How New York City Rent Increases Are Set for Rent-Stabilized Apartments

For NYC rent-stabilized apartment renewals beginning October 1, 2026 through September 30, 2027, the Rent Guidelines Board’s Order #58 sets a 0% adjustment for both one-year and two-year leases. The board adopts these annual guidelines after weighing housing-industry costs, financing, housing supply, cost-of-living measures, staff research and public input; it does not use a single published formula to convert those factors into a percentage.

Who sets the annual rent-stabilized increase?

The New York City Rent Guidelines Board (RGB) sets annual adjustments for covered rent-stabilized apartment renewal leases. Its guidelines do not determine increases for unregulated apartments or subsidized housing. The Mayor’s Office says the nine-member board sets adjustments for approximately one million stabilized apartments, lofts and single-room-occupancy units; the RGB describes approximately one million dwelling units as subject to the Rent Stabilization Law. The board considers economic evidence and public submissions at annual meetings and hearings, then adopts an order. No single factor is described as mechanically determining the result: the published material sets out considerations and a deliberative process, not a calculation formula.

What increase applies to a renewal lease in 2026–27?

Order #58, adopted June 25, 2026, applies to covered leases commencing October 1, 2026 through September 30, 2027. It sets these apartment renewal adjustments:

Lease term Order #58 adjustment Commencement window
One year 0% October 1, 2026–September 30, 2027
Two years 0% October 1, 2026–September 30, 2027

A term of up to and including one year counts as a one-year lease; a term longer than one year and up to and including two years counts as a two-year lease. A lease beginning before October 1, 2026 falls under the earlier order’s date window, not Order #58. Order #58 also sets 0% for its covered one- and two-year loft increase periods, which are distinct from ordinary apartment renewals. RGB apartment and loft orders

What does the board consider when choosing a guideline?

For Order #58, the explanatory statement describes statutory considerations that include the economic condition of the affected-area residential real-estate industry, current and projected living costs, and other available data. The housing-industry factors include:

  • Current and projected real-estate taxes, sewer rates and water rates.
  • Gross operating and maintenance costs, including insurance, government fees, fuel and labor.
  • Financing costs and the availability of financing.
  • Housing supply and vacancy rates.

RGB staff researches the stabilized residential market, including operating and maintenance costs, financing, housing supply and cost-of-living indices. The board also reviews staff reports and memoranda, government-agency and independent-organization material, and public testimony and written submissions. Order #58 explanatory statement

What public input looked like in 2026

The documented 2026 process included seven public meetings and four public hearings. The explanatory statement records approximately 473 written submissions from tenants and tenant groups, 104 from owners and owner groups, six from public officials, and 104 oral or video submissions. These are figures for that year’s process, not a standing annual quota or forecast.

How does this compare with the previous order?

The previous Apartment & Loft Order #57 covered leases beginning October 1, 2025 through September 30, 2026. Its apartment renewal adjustments were 3% for one year and 4.5% for two years. The applicable percentage depends on the lease commencement window, so a rate from one order should not be applied to a lease covered by another.

Order Lease commencement window One-year apartment renewal Two-year apartment renewal
#57 October 1, 2025–September 30, 2026 3% 4.5%
#58 October 1, 2026–September 30, 2027 0% 0%

What the annual percentage does—and does not—settle

The guideline covers ordinary renewal adjustments within its scope; it is not by itself a full calculation of an individual apartment’s lawful rent. Order #58 says adjustments already implemented and included in the September 30, 2026 base rent remain in the base used for future calculations. It also requires amounts charged and paid above the order’s authorized level to be credited against the next month’s rent. The order has separate provisions for lofts and for certain units entering stabilization after rent control, so those situations should not be treated as ordinary apartment renewals. Order #58 text

Preferential rent can also affect the calculation. NYC311 distinguishes preferential rent—the lower amount charged than the legal regulated rent—and says that for tenants paying preferential rent on or after June 14, 2019, guideline increases during the tenancy are based on the preferential rent; the legal regulated rent cannot be collected until the apartment is vacated. How to check whether your apartment is stabilized and review its rent

  1. Check your lease. Look for rent-stabilization language and renewal terms. If the status is unclear, request the apartment’s rent history from New York State Homes and Community Renewal (HCR).
  2. Compare the lease date with the order. Match the renewal’s commencement date and term to the applicable RGB order before relying on a percentage.
  3. Review the apartment’s records. Rent history and other lawful adjustments may affect the legal rent; the annual guideline alone cannot confirm an apartment-specific amount.
  4. Contact HCR about a possible overcharge. NYC tenant guidance directs tenants who believe they are being overcharged to file an HCR rent-overcharge complaint. NYC tenant resources

The RGB’s FAQ cautions that its information does not replace statutes, regulations, official orders, or administrative and court decisions. For an individual status or overcharge dispute, use HCR’s process or seek appropriate tenant counsel. RGB frequently asked questions
