Records may also be analyzed to study treatment histories and outcomes. In the United States, HIPAA protections depend on which organization handles the information and why; they do not create one blanket consent rule for every AI use. To understand the privacy implications of a particular tool, ask what data it uses, who handles it, whether it is retained or reused, and how the organization safeguards and oversees the system.
How healthcare AI systems use medical records
Clinical decision support (CDS) is a broad category of digital tools that provide timely, person-specific information to help improve care. The Office of the National Coordinator for Health Information Technology (ONC) describes examples such as patient-data summaries, diagnostic support, order sets, documentation templates, reference materials, guidelines, and alerts. A CDS tool may be built into an electronic health record (EHR) or provided separately.

These tools combine information about an individual patient with computer-usable medical knowledge. Depending on the task, that might mean using record information to surface a relevant guideline or generate a summary for a clinician. Separately, health records can be analyzed to examine treatment histories and outcomes and help inform care plans for patients with similar conditions.

Why the quality of the record matters
AI output depends in part on the quality and relevance of the information available to the system. The National Institute of Standards and Technology (NIST) summarizes the relationship this way: “Data is the fuel, and AI is the engine. Data quality is the key to AI because the accuracy, reliability, and relevance of the outputs generated by these systems are directly dependent on the quality of the data that they are trained on; essentially, ‘garbage in, garbage out’.” In practice, outdated, incomplete, or inaccurate information can affect what a system presents, so data quality and timeliness matter alongside privacy.
What HIPAA does—and does not—say about AI
This article describes the U.S. framework. HIPAA is not a worldwide privacy law, and its requirements depend on the organization, the information involved, and the purpose of its use or disclosure.

The HIPAA Privacy Rule applies to health plans, healthcare clearinghouses, and healthcare providers that conduct certain electronic transactions. Relevant requirements also apply to business associates that handle protected health information (PHI) on behalf of covered entities. The rule sets limits and conditions on certain uses and disclosures of PHI and gives individuals rights concerning their records.

There is no single consent rule for every AI use
The Privacy Rule permits some uses and disclosures for treatment, payment, and healthcare operations under specified conditions; some qualifying exchanges do not require a specific authorization. That does not mean every AI-related use is automatically allowed, or that a patient’s specific authorization is always required. The answer depends on the entity, purpose, disclosure, and other applicable requirements.

HIPAA also does not automatically cover every health app or technology company. Businesses outside HIPAA may still be subject to other protections, including the Federal Trade Commission Act and the Health Breach Notification Rule. “Not covered by HIPAA” therefore does not mean “no privacy protection.”
What safeguards can protect records used by AI?
Under the HIPAA Security Rule, safeguards can include access controls such as passwords or PINs, encryption, and audit trails that record who accessed information and what changed. These are examples of protections, not a guarantee that any system is secure by virtue of using one control. Healthcare organizations also need security practices suited to their systems and risks.

Safe use involves more than a vendor’s technical design or a privacy notice. ONC’s SAFER Guides address organizational responsibilities for AI-enabled EHR systems used in administration, diagnosis, treatment, and care management, as well as configuration, validation, maintenance, APIs, patient identification, and CDS. That makes the organization’s implementation and oversight part of the safety picture.

HHS recognizes two HIPAA methods for de-identifying information: Safe Harbor and Expert Determination. Properly de-identified information is no longer individually identifiable under the HIPAA standard, but HHS describes the risk of re-identification as very small, not zero. Ask whether a system uses identifiable information or information de-identified under a recognized method; do not treat the word “de-identified” as a promise of zero risk.

- Privacy Screen Filter Size: If the visible area of your display has the following dimension: Width x Height (Exclude Frame/Arrow 1 to 3 mm errors): 20 15/16" x 11 13/16" (532 mm x 299 mm), then this filter is good for you. Very Important to double check your screen's Width and Height excluding frame before ordering. It's not recommended to make your selection based solely on your screen's diagonal size
- Left and Right Privacy: Not block visibility directly behind you, regardless of distance. The privacy filter makes the screen appear dark when looking at it from an angle (left and right 30 to 180 degree), but clear when looking directly at it. To change the privacy levels, simply adjust your monitor's brightness level accordingly
- Matte and Glossy Sides: It's a reversible privacy screen filter, giving you the flexibility to choose glossy or matte finish. The matte side will have less glare, however the glossy side will have stronger privacy
- Perfect for Open Workspaces: Ensure your working space is bright and well lit. Privacy screens do not work in dimly lit areas
- Two Installation Option: Option 1 uses clear double side adhesive strips that securely attach to any computer screen. Option 2 (for computer screens with a raised bezel only) uses slide mount tabs that easily stick to the display frame, allowing you to take out the privacy screen filter easily as needed
What patients can ask a provider or AI vendor
For a specific system, general descriptions of AI and HIPAA are not enough to establish exactly what happens to a person’s records. These questions can help clarify the deployment:
- What records or data fields does the tool use for this function?
- Does it process identifiable information, or data de-identified under a recognized method?
- Which organization operates the AI, and is it acting for a HIPAA-covered provider or health plan?
- Is information retained, reused, or disclosed beyond the immediate care purpose? If so, on what basis?
- Who can access the information, and what access controls, encryption, and audit logging are in place?
- How does the organization validate and monitor the system, and how does its output fit into clinician review and decision-making?
How to compare healthcare AI systems
There is no evidence here to rank specific vendors. For a meaningful comparison, evaluate the system’s intended task and deployment rather than relying on a general claim that it “uses AI.”
| What to compare | What to find out |
|---|---|
| Clinical task and intended users | What does the tool provide—such as a summary, alert, or diagnostic support—and who is expected to use it? |
| Patient-specific inputs | Which information does the tool use, and how much of the record is in scope for that function? |
| Use, retention, and disclosure | Is information retained, reused, or disclosed beyond the immediate care purpose, and what rules or agreements govern that? |
| Safeguards and oversight | What access controls, encryption, and audit practices apply, and who is responsible for configuration, validation, maintenance, and monitoring? |
| Data quality and timeliness | How does the organization address incomplete, inaccurate, or outdated record information that could affect an output? |
| Workflow and clinician review | Where does the output appear in care, and how does it support rather than bypass clinician review and decision-making? |
Patient rights to records
People generally have a HIPAA right to access PHI in designated record sets maintained by or for covered entities, including relevant records held by business associates, subject to limited exceptions. Rights can include obtaining copies and requesting amendment of information that is inaccurate or incomplete, under the conditions in the rule. These rights concern access to records; they do not by themselves answer every question about a particular AI tool’s data handling.
