Two GST authorities can examine related facts, but they cannot ordinarily start duplicate statutory proceedings for the same tax liability or alleged offence, based on the same facts, while seeking the same demand or relief. Section 6(2)(b) of the Central Goods and Services Tax Act, 2017 (CGST Act), and corresponding State and Union Territory provisions, are the starting point. The Supreme Court’s decision in M/s Armour Security (India) Ltd. v. Commissioner, CGST, Delhi East Commissionerate & Anr., 2025 INSC 982, decided on 14 August 2025, explains how to test whether two matters truly concern the “same subject matter.”
What section 6(2)(b) is designed to prevent
GST administration is built around cross-empowerment. Officers operating under the CGST Act may exercise powers in areas that also involve State GST or Union Territory GST administration, and the corresponding State and Union Territory laws contain related coordination rules. That structure helps authorities investigate and assess tax, but it also creates a risk: two officers may act on the same underlying transaction and seek the same tax or relief.

Section 6(2)(b) addresses that risk. In substance, it restricts a proper officer under the CGST Act from initiating proceedings on a subject matter where a proper officer under a State GST or Union Territory GST Act has already initiated proceedings on that same subject matter. The protection is about overlapping statutory proceedings, not about giving a taxpayer immunity from every later question concerning a transaction.

The corresponding provision in the relevant State or Union Territory enactment must also be checked. Wording, amendments and commencement dates can differ, so a conclusion should be tied to the law applicable to the taxpayer, authority and period involved.

The Supreme Court’s two-part test in Armour Security
In Armour Security, the Supreme Court of India set out a practical boundary for “same subject matter.” Justice J.B. Pardiwala wrote:
“The twofold test for determining whether a subject matter is ‘same’ entails, first, determining if an authority has already proceeded on an identical liability of tax or alleged offence by the assessee on the same facts, and secondly, if the demand or relief sought is identical.”
Both parts matter. A shared taxpayer, product, customer or broad tax question is not enough by itself. The documents must be compared to determine what liability is alleged, which facts support it, and what the authority actually wants the taxpayer to pay or do.
First part: identical liability or offence on the same facts
Start with the legal and factual foundation of each matter. Ask whether both authorities allege the same taxable conduct or the same offence, relying on the same invoices, returns, contracts, movement of goods, period and other evidence. A common transaction may still support different liabilities. For example, one proceeding might allege an incorrect classification, while another concerns a separate failure to account for a supply or a distinct penalty-triggering act.

Tax period is especially important. Proceedings covering April 2021 to March 2022 are not automatically identical to proceedings covering a later financial year, even if the business model and customers are unchanged. Likewise, two notices may refer to the same customer but rely on different supplies or different factual allegations.
Second part: identical demand or relief
Compare the outcome sought, not merely the wording of the allegations. Are both authorities demanding the same tax amount for the same period? Are both seeking the same interest, penalty, reversal, confiscation-related relief or other statutory consequence? If one matter seeks tax and another seeks a legally distinct consequence based on different conduct, the overlap may not satisfy the Court’s test.
The comparison should use the operative portions of the documents: the proposed computation, tax head, period, statutory sections, penalty clauses and directions. A notice that uses similar language but calculates a different liability is not automatically a duplicate. Conversely, a change in terminology does not cure a matter that in substance seeks the same amount on the same factual case.

| What the two communications share | What differs | How the section 6(2)(b) issue may arise |
|---|---|---|
| Same taxpayer and similar business activity | Different tax periods or separate supplies | Similarity alone does not establish the same subject matter. |
| Same transaction or invoice group | Different alleged liabilities or offences | Analyse whether the legal liability and factual foundation are truly identical. |
| Same alleged conduct and facts | One document is only a summons or preliminary inquiry | An inquiry or summons is not, by itself, a second barred proceeding. |
| Same liability, same facts and same period | Both seek the same tax or relief | This is the strongest case for raising a section 6(2)(b) objection. |
| Same factual background | One authority seeks a distinct statutory consequence | Determine whether the relief is genuinely different or merely relabelled. |
This table is an application of the Supreme Court’s reasoning, not a substitute for reading the notices and the applicable enactments.
Summonses, inquiries and proceedings are different stages
A summons asking for books, statements or attendance does not automatically prove that the issuing authority has initiated a second statutory proceeding barred by section 6(2)(b). The Supreme Court distinguished an inquiry from proceedings that determine or pursue a specific tax liability or alleged offence.
That distinction does not make a summons optional. A recipient should comply with a lawful communication, observe the attendance or document deadline, and preserve evidence of what was supplied. If another authority has already opened a matter on the same facts, the recipient can state that fact and request that the authorities coordinate or clarify the scope. The overlap objection should be raised through the appropriate authority or procedural route, supported by the actual documents.

How to compare two GST communications step by step
- Preserve the complete record. Save the original email or portal download, annexures, computation sheets, summons, show-cause notice, order, acknowledgment and proof of service. Record the issue date and response deadline for each document.
- Identify the issuing authority and enactment. Note the commissionerate, proper officer, Central or State/Union Territory designation, and whether the document cites the CGST Act, a State/UT GST Act, the Integrated GST Act or another provision.
- Classify the procedural stage. Mark each communication as an inquiry, summons, audit communication, show-cause notice, adjudication order, appeal-related step or recovery action. The label used by the authority is useful, but the contents and statutory power matter more.
- Extract the alleged conduct and facts. List the invoices, returns, e-way bills, contracts, goods or services, customers, dates and evidence relied upon. Use the same level of detail for both matters.
- Match the liability or alleged offence. Compare the tax head, classification, exemption, input-tax-credit issue, suppression or other alleged breach. Ask whether each authority is pursuing the identical liability on the same facts.
- Match the requested demand or relief. Compare tax, interest, penalty and any other direction, including the period and calculation. Note whether the amounts are identical, partially overlapping or separate.
- Check the response route. Follow the portal, address and deadline specified in each communication. State the overlap objection clearly, attach the comparison and ask for a written decision or clarification rather than silently withholding a response.
The first six steps operationalise the Supreme Court’s twofold test. The final step is case management: deadlines and procedural posture can affect the practical remedy even where the legal objection appears strong.

Respond before the deadline
A duplicate-proceeding objection is not a substitute for a timely reply. Submit the response in the manner required by the notice, identify the earlier proceeding, and explain why the two matters concern the same liability, facts and relief. If additional time is needed to obtain records or instructions, request it in writing instead of allowing the deadline to expire.
Build a side-by-side schedule
Create a short schedule with one row for each issue: authority, enactment, period, transaction or document set, legal provision, tax computation, interest, penalty and relief. Attach the first notice and proof of its initiation, not just a description of it. This makes it possible for the second officer to test the objection against the actual record.

Ask for scope clarification where the second communication is an inquiry
If the later document is a summons or information request, explain that a proceeding concerning the same matter is already pending and ask what distinct issue the inquiry addresses. Continue to provide information that is properly requested, while reserving the objection that a second statutory proceeding cannot duplicate the first. Keep copies of statements and documents supplied to avoid inconsistent positions.
Best Value
Use the correct procedural remedy
Depending on the stage, the practical route may include a written objection to the proper officer, a reply to a show-cause notice, submissions in adjudication, an appeal from an order, or a court remedy where ordinary procedures are inadequate. The Supreme Court’s interpretation does not automatically cancel a notice or guarantee that the same amount will never be pursued twice. A lawyer or tax professional should map the objection to the document’s statutory stage and the applicable State or Union Territory law.
Worked examples
Example 1: the strongest overlap
A State GST officer issues a notice alleging that a company wrongly treated a specified set of invoices as exempt supplies for one tax period and demands tax, interest and penalty. A Central officer later issues a notice citing the same invoices, same period, same exemption issue and the same computed tax and relief. The taxpayer can point to identical facts, identical liability and identical relief, then request that the later proceeding be dropped or otherwise dealt with consistently under section 6(2)(b) and the applicable corresponding law.
Example 2: same business, different liability
A State officer examines a company’s classification of services during one year. A Central officer later investigates a separate input-tax-credit claim for another year, relying on different invoices and records. The company and industry are the same, but the alleged liability, facts and period differ. The notices may be related in a broad sense without being the same subject matter under the Supreme Court’s test.
Example 3: inquiry followed by a notice
A Central summons requests contracts and ledgers after a State audit has begun. The summons itself does not establish a barred second proceeding. If the Central authority later issues a show-cause notice demanding the same tax for the same transactions and period, the taxpayer’s comparison changes: the later notice, rather than the initial summons, is the document to test against the earlier proceeding.
Common mistakes that weaken an overlap objection
- Relying on the taxpayer’s identity alone: the same registration number does not prove identical liability.
- Calling every communication a proceeding: inquiries and summonses must be distinguished from notices and adjudication.
- Ignoring the relief sought: similar allegations may lead to different statutory demands.
- Skipping the tax period: different periods can create separate liabilities even under an unchanged business model.
- Failing to answer: an objection should be raised while complying with applicable deadlines.
- Assuming the statute operates automatically: the record must establish the factual and legal match, and the proper authority or court may need to decide the issue.
Limits, jurisdiction and changing law
Section 6(2)(b) operates within the CGST Act’s cross-empowerment framework and alongside corresponding State and Union Territory provisions. The precise text, delegated authority, amendments and effective dates should be verified for the relevant jurisdiction and tax period. The Supreme Court’s controlling decision for the interpretation discussed here is Armour Security, 2025 INSC 982, decided on 14 August 2025; later legislation or judgments could alter the position.
There is no basis to describe every second investigation as unlawful or to promise that a taxpayer will never face two communications about connected transactions. The legally important question is narrower: has an authority already proceeded on an identical tax liability or alleged offence, on the same facts, while another authority seeks an identical demand or relief?
Bottom line for businesses receiving two demands
Do not decide that you are being taxed twice merely because two GST authorities have contacted you. Compare the authority, enactment, procedural stage, tax period, alleged conduct, legal liability, factual foundation and relief sought. If the documents match on the Supreme Court’s two elements, raise section 6(2)(b) promptly and support the objection with the complete record. If they do not, comply with each distinct process while keeping the issues and payments separately documented.
