The U.S. Nuclear Regulatory Commission (NRC) licenses commercial nuclear reactors through a documented safety review, an environmental review and a legally required hearing process. An applicant must provide technical, site, financial, antitrust, security, emergency-planning and operating information. The project then follows either the two-step process in 10 CFR Part 50 or the combined-license process in 10 CFR Part 52.
A Part 50 project obtains a construction permit and later a separate operating license. A Part 52 combined license (COL) authorizes construction and provides conditional authority to operate, but the plant cannot load fuel or operate merely because the COL was issued: the licensee must complete the required inspections, tests, analyses and acceptance criteria (ITAAC), and the Commission must make the required finding under 10 CFR 52.103(g).

What the NRC is actually licensing
The NRC’s decision is not based on a single reactor drawing or a short application form. It evaluates whether the proposed facility can be built and operated without unreasonable risk to public health and safety and whether its environmental effects comply with federal requirements. The applicant’s record normally covers several connected subjects:

- Environmental effects: impacts on land, waterways, wildlife and other resources required by federal environmental law.
- Security and emergency planning: physical protection, cyber and operational security measures, emergency plans and arrangements with response organizations.
- Operations: staffing, training, procedures, technical specifications, fire protection and programs for maintaining safety during the plant’s life.
- Financial and antitrust information: evidence relevant to the applicant’s ability to complete and operate the facility, plus antitrust material required by the Atomic Energy Act.
The NRC staff uses standard review plans and checks whether the applicant’s assumptions are technically correct and whether the proposed activities would adversely affect the environment. Reviews can involve coordination with the Environmental Protection Agency, U.S. Fish and Wildlife Service and National Oceanic and Atmospheric Administration, among other agencies.

Licensing is therefore a record-building process. The license contains legally enforceable conditions, while the safety analysis, technical specifications, environmental documents and hearing record explain why those conditions are acceptable.
The two licensing routes
Part 50: construction permit, then operating license
Part 50 is the traditional two-step route. First, the applicant seeks a construction permit. Its preliminary safety analysis report (PSAR) describes the proposed design and safety features at a preliminary level. The environmental report evaluates construction and operation effects, and the application includes the required financial and antitrust information.
After the construction permit is issued, the company builds the plant while completing and refining its design. Before operation, it submits an operating-license application supported by a final safety analysis report (FSAR). That package includes final technical specifications, fire-protection and security programs, emergency-preparedness plans and other operational information. The NRC then determines whether the completed facility and proposed operating programs satisfy the license requirements.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsThe practical advantage is design flexibility. A change that was not resolved at the construction-permit stage can be developed and submitted for NRC review with the operating-license application. The tradeoff is that the project faces two major licensing decisions, and the operating license is not available until the later review is complete.

Part 52: combined license
Part 52 offers a combined license that joins construction authorization with conditional operating authority. The applicant generally provides the required facility information earlier and identifies the ITAAC that must be satisfied before operation. The process can use an early site permit and a certified standard plant design, allowing approved site or design work to serve as a foundation for a later COL application.
The benefit is greater regulatory resolution before major construction. The cost is earlier completeness: design information incorporated into the COL is harder to change during construction unless the change is allowed by the regulations and reviewed by the NRC. A COL authorizes construction much like a Part 50 construction permit, but it does not remove the final operating gate created by ITAAC and the Commission’s 10 CFR 52.103(g) finding. The Part 52 alternative licensing process was established in 1989.
| Issue | Part 50 | Part 52 |
|---|---|---|
| Construction and operation authority | Separate construction permit followed by a separate operating license. | One combined license provides construction authorization and conditional authority to operate. |
| When design information becomes binding | More design can remain preliminary during construction and be finalized for the operating-license application. | More facility and design information is established up front in the COL and related approvals. |
| Design-change flexibility | Generally greater flexibility to submit design changes with the later operating-license review. | Less flexibility for changes not already approved or addressed by the COL framework. |
| Final operating gate | The NRC must issue the operating license after reviewing the final facility and operating programs. | ITAAC must be completed and the Commission must make the 10 CFR 52.103(g) finding before operation. |
| Early approvals | Does not use the Part 52 early-site-permit and certified-design framework as its defining route. | Can rely on early site permits and certified standard plant designs. |
| Public-hearing opportunities | Hearings and opportunities to challenge the construction-permit and operating-license decisions occur at the applicable stages. | Hearing opportunities include the COL proceeding and a later, narrowly limited ITAAC hearing window. |
How an NRC licensing case proceeds
1. The applicant prepares the technical and legal record
The company assembles the safety analysis, environmental report, site characterization, security and emergency plans, financial and antitrust information and the operational programs required for the chosen route. Under Part 50, the first submission is centered on the PSAR and construction permit. Under Part 52, the application is designed to resolve more of the facility and its acceptance criteria before construction proceeds.
2. The NRC dockets and reviews the application
NRC staff review the submission against applicable regulations and standard review plans. Questions, requests for additional information and revisions can expand the record. Technical reviewers examine accident sequences, safety systems, site hazards and operating programs; environmental reviewers examine resource impacts and alternatives. The staff’s review does not replace the applicant’s responsibility to provide a complete and supportable safety case.

3. Environmental review runs alongside safety review
The environmental report and NRC’s environmental review address effects on land, waterways, wildlife and other legally protected resources. The NRC may coordinate with other federal agencies whose expertise covers air, water, species or coastal issues. Environmental findings can affect license conditions and the issues available for public litigation, even though they are not part of the later ITAAC hearing described below.
4. The adjudicatory process provides a hearing
The Atomic Energy Act requires a hearing for an application for a combined construction permit and operating license. The hearing process is conducted under NRC rules and can include an evidentiary proceeding before the agency’s licensing board. Affected people and organizations may raise health and safety issues and, where the statutory requirements are met, antitrust issues. A participant must satisfy standing requirements and submit a contention that is specific, supported and within the scope of the proceeding.
Public notices, application documents, environmental material and hearing procedures are distributed through NRC channels and the Federal Register. A person does not become a party simply by disagreeing with nuclear power; the contention must identify a genuine material dispute with the application or the agency’s review.

What changes between the Part 50 steps
Construction-permit stage
- File the construction-permit application with the PSAR, environmental report and required financial and antitrust information.
- Respond to NRC technical and environmental questions and participate in the hearing process applicable to the permit.
- Receive the construction permit only after the NRC’s findings and any required hearing process support issuance.
Operating-license stage
- Complete construction while resolving the final design and preparing the FSAR.
- Submit the operating-license application with final technical specifications, fire-protection, security and emergency-preparedness plans.
- Support NRC inspections and reviews of the as-built facility and operating programs.
- Address any hearing issues and satisfy the conditions required before the operating license can be issued.
Because the operating decision is separate, a Part 50 permit is not permission to run the reactor. It authorizes construction under its conditions; operation requires the later operating license.

How a Part 52 project reaches operation
ITAAC are the construction-to-operation checklist
ITAAC stands for inspections, tests, analyses and acceptance criteria. They turn important design commitments into verifiable conditions. A typical set includes criteria showing that safety-related structures and systems were installed correctly, tested as required and perform within specified limits. Most ITAAC generally come from the reactor technology’s certified design; the remainder are site-specific.
Completion notifications and NRC verification
During construction, the licensee performs the required inspections, tests and analyses, keeps the supporting records and submits completion notifications. NRC inspectors review implementation and can examine whether the evidence supports each acceptance criterion. If work does not meet a criterion, the licensee must correct the condition or follow the applicable regulatory process rather than treating the COL as automatic permission to operate.
The 10 CFR 52.103(g) finding
The Commission must find that the ITAAC acceptance criteria have been met before the facility may begin operation. This finding is the final Part 52 operating gate. The COL’s operating authority is therefore conditional until the finding is made; construction authorization and operating permission are not interchangeable.

What the public can challenge
Issues in the main licensing proceeding
In the main proceeding, an eligible participant can challenge material health, safety and, in some circumstances, antitrust issues. Environmental issues can also be litigated when they fall within the proceeding’s rules and the participant supplies a valid contention. Challenges must be timely and specific; broad objections, unsupported assertions and issues outside the agency’s authority can be rejected.
Best Value
The special ITAAC hearing
For a planned first fuel load, the NRC publishes a Notice of Intended Operation 210 to 285 days before the scheduled loading date. Members of the public then have 60 days after publication to request an ITAAC hearing. A requester must demonstrate standing and present an admissible contention.
That hearing is deliberately narrow. It addresses whether the acceptance criteria have been or will be met. Environmental contentions are excluded from the ITAAC proceeding, so a person seeking to litigate environmental effects must use the earlier licensing or environmental-review opportunities rather than wait for this final checkpoint.
Practical preparation for a contention
- Identify the exact license condition, ITAAC item, safety analysis or environmental finding at issue.
- Explain the factual or technical dispute instead of stating only that the project is unsafe.
- Provide supporting facts or expert information required by NRC rules.
- Show how the issue could change a finding, acceptance criterion or license condition.
- File within the notice’s deadline and establish a concrete injury for standing.
Can a company operate as soon as it receives a COL?
No. A COL permits construction and sets the framework for conditional operation, but the licensee must first complete the ITAAC, provide the required completion notifications, support NRC verification and obtain the Commission’s 10 CFR 52.103(g) finding. Fuel loading and operation cannot begin merely because the COL document has been issued.
How long does a combined license last?
The NRC states that a COL is valid for 40 years beginning on the date of the Commission’s 10 CFR 52.103(g) finding that the acceptance criteria are met. The NRC also states that the COL can be renewed for an additional 20 years. Those periods concern the COL’s stated duration; they do not eliminate continuing compliance duties, inspections, reporting or enforcement throughout plant operation.
What this federal license does not replace
NRC approval is the federal nuclear license, not a universal permit for every activity associated with a project. Construction may also require state, local or other federal approvals, and project schedules depend on the reactor technology, site, docket status, supply chain and later rule changes. A reader evaluating a specific project should check its current NRC docket and the applicable regulations rather than assume that the generic Part 50 or Part 52 sequence predicts its exact dates.
Choosing between the routes
The choice is principally a tradeoff between flexibility and early resolution. Part 50 leaves more room to finalize design details during construction but requires a second major licensing decision before operation. Part 52 resolves more design and acceptance information earlier and can use standardized designs and early site permits, but changes that were not approved in the COL framework can be harder to make. In either route, the NRC’s safety and environmental findings, legally required hearings and enforceable license conditions determine whether the project may proceed.
