In India, the result depends on the product’s HSN classification, whether a seed is genuinely of seed quality, the product’s condition and intended use, and— for specified farm produce—whether it is pre-packaged, labelled and within the 25 kg or 25 litre threshold. The central goods-rate and exemption notifications were replaced in September 2025, so an exact 2026 rate must be checked in the current notification and later amendments before you invoice.
What actually determines GST on an agricultural item
The everyday description on a purchase order is not enough. “Seed”, “grain”, “fertilizer”, “pesticide” and “farm input” are commercial descriptions, not complete GST classifications. Start with the item’s legal description and likely HSN heading, then test the facts that can move it into a different entry.

- Identity: record the species or crop, variety where relevant, and whether the item is whole, split, milled, treated, blended or otherwise processed.
- Seed status: establish whether the goods are of seed quality and sold for planting, rather than being ordinary edible, feed or industrial commodity.
- Packaging facts: for entries affected by the pre-packaged-and-labelled rule, record whether the product was packed in advance, labelled and packed in a quantity of not more than 25 kg or 25 litres.
- Supply type: distinguish goods from a service such as farm labour, machinery rental or warehousing.
- Applicable instrument: use the current central rate or exemption notification, then check amendments and the corresponding IGST, State GST or Union territory instruments for the transaction.
A correct HSN does not by itself prove an exemption. The exact wording of the entry and the factual condition of the goods must match.

- Write a precise product description. Include crop or species, physical form, processing, treatment, intended use and package size. “Maize” is incomplete; “maize of seed quality for sowing” is materially more useful.
- Identify the probable HSN heading. Use the Customs/GST classification structure and the exact entry description. Do not select a rate from a search result that only matches a trade name.
- Test seed quality where relevant. A product can be botanically a seed but still be sold as food, feed or an industrial commodity. Evidence such as product specifications, labels, purchase orders and how the goods are marketed may be needed to support the classification.
- Check processing and condition. Cleaning, splitting, milling, roasting, treating or blending can move goods away from an entry for unprocessed agricultural produce. The description must reflect the goods as supplied, not the crop from which they originated.
- Apply the packaging test for listed farm produce. Note whether the goods are pre-packed and labelled and whether the package is at or below 25 kg or 25 litres. The CBIC clarification concerns agricultural farm produce in packages containing more than 25 kg or 25 litres; it is not a universal rule for every product called a grain.
- Read the current 2025 replacement notification. Notification 9/2025-Central Tax (Rate) covers goods-rate changes and Notification 10/2025-Central Tax (Rate) covers exempt goods. Both are dated 17 September 2025 and were issued in supersession of the respective earlier central notifications. Check subsequent amendments before relying on an entry in 2026.
- Document the conclusion. Keep the product literature, laboratory or quality documents where available, package photographs, contracts and the notification paragraph used. This file is important if a customer, auditor or tax officer challenges the classification.
Seeds: why “seed quality” is the decisive distinction
CBIC’s published material separates goods of seed quality from other goods in the same broad commodity chapters. That distinction is why two products with the same botanical name can receive different treatment. A lot sold and documented for sowing may fit a seed-quality entry, while the same crop sold for human consumption or processing may fall elsewhere.

Maize seed example
CBIC’s GST Rates FAQ answers the question, “What is the HS code for Maize Seeds and its GST rate?” It identifies maize of seed quality under heading 1005 and gives a Nil-rated result in the schedule addressed by that FAQ. Because the September 2025 notifications superseded the earlier central rate instrument, this is a CBIC classification example, not a blanket promise of the rate for every 2026 maize transaction. Confirm the current entry before issuing an invoice.
Chapter 12 oilseeds
The earlier CBIC schedule’s Nil-rate section included goods of seed quality and named examples such as soya beans, groundnuts, linseed, rape or colza seeds and sunflower seeds. It separately listed Chapter 12 goods other than seed quality in a taxable schedule. Those published entries remain useful leads for classification, but they should not be treated as the operative 2026 rate without checking the replacement notification.
Isabgol illustrates the factual risk
The GST Council’s Authority for Advance Ruling index includes a question about whether Isabgol seeds are fresh or qualify as goods of seed quality. An index entry is not a ruling for every taxpayer, but it shows why a common-market label cannot settle the issue. If the facts, intended use or evidence are disputed, obtain item-specific advice or consider the applicable advance-ruling route.
Grains and cereals: packaging and labelling can change the result
The earlier schedule separated specified cereals sold pre-packaged and labelled from the same types of cereals sold otherwise. That means the invoice description should not stop at “rice”, “wheat”, “pulses” or another cereal name. Record the packing method, label, quantity and whether the goods are within the relevant agricultural-farm-produce entry.

The 25 kg or 25 litre clarification
CBIC Circular No. 229/23/2024-GST states: “Consequently, supply of agricultural farm produce in package (s) containing quantity of more than 25 kilogram or 25 litre will not attract GST levy of 5%.” The sentence describes the clarification made by that circular. It does not establish the exact post-2025 rate for every cereal, nor does it remove the need to confirm that the product is covered by the relevant entry.
For a shipment, capture the quantity of each package rather than only the total consignment weight. A 500 kg consignment in bags of 50 kg is factually different from the same weight in consumer packs of 5 kg. Also distinguish goods packed by the supplier from goods merely transported in a container; the legal pre-packaged-and-labelled test concerns how the product is supplied.
Fertilizers, pesticides and machinery are not one GST category
Do not apply a generic “agricultural input” rate. The older CBIC table placed fertilizers in Chapter 31 and listed plant-protection products under heading 3808. The heading includes products such as insecticides, rodenticides, fungicides, herbicides, anti-sprouting products and plant-growth regulators. The exact description, formulation and use determine the relevant entry.
Recommended Free Tools
- Fertilizers: identify the chemical or blended formulation and the precise Chapter 31 description. A branded name or a claim that a product improves soil is not a substitute for classification.
- Plant-protection products: determine whether the formulation is an insecticide, fungicide, herbicide, rodenticide, anti-sprouting product or growth regulator under the heading description.
- Farm machinery: classify the machine as goods according to its own HSN description. If the transaction is for hiring or renting machinery, analyze it as a service instead.
The detailed current treatment for these categories must be checked against the September 2025 schedules and amendments. Do not copy a percentage from an older CBIC table into a 2026 invoice without that verification.

Specified agricultural services that may be Nil-rated
The official service schedule contains a specific Nil-rated list for certain agricultural-support services. Examples include agricultural operations directly related to producing agricultural produce, farm labour, specified processes that do not alter the essential characteristics of the produce, rental of agro-machinery, storage or warehousing, agricultural extension services, and services supplied by an agricultural produce market committee or commission agent in relation to agricultural produce.
The exemption is description-based. A service purchased by a farmer is not automatically exempt. For example, identify whether a contractor is supplying an enumerated cultivation operation or a different taxable contract; whether a process preserves the essential characteristics or changes the goods; and whether a storage service is the listed agricultural warehousing service. Keep the work order and scope of supply aligned with the entry you rely on, and verify the current service notification for the date of supply.
Historical schedule clues versus current 2026 law
| Issue | What older CBIC material shows | How to use it now |
|---|---|---|
| Maize of seed quality | FAQ example: heading 1005 and Nil-rated in the FAQ’s stated schedule | Use as a classification lead; confirm the 2025 replacement entry and amendments |
| Chapter 12 seed-quality goods | Named oilseeds and other goods of seed quality appeared in a Nil-rate section | Do not quote as a verified 2026 rate until checked in Notification 9/2025 or 10/2025 as applicable |
| Listed cereals | Separate treatment for pre-packaged-and-labelled goods and goods sold otherwise | Check the product entry, package facts and current notification together |
| Packages over 25 kg or 25 litres | 2024 circular says agricultural farm produce in such packages is outside the described 5% levy treatment | Apply only where the goods fit the relevant farm-produce entry; do not generalize to every grain |
| Fertilizers and plant-protection products | Older table points to Chapter 31 and heading 3808 entries | Verify the exact formulation and current 2025 schedule |
| Specified farm services | Older service list includes cultivation, labour, certain processing, machinery rental and warehousing | Match the actual scope to the current service exemption wording |
What changed with the September 2025 notifications
The Ministry of Finance FAQ on the 56th GST Council decisions, posted on 18 September 2025, identifies Notification 9/2025-Central Tax (Rate) for goods-rate changes and Notification 10/2025-Central Tax (Rate) for exempt goods. Each notification is dated 17 September 2025 and supersedes the respective earlier central notification. This matters because a rate copied from an older CBIC schedule can be outdated even when the HSN classification remains a useful starting point.
For an inter-State supply, also check the applicable IGST instrument; for an intra-State supply, apply the corresponding Central GST and State GST or Union territory GST treatment. Confirm the effective date, later amendments and any transitional rule before finalizing invoices, returns or contract pricing.

Invoice and compliance checklist
- Use the exact product description, not only a trade name.
- State the HSN or service classification supported by your documents.
- For seeds, retain proof of seed quality and intended planting use where that distinction is relied upon.
- For grains and other listed farm produce, record pre-packaging, labelling and the quantity in each package.
- Check the current September 2025 notification and every relevant amendment on the date of supply.
- Apply the correct central, State, Union territory or integrated GST instrument for the transaction’s place of supply.
- Keep purchase orders, technical sheets, labels, test certificates, contracts and transport documents together.
- If the buyer disputes the rate, do not change the HSN merely to match the customer’s requested percentage; resolve the factual and legal classification first.
Common mistakes and how to correct them
Using “agricultural input” as the HSN description
This hides the distinction between seed-quality goods, food or feed grains, fertilizers, pesticides, machinery and services. Replace it with the specific commodity, condition and use.
Assuming every seed is exempt
Seed quality is an express classification distinction. A seed sold for planting can be treated differently from the same broad commodity sold for another purpose. Obtain evidence instead of relying on the word “seed” in a catalogue.
Applying the 25 kg rule to every package
The CBIC circular addresses agricultural farm produce and the defined pre-packaged-and-labelled treatment. It does not create a universal exemption for all agricultural products or all packages above 25 kg.
Quoting an old rate as current law
The 2025 supersession is the central warning. Use older CBIC tables and FAQs to locate likely headings, then verify the operative 2025 entry and amendments.
Treating every farm-related service as exempt
Only specified descriptions qualify. Compare the actual scope of work with the listed agricultural-support entry and retain the contract that proves what was supplied.
When professional advice or an advance ruling is appropriate
Escalate a transaction when the product has multiple possible uses, processing changes its character, seed quality is disputed, packaging facts are unclear, or the tax difference is material. Present the complete specification, labels, intended use, package details, supply contract and proposed HSN to a GST professional. Where available and appropriate, an advance-ruling application can address the applicant’s specific facts; it should not be treated as a universal answer for unrelated goods or taxpayers.
Quick Recap
Practical answer for common scenarios
| Scenario | Correct first question | Safe conclusion from the available official material |
|---|---|---|
| Maize sold for sowing | Is it documented and supplied as maize of seed quality under the relevant heading? | CBIC’s FAQ gives heading 1005 and Nil as an example; verify the current 2025 entry before invoicing. |
| Oilseeds such as groundnut or sunflower seed | Are the goods of seed quality or ordinary commodity, and what is their condition? | The older schedule distinguished seed-quality goods; the current rate is not asserted without the replacement notification. |
| Cereal in a 50 kg bag | Is it agricultural farm produce covered by the relevant entry and outside the pre-packaged threshold? | The 2024 circular addresses packages over 25 kg; confirm the product entry and current notification. |
| Fertilizer blend | What is the exact Chapter 31 formulation and description? | Do not use a generic farm-input rate; verify the 2025 schedule. |
| Custom farm harvesting or storage | Does the actual scope match a specifically listed agricultural service? | Some enumerated services are Nil-rated, but exemption is not automatic for every farm-related contract. |
