighbor guide. Operators must meet applicable occupancy, safety, noise and waste rules; the city specifies smoke detectors, carbon monoxide detectors, fire extinguishers and parking provisions.
Nashville, Tennessee The cited city guidance does not state a general definition or eligibility rule for comparison here. Occupancy is capped based on the number of sleeping rooms. A local responsible party’s phone number must be posted, and that person must answer calls 24/7 during stays. Permit holders are responsible for guest activity and applicable room, occupancy and sales taxes, and properties must comply with relevant building, fire, noise and waste rules. The city page was last updated March 13, 2026.

The definitions and thresholds in the table apply only to the named jurisdictions. Even neighboring cities—or different property types within one city—may use different definitions, permits, host eligibility rules and tax requirements.

What should homeowners check before renting out a home?

Owning a property does not automatically make it eligible for short-term renting. Before listing, check the rules for the exact address and type of property, then verify the following:

  • Eligibility: Does the city restrict rentals to a principal residence, or exclude particular building or housing categories?
  • Permission and registration: Is a city registration or permit required? Must a platform or rental company also be licensed? Are there fees, renewal dates or document requirements?
  • Limits: Are there restrictions on rental days, host absence, guest numbers or occupancy?
  • Safety and neighborhood duties: What local rules apply to alarms, fire equipment, exits, parking, noise and waste? Are you responsible for guests’ conduct?
  • Tax: Which local room, occupancy or sales taxes apply, and who must collect or remit them?

Requirements for alarms or extinguishers are jurisdiction-specific. A device or product choice should not be treated as proof of compliance: check local code and any applicable certification requirements.

Can a tenant host a short-term rental?

Sometimes a city may allow a tenant to register, but that does not settle whether the tenant has permission under a lease, landlord policy or condominium rules. Toronto says renters can register but advises them to check their rental agreement and condo rules, or obtain written landlord consent. The City does not verify landlord consent as part of registration.

New York City’s host rules apply to tenants as well as owners, and some buildings or rental agreements can make a property ineligible. A city registration therefore does not necessarily resolve private restrictions. The consequences of hosting without required private permission depend on the jurisdiction and the agreement; they should not be assumed to be the same everywhere.

What should visitors check before booking?

Use the local government’s visitor guidance for the city where the property is located. In Toronto, the City advises visitors to check a listing for a registration number and says guests should receive 24-hour contact information and see a posted exit diagram. Its guidance also says operators must not discriminate on listed protected grounds or refuse service to a person with a disability, including someone accompanied by a service animal.

  1. Look for any registration or permit details the city says should appear in a listing.
  2. Confirm who to contact during the stay and how to reach them; check that the accommodation provides the safety and exit information required locally.
  3. Check the allowed occupancy and any house rules for noise, parking, garbage or recycling.
  4. Find the city’s complaint route before you need it. Toronto directs visitors and residents to 311 for non-emergency concerns such as an unregistered, unsafe or nuisance rental.

These are Toronto-specific visitor instructions and should not be assumed to be the exact process in another city.

What do the rules mean for neighbors and housing?

Local requirements can give neighbors clearer ways to report nuisance concerns and can make an operator responsible for guest conduct. Toronto identifies noise, waste and suspected rentals that are not principal residences as concerns residents can report; Nashville makes permit holders responsible for guest activity; and Alexandria requires a good-neighbor guide alongside local safety and nuisance compliance.

The official sources cited here describe rules and policy aims, not comparable causal estimates of how short-term rental regulation changes rents, long-term housing supply, visitor prices or homeowner earnings. Those effects should not be presented as settled based on these jurisdictional rules alone.
