How Political Campaigns Can Use AI Without Exposing Donor or Voter Data

Political campaigns can use AI with less risk by keeping identifiable donor and voter records out of unapproved tools, using public or fictional examples for routine tasks, and checking a tool’s current data-handling terms before sensitive use. Treat AI as a workflow that needs controls—not as a secure place for campaign records by default.

How can political campaigns use AI without exposing donor or voter data?

Start by deciding what information a task actually needs. A public speech draft may need no donor or voter details; an internal analysis may need only aggregated figures or a carefully de-identified excerpt. Keep identifiable records in campaign systems with limited access unless the campaign has specifically reviewed and approved the AI tool and the intended use.

Before staff submit campaign information, confirm the tool’s current terms and settings for retention, model-training use, access, deletion, subcontractors, incident response, and account administration. No AI provider’s current controls or contract terms are established by the sources cited here, so do not infer that a product can safely handle identifiable records from its name or general privacy claims alone.

Which campaign data needs the most care?

“Donor data” can mean information disclosed in federal reports or a campaign’s own records; those are not interchangeable. Voter files and credentials raise different questions again. The Federal Election Commission’s guidance addresses particular federal contributor disclosures and uses, not every campaign dataset or every AI service.

Data type What the cited guidance establishes Practical approach
Public campaign material The sources do not establish a special restriction on ordinary public campaign copy. Use public material or fictional examples for routine drafting when they are sufficient; still review the output before use.
Contributor details disclosed in federal reports Federal committees report a contributor’s name, address, occupation, and employer for an individual contribution above the applicable itemization threshold. The FEC says reports are made public within 48 hours of receipt. Its guidance limits certain uses of information taken from those reports. FEC guidance Do not assume that public availability makes the information unrestricted input for AI or fundraising.
Campaign’s own donor CRM and fundraising records The FEC guidance distinguishes information taken from its reports from a committee’s own contributor list; it says the restriction does not bar a committee from compiling and distributing its own list. That is not a complete privacy rule for every campaign-held record or AI use. FEC guidance Keep records in access-controlled campaign systems and obtain jurisdiction-specific legal and security review before any AI use.
Voter-level records The cited FEC contributor guidance does not establish the rules for voter files. The EAC warns that AI can accelerate phishing and impersonation and that generated voter information can be inaccurate. EAC guidance Avoid uploading identifiable voter records to an unapproved service; verify voter-facing details with the relevant election office.
Credentials, financial records, and internal files The EAC identifies AI-assisted phishing and impersonation as risks; the cited federal sources do not certify a tool for processing these records. EAC guidance Do not include passwords, access tokens, or sensitive files in prompts. Verify unusual requests through a separate, known channel.

What the federal rules say—and do not say

FEC contributor information

In its 2018 guidance, the FEC says federal committees must report identifying details for individual contributions above the applicable threshold: more than $200 per election cycle, or per calendar year for PACs and party committees. It says information about individual contributors taken from FEC reports may not be sold or used to solicit contributions—including political or charitable contributions—or for commercial purposes. The guidance gives examples and distinguishes report-derived information from a committee’s own list; it is not a blanket statement that all donor information is public or freely reusable. Read the FEC guidance.

The FEC also cautions that its explanatory page does not replace the law. Its page concerns federal disclosure and specified list-use questions; it does not settle every rule governing state or local campaigns, voter data, campaign-held records, or vendor relationships. Get legal review for the campaign’s jurisdiction and intended use.

AI-assisted campaign media

In September 2024, the FEC said the existing federal ban on fraudulent misrepresentation applies irrespective of technology, including AI-assisted media, and that applications are considered case by case. The Commission summarized its position: “The statute, and the Commission’s implementing regulation, is technology neutral.” This is about fraudulent misrepresentation in campaign activity, not a comprehensive federal privacy regulation for AI. A cautious AI workflow for campaign teams

  1. Classify the input. Identify whether the task involves public copy, identifiable donor or voter records, credentials, financial records, or internal strategy. If it is sensitive, do not proceed on convenience alone.
  2. Reduce the information. Try public sources, fictional examples, aggregated figures, or an excerpt with identifying details removed. Redaction can lower exposure but does not guarantee anonymity: a distinctive combination of facts may still identify someone.
  3. Approve the specific tool and use. Review current product settings and contractual terms for retention, model improvement or training use, access controls, deletion, subcontractors, incident response, and account administration. Record which staff and workflows are approved.
  4. Restrict access and assign accountability. Give access to campaign files and AI-enabled workflows only to staff who need it. Assign a human reviewer to sensitive outputs and important external communications.
  5. Verify unusual requests outside the message thread. The EAC warns that AI can speed up phishing and impersonation. Confirm requests for credentials, donor lists, or urgent transfers using a known phone number or another established channel—not contact details supplied in the suspicious message. EAC guidance
  6. Check voter-facing facts against official sources. The EAC warns that AI-generated election information may sound plausible while being inaccurate, including details about voting dates, hours, and locations. Confirm those details with the relevant election office before publishing or sending them. EAC guidance
  7. Review political media for misleading attribution. Have counsel assess content that could falsely appear to speak or act for another candidate or party, or falsely claim authority in a contribution request, in light of the FEC’s technology-neutral fraudulent-misrepresentation rule.
  8. Keep recoverable copies. CISA’s election-security toolkit lists secure offline backups as a resilience measure. Consult the current toolkit and apply the campaign’s own backup and restoration controls. CISA election-security toolkit

Can campaigns put donor lists into ChatGPT?

There is no blanket yes based on the cited rules. The answer depends on what the list contains, how it was obtained, the purpose of the use, the campaign’s jurisdiction, and the specific service’s current terms and controls. In particular, the FEC’s restrictions on information taken from its reports should not be confused with its treatment of a committee’s own list—or treated as permission to upload that list to an AI provider. Until legal and security reviewers approve a specific tool and use, keep identifiable donor records out of prompts.
