Short answer: uploading a release through a distributor does not prove that you own every right in it, register the music with the U.S. Copyright Office, or collect every royalty. A release can contain separate composition and sound-recording rights, and a claim, rejection, or takedown means different things depending on who issued it and which use is challenged. This guide explains the U.S. systems and the practical steps an independent artist can take before and after distribution.
Start with the two copyrights in a single track
U.S. copyright law treats a song’s musical work and its sound recording as separate works. The musical work is the underlying composition: melody, lyrics, and other songwriting elements. The sound recording, often called the master, is a particular recorded performance of that composition. The distinction appears in the Copyright Act and in the U.S. Copyright Office’s Music Modernization Act materials (Title 17, 2024 edition; Music Modernization Act).

One person may own both layers, but that is not automatic. A songwriter can own the composition while a label owns the master. A producer may retain an interest in a beat. A collaborator may own a percentage of the songwriting. A sample, interpolation, remix, or guest performance can add more rights holders. Permission for one layer does not clear the other: a license to use a beat does not by itself prove that the underlying composition, samples, or recording are cleared for every service and monetization feature.

A distributor’s agreement normally authorizes delivery and related services under its contract. It is not a declaration that you own all included material, and it does not replace agreements with co-writers, producers, performers, sample owners, or a label. Read the grant of rights, territory, term, platforms, monetization options, fees, reporting, termination rules, and dispute process before accepting it.

Build a rights inventory before you submit
For every track, create a written record of who created, performed, and controls each element. This is practical evidence if a service asks you to verify rights; it is not a guarantee that a dispute will be decided in your favor.
Record the people and ownership shares
- List every songwriter and the agreed composition split.
- Identify the master owner or owners and any label or recording agreement.
- Record producers, featured artists, session performers, engineers, and remixers whose contracts affect use.
- Note whether a collaborator has approved the specific release, territory, and monetization plan.
Check every borrowed or licensed element
- Save the beat or instrumental license, including whether it is exclusive or non-exclusive.
- Document sample and stem licenses, receipts, clearance emails, and restrictions on commercial use.
- For an interpolation, clear the newly recorded performance of the existing composition as well as any recording rights that apply.
- For a cover, confirm the licenses required for the intended formats and territories; a cover license does not authorize use of the original master.
- Keep remix, collaboration, and work-for-hire agreements with the final audio files.
SoundCloud’s rights-verification guidance gives a useful example of the documentation a distributor may request: beat or sample licenses, receipts, and collaboration or remix agreements. Its official explanation is direct: “As a distributor, we can only approve releases when we can confirm you’re the rightsholder.” See SoundCloud’s rights-verification guidance. Policies vary by service, so keep the signed documents and the exact license terms rather than relying on a checkout-page summary.
Distribution, copyright registration, and royalty registration are separate
What a distributor does
A distributor delivers audio, metadata, artwork, and release instructions to services under its own operational rules. It may offer reporting, payment processing, fingerprinting, or platform monetization, but the exact package is contractual. Delivery is not copyright registration, and acceptance is not a ruling that no third party owns an interest.

What the U.S. Copyright Office does
Registration with the U.S. Copyright Office is a separate legal process. Uploading a track to a distributor or streaming service does not automatically register it. Registration can provide important litigation benefits, including potential eligibility for statutory damages and attorneys’ fees when the statutory requirements are met. The Copyright Office explains the process and benefits in its Music Modernization FAQ. Registration does not transfer ownership to the Office; your contracts and the facts of creation still determine who owns what.
What The MLC does
The Mechanical Licensing Collective (The MLC) administers the U.S. blanket license for qualifying digital uses of musical works and provides a way to claim works and associated royalties. Copyright Office guidance says that registering a work with the Office does not substitute for registering it with The MLC when you want to receive applicable MLC royalties. It also explains that Copyright Office registration is not required for eligibility for certain MLC statutory royalties. Read the Music Modernization Act overview and the FAQ for the current U.S. procedures.
Separate the royalty streams
“Streaming royalties” is not one universal pot. Start each payment question by identifying the right, the use, the territory, the paying service or collective, the registered claimant, and the statement where the use should appear.

| Right or use | Typical U.S. system | What to verify |
|---|---|---|
| Sound recording delivered to an interactive service | Distributor or label accounting under its contract | Which services are included, the contract’s deductions, reporting period, and payment threshold |
| Musical-work mechanical royalties from qualifying digital uses | The MLC’s blanket-license system | Song registration, writer and publisher information, ownership shares, and unmatched-use notices |
| Composition public-performance royalties | A performing rights organization (PRO) and its reciprocal arrangements | Writer and publisher affiliations, registrations, territory, and cue or usage reporting |
| Statutory royalties for certain noninteractive digital performances of sound recordings | SoundExchange under the statutory framework | Whether the use qualifies, who is registered as the featured artist or sound-recording rights owner, and the applicable payee shares |
| Video, downloads, physical products, or other uses | Service, license, distributor, label, or collective specified by that use | The license covering the format, territory, and master and composition rights |
The MLC’s musical-work mechanical royalties are not the same as distributor payments for streams, PRO public-performance royalties, or statutory sound-recording royalties. Eligibility and payment depend on the use and statutory definitions; do not apply a single rate or promise that one distributor collects every stream-related payment. The Copyright Office’s Music Modernization Act materials and Title 17 describe the separate systems.

Automated match or monetization claim
A platform may detect audio that resembles another reference file and place advertising, tracking, or a restriction while the matter is reviewed. A match is not automatically a court finding of infringement. It can be triggered by your own earlier delivery, a collaborator’s upload, a non-exclusive beat used by multiple artists, or an incorrect reference file. Check the matched segment, claimant name, territory, and policy outcome shown in the platform dashboard.

Distributor review or rejection
A distributor may pause or reject a release because it cannot verify ownership, the metadata conflicts with another submission, the license excludes a requested feature, or the content violates a platform rule. A rejection does not necessarily decide who owns the copyright. Ask which file, contributor, license term, or delivery option caused the decision and whether corrected documentation or a resubmission is allowed.
Takedown notice
A takedown removes or restricts access under the service’s notice-and-counter-notice process. Preserve the notice, the affected URLs or asset IDs, the stated deadline, and the exact response instructions. Do not assume that a distributor can reverse a takedown issued directly by a platform or rights owner.

For disputes over ownership interests in musical works licensed through the U.S. blanket-license system, the Copyright Office describes an MLC dispute-resolution committee and related procedures in its Music Modernization FAQ. That route is specific to the described MLC context; it is not a universal appeal path for every Content ID match, distributor complaint, takedown, or lawsuit.

How to respond to a claim or rejection
- Identify the issuer. Determine whether the notice came from a distributor, a streaming service, a video platform, a collective, a rights owner, or a court.
- Identify the work and use. Note the composition, master, video, sample, or other asset named; the matched time range; the territory; and whether the use is interactive streaming, noninteractive performance, video, download, or another format.
- Read the remedy and deadline. Follow the exact dashboard or notice procedure. Do not invent a response period from another service’s policy.
- Assemble proof. Gather signed contributor agreements, split sheets, beat or sample licenses, receipts, registration details, delivery records, and correspondence. Keep the original files and metadata.
- Check the license against the feature. A license may allow distribution but exclude Content ID, short-form video delivery, advertising, remixing, or particular territories. Non-exclusive material can be licensed to multiple artists.
- Choose the narrowest accurate response. Correct metadata when that is the issue; withdraw an unsupported monetization option when the license excludes it; dispute a match only when your documentation supports the required representation; and use a counter-notice only after understanding its legal assertions.
- Escalate when ownership is contested. For a threatened lawsuit, a demand involving substantial money, or an unresolved split or sample dispute, consult a qualified copyright attorney in the relevant jurisdiction.
Platform rules can be stricter than the underlying license
SoundCloud illustrates why a license and a platform feature must be analyzed separately. Its guidance says releases are approved when it can confirm that the uploader is the rightsholder or has proper permission. It also says non-exclusive beats, samples, or stems must be excluded from its YouTube Content ID and specified TikTok and Meta delivery choices. That is a SoundCloud-specific policy example, not a rule that applies to every distributor or platform. Read the current service terms and select only the monetization destinations your license permits.
Spotify’s U.S. music-video guidance is another platform-specific workflow. Spotify says it relies on songwriter and publisher ownership data registered with The MLC to determine eligibility, separately from label or distribution delivery, and describes registration and opt-in steps for each songwriter associated with the underlying work. This should not be generalized to every music-video service or territory; platform requirements can change. The guidance also lists Kosign, Sentric Music, Songtrust, and TuneCore Publishing Administration as sources of information about publishing administration and global royalty collection, without establishing a ranking or endorsement. See Spotify’s U.S. music-video publishing-rights guidance.
Compare service contracts by rights and workflow
If you are choosing among distributors or publishing administrators, compare the terms that affect control and claims rather than assuming that a familiar name handles everything.
- Rights granted and retained: Is the agreement a limited service authorization, an exclusive license, or something broader?
- Territory and term: Which countries and platforms are covered, and how quickly can you terminate or remove a release?
- Eligible features: Does the service deliver Content ID, short-form video, social monetization, lyrics, or music videos, and what materials are excluded?
- Non-exclusive content: How are shared beats, samples, stems, and public-domain or traditional elements treated?
- Money and reporting: What fees, deductions, payment thresholds, statements, and currencies apply, and which royalty streams are outside the service?
- Claims support: Who receives a notice, what evidence is accepted, and is there an appeal or resubmission path?
- Separate registrations: Must you register songs with The MLC, a PRO, SoundExchange, or another organization yourself?
No contract can eliminate every third-party claim. The practical advantage of a well-documented workflow is that you can identify the relevant right quickly and respond without making an inaccurate ownership statement.
U.S. rules do not automatically apply worldwide
The systems described here are primarily U.S.-specific. Copyright ownership, collective management, neighboring rights, mechanical licensing, moral rights, private-copying schemes, and takedown procedures differ by country. A release available globally may therefore require territory-specific licenses, registrations, tax forms, or collection arrangements. Confirm the law and service rules in each important market instead of treating U.S. registration or The MLC enrollment as worldwide clearance.
A release-day rights checklist
- Confirm the composition and master owners in writing.
- Store every beat, sample, stem, interpolation, cover, collaboration, and remix permission.
- Check whether each permission covers the intended territory, platforms, formats, and monetization tools.
- Register the musical work with The MLC when you are eligible to claim applicable U.S. blanket-license royalties; consider separate Copyright Office registration for its legal benefits.
- Register with the relevant PRO and sound-recording royalty system when their eligibility rules fit your work.
- Read the distributor’s rights grant, exclusions, fees, reporting, term, removal, and dispute provisions.
- Keep ISRC, UPC, writer, publisher, and split information consistent across submissions.
- Save notices and dashboard screenshots whenever a service flags, rejects, monetizes, or removes a release.
The core principle is simple: distribution is a delivery service, not a universal copyright clearance or registration system. Treat composition rights, master rights, and each royalty stream as separate records, then match any claim to the exact notice and procedure that governs it.
