A change does not automatically cancel every immigration benefit. First identify your case’s stage—PERM, I-140, or I-485—then assess H-1B work authorization separately. A qualifying worker may be able to start with a new H-1B employer under H-1B portability; certain employment-based adjustment applicants may separately qualify to change jobs after their I-485 has been pending at least 180 days.
What happens to my green card if my employer withdraws sponsorship?
There is no single answer based only on the phrase “withdraws sponsorship.” The employer may have stopped a PERM process, declined to file an I-140, withdrawn an approved petition, ended your H-1B employment, or changed its corporate structure. Those are different events, and the available agency guidance does not establish that any one of them automatically cancels every part of a worker’s immigration history or determines the outcome of an individual case.

Start by separating two tracks:
- Permanent-residence sponsorship: The employer-led labor-certification process may involve PERM, followed by an employer-filed I-140 immigrant petition and, if eligible and the required visa is available, an I-485 adjustment application.
- Temporary employment authorization: Your H-1B status and authorization to work for a particular employer are separate from the green-card process. A green-card filing alone does not answer whether you may continue working or move to another employer.
For an initial orientation, the Department of Labor’s PERM overview describes the labor-certification process, while its permanent labor certification page explains employer filing responsibility, the filing date’s role, and certification validity. These points can help you identify your stage, but they do not resolve every consequence of withdrawal or revocation.

Which stage of the green-card process are you in?
Locate the latest filing receipt, approval notice, or decision notice before drawing conclusions. The names of the documents and the dates on them matter more than a general statement that the company is “sponsoring” you.

| Stage | What to locate | What it tells you |
|---|---|---|
| PERM labor certification | PERM filing record and, if approved, the certified labor certification | Whether the employer’s labor-certification process has been filed or certified. The process is employer-led. |
| I-140 immigrant petition | I-140 receipt notice and decision notice | Whether an immigrant petition was filed and whether it was approved, denied, or remains pending. |
| I-485 adjustment of status | I-485 receipt notice, filing date, and any decision notice | Whether an adjustment application is pending and how long it has been pending, which is relevant to potential AC21 portability. |
A case can be at different stages for different family members, and a worker may have prior filings that affect the questions to ask. Do not infer that an I-485 exists merely because an I-140 was approved, or that an I-140 was approved merely because PERM was certified.
What changes at the PERM stage?
PERM is the Department of Labor’s permanent labor-certification process. DOL describes the employer as responsible for filing; the worker can benefit from understanding the sequence, but the worker does not independently carry out the employer’s filing obligations. The general sequence is to identify a permanent, full-time job, obtain a prevailing-wage determination, complete applicable recruitment and notice steps, and file the application. See DOL’s PERM program page for the process outline.
If the employer stops the process before filing, there may be no PERM filing date to use for this case. If it has already filed, the filing date is used by USCIS and the Department of State as the priority date, according to DOL’s permanent labor certification guidance. That date is useful information to record, but it should not be treated as proof that the worker can retain or use a priority date in every later scenario.

DOL also says a certified labor certification should be submitted with Form I-140 within its 180-day validity period. This is a deadline for using the certified labor certification in that filing sequence. It is not, by itself, an answer about whether a priority date will be retained after a withdrawal or revocation, nor does it establish what happens in a particular case if the employer stops cooperating.
At this stage, determine whether the employer merely paused recruitment, filed PERM, received certification, or filed an I-140 afterward. Ask for copies of the filing and any agency notices rather than relying only on informal descriptions of the case.
What if an I-140 has been filed or approved?
An I-140 receipt or approval notice establishes a different point in the process than PERM alone. Record whether the petition is pending or approved and whether the employer has communicated that it intends to withdraw it. The materials cited here do not fully settle the effects of I-140 withdrawal or revocation, priority-date retention, or every related exception. Those questions depend on the actual filings, dates, and applicable rules; do not assume that a general PERM rule answers them.

If an I-485 is also pending, evaluate that adjustment application separately. The existence of an I-140 does not, on its own, establish that the I-485 has been pending long enough for portability or that a proposed job qualifies. Likewise, the potential for adjustment portability does not mean the underlying petition can simply be transferred to a new employer. USCIS distinguishes portability of a qualifying adjustment application from transferring the application to a new petition or basis in its Policy Manual, Volume 7, Part A, Chapter 8.

Can I change employers while my green-card application is pending?
Possibly, but two separate questions need answers: whether you can begin work for a new employer in H-1B status, and whether your pending adjustment case can remain viable after a job change. One rule does not automatically satisfy the other.
| Question | Rule to examine | Key conditions identified in agency guidance |
|---|---|---|
| May I start a new H-1B job? | H-1B portability | A qualifying worker may begin new employment after the prospective employer files a nonfrivolous H-1B petition before the worker’s authorized stay expires, with an unexpired approved LCA covering the new work. Check the full conditions in DOL’s Fact Sheet #62W. |
| May my employment-based I-485 continue after a job change? | AC21 adjustment portability | USCIS describes eligibility for certain EB-1, EB-2, or EB-3 applicants with an approved immigrant petition and an I-485 pending at least 180 days, if the new position is in the same or a similar occupational classification and no exclusion applies. |
How H-1B portability affects work for a new employer
H-1B portability concerns employment authorization with a new H-1B employer; it is not a green-card portability rule. DOL’s Fact Sheet #62W describes a qualifying worker beginning new employment when the prospective employer files a nonfrivolous H-1B petition before the worker’s authorized stay expires and has an unexpired approved Labor Condition Application (LCA) covering the work.

Do not reduce this to “a new employer filed something, so I can work.” The filing, timing, status, and LCA requirements matter. The new employer and an immigration attorney should review the exact facts before you rely on portability. Check your H-1B approval notice and the authorized-stay end date, as well as the petition and LCA details for the proposed job.
DOL’s H-1B, H-1B1 and E-3 Specialty Workers overview provides broader program context. The specific portability fact sheet is the more directly relevant source for a potential employer change. Neither source decides whether a particular worker meets all requirements.
When AC21 adjustment portability may apply
AC21 portability is a separate option for certain people whose employment-based adjustment applications are already pending. USCIS describes the relevant route for some EB-1, EB-2, and EB-3 applicants with an approved immigrant petition when the I-485 has been pending for 180 days or more and the new position is in the same or a similar occupational classification. See the current USCIS Policy Manual chapter on transfer of underlying basis for the framework and exclusions.

To assess whether this route might fit, establish each element rather than relying on the word “portability”:
- Is the underlying immigrant petition approved?
- Is the adjustment application based on EB-1, EB-2, or EB-3?
- Has the I-485 been pending for at least 180 days?
- Do the duties and occupational classification of the proposed new position qualify as the same as or similar to the sponsored position?
- Does an exclusion apply to the applicant or petition?
USCIS lists exclusions, including adjustment applicants whose approved petitions are based on extraordinary ability or a national interest waiver. Do not assume every employment-based adjustment applicant can use this route. The 180-day threshold is an eligibility condition described in agency guidance, not a guarantee that a job change will be accepted.
Job titles alone may not show whether two positions are in the same or a similar occupational classification. Keep the old and proposed job descriptions, including responsibilities, and ask counsel to assess them against the applicable standard. USCIS also clarifies that AC21 portability is distinct from transferring an adjustment application to a new petition or basis; it should not be described as an automatic transfer of sponsorship to the new employer.
How to assess your options in order
- Write down what changed. Identify the employer’s actual action: recruitment stopped, PERM was not filed, an I-140 was not filed or may be withdrawn, H-1B employment ended, or the company changed its structure. A general statement that “sponsorship is over” is not precise enough to assess.
- Inventory the permanent-residence filings. Note whether PERM was filed or certified, whether an I-140 was filed and its decision status, and whether an I-485 was filed and remains pending. Use notices and records, not assumptions.
- Record relevant dates. Capture the PERM filing date, certification date, I-140 filing and decision dates, I-485 receipt and filing date, and any stated H-1B authorized-stay end date. Dates can control different questions, so keep them attached to the document that establishes them.
- Assess work authorization independently. If you are considering another H-1B employer, have the prospective employer verify the petition filing, LCA, timing, and status conditions described by DOL before you begin work.
- Test adjustment portability only if an I-485 is pending. Check the petition category, approval, pending duration, proposed job duties and classification, and possible USCIS exclusions. Do not treat H-1B portability as a substitute for this review.
- Get advice on unresolved consequences. Ask a qualified U.S. immigration attorney to review the notices, employment records, and employer communications before relying on a conclusion about withdrawal, revocation, priority-date retention, or a job change.
Documents and details to collect
Organize a single record set before speaking with the employer, new employer, or attorney. The following items correspond to facts that determine which process or deadline may be relevant:
- PERM filing information and any certified labor certification.
- I-140 receipt and decision notices, including any notice about withdrawal or revocation.
- I-485 receipt notice, filing date, and any decision or other USCIS notice.
- H-1B approval notice and documentation showing the authorized-stay end date.
- Current and proposed job descriptions with duties, not just job titles.
- Written employer communications explaining what support is ending or changing, and when.
- Filing records or LCA information provided by a prospective H-1B employer.
This list helps frame a case review; it is not a legal determination or a complete filing checklist. Keep copies and note when each document was received. If a deadline or employment change is imminent, contact counsel promptly rather than waiting for every record to be assembled.
Common assumptions that can lead to a wrong answer
- “My green-card case lets me keep working.” A permanent-residence filing does not by itself settle H-1B work authorization. Assess the work-authorization track separately.
- “All 180-day rules mean the same thing.” DOL’s 180-day validity period for a certified labor certification is different from USCIS’s 180-day pending-I-485 threshold for certain AC21 portability cases.
- “An approved I-140 means I can switch jobs.” The cited AC21 guidance concerns qualifying adjustment applicants and includes category, approval, pending-time, job-similarity, and exclusion conditions.
- “A new H-1B filing preserves my green-card case.” H-1B portability concerns work for a new H-1B employer; it does not itself establish that an I-485 can continue after a job change.
- “A priority date is automatically retained after withdrawal.” DOL identifies the PERM filing date as the priority date used by USCIS and the Department of State, but the cited material does not settle every retention consequence after withdrawal or revocation.
Where to verify the rules
Use agency guidance for the relevant process and have a qualified attorney apply it to your documents. DOL’s PERM program page outlines the labor-certification steps; its permanent labor certification page addresses filing responsibility, priority-date information, and certification validity. For H-1B portability, consult DOL Fact Sheet #62W. For adjustment portability, consult the USCIS Policy Manual, Volume 7, Part A, Chapter 8. These sources describe general rules, not the outcome of an individual worker’s case.
