HUD may conduct the review itself under Part 50, or an authorized local or tribal government or state may take responsibility under Part 58. USDA Rural Development now follows USDA’s department-wide NEPA procedures in 7 CFR part 1b; its former part 1970 was rescinded in 2026. For covered work, environmental clearance must come before commitment or expenditure of project funds.
What the review means for a housing project
An environmental review evaluates potential effects of a proposed project and whether conditions at the site could harm future residents. It is not one uniform checklist: applicable laws and standards, the depth of analysis, and the responsible reviewer depend on the program, activity, and location.

Depending on the project, the review may involve HUD standards concerning noise or hazardous operations, floodplain and wetland requirements, historic preservation, and other federal authorities. A site-specific review determines which considerations apply; a housing project does not automatically trigger every possible review topic.

These requirements can affect more than construction. They may influence site selection, design, application sequencing, funding decisions, and coordination with agencies responsible for other laws. HUD says covered project funds cannot be committed or spent before environmental clearance. The review level depends on the assistance and activity.

This feature minimizes the risk of stumbling, ensuring a quick response and 100% safety. You can put your heart and soul into your work without any worries or cares.
- 【360-DEGREE SWIVEL TOP】: In actual use, the user has to hang the safety rope to a high place and move in all directions. The housing can rotate 360 degrees horizontally. The O-ring can swing 180 degrees vertically, which reduces the risk of entanglement of the web rope and extends the rope service life
- 【NO-TANGLE DURABLE WEBBING】The 6FT lifeline is made of ultra-high molecular weight polyethylene(UHMWPE). The tough webbing is highly resistant to abrasion, aging, impact, corrosion and won’t soften from frequent use. The internal anti-tangle system makes the retracting of the lifeline smoother with no tangle. The minimum breaking force is up to 4,550 LBS.
- 【COMPACT & LIGHTWEIGHT HOUSING】Unlike most products on the market with fragile plastic casing, our SRL features a robust and durable PA casing, which makes the product drop-resistant, corrosion-resistant and high-temperature-resistant. The PA casing ensures the hardness, along with the web lifeline keeping the overall weight of the product very light. It ensures long-lasting performance in challenging work environments. Its solid construction strengthens the lifeline's durability, providing dependable fall protection for users. The load capacity is around 130-310LBS.
- 【QUICK-ACTION BRAKING SYSTEM】When sudden fall is detected, the quick-action braking system will lock immediately, and the rope continues to descend very slowly for a short distance before stopping. This not only controls the speed of descent, but also reduces the traction force on users during the fall, effectively protecting the human body from being injured due to sudden stops. Max. Arrest Distance: 39", Avg. Arrest Force: 900 lbs.
Who conducts the review: HUD Part 50 or Part 58?
The HUD funding program’s governing authority determines whether HUD conducts the review or an eligible responsible entity may assume the federal responsibility. A city’s involvement in a project does not, by itself, mean it has authority to perform a Part 58 review for that program.
| Route | Who is responsible | What determines whether it applies |
|---|---|---|
| HUD Part 50 | HUD performs the environmental review under its procedures. | Applies to programs for which the governing law does not permit a responsible entity to assume the review. HUD’s Special Applications Center identifies FHA and HUD Multifamily programs as examples; confirm the route for the specific program. |
| HUD Part 58 | An authorized responsible entity assumes federal review responsibility and owns the review’s scope, content, and finding. | Available only when the relevant program statute permits assumption. HUD identifies eligible responsible entities as states, tribes, and units of general local government. |
| USDA Rural Development | USDA Rural Development follows the department-wide NEPA framework in 7 CFR part 1b. | The prior agency-specific 7 CFR part 1970 was removed by USDA’s April 3, 2026 final rule. The exact current housing applicant workflow should be confirmed with the appropriate Rural Development environmental official. |
HUD’s environmental regulations index describes Parts 50 and 58 and related authorities. For a particular project, verify the program’s review route with the administering agency before assuming that HUD, a local government, or USDA will be the reviewer.

When clearance must happen—and why timing matters
For covered HUD activities, environmental clearance must precede commitment or expenditure of project funds. That sequencing can constrain when a recipient finalizes decisions or begins funded work. Check the requirements for the specific assistance and activity rather than treating application approval, clearance, and construction as interchangeable milestones.
The review can vary even within housing programs. For example, HUD’s notice on public housing agency activities describes tenant-based rent subsidies without physical changes as generally not requiring a NEPA review in the same way as site acquisition or development. That example is specific to its context and does not establish the treatment of other programs or activities; other requirements may still warrant consideration.

USDA Rural Development’s 2026 change
USDA announced on May 12, 2026, that Rural Development programs would follow the department-wide modernized NEPA rule. The April 3, 2026 final rule rescinded USDA Rural Development’s agency-specific 7 CFR part 1970 as procedures were consolidated into 7 CFR part 1b. For current project planning, the applicable framework is therefore part 1b, not the former part 1970 process.
An older USDA Rural Development instructions page still says that part 1970 remains in effect, which conflicts with the later final rule and May 2026 announcement. The page’s direction to contact State Environmental Coordinators can be used as a contact lead for Rural Housing Service projects and certain other programs, but it does not establish the current technical workflow. Ask the appropriate Rural Development environmental official how part 1b applies to the specific project; do not rely on classifications or thresholds from the rescinded rule.

What HUD and USDA’s September 2026 agreement changes—and what it does not
HUD and USDA announced a memorandum of understanding on September 29, 2026, aimed at improving coordination for jointly funded housing. The announcement sets out objectives, not a finished shared review system.
- The departments plan to evaluate categorical exclusions for housing funded by HUD and USDA.
- They plan to develop a way to designate a lead agency and streamline adoption of the other department’s approved environmental assessments and impact statements for jointly funded housing.
- The announcement says the departments will maintain compliance with Part 58 as it stood on January 1, 2025, subject to any categorical-exclusion changes made through standard rulemaking.
- They will evaluate whether joint physical inspections are feasible.
The announcement does not provide an implementation date, establish a new categorical exclusion, or describe a completed lead-agency procedure. It also does not say that clearance from one department automatically satisfies the other department’s requirements. Projects with both HUD and USDA assistance should therefore confirm the applicable review responsibilities and sequencing with both agencies rather than assume there is already one shared clearance.

How to plan a project review
- List the funding and program authorities. Identify every HUD or USDA program supporting the project; the source and statutory authority of assistance determine which review framework may apply.
- Describe the proposed activity. Distinguish tenant-based assistance without physical changes from acquisition, rehabilitation, or development. The activity helps determine the review level and applicable requirements.
- Confirm the reviewer and route. For HUD, establish whether Part 50 applies or whether the program permits an eligible responsible entity to assume responsibility under Part 58. For USDA Rural Development, seek project-specific direction under part 1b from the appropriate environmental official.
- Account for the site and related requirements. Work with the responsible reviewer to identify which site conditions and authorities matter for the proposed work; do not assume that every environmental topic applies to every location.
- Sequence funding decisions around clearance. Confirm what counts as a commitment or expenditure under the applicable program and do not commit or spend covered funds before clearance.
- For joint HUD-USDA funding, verify coordination directly. Ask each agency what review and document-adoption procedures are currently available; the September 2026 MOU announcement describes intended coordination, not an operational process.
Where to check records and project-specific instructions
HUD’s environmental records resources, including its HEROS public records system, make environmental assessments and categorically excluded reviews available and show records during comment periods. The system says tiered reviews are available for five years. For an active review, use the comment contact and submission instructions in that individual record.
HUD’s environmental laws and regulations index is the starting point for its Parts 50, 51, 55, and 58 materials. For USDA Rural Development housing, request current project-specific instructions from the relevant environmental official rather than relying on the superseded part 1970 process or an older page that still describes it as active.
