The rate depends on the service being supplied: restaurant service is generally stated at 5% without input tax credit in the official guidance, while platform services are stated at 18%. Delivery is less clear: official guidance gives different rates for differently described delivery services, and the available sources do not establish one universal rate for every food-order delivery fee. To understand a particular bill, separate the restaurant, platform and delivery charges, then check the itemized bill or tax invoice rather than inferring the tax from the final total.
Why one order can contain several GST treatments
A delivery-app checkout brings together services that may be supplied by different parties. The restaurant supplies restaurant service; the app may supply a platform service; and a delivery provider may supply delivery. Those components are related to one order, but that does not make them one service for GST purposes.

In a written Rajya Sabha answer dated 1 April 2025, Minister of State for Finance Pankaj Chaudhary said that restaurant services other than those at specified premises are taxed at 5% without input tax credit, whether supplied directly by a restaurant or through an electronic commerce operator (ECO), such as Swiggy or Zomato. The same answer states that other services provided by food-delivery apps, including platform services, are taxed at 18%.

Those statements answer two important parts of the question, but they do not settle the rate for every delivery charge on every food order. Official material discusses delivery services in different ways and gives different rates for those defined contexts. The 2025 parliamentary answer also says that a proposed clarification concerning delivery of food ordered through apps had been referred for further examination. It would therefore be misleading to assume that either the restaurant rate or the platform rate automatically applies to the entire bill.

Which GST rates do official sources state?
| Charge or service category | Rate stated in the cited official material | What the rate applies to—and what it does not establish |
|---|---|---|
| Restaurant service | 5% without input tax credit, according to the Ministry of Finance’s 1 April 2025 Rajya Sabha answer. | Restaurant services other than those at specified premises, whether provided directly or through an ECO. This is not a statement that every charge in an app checkout is taxed at 5%. |
| Other app services, including platform services | 18%, according to the same 1 April 2025 answer. | Other services supplied by the food-delivery app, such as platform services. It should not be described as an 18% tax on the food itself. |
| Local delivery service | 18% in the context described by the FAQ for the 56th GST Council meeting. | The FAQ describes local delivery services and says who pays in cases involving registered or unregistered providers. It does not, by itself, establish that every food-order delivery fee belongs to this category. |
| Delivery in relation to goods supplied or ordered through an ECO | 5% without input tax credit in a separate PIB FAQ published in 2026. | The FAQ describes ECO-enabled delivery services in relation to goods. Its wording should not be treated as an unambiguous resolution of the distinct food-delivery question raised in the 2025 parliamentary answer. |
The rates in the table are tied to the service descriptions and contexts in the cited official material; they are not an app-by-app schedule. The sources do not establish that Swiggy and Zomato have different general GST rates, nor do they show that their checkout labels or invoice layouts are identical. A comparison of two final totals alone cannot show whether a difference comes from the tax treatment, the underlying charges, or some other difference in the orders.
Why the delivery-fee answer needs care
Delivery is the part most likely to prompt the question, “Is GST on the food or on the delivery fee?” The available official statements do not support a single universal answer for all food-delivery orders. Their descriptions are not interchangeable: one refers to local delivery services, another to delivery in relation to goods supplied or ordered through an ECO, and the parliamentary answer records that the rate clarification for food ordered through apps was still under further examination in April 2025.
The GST Council website lists FAQs for its 57th meeting, held on 8 October 2026. The page information available for this article does not expose the underlying FAQ text, so it is not possible here to say whether that meeting resolved the earlier food-delivery question. Do not treat the listing of the meeting or its FAQs as proof of a particular delivery rate. For a current legal determination, the relevant notifications and the text of any applicable current FAQ need to be checked along with the description of the actual supply.

This distinction matters because a category-specific rate is not automatically a bill-line answer. A line called “delivery” may be associated with a particular supply, but the name alone does not disclose how that supply is classified under the applicable rules. Nor does a rate quoted for one delivery-service context prove that another, differently described food-delivery service receives the same treatment.
Who pays GST, and what you see on the bill
The official FAQs also distinguish who is liable to pay GST. In the delivery contexts they describe, when an unregistered delivery provider supplies through an ECO, the ECO pays under section 9(5); when the provider is registered, the provider pays. The 2026 FAQ on ECO-enabled delivery describes a similar allocation for the service category it covers.
That allocation answers a legal remittance question: which party must pay the tax to the government in the described circumstances. It does not, by itself, show the amount a customer will see on a particular checkout screen, which bill line carries it, or how the tax has been incorporated into the amount charged. A platform’s responsibility to remit tax is not proof that the customer’s bill displays a separate line with the same name or amount.

It is useful to keep three questions separate when reading a charge: what service the charge is for, which rate applies to that supply, and which supplier or ECO is responsible for remitting the tax. A bill may help identify the charge and tax amount, but it does not necessarily explain every legal relationship behind the transaction.
How to check GST on a specific order
- Open the completed order’s breakdown or invoice. Use the bill or tax invoice available for that order, rather than estimating tax from the amount paid or relying on a general description of how delivery apps work.
- Separate charges by the service they appear to represent. Look for restaurant or food charges, platform or app charges, delivery charges, and any separately described service charge. The exact labels and layout may differ; the official sources do not document current Swiggy and Zomato checkout screens.
- Read the tax amount and taxable value, if shown. Do not assume that a single “taxes” total reveals how much relates to each service. If the invoice shows a value and tax for a line, use the invoice’s figures rather than calculating a rate from the overall order total, which may include several charges.
- Compare the description with the relevant service category. The 5% restaurant-service statement applies to the restaurant category described by the Ministry of Finance; the 18% statement covers other app services such as platform services. Delivery needs more care because the official sources describe different contexts and do not establish one rate for every food-order delivery charge.
- Check the invoice issuer and supplier details. Section 31 of the CGST Act addresses tax invoices for taxable services, including the value and tax charged, subject to prescribed rules and exceptions. The invoice can therefore be more informative than a checkout summary, although the exact information and presentation depend on the applicable rules and the transaction.
- If the treatment is unclear, ask about the particular line. Request clarification from the app or supplier identifying the service, taxable value, tax amount and invoice entry in question. An order-specific question is more useful than asking whether “GST on delivery” is always a certain percentage, because the sources do not support a universal answer.
This process helps identify what the customer has been charged without turning a final total into a tax calculation. It also avoids treating a tax-remittance rule for a supplier as if it were an explanation of the customer-facing invoice.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. Why Swiggy and Zomato totals can differ
A different total between two orders does not establish that the apps apply different GST rates. Orders may contain different food amounts, charge descriptions or combinations of services, and the official sources cited here do not provide a live comparison of either app’s checkout or establish that their fee labels match. Even if the tax rate for a particular category is known, the total cannot be explained without knowing which taxable values and charges make up each order.

For a fair comparison, use the itemized bills for comparable orders and compare like with like: restaurant service against restaurant service, platform service against platform service, and delivery against delivery. Do not compare only the final totals, or infer an app-wide tax policy from one receipt. If either bill gives only a combined taxes figure, it may not provide enough detail to attribute that total to each component.
Service charge is not itself a government levy
CBIC says that a service charge is not a statutory levy. That means it is not the same thing as GST imposed by the government. CBIC also explains that a service charge, like any other supply, can itself be liable to GST. So a separately named service charge may be a charge for a supply and may have GST treatment of its own; its presence does not make it a government tax, and it should not be conflated with the GST amount.
Recommended Free Tools
When a bill includes both a service charge and tax, read the descriptions and invoice detail rather than grouping both under the informal label “tax.” The fact that a charge is not a statutory levy does not, by itself, decide whether GST may apply to the supply represented by that charge.

What the available figures do—and do not—tell you
The clearest consumer takeaway is category-specific: the Ministry of Finance’s 2025 answer states 5% without input tax credit for the specified restaurant-service category and 18% for other app services such as platform services. The 56th Council FAQ gives 18% for local delivery in its stated context, while a 2026 PIB FAQ gives 5% without input tax credit for delivery in relation to goods supplied or ordered through an ECO. Those statements should be read according to their stated categories, not combined into a blanket rate for every line called delivery.
None of these figures is a calculation of the increase on a particular customer’s order. The final bill depends on the actual charges, taxable values and applicable treatment for that transaction. The 2025 parliamentary answer did not provide an annual estimate of the burden on consumers, and the official material described here does not justify inventing a typical rupee increase or a standard GST total for Swiggy or Zomato orders.
