Start by identifying the product, its intended use and the EU Member State where it will be sold. Then check the rules for that product and route to market, establish whether CE marking is legally required, and prepare the applicable conformity records, labels, instructions and traceability information before shipment. Food, feed, plants and food-contact articles may need a separate compliance workstream.
Start with the product and destination
EU requirements depend on what the item is, what it is intended to do and where it will be sold. Rules may govern design, materials or composition, manufacturing, performance, testing, packaging, labels and safety information. Product-specific EU legislation may apply alongside general product-safety rules; where EU-wide rules do not fully govern a subject, national requirements may also matter. The European Commission explains how to identify the applicable rules in its product-requirements guidance.

- The product’s exact identity, intended purpose and reasonably foreseeable use.
- Its materials, components and key technical characteristics.
- Whether it is sold to consumers or businesses, and whether it is offered online, in shops or both.
- The EU Member State or states where it will first be made available.
Use the European Commission’s general product-compliance guidance and Access2Markets to investigate the requirements for that product and destination. Access2Markets’ My Trade Assistant can help identify import procedures, but the relevant tariff classification and trade details must be established first; they cannot be inferred from a broad product description alone.

Check whether CE marking applies
CE marking is required only for products covered by EU harmonisation legislation that provides for it. It is not a general EU safety approval, a certificate that every product must obtain, or a mark of Indian or EU origin. The Commission says it is forbidden to affix CE marking to products outside the legislation that requires it. Check the product’s legal scope before commissioning an assessment or placing the mark, using the Commission’s CE-marking guidance.
Where CE legislation applies, the manufacturer—not a generic certificate provider—has responsibility for the applicable conformity-assessment process, technical documentation, EU declaration of conformity and correct affixing of the mark. Depending on the law and product, the route may involve harmonised standards and may require a notified body. Identify the specific legislation and assessment route first; do not buy or display a generic “CE certificate” as a substitute for the required legal steps.
If the product is not in a CE-marked category, that does not mean it is exempt from safety requirements. It means the applicable non-CE product rules must be identified instead.

Allocate EU-side responsibilities correctly
Being based in India does not remove a manufacturer’s obligations for products in scope of EU rules. The Commission’s manufacturer and importer guidance describes the responsibilities involved in placing products on the EU market. The exact tasks depend on the product legislation, but the roles are not interchangeable:
| Role | What to establish |
|---|---|
| Manufacturer in India | Identify the applicable rules and fulfil the manufacturer’s relevant assessment, documentation, declaration, marking, labelling, language and traceability duties. |
| EU importer | Verify that the manufacturer has fulfilled the applicable obligations before placing imported products on the market, and provide importer contact details where required. |
| Authorised representative | Confirm whether the relevant legislation permits or requires an appointment, and define the specific tasks delegated. It is not a generic substitute for the manufacturer. |
| EU responsible person under GPSR | For a non-EU manufacturer where the General Product Safety Regulation framework requires one, identify the EU-based responsible person and ensure the required role is covered. |
An authorised representative and a GPSR responsible person are distinct legal roles; an importer may also have separate obligations. The Commission’s 2025 guidance on the EU general product-safety legislative framework discusses GPSR duties, online offer information and the responsible-person requirement. Check the product’s scope, the applicable sector legislation and the date the product is placed on the market rather than assuming GPSR replaces sector-specific rules.
Prepare product information, labels and online offers
For the rules that apply to the product, determine which identification details, business contacts, instructions, warnings and markings must accompany it. General product-compliance requirements can call for information on the product itself, its packaging or accompanying documents, depending on the product and practical constraints. Keep the product, packaging, instructions and online listing consistent so that buyers and authorities can identify the item and understand relevant safety information.

Language is a destination decision, not a single EU-wide label choice. Safety information must be in a language consumers can understand, as determined by the Member State where the product is sold. If selling in multiple countries, check each country’s language requirements and prepare the appropriate versions. For online sales, check what safety and traceability information must appear in the offer as well as what must accompany the shipped product; the Commission’s GPSR business guidance addresses online offers.
For prepacked goods, check the applicable nominal-quantity declaration and retain evidence that the declared quantity is controlled. The ℮ mark is optional, not a universal requirement; using it brings quantity-control responsibilities. See the Commission’s e-mark guidance for prepackaged products.

Do not treat regulated agricultural or food-related products as ordinary consumer goods with an extra label. Depending on the commodity and origin, the EU may require authorization, an eligible or listed establishment, official certificates, traceability, border controls, pest or residue conditions, origin information, or category-specific marketing standards. The Commission’s food and feed import-controls Q&A and Access2Markets guidance on animal and plant products describe relevant controls; Access2Markets specifically identifies India-related fresh-produce requirements.

- Increased workplace safety – These SDS/MSDS stickers make it easy for employees to clearly see what chemicals or hazardous materials they are working with so that accidents can be prevented.
Food-contact articles also need their own check: establish which rules apply to the materials and intended contact, rather than assuming that the rules for the food itself settle the article’s compliance. For food, feed and plant shipments, verify the exact commodity conditions and documents before dispatch, because missing eligibility or certification can affect entry at the border.
The Commission’s EU-India agri-food factsheet states that products imported under the agreement still have to meet EU health and food-safety standards. Any tariff treatment does not waive those safety or labelling obligations.
Use a pre-shipment compliance workflow
- Define the product and route. Record identity, intended use, materials and components, customer type, sales channel and target Member States.
- Map the legal requirements. Use the Commission’s product-requirements guidance and Access2Markets to identify applicable EU legislation, national requirements and import procedures. Resolve product classification and destination details rather than guessing from a generic description.
- Make the CE decision. Confirm whether harmonisation legislation covers the product. If it does, identify the assessment route, relevant standards where applicable, technical-file contents, declaration and marking rules. If it does not, do not add CE marking.
- Assign the responsible parties. Document the manufacturer’s and importer’s tasks. Determine whether an authorised representative appointment or GPSR responsible person is required, and record the exact legal role rather than using the titles interchangeably.
- Review the complete product offer. Check product and package identification, required contacts, instructions, warnings, markings, online disclosures, destination languages and any quantity declaration. If using the ℮ mark, ensure the associated quantity-control obligations are met.
- Run separate regulated-goods checks. For food, feed, plant products and food-contact items, verify commodity-specific authorization, establishment eligibility, certificates, border controls and relevant standards before shipment.
- Retain the compliance record. Keep applicable test results, declarations, technical documentation, label and instruction versions, batch identification and shipment records available to the responsible parties. Reassess when the product, destination or applicable legislation changes.
Keep compliance evidence tied to each product version
Compliance work should be traceable to the model or product version that was assessed and the label version supplied with it. Keep records in a form the manufacturer, importer and any legally appointed representative or responsible person can access. When a material, component, intended use, warning, destination or online offer changes, check whether that change affects the applicable requirements or the evidence already held.
There is no defensible one-size-fits-all test package, certificate, label or service recommendation for an unspecified product. The appropriate evidence and support depend on the product’s legal route and the role a provider is actually engaged to perform.
