Service Canada normally allocates it from your separation week at your normal weekly earnings, which can postpone the week in which EI becomes payable. You must report the payment and its terms.
A temporary federal measure changes that result for claims or allocations starting from March 30, 2025 through October 9, 2027: separation earnings are not deducted from EI benefits. New claims in that same window generally have the one-week waiting period waived. The payment itself does not decide whether you qualify; your separation reason, insurable hours and other claim conditions are assessed separately.

The regular rule treats severance paid because of a lay-off or separation as EI earnings. The Employment Insurance earnings chart lists severance under sections 35(2) and 36(9) of the EI Regulations. Service Canada generally allocates the payment beginning in the week you were laid off or separated, using your normal weekly earnings for that employment and taking other relevant earnings into account.

Allocation is not the same as saying that severance makes you permanently ineligible. It is an accounting step that determines when earnings are considered against a claim. Depending on your dates and amounts, the ordinary allocation can affect:
- the effective start of the claim;
- the week in which the waiting period is served;
- when EI payments begin;
- the amount payable in particular weeks; and
- the date your benefit period ends.
The exact result depends on your last day worked, separation date, normal weekly earnings, the amount and type of every separation payment, and whether the temporary measure applies.
Service Canada’s official guidance explains the general earnings and allocation rules in its Employment Insurance earnings chart and its page on the various types of earnings.

How ordinary severance allocation is calculated
1. Service Canada identifies what the payment really is
A cheque labelled “severance” is not the only fact considered. Service Canada looks at the payment’s amount and type, who paid it, the reason and contractual terms, and where the money came from and is going. This matters when a settlement combines several items, such as wages, vacation pay, pay in lieu of notice, a closure bonus and severance.
2. The payment is assigned to weeks
Under the ordinary method, allocation starts with the week of lay-off or separation. Service Canada uses your normal weekly earnings from the employment as the weekly basis. A payment large enough to cover several weeks can therefore be spread across several weeks rather than deducted all at once.
3. Other separation payments can change the span
Vacation pay, pay in lieu of notice and other amounts connected to the end of employment may also be earnings. Their amounts and terms are considered with severance when Service Canada determines the weeks covered. Do not assume that calling every amount “severance” produces one standard result.

4. The allocation is matched to your claim timeline
The allocated weeks are compared with the claim’s start, waiting-period rules and payable weeks. That comparison determines whether the first payment is delayed, whether a week is unpaid, or whether the allocation changes the end of the benefit period. A claimant cannot determine the first payable date from the severance amount alone.
The temporary measure that applies to current claims
For a claim or an allocation that starts between March 30, 2025 and October 9, 2027, separation earnings are not deducted from EI benefits. Employment and Social Development Canada (Service Canada) states:
“Under the temporary measure, if your claim or the allocation starts between March 30, 2025, and October 9, 2027, earnings from separation are not deducted from your benefits.”
The current notice lists these examples of separation earnings covered by the measure:
- vacation pay;
- pay in lieu of notice;
- severance pay;
- closure bonuses; and
- sick-leave credits.
This is a date-based exception to the ordinary deduction rule, not a permanent change to EI legislation. Check the current Temporary Employment Insurance measures notice when your claim is close to either boundary.
Waiting-period waiver
New EI claims starting from March 30, 2025 through October 9, 2027 generally have the one-week waiting period waived. The notice allows a claimant to serve the waiting period if doing so is advantageous because of a Supplemental Unemployment Benefit (SUB) plan top-up. A SUB plan can have its own conditions, so do not assume that choosing to serve or waive the week has the same financial result for every claimant.

What the temporary measure does not decide
The temporary rule addresses the treatment of separation earnings. It does not by itself establish that you meet the qualifying-hours requirement, that your interruption of earnings is valid, or that your separation was through no fault of your own. Those are separate eligibility questions.
Severance treatment and eligibility are separate decisions
Receiving severance does not automatically disqualify you from EI, and the absence of severance does not guarantee approval. Service Canada assesses the reason your employment ended, your insurable employment and hours, your availability and other claim requirements independently from how a payment is allocated.
There is also a separate temporary rule for the reason for separation. For claims starting from October 11, 2026 through October 9, 2027, the assessment uses only the most recent reason for separation. If the most recent job ended through no fault of the claimant, qualifying-period insurable employment and hours are used to establish the claim. This rule concerns the separation reason; it is distinct from the rule that stops deduction of severance and other separation earnings. The government describes both measures in its temporary-measures notice.

Claimants are responsible for reporting income, benefits and self-employment activity. Report the payment even when you believe the temporary measure means it will not be deducted. Service Canada must first determine what the payment is and whether the date window applies.
For an individual assessment, have these details available:
- your last day worked and the legal separation date;
- the date your EI claim starts, or the date an allocation would start;
- the amount, type and payment date for each amount;
- your normal weekly earnings before separation;
- any vacation pay, pay in lieu of notice, closure bonus, sick-leave credit or other separation payment;
- the employer letter, settlement agreement or other document describing the reason, terms and source of the payment; and
- whether a SUB plan or another employer benefit is involved.
Service Canada’s guidance distinguishes when earnings are considered paid and when they are payable. Earnings are considered paid when received and accepted, or when they are expected shortly. They are payable when the payer is required to pay them and you can legally demand immediate payment. Those timing rules can matter when a settlement is signed in one week but money is received in another.

Worked example of the ordinary rule
Service Canada’s published illustration uses employment ending on October 10, 2025, normal weekly salary of $800, $800 in vacation pay and $2,400 in severance. Under the ordinary allocation shown in that example, wages and separation payments are apportioned across weeks beginning with the separation week. The illustration shows a waiting-period week of November 9–15, 2025, with benefits payable beginning November 16–22, 2025.
This example demonstrates the mechanics of allocating earnings across weeks; it is not a prediction for a claim covered by the temporary measure. A claim or allocation beginning within the March 30, 2025–October 9, 2027 window may have separation earnings excluded from the deduction calculation and may have its waiting period waived. Read the full example and definitions on Service Canada’s earnings page.
How much EI could be payable after the severance issue is resolved?
The severance calculation does not set your weekly EI rate. For regular benefits, most recipients receive 55% of average insurable weekly earnings, subject to the annual maximum. For 2026, Employment and Social Development Canada lists maximum yearly insurable earnings of $68,900 and a maximum regular EI benefit of $729 per week.
Those are benefit-rate limits, not severance amounts and not a promise that an individual claim will receive $729. Your actual rate depends on insurable earnings, the applicable divisor and your claim record. The official formula and current maximums are on EI regular benefits: How much could you receive.
Compare the main outcomes by date and question
| Question | Ordinary rule | Temporary window |
|---|---|---|
| Are severance and other separation earnings deducted? | Usually yes; allocated from the separation week using normal weekly earnings. | No deduction when the claim or allocation starts March 30, 2025–October 9, 2027. |
| Is the one-week waiting period served? | Ordinary waiting-period rules apply. | Generally waived for new claims starting March 30, 2025–October 9, 2027; serving it can be advantageous under a SUB top-up. |
| Does the payment determine eligibility? | No. Separation reason and other requirements are assessed separately. | No. The earnings exception does not replace the eligibility test. |
| Which separation reason is reviewed? | The applicable EI assessment rules determine this. | For claims starting October 11, 2026–October 9, 2027, only the most recent separation reason is reviewed. |
The date in the first column is the claim or allocation start date, not necessarily the date the cheque was deposited. Keep the two timelines distinct when you compare your situation with the table.

A practical checklist before and after you apply
- Apply promptly. Record your last day worked and separation date. Do not wait for a severance cheque before starting an EI claim if you are otherwise unemployed.
- Gather documents. Keep the record of employment, termination letter, settlement or release, pay statements and any SUB-plan information.
- Separate each payment type. List wages, vacation pay, pay in lieu of notice, severance, bonuses and credits individually with their amounts and dates.
- Report everything requested. Use the reporting method Service Canada provides and keep confirmation of what you submitted.
- Check the date window. Determine whether the claim or allocation starts inside March 30, 2025–October 9, 2027. If it does, ask how the temporary measure is being applied.
- Ask about the waiting period. If an employer SUB plan is involved, compare the result of serving the week with waiving it.
- Review the decision. If Service Canada’s allocation appears inconsistent with your documents, request an explanation and follow the reconsideration instructions on the decision notice.
Common mistakes that cause confusion
Assuming every severance cheque delays EI
That can describe the ordinary rule, but it is incomplete for claims or allocations inside the temporary window. Check the dates before forecasting a delay.

Assuming the temporary measure means no reporting is required
The exception changes deduction treatment; it does not remove the obligation to disclose income and payment terms.
Using the cheque date as the only relevant date
Allocation can begin with the separation week, and Service Canada distinguishes paid and payable earnings. The claim or allocation start date controls whether the temporary exception is available.
Treating severance as an eligibility decision
A payment and the reason for separation are different issues. A claimant can have severance and still qualify, or have no severance and fail another qualifying condition.
Applying the 2026 maximum to every claimant
$729 is the 2026 maximum regular weekly benefit, based on the stated annual insurable-earnings ceiling. It is not an automatic payment.
Where to verify your personal result
Start with the official earnings chart for the payment category, then read the detailed earnings and allocation guidance. Check the temporary-measures page for the current end date and exceptions. Use the regular-benefit amount page for the rate formula and annual maximums.
For a decision on your claim, Service Canada needs the facts in your documents: separation date and reason, claim or allocation start date, payment type and terms, normal weekly earnings and any related benefits. General examples cannot replace that individual assessment, especially when a date falls near the temporary measure’s boundaries.
