How GST Applies to Bank Charges and Inter-Branch Services in India

GST treatment depends on what the bank supplies, which customer or GST registration receives it, whether consideration is charged, and whether a specific exemption applies. A bank fee paid by a customer and an uncharged service between a bank’s separate GST registrations are different GST questions: some specified banking items are exempt, but bank charges are not exempt as a category, and services between distinct persons can be supplies even without a charge.

Is GST charged on bank charges?

Sometimes. A bank charge must be classified by the service it pays for, then checked against the applicable rate and exemption entry. The fact that a charge appears on a bank statement, relates to an account or loan, or is collected by a bank does not by itself establish whether it is exempt or taxable. Nor does the fact that one charge is exempt mean other fees associated with the same account or product receive the same treatment.

CBIC’s banking-sector FAQ explains that banks may charge different customers different amounts for the same service, including free or concessional prices, for commercial reasons. For a service supplied to a customer who is not a related person, the taxable value is generally the transaction value charged or recovered under section 15 of the CGST Act. The FAQ says a bank need not increase that value simply because it offered a concessional or differential price. That is a valuation principle for the described customer transaction; it does not decide whether the service is taxable in the first place or establish a universal GST rate for bank fees.

Interest and ancillary charges are not interchangeable

The GST rate and exemption listing includes a nil-rate entry for interest or discount on deposits, loans or advances, except interest involved in credit-card services. This is a defined exemption, not a general exemption for every amount connected with borrowing or banking. A processing fee, account fee, card fee, late-payment charge or other ancillary amount needs its own classification and the relevant current rate or exemption entry. Do not treat a charge as exempt merely because it is billed alongside exempt interest.

The same caution applies to other banking-related exemptions. The listing includes limited entries such as specified services to Basic Saving Bank Deposit account holders under the Pradhan Mantri Jan Dhan Yojana (PMJDY), and a defined acquiring-bank settlement service subject to a stated transaction threshold. Eligibility depends on the actual service and the conditions in the relevant entry. Check the applicable entry and any amendments before relying on it; the available material does not establish one GST rate covering all bank charges.

How to assess a customer charge

  1. Read the description and identify the service. A statement label can be abbreviated or generic. Check the bank’s invoice, tariff or transaction records to understand what the charge compensates the bank for.
  2. Check whether an exemption fits that exact supply. Confirm the exemption’s description, recipient or service conditions, and any threshold or other limitation. Do not extend an exemption by analogy to a different fee.
  3. If the service is taxable, identify the amount charged or recovered. For a customer who is not a related person, CBIC’s FAQ describes the transaction value as the applicable value under section 15, without an automatic uplift just because the price is concessional.
  4. Check the invoice and place-of-supply details. A taxable invoice, the customer’s GSTIN or recorded location, and the bank’s description of the service can help establish how the bank treated the transaction. An invoice format concession does not make a supply exempt.

Is GST applicable to inter-branch services?

It can be, even when the bank does not raise a bill or record an expense for the receiving branch. For GST purposes, a bank’s branches or offices registered separately under GST can be “distinct persons” even though they belong to the same legal entity and share a PAN. Section 7 read with Schedule I of the CGST Act treats certain supplies between related persons or distinct persons as supplies in the course or furtherance of business even when made without consideration.

CBIC’s banking FAQ specifically addresses head-office management oversight or stewardship supplied to a branch in India. It says such services can be a supply between distinct entities despite the absence of a charge and even if the branch records no corresponding expense. Calling an activity “internal support,” “cost allocation” or “administration” does not determine its treatment. The relevant questions are whether a service is being supplied, which GST registrations are involved, and how the applicable supply and valuation rules apply.

The distinction is not that every internal activity must automatically be taxed. First establish the supplier and recipient registrations and the substance of the activity. A service between separate registrations may fall within the distinct-person rules; an activity within one registration is not automatically converted into an inter-registration supply merely because it involves different offices. The cited CBIC guidance also distinguishes a service to an unrelated recipient: generally, a service supplied without consideration to an unrelated person does not amount to a supply under that guidance. Imports of services by a bank from a related person or its overseas establishment in the course or furtherance of business are addressed separately, so they should not be analyzed by applying the unrelated-recipient rule in isolation.

How are inter-branch services valued?

Whether an inter-branch service is a supply and how it is valued are separate questions. Once the relevant registrations and service are identified, valuation must be considered under the applicable rules. For supplies between distinct persons, Rule 28 of the CGST Rules is central. CBIC’s bank-specific FAQ explains that where the recipient is eligible for full input tax credit, the value declared in the invoice is deemed to be the open-market value. This is a specific valuation provision; it should not be read as a general permission to select any figure without regard to the facts and applicable rules.

The same FAQ discusses banks that use the section 17(4) option, under which a bank or financial institution may avail 50% of eligible input tax credit, subject to statutory conditions. In the valuation situation described there, where no open-market value for like kind and quality is available for the branch service, CBIC says a reasonable basis consistent with Rules 30 and 31 may be adopted. The FAQ also describes estimating support costs through a branch or office certificate for specified stewardship situations, with liability timed when the costs are determined or the certificate is received. These are administrative answers for the circumstances described, not a single mandatory method for valuing every support service.

ITC status affects the analysis

Do not infer that the bank’s input tax credit treatment is the same for every registration or service. CBIC states that the 50% ITC restriction does not apply to tax on supplies between registered persons having the same PAN, while its FAQ discusses the restriction in relation to specified services involving offshore related or distinct persons. The relevant bank option, statutory conditions, recipient registration and nature of the service therefore matter. A business reviewing a branch invoice should not assume that the recipient’s ability to claim credit is established solely by the existence of an invoice.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The practical sequence is to determine whether the recipient registration is eligible for full ITC, whether the bank has opted for the section 17(4) treatment, and whether the specific domestic or offshore scenario falls within the guidance being applied. If no like-kind-and-quality market value can be identified in the situation covered by the FAQ, document the reasonable valuation basis and the supporting records, rather than presenting a cost allocation as automatically correct.

Which location determines the place of supply?

Place of supply helps determine whether a domestic service is treated as inter-State or intra-State for GST purposes. Under section 12(12) of the IGST Act, for banking and other financial services supplied to a person, the place of supply is generally the recipient’s location on the supplier’s records. If that location is not recorded, the supplier’s location is the fallback. CBIC’s FAQ says the address ordinarily used for customer communication may be considered; for a registered customer, a bank may rely on the customer’s GSTIN.

This rule makes the bank’s records important. The location is not necessarily the physical branch where a customer happens to receive assistance. Confirm the location the bank has recorded for the recipient and whether the customer supplied a GSTIN. A customer’s account or mailing details, the service’s actual recipient, and the bank’s recorded information may all be relevant to understanding the invoice.

A customer transaction facilitated by another branch

CBIC’s FAQ illustrates an account held in one State and a service facilitated at a branch in another. The place of supply for the customer-facing service follows the customer or account location on the bank’s records under the applicable rule. If the second branch separately supplies a facilitation service to the first branch, that inter-branch service is a distinct supply and is treated separately. The customer-facing service and the branch-to-branch service should not be collapsed into one transaction simply because both are involved in completing the customer’s request.

Cross-border cases have separate rules

Do not apply the domestic recipient-location rule indiscriminately to cross-border banking services. The IGST Act has a separate rule for certain services supplied by a banking company to account holders in cross-border circumstances: the place of supply is the supplier’s location. The precise facts and statutory category must be checked before applying that rule.

CBIC also addresses qualifying services supplied from an Indian bank, or a foreign bank’s Indian branch, to its offshore head office or branch. Where the services are neither intermediary services nor services to account holders, the FAQ describes them as inter-State supplies between distinct establishments and says they are not treated as exports in the circumstances discussed. That is a specific cross-border treatment, not a general statement that every service to an overseas office is or is not an export. Identify the establishments, registrations, recipient, and nature of service before reaching a conclusion.

What should a business check on a bank invoice?

Banks have some flexibility in the form of tax documents they issue, but that flexibility concerns documentation, not the underlying tax treatment. Under the invoice rules described in CBIC’s guidance, a banking company supplying taxable services may issue an invoice or substitute document without serial numbering and without the recipient’s address if the other prescribed information is present. CBIC’s FAQ also says banks and specified financial suppliers may issue invoices within 45 days from the date of supply of service. These concessions do not make a taxable supply exempt or eliminate the need to identify what the charge relates to.

  • Charge description: Determine the actual service rather than relying on an unexplained statement abbreviation.
  • Supplier and recipient: For an internal service, record the supplier and recipient GST registrations. A common PAN does not erase distinct-person treatment between separate registrations.
  • Consideration and valuation: Note whether the bank charged an amount, whether a no-charge service is between distinct or related persons, and what valuation basis applies.
  • Exemption or rate entry: Match the specific supply to the relevant entry and its conditions; do not infer an exemption from a related product or fee.
  • Place of supply: Check the location on the bank’s records, the recipient’s GSTIN where applicable, and whether a special cross-border rule is relevant.
  • ITC position: Establish the bank’s applicable ITC treatment and the recipient’s credit eligibility before drawing conclusions from the invoice value.
  • Supporting records: Retain the invoice or substitute document, service description, registration details, valuation working and any cost certificate used in a stewardship valuation situation.

For a disputed or material charge, compare the bank’s document with the transaction records and the current statutory entry rather than relying on the label alone. The CBIC FAQ provides administrative guidance for the scenarios it answers; an actual transaction-specific conclusion depends on current law, the exact service, and the registrations and records involved.
