A GST Council recommendation is not automatically law. Article 279A gives the Council a constitutional role to recommend GST policy, but the recommendation normally becomes enforceable only after Parliament, a State legislature, or an authority empowered by a GST Act makes the required Act, rule, or notification. The instrument’s wording and commencement clause—not the date of the Council meeting or a press release—determine what taxpayers must do.
Are GST Council recommendations binding?
As a general constitutional rule, no. The Council recommends GST policy to the Union and the States; it does not ordinarily enact a tax, amend a rule, or impose a compliance duty merely by adopting a proposal. The Supreme Court of India settled this point in Union of India v. Mohit Minerals Pvt. Ltd., decided on 19 May 2022. The judgment rejected the proposition that every Council recommendation categorically binds the Union and the States. The Court treated recommendations as having persuasive value within the constitutional scheme.

The Court’s conclusion begins: “The recommendations of the GST Council are not binding on the Union and States for the following reasons:” That statement addresses the general constitutional status of recommendations. It does not mean that a recommendation can never matter legally. Parliament may enact a law that authorizes delegated legislation only after a specified recommendation, or otherwise requires the government to consider or follow a recommendation for a defined purpose. In that narrower situation, the resulting rule or notification derives its force from the enabling Act and the conditions written into it—not from the Council decision standing alone.

What the Constitution gives the GST Council
Article 279A creates a recommending body
The Constitution (One Hundred and First Amendment) Act, 2016 inserted Article 279A and established the GST Council. Article 279A(4) lists the subjects on which the Council makes recommendations to the Union and the States. These include the goods and services that should be taxed or exempted, model GST laws, principles governing levy and place of supply, thresholds below which registration or collection may not be required, and rates, including special rates or rates for a specified period. The Council may also recommend other GST matters that it decides to take up.
Those assignments explain why a Council meeting can announce a significant policy direction without itself changing the text of the Central Goods and Services Tax Act, a State GST Act, the rules made under them, or a notification already in force.
How the Council votes
Article 279A provides for a three-fourths weighted majority of the members present and voting. The Union government’s vote carries one-third of the total weighted votes, while all State governments together carry two-thirds. These are constitutional voting weights, not a statement that a recommendation has the same legal status as legislation. A recommendation adopted by the required majority still has to travel through the legal route applicable to its subject.
Who has lawmaking power
Article 246A gives Parliament and State legislatures power to make GST laws, subject to the constitutional allocation of that power. Whether a proposal needs an amendment to an Act, a new enactment, or delegated legislation depends on the subject and the text of the governing statute. The Council cannot substitute for the legislature where the Constitution or an Act requires legislative action.

How a recommendation becomes an operative rule
The practical sequence is easier to understand if each legal stage is separated from the policy announcement.
-
The Council considers and adopts a recommendation
Members debate the proposal and, where the constitutional voting requirement is met, adopt a recommendation. Meeting minutes, a press release, or a summary may describe the intended policy, but those materials are not automatically the source of a taxpayer’s enforceable duty.
-
The government identifies the legally required route
Officials determine whether the proposal can be implemented under an existing power or whether Parliament or one or more State legislatures must amend or enact legislation. A rate written directly into an Act cannot ordinarily be replaced by an administrative announcement. Conversely, an Act may already authorize the government to prescribe exemptions, procedures, forms, or other details by rule or notification.

The competent authority issues the instrument
Where primary legislation is required, Parliament or the relevant State legislature passes the amendment or new Act through the constitutional process. Where delegated legislation is authorized, the empowered government or authority makes a rule or issues a notification under the specified section. Official Central Tax listings contain, for example, notifications that amend the CGST Rules. The individual document must be read to confirm its statutory authority and exact text.

The instrument states when it starts
An amendment, rule, or notification normally includes a commencement clause or an effective date. That date can be the date of publication, a later date, or another date expressly specified by the instrument. A Council meeting date does not replace the commencement provision.
-
Taxpayers apply the operative text
Once the valid instrument has commenced, businesses apply its precise provisions to invoices, returns, tax payments, records, and contracts. If later corrigenda, amendments, or replacement notifications alter the text, the current version and its own commencement terms control.
Which legal instrument is needed?
| Route | Decision-maker | Authority and scope | What makes it binding | Date that governs |
|---|---|---|---|---|
| Constitutional amendment | Parliament using the constitutional amendment procedure | Changes constitutional text; this is an exceptional route and cannot be completed by a Council vote alone. | The enacted constitutional amendment, once brought into force. | The commencement provision for the amendment. |
| Act of Parliament | Parliament | Creates or changes provisions in central GST legislation, including matters that cannot be delegated. | The enacted statutory text and any conditions it contains. | The Act’s appointed or specified date. |
| State GST Act | The relevant State legislature | Creates or changes the State-law component within the legislature’s GST authority. | The enacted State law and its commencement terms. | The date stated in that State enactment or commencement notification. |
| Delegated rule or notification | The Union or State authority empowered by the relevant GST Act | Fills in details—such as procedures, exemptions, or other matters—only within the power delegated by the Act. | A valid instrument made under the enabling section, including any statutory condition requiring a recommendation. | The effective date written in the rule or notification. |
The table’s key limitation is scope: delegated legislation cannot lawfully do more than the enabling Act permits. If the Act requires a Council recommendation before a particular notification can be made, that condition may be binding for that specific delegated action. It does not convert every Council recommendation into a generally compulsory command to the Union and States.
What the Mohit Minerals judgment changed
Before the Supreme Court’s 19 May 2022 judgment, public debate often treated the Council’s cooperative design as proof that its recommendations were binding. The Court separated the political and constitutional importance of cooperation from legal compulsion. The Council is a powerful forum for harmonising GST policy, but its recommendation is not, by itself, an Act of Parliament, a State enactment, or a statutory notification.

The judgment should be read with the relevant GST legislation. A statute can give legal significance to a recommendation in a defined setting—for example, by authorizing a delegated instrument on the condition that the Council has recommended a particular course. In such a case, the enforceable obligation comes from the resulting instrument made under the Act. The recommendation is part of the statutory precondition or policy process; it is not a free-standing tax rule that taxpayers can enforce or challenge without examining the instrument.
Early GST Council meeting minutes contain debate among ministers and officials about whether recommendations would bind governments or legislatures. Those records provide historical context, but the Supreme Court’s later constitutional analysis is the controlling general answer described above.
Does a GST rate change apply from the Council meeting date?
Not automatically. A rate discussion or decision announced after a Council meeting is not enough, by itself, to tell a business which rate to print on an invoice. The applicable rate depends on the Act, amendment, rule, or notification that legally implements the change and on that instrument’s effective date.
For a rate prescribed through legislation, look for the amending Act and its commencement clause. For a rate, exemption, or procedural detail delegated to the government, look for the notification issued under the relevant statutory power. A notification may take effect on publication, on a future date, or on another date stated in its text. The date of the Council’s meeting and the date of a press release may be earlier than the legal effective date, and neither should be used as a substitute for the instrument.

When a transaction spans a changeover date, preserve the version of the law and notification that applied on the relevant date and document the reasoning used for the classification, rate, exemption, and time of supply. If the instrument contains transitional language, follow that language rather than assuming that the new rate applies to every open transaction.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Where to check the notification that implements a recommendation
Use the official legal publication or notification listing, not only a meeting summary circulated by email or reproduced on a commercial site. For central GST matters, the official Central Tax notification listing includes instruments such as amendments to the CGST Rules. State GST changes may appear in the relevant State’s official gazette or tax-department publication.
- Identify the subject announced by the Council: rate, exemption, threshold, rule, place-of-supply principle, or another matter.
- Search the official Central Tax or State notification listing for the instrument issued after the announcement.
- Record the notification or amendment number, date, issuing authority, and the statutory section cited as its legal basis.
- Read the operative clauses, schedules, substitutions, and provisos. Do not rely only on the title or a summary.
- Locate the commencement sentence and note whether it is immediate, prospective, or tied to a separately appointed date.
- Check for corrigenda, later amendments, rescissions, and State-specific instruments before changing systems or filing returns.
- Retain a copy of the instrument and the version in force for the tax period under review.
A printed GST Acts bare act or other GST law reference book can help locate the constitutional provisions and enabling sections, but it is not a substitute for checking current amendments and notifications. Statutory text can change after a book is printed.

Three practical examples
A Council recommendation on a rate
Assume the Council recommends reducing the rate for a class of goods. The recommendation explains the intended policy. If the rate is embedded in legislation, an amendment must be enacted through the required legislative route. If the governing Act authorizes the government to prescribe the rate by notification, the empowered authority must issue that notification. A business changes its invoicing rate from the notification’s commencement date, not merely from the meeting date.
A recommendation to alter a compliance rule
Assume the Council recommends a new filing procedure and the CGST Act authorizes rules on that procedure. The government may amend the CGST Rules through a properly issued notification. The notification’s text determines the new form, reporting period, exceptions, and start date. If no authorized rule or notification is issued, the recommendation alone does not rewrite the existing filing rule.
An exemption requiring a statutory condition
Assume an Act allows an exemption notification only after a recommendation on the specified class of supplies. The recommendation may satisfy that statutory condition, but the exemption becomes available to taxpayers only when the authorized notification is made and effective. The notification’s scope—definitions, conditions, documentation, and date—controls who can claim it.
Common mistakes and how to correct them
- Treating a press release as legislation: use it to understand policy intent, then locate the enacted amendment, rule, or notification.
- Using the meeting date as the effective date: read the commencement clause in the operative instrument.
- Assuming every recommendation is either binding or meaningless: check whether the enabling Act makes a recommendation a condition for a specific delegated action.
- Applying a central notification to every GST component: determine whether the change concerns central law, State law, or both, and verify the corresponding State instrument where required.
- Reading only the headline rate: inspect schedules, product definitions, provisos, exclusions, transitional rules, and later corrigenda.
- Relying on an old bare act: compare the printed text with current official amendments and notifications for the period being filed.
A compliance checklist for businesses
- Have you identified the exact Council recommendation and the subject it covers?
- Which Act or constitutional provision supplies the legal authority for implementation?
- Does the change require Parliament or a State legislature, or is delegated legislation available?
- What is the instrument number, issuing authority, and publication date?
- What wording actually changes the rate, exemption, rule, threshold, or procedure?
- Is there a statutory precondition, such as a required recommendation, and is it satisfied?
- What commencement date and transitional provisions apply?
- Have you checked for later amendments, corrigenda, rescissions, or State-specific measures?
- Can you preserve the instrument and your tax-period analysis for audit or dispute purposes?
The legal answer in one sentence
A GST Council recommendation sets policy direction and can be a statutory precondition for a particular delegated action, but it becomes an enforceable GST rule only through the constitutional or statutory instrument authorized to implement it; that instrument’s exact text and effective date govern compliance.
