Automated license plate reader (ALPR) records are kept for a period set by the applicable state law, local agency policy, and the type of record. An ordinary camera hit may follow a routine deletion schedule, while data preserved for a criminal investigation can remain available longer. Access rules are just as jurisdiction-specific: a statute may authorize named law-enforcement users without making the underlying plate history available to the public or to the vehicle owner.
North Carolina and Vermont show why a national number is misleading. North Carolina law addresses agency policies and special preservation requests; Vermont’s version of 23 V.S.A. § 1607 effective July 1, 2025 sets an 18-month limit for covered information and limits active-data accounts to designated personnel. Those examples are not a nationwide rule. To determine what happened to a particular plate record, identify the state, operating agency, data category and current policy first.

Why ALPR retention has no national timetable
An ALPR system photographs or otherwise captures a vehicle’s plate and usually associates the image with time, date and location. The resulting record can be treated as operational data, investigative evidence, a preservation hold or a public record, depending on the jurisdiction. Each category can have a different clock.
State legislatures have taken different approaches to retention, sharing, policy requirements and public-records treatment. The National Conference of State Legislatures’ overview of state ALPR statutes documents that variation, but it does not create a single nationwide schedule. A vendor’s default setting also cannot override a state requirement or an agency’s written policy.

For a useful answer, separate four questions:
- What law and agency policy govern the system?
- Is the record ordinary operational data, or was it preserved for a request or investigation?
- Who is allowed to query the system or receive a disclosure?
- Does a public-records law provide a route to obtain it, and does an exemption apply?
Without those facts, claims such as “police keep every plate for 30 days” or “anyone can request their own history” are unsupported.
Start with the jurisdiction and the operator
Identify the government entity
Find the department, sheriff’s office, transportation agency or other public body that owns or operates the cameras. A regional system may involve several agencies, and the agency that installed a camera may not be the custodian of the database. The custodian’s policy generally controls day-to-day deletion and access, subject to state law.
Check the current policy and statute
Some laws require a written ALPR policy before a system goes live. That policy may state the retention schedule, authorized users, audit requirements, sharing rules, permissible purposes and deletion method. Ask for the current policy rather than relying on an older manual or a vendor description. Confirm the statute’s effective date because legislatures can amend both retention and disclosure rules.

Pin down the data category
Ask whether you mean an unflagged plate capture, a hit associated with a hot-list alert, a record linked to an open case, a copy exported to an evidence system, or information covered by a preservation request. A general schedule may not apply once investigators place data on hold. Copies in case files, dispatch systems or backups can follow separate legal requirements.

Ordinary retention versus preserved evidence
Routine retention is the normal lifecycle for captured plate data. When that period ends, the agency should delete the record under its policy and any applicable statute. A preservation request changes the analysis: the custodian may have to keep specified data so it is not overwritten while a lawful investigation or proceeding is pursued.
Preservation does not automatically make data public or permit unlimited searching. It normally identifies the records to be held, the official requesting them and the legitimate purpose. A later request can sometimes extend the period, as North Carolina’s statute illustrates. Deletion duties can also reach derivative copies and backups, although the exact rule depends on the jurisdiction.
North Carolina: policy requirement and a one-year preservation clock
Written policy before operation
North Carolina General Statutes § 20-183.31 requires an agency using an ALPR system to adopt a written policy before the system is operational. The policy requirement means a requester should look for the agency’s document, not just the statute, to learn the ordinary schedule and authorized uses.

Data covered by a preservation request
North Carolina General Statutes § 20-183.32 provides a specific destruction rule for captured plate data subject to a preservation request. The data must be destroyed according to the custodian’s retention policy one year after the initial preservation request, unless another preservation request arrives within that year. A timely subsequent request resets the period from the later request.

This is not a statement that every North Carolina plate capture lasts one year. It is a statutory rule for data covered by the specified preservation process. Ordinary records may be deleted on a different schedule set by the custodian’s policy.
Who may receive preserved data
Disclosure under this provision is limited to a criminal justice officer at a state or local law-enforcement agency, or a similar federal official. The recipient must have a legitimate law-enforcement purpose and make a written request. The same statute states: “Captured plate data shall not be sold for any purpose.” A private person cannot rely on this provision as a general right to obtain a plate history.
Vermont: 18 months and designated account holders
Active-data access
The version of Vermont 23 V.S.A. § 1607 identified as effective July 1, 2025 limits active-data access within a department to designated personnel who have accounts for authorized queries. Possessing an account is therefore not equivalent to having unlimited access; the query must be authorized under the department’s rules and the law.

For covered information, Vermont sets a permitted retention period of 18 months. When that period expires, the Department of Public Safety and local agencies holding the information must destroy it and cause any copies or backups made from the original data to be destroyed. The statutory language expressly reaches those copies and backups, rather than allowing an agency to keep an unregulated duplicate indefinitely.

The Vermont period applies to the information and circumstances described by that statute. It should not be converted into a claim that every ALPR system in Vermont, or every state elsewhere, uses an 18-month schedule.
North Carolina and Vermont compared
| Question | North Carolina | Vermont (version effective July 1, 2025) |
|---|---|---|
| Policy requirement | Agencies using ALPR must adopt a written policy before the system is operational (G.S. 20-183.31). | The cited provision governs covered information and access; consult the department or local agency policy for operational details. |
| Retention figure established in the cited rule | One year after an initial preservation request, unless another request arrives within that period and resets the clock (G.S. 20-183.32). | 18 months for covered information. |
| What triggers the stated period | A preservation request, not necessarily every routine capture. | Expiry of the permitted period for covered information. |
| Who may query or receive data | Preserved-data disclosure to a criminal justice officer at a state or local law-enforcement agency, or similar federal official, for a legitimate purpose and on a written request. | Active-data accounts are limited within a department to designated personnel making authorized queries. |
| Copies and backups | The cited preservation provision sets the destruction point through the custodian’s retention policy; ask the custodian how exported copies are handled. | The department or local agency must destroy the information and cause copies or backups to be destroyed when the period expires. |
| Sale | Captured plate data may not be sold for any purpose. | Not stated in the cited provision; check current Vermont law and policy. |
Who can access ALPR records?
Authorized agency users
The first access layer is the system account. Agencies commonly restrict accounts to designated employees, require a stated law-enforcement or transportation purpose, and log searches. An employee’s ability to sign in does not prove that every search is permitted. Vermont’s cited rule makes this distinction explicit by limiting active-data accounts to designated personnel and authorized queries.
Other law-enforcement agencies
Interagency sharing depends on the governing statute, written agreements and the purpose of the request. North Carolina’s preservation provision names eligible criminal-justice recipients and requires a written request tied to a legitimate law-enforcement purpose. That is narrower than an unrestricted database available to every agency.

Investigators may disclose records through a process authorized by the jurisdiction, such as a written request under a statute, a subpoena or a court order. The correct process and any notice requirement vary. A person who needs a record for litigation should ask the custodian and, where appropriate, the court or attorney handling the case rather than assuming a public-records request is sufficient.
Best Value
The general public and the vehicle owner
Public access is a separate question from operational access. A state public-records law may define the record as public, exempt it because it reveals investigative methods or an active case, or require redaction of location and personal information. Some laws provide no special right for an owner to obtain every appearance of their plate. Do not promise that a person can retrieve their own history, and do not assume that every ALPR record is categorically exempt.
How to find out whether a particular record still exists
- Name the custodian. Record the agency, camera location, approximate date and time, plate state and plate number. If the system is regional, ask which entity maintains the database.
- Request the current ALPR policy. Look for retention periods, preservation procedures, authorized users, sharing partners, audit logs and deletion of exports or backups.
- Ask which category applies. State whether you seek a routine capture, an alert, an investigative copy or data held under a preservation request.
- Use the applicable public-records process. Send a focused request to the custodian and ask for the legal basis of any denial or redaction. A request for the policy may be easier to answer than a request for a plate-history search.
- Ask about preservation promptly. If the record may be evidence in a pending matter, ask the agency or your attorney what lawful preservation mechanism is available before the routine schedule expires.
- Verify the response date and version. Request the policy and statute version in force when the capture occurred and when your request was made; a later amendment may not govern an earlier record.
Common misunderstandings and how to avoid them
- “The vendor decides the retention period.” The operating agency and applicable law set the legal requirements; software settings should implement them.
- “A one-year rule means every plate is stored for a year.” In North Carolina, the cited one-year period follows an initial preservation request and can reset after another request.
- “An employee account means anyone can search.” Designated accounts and authorized purposes can limit queries, as Vermont’s rule demonstrates.
- “A public-records request always reveals the plate history.” Investigative, privacy and security exemptions may apply, and public-records treatment differs by state.
- “Deleting the primary database deletes everything.” Exported case files, copies and backups may have separate handling requirements; Vermont expressly addresses copies and backups.
What the available figures do—and do not—tell you
The documented figures are legal periods for particular circumstances: one year after an initial North Carolina preservation request, subject to a resetting request, and 18 months for covered Vermont information under the version effective July 1, 2025. They are not national averages, vendor benchmarks or proof of how long every agency keeps every capture. No nationwide retention statistic establishes a default for the United States.
For a reliable answer about one record, obtain the current statute and agency policy for that system, classify the record correctly, and ask the custodian how sharing, preservation, deletion and public disclosure apply. That approach avoids both false reassurance that a record is gone and false certainty that it remains accessible.
