An NBA team can re-sign a former player even when it is over the salary cap if an applicable exception allows the signing. The player does not get a special “returning player” contract: the key is whether he qualifies for Bird, Early Bird or Non-Bird rights, and what that exception permits under the rules for that season.
What happens when a player returns to his former team?
He signs as a free agent, just as he would with another team. His previous connection to the team may give it an exception to the salary cap, but returning alone does not grant a special contract category or guarantee a particular salary. The team first has to establish which rights the player has and then apply the relevant salary limit and contract conditions.

The NBA’s free-agency explanation describes the Bird, Early Bird and Non-Bird exceptions. The league’s 2024–25 CBA 101 provides additional context on the rules. The governing NBA–NBPA agreement is identified by the NBPA as effective July 1, 2023, and running through the 2029–30 season, with either side able to opt out after 2028–29.
Which exception can the team use?
The distinctions are based mainly on qualifying time with the team and the salary formula available for the first contract year. A trade or qualifying waiver assignment can affect whether service with the team counts toward eligibility, so a player’s movement history matters.

Bird rights
Bird eligibility generally requires that the player spent some or all of each of the three consecutive seasons before free agency with the team. Under the NBA’s explanation, a change of teams by trade or a qualifying waiver assignment during the first of those seasons can preserve eligibility. A qualifying team may offer a first-year salary up to the player maximum, but that ceiling is not a guarantee that the team will offer it or that every other contract rule is satisfied.
Early Bird rights
Early Bird generally applies after two consecutive seasons with the team, subject to the movement rule. Its first-year salary ceiling is the greater of 175% of the player’s previous salary or 105% of the prior season’s average player salary. An Early Bird contract must last at least two seasons; an option year does not count toward that minimum.

Non-Bird rights
If neither Bird category applies, the former team may still be able to re-sign the player using Non-Bird. The first-year ceiling is the greatest of 120% of his previous salary, 120% of the applicable minimum salary, or—if he is a restricted free agent—the qualifying offer. These are formula limits, not a prediction of what the team will offer.
How to assess a particular re-signing
- Check the player’s service history. Establish which seasons he spent with the team and whether a trade or qualifying waiver assignment affects the continuity rules.
- Identify his free-agent status. Determine whether the player is restricted or unrestricted; the qualifying-offer branch of the Non-Bird formula applies to a restricted free agent.
- Apply the eligible exception’s formula. Use the appropriate season-specific salary inputs and, for Early Bird, confirm the minimum contract length.
- Check the team’s situation and the season’s rules. The exception answers whether the team may exceed the cap for the signing; it does not establish that every offer fits the team’s other cap, tax or apron constraints.
Without player-specific service and contract details, and current team and season information, it is not possible to say which exception applies or how much a former team can offer in a particular case.

Why the season matters
Salary-cap figures and related thresholds change by season. The NBA announced a $164.961 million salary cap for 2026–27 in its 2026–27 cap announcement. That is the cap for that season only; it is not the tax level or either apron, and it should not be carried into another year. The CBA 101 PDF displays 2024–25 figures, which should not be treated as current 2026–27 amounts.
