Donation is one possible route—not a guaranteed outcome for every loaf, pastry, or store. The rules and practical steps vary by product, recipient, and location.
What may happen to bakery items a store cannot sell?
A store may identify surplus items, check their condition and packaging, and arrange a transfer to a community food recipient. That is a general illustration, not a universal chain procedure: there is no single national process established for grocery bakeries, and available guidance does not show how often stores donate, discount, compost, or discard bakery surplus.

Food banks, pantries, shelters, soup kitchens, and food rescue organizations may be potential recipients. The U.S. Environmental Protection Agency recommends contacting local organizations to learn what they accept and arranging pickup or delivery. A recipient’s capacity, schedule, and acceptance policy can affect whether a particular item can be donated.
Feeding America says its network receives donations from food and grocery companies, including retailers, and distributes them through partner food banks. Examples of items in its corporate donation program include products near their code dates, discontinued or seasonal products, and products with quality issues that remain fit for human consumption. Those examples do not mean every member food bank accepts every bakery product.

When is unsold bakery food suitable to donate?
The central question is whether the food remains wholesome and can be transferred safely under applicable local rules. A product that is spoiled, contaminated, or mishandled should not be donated. Packaging condition and available product information also matter.
- Condition: Do not donate food showing signs of spoilage. A date alone does not establish whether the food is safe.
- Packaging and labeling: Unopened food should remain in its original packaging. Food should be appropriately labeled, including major allergens, where applicable.
- Protection: Keep food protected from contamination, including dust, debris, spoiled or recalled products, and cleaning supplies. Food handlers should follow clean hygiene practices.
- Recipient requirements: Confirm that the recipient accepts the item and can handle it within its own food-safety procedures.
- Local requirements: Applicable state or local food codes and other rules govern how food may be stored, prepared, packaged, displayed, labeled, and donated.
Bakery products are not all alike. Ingredients, packaging, handling, and shelf stability differ, so the same donation arrangement may not work for every bread, cake, or pastry.

Does a passed sell-by date mean bakery food is unsafe?
No. The FDA says that a passed “sell-by” date does not necessarily mean food has gone bad or is unsafe. A date is not a substitute for checking the food’s condition and handling. A recipient’s policy or a local rule may also set limits beyond the date label, so a store should check those requirements rather than assume that an item is acceptable—or unsafe—solely because the date has passed.

FDA retail guidance calls for safe handling throughout storage and transfer. Food should be wholesome, protected from contamination, and labeled appropriately. Donors should use suitable transport equipment to maintain safe conditions when temperature control is needed, and keep useful records such as what was donated, the date, transporter, and storage temperature.

Temperature-sensitive items
FDA’s retail donation guidance gives holding thresholds of 135°F or above for hot food and 41°F or below for cold food, and says transport must maintain safe temperatures. These thresholds are relevant when a donated food requires hot or cold holding; they should not be read as a requirement that every shelf-stable loaf or pastry be temperature-controlled.
Transfer and records
For temperature-sensitive food, suitable vehicles and equipment should keep the food at safe temperatures during transport. Recording the donated food, transfer date, transporter, and storage temperature can help document how the food was handled. The precise requirements depend on the applicable food code and the donation arrangement.

What rules apply to grocery food donations?
The FDA’s 2022 Food Code clarified that retail food donations are acceptable when food has been stored, prepared, packaged, displayed, and labeled in accordance with applicable food-code provisions and governing statutes or ordinances. The Food Code is a model code, not one nationwide rule that automatically governs every store. Adoption and requirements depend on the relevant state or local jurisdiction.
Federal law also provides conditional liability protections for qualifying good-faith donations. USDA describes the Bill Emerson Good Samaritan Food Donation Act and amendments passed January 5, 2023, which extend protection to qualified direct donors—including retail grocers—who donate directly to individuals at no cost. Conditions apply; USDA says its summary is informational and not legal advice.

How can a local organization coordinate bakery donations?
- Ask what it accepts. Contact a local food bank or food rescue organization about bakery items, packaging, labeling, and any date-related limits.
- Agree on logistics. Set a pickup or delivery schedule that fits the food’s condition and any temperature-control needs.
- Check rules and handling. Confirm the applicable local food requirements and plan safe storage, preparation, packaging, labeling, and transport.
- Keep transfer information. Record useful details such as the items, date, transporter, and storage temperature when relevant.
EPA lists food banks, pantries, shelters, soup kitchens, and food rescue groups as possible recovery partners; it does not endorse listed organizations or their services. A store or donor should verify acceptance and arrangements directly with the local recipient.
What the national figures do—and do not—show
EPA estimated about 66 million tons of wasted food across U.S. food retail, food service, and residential sectors in 2019. That figure is not specific to grocery stores or bakery departments, and it does not measure how much bakery surplus is donated.
EPA reported that 44.2 million people lived in food-insecure U.S. households in 2022. This is context for food recovery, not a count of people reached by grocery bakery donations.
