Pharmaceutical exporters and clinical research providers in India can generally preserve eligible GST input tax credit (ITC) on qualifying zero-rated supplies, but an export does not make every business expense creditable or guarantee a refund. The result depends on ordinary ITC conditions, the export classification and place-of-supply rules, any blocked-credit or apportionment restriction, and the refund route and evidence applicable to the tax period.
What ITC covers—and what it does not
Input tax credit is credit for eligible GST paid on inputs and services used in making a business’s supplies. For an exporter, it can prevent GST on eligible purchases from becoming a final cost when the output supply is zero-rated. Credit is not automatic simply because a purchase was made by a company, recorded in its books, or associated with export activity.

The starting point is the CGST Act’s conditions and restrictions. The taxpayer must assess the transaction under the operative rules for the relevant period, including whether the credit is supported by required records and whether a statutory restriction applies. Blocked-credit provisions remain relevant to zero-rated businesses; zero-rating does not override them.

Where an input or service supports both eligible taxable or zero-rated supplies and exempt supplies or non-business activity, the credit may need to be apportioned. A pharmaceutical company, for example, should not treat every office, facility, vehicle, or professional-service expense as fully creditable without examining the expense, its use, and the applicable restriction. The same principle applies to a clinical research provider with mixed projects or activities.

Zero-rated supply is not the same as an unconditional refund
Under section 16 of the IGST Act, exports of goods or services and qualifying supplies to an SEZ unit or developer are zero-rated. The statutory phrase is “export of goods or services or both.” Zero-rating generally preserves eligible ITC, subject to statutory restrictions such as those applicable under CGST Act section 17(5). It does not mean that every purchase qualifies, or that the tax authority must refund every credit balance.
A registered supplier generally considers one of two routes for a qualifying zero-rated supply. Which route is available and appropriate must be checked against the law and conditions operative for the transaction and tax period.
| Route | What the supplier does | What is claimed | Key point |
|---|---|---|---|
| Without payment of integrated tax | Makes the supply under a bond or letter of undertaking (LUT), as applicable | Refund of eligible unutilised ITC | The credit must first be eligible, and the refund calculation and supporting conditions still apply. |
| With payment of integrated tax | Pays integrated tax on the qualifying supply | Refund of the integrated tax paid | This route is subject to applicable conditions and rules; do not assume it is available for every supply or period. |
The choice affects cash flow and the kind of refund being sought. Under the LUT/bond route, a balance of eligible credit may remain unutilised until the prescribed refund process is completed. Under the payment route, the refund claim concerns tax paid on the supply. The applicable rules, notifications, and taxpayer circumstances should be checked before electing or filing; zero-rating by itself does not settle the route.

Checks for pharmaceutical goods exporters
A goods export must be treated as a specific transaction, not as a blanket entitlement covering all credits held by the exporter. CBIC FAQ material identifies export duty and overlapping drawback or IGST-refund treatment as material restrictions when assessing refunds of unused ITC. Their effect depends on the export and benefit claimed, so verify the applicable statutory text and notifications rather than relying on a general rule of thumb.
Before treating a goods shipment as refund-eligible
- Confirm the supply and route. Establish that the transaction is an export of goods and identify whether the business is using the LUT/bond route without payment of integrated tax or the route involving payment of tax, subject to the current rules.
- Check product-specific and transaction-specific restrictions. Determine whether export duty applies and whether drawback or another IGST-refund treatment has been claimed. Do not assume that benefits can be combined.
- Test the input credits. Separate eligible credit from blocked credit, credit attributable to exempt or non-business use, and any amount requiring apportionment.
- Match records to the shipment and period. Assemble the relevant tax invoices, returns, export evidence, and credit records. Confirm that the evidence and filing timing meet the rules applying to the claim.
- Reconcile benefits already taken. Compare the refund request with any drawback or tax refund relating to the same exports so the claim does not overlap an excluded or incompatible benefit.
These checks are particularly important where a business exports different products, uses more than one refund treatment, or has both export and domestic activity. The existence of a positive ITC balance is not by itself proof that the balance is refundable.
When clinical research is an export of services
A clinical research provider should test each cross-border service against the statutory export-of-service conditions. A customer’s foreign address alone does not establish an export. The CBIC FAQ describes a test that includes the supplier being in India, the recipient being outside India, the place of supply being outside India, qualifying payment, and the supplier and recipient not being merely distinct establishments of the same person for this purpose.

These elements work together. If the place of supply is in India, or another required condition is not met, the service does not qualify as an export merely because the contract was signed with an overseas customer or payment arrived from abroad. Classification should be based on the actual service and facts for the contract, not just the invoice label.

- Identify the supplier and recipient. Determine which legal person supplies the service and which person receives it. Check the recipient’s relevant establishment and whether the parties are establishments of the same person.
- Describe the deliverable. Read the scope of work and identify what the Indian provider undertakes to deliver—for example, the contracted research service itself or an activity limited to arranging another party’s service. The contractual description should match what is actually performed.
- Determine place of supply. Apply the relevant IGST Act provision to the particular service. Do not select the general rule without checking whether a more specific provision or notification applies.
- Verify payment and evidence. Confirm that the payment arrangement meets the statutory export condition and retain the contract, invoices, payment evidence, and records that connect the payment to the service.
- Document the conclusion per contract or service line. Where a contract contains different services or roles, assess them separately if their place-of-supply or export treatment may differ.
Pharmaceutical-sector R&D has a place-of-supply issue to check
CBIC’s notification index identifies Notification No. 04/2019-Integrated Tax, dated 30 September 2019, as notifying place of supply for pharmaceutical-sector research and development services under section 13(13) of the IGST Act. This makes the notification a specific checkpoint for pharmaceutical R&D work; it is not a basis to assume that every clinical research or pharmaceutical service is covered.
The index entry alone does not establish the notification’s complete operative scope or its current status after any later amendment. For a particular service, examine the full notification and amendments effective for the relevant period, then compare the defined coverage with the contract, deliverables, and actual work. If the service falls outside that provision, determine the applicable place-of-supply rule rather than treating the notification as a general pharmaceutical-export rule.

Own-account work, intermediary activity, and subcontracting
Clinical research contracts can involve several parties: a foreign sponsor, an Indian provider, investigators or other vendors, and overseas subcontractors. Whether the Indian provider supplies the main service on its own account or merely arranges another person’s supply can affect intermediary analysis and place of supply. The answer turns on the provider’s real role, not only on labels such as “agent,” “coordinator,” or “consultant.”
CBIC Circular No. 159/15/2021-GST, dated 20 September 2021 in the CBIC index, explains that a person supplying the main service on its own account is not an intermediary merely because it may be an agent or broker in another sense. It also explains that subcontracting a main service is not intermediary activity when the subcontractor provides that main service rather than arranging or facilitating it. The circular states that the special place-of-supply provision for intermediary services applies only where either the intermediary supplier or the recipient is outside India.
Questions to ask about the contract
- Is the Indian provider responsible to the customer for a defined research service or deliverable?
- Does it perform that service itself, including through subcontractors, or does it only arrange or facilitate a separate supplier’s service?
- Who contracts with and is liable to the customer for the main deliverable? Who invoices, bears performance responsibility, and handles deficiencies?
- Do the scope, work orders, communications, and actual conduct support the same characterization?
For an Indian exporter that outsources part of its work to a supplier outside India, CBIC Circular No. 78/52/2018-GST, dated 31 December 2018, describes two supplies: the Indian exporter’s supply to the overseas recipient for the full contract value, and an import of services by the Indian exporter from the foreign subcontractor for the outsourced portion. The customer-facing export and the inward subcontracted service therefore need separate tax analysis. The subcontract does not by itself reduce the value of the exporter’s supply to its customer, and the import leg should not be ignored when reviewing the overall treatment.

How to claim an unutilised ITC refund
For a zero-rated supply made without payment of tax under LUT or bond, CBIC’s refund rules provide an electronic claim in FORM GST RFD-01 through the Common Portal. The rules set a calculation using zero-rated turnover, Net ITC, and adjusted total turnover, along with definitions, evidence, and timing requirements. The formula is not a guarantee of a payment equal to the full ledger balance: the eligible credit, relevant turnover, period, attribution, and any applicable restrictions determine the claim.
At a high level, the prescribed calculation relates qualifying zero-rated turnover to adjusted total turnover and applies Net ITC for the relevant period. Use the current rule text and its defined terms when calculating; do not substitute total company purchases or the entire electronic credit ledger for the prescribed inputs. The applicable turnover definitions and the nature of the supply matter, and an individual claim cannot be estimated without the period’s returns, invoices, export evidence, and credit attribution.
- Fix the tax period and route. Identify the period for which the refund is claimed and confirm that the supply was made under the applicable LUT/bond route without payment of tax, if claiming unutilised ITC on that basis.
- Reconcile credit and turnover. Determine eligible Net ITC and the applicable zero-rated and adjusted total turnover figures under the rules. Apply attribution or apportionment where required.
- Collect export or SEZ evidence. The refund rules specify supporting evidence and timing requirements for exports and SEZ supplies. Match the required evidence to the transactions and tax period.
- File the prescribed form electronically. Submit FORM GST RFD-01 through the Common Portal with the required declarations and documents for the claim type and period.
- Retain the working papers. Keep the calculation, invoice and return reconciliations, export or SEZ records, LUT/bond details, payment records where relevant, and an explanation of credit allocation available for review.
Refund processing depends on compliance with the prescribed form, calculation, supporting evidence, and deadlines. A filed claim is not an assurance that the amount requested will be sanctioned; a mismatch in turnover, credit attribution, export records, or a restriction on the benefit can affect the result.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsWhat to assemble before a case-specific review
For a useful eligibility and refund assessment, prepare one record set for the tax period and each relevant category of supply. That lets the reviewer test both the outward classification and the underlying credit rather than treating the refund balance in isolation.
- GST registration details and the tax period under review.
- Outward invoices, contracts, scopes of work, and a description of the actual deliverables.
- For clinical research, recipient establishment details, payment evidence, and analysis of the applicable place-of-supply provision, including any pharmaceutical R&D notification issue.
- For goods exports, shipment and export documentation, export-duty status, and records of drawback or any IGST refund claimed.
- Input invoices, the credit ledger and return reconciliations, and an allocation of credit among zero-rated, other taxable, exempt, and non-business uses.
- The LUT or bond election and the refund route used, plus the calculation and evidence required for the relevant claim.
- For outsourced work, the foreign subcontractor agreement, the outsourced scope and value, and the tax treatment considered for the import-of-services leg.
GST rules, portal requirements, and notified instructions can change. Apply the operative Act, rules, notifications, and circulars for the relevant tax period before filing. The CBIC circulars and the notification index provide important interpretive checkpoints, but a specific service’s classification and refund amount depend on its documents and facts.
