How Government Bitcoin Seizures and Forfeiture Work in the United States

A Bitcoin seizure is not the same as a completed forfeiture. In a federal case, agents first take control of cryptocurrency under legal authority. The government then must use a criminal, civil judicial, or administrative forfeiture process to establish a legal basis to keep it. Ownership changes only when that process becomes final; a seizure announcement, warrant, or civil complaint does not by itself prove that forfeiture has occurred.

This guide describes federal practice and U.S. Department of Justice guidance. State proceedings, the statute used in a particular case, and the court’s orders can change the analysis. If your wallet or exchange account is involved, the official notice and a lawyer who handles forfeiture—not a general explainer—should control your response.

Seizure and forfeiture are different stages

Seizure gives the government possession or control of property while it investigates and pursues a legal remedy. With cryptocurrency, that normally means moving coins or tokens to a wallet controlled by the government or its custodian. The seizure is temporary in the sense that it does not itself transfer title.

Forfeiture is the legal process that transfers ownership to the United States. A final criminal forfeiture is imposed as part of a sentence after conviction. A civil judicial forfeiture is decided in a case against the property. An administrative forfeiture can become final when the seizing agency receives no compliant claim within the applicable notice period. The route determines who is named, which tribunal handles the matter, and how an owner or other interested person must object.

For that reason, a headline saying that authorities “seized” Bitcoin, or a DOJ complaint alleging that cryptocurrency represents fraud proceeds, should not be read as proof that the government has won the case.

The three federal forfeiture tracks

The Department of Justice summarizes the three federal routes on its Types of Federal Forfeiture page. The practical differences are:

Track What the case is against How it becomes final Notice and response points
Criminal forfeiture The criminal defendant and the defendant’s property interest A conviction is required; forfeiture is ordered as part of the sentence and is generally tied to the convicted counts. Third parties with an interest use a separate ancillary proceeding after the court’s preliminary forfeiture order. The criminal case’s indictment, court orders, and ancillary notice control.
Civil judicial forfeiture The property itself; the United States is the plaintiff and an interested person becomes a claimant A federal court decides whether the property is forfeitable under the statute alleged in the complaint. DOJ’s 2025 policy manual describes a claim deadline of at least 35 days after notice is sent. An answer or Rule 12 motion is due no later than 21 days after the claim is filed, subject to the governing rules and orders.
Administrative forfeiture The property, handled by the seizing agency without an initial court case It can become final when no one files a compliant claim contesting the forfeiture by the deadline in the notice. Written notice is generally due as soon as practicable and no later than 60 days after seizure, subject to statutory exceptions. The claim deadline is the date stated in the notice; when direct notice was not received, the general publication rule is 30 days after the last publication day.

Administrative forfeiture is not a way around due process. A claim must identify the specific property and the claimant’s interest, be made under oath, and be subject to the penalty of perjury. A qualifying claim generally requires the government to file a civil complaint, include the property in a criminal indictment, return the property, or obtain a court extension within the period specified by 18 U.S.C. § 983(a)(3), generally 90 days after the claim.

A petition for remission or mitigation is different from a claim contesting forfeiture. Remission asks the government to provide discretionary relief under its regulations; it does not litigate whether the property is legally forfeitable. Pending notices and the available claim or petition routes are listed through the Justice Department’s Asset Forfeiture Management Staff information and Forfeiture.gov.

How agents seize Bitcoin in practice

Bitcoin is not taken merely because its transaction history is visible on a blockchain. Agents need legal authority and the technical ability to transfer the asset. The DOJ Asset Forfeiture Policy Manual 2025 describes the operational sequence, while warning that agencies may not be able to access every cryptocurrency or wallet.

  1. Confirm storage and disposition capability. Before acting, agents should consult the U.S. Marshals Service about whether the cryptocurrency can be stored and, when legally permitted, liquidated through available procedures. Unsupported assets or unusual custody arrangements may require a different plan.
  2. Obtain authority to take control. Depending on the facts, this can include a seizure warrant, authority already provided by a search warrant, or valid consent. The warrant must identify the property or the place and device where the wallet and private keys can be accessed. A domestic self-custodial wallet may therefore be reached through a phone, computer, hardware device, or location holding the keys.
  3. Access the wallet or account lawfully. The government must obtain the private key, seed phrase, exchange access, or other technical control needed to move the cryptocurrency. Blockchain records alone do not give agents the power to spend coins.
  4. Move the cryptocurrency to a government-controlled wallet. The manual directs agencies to transfer the asset promptly because another person may possess a copy of the private key. The transfer creates a controlled record of the seized amount and transaction.
  5. Record and process the property. The seizing agency enters the asset into the federal forfeiture system, documents its value and custody, and may transfer it to a U.S. Marshals Service or contractor wallet under current procedures.
  6. Start the appropriate forfeiture route. Prosecutors and the agency determine whether the matter proceeds criminally, through a civil judicial complaint, or administratively. That choice is affected by the suspected offense, the property’s statutory status, and whether a criminal defendant or an identifiable owner is available.

These steps describe policy guidance, not a guarantee that an agency can retrieve a particular coin. A self-custody setup, an inaccessible key, a privacy-enhancing design, or unsupported token can affect whether transfer is technically possible.

Who holds seized cryptocurrency?

The investigating or seizing agency normally performs the initial seizure and begins the administrative process. U.S. Attorneys’ Offices prosecute federal criminal and civil forfeiture matters. The U.S. Marshals Service is the program’s primary custodian of seized and forfeited property, with stated exceptions, and disposes of property in its custody as federal law allows. Cryptocurrency may move from the seizing agency to a specialized USMS or contractor wallet rather than remaining with the original investigators. DOJ describes these responsibilities on its Asset Forfeiture Program Participants and Roles page.

Custody is not the same as ownership. Until forfeiture is final, the government is holding the asset while the legal process continues. A transfer between government wallets changes who safeguards the keys, not whether the claimant has a valid property interest.

Does the government immediately sell seized Bitcoin?

Generally, no. DOJ’s 2025 policy states: “Cryptocurrency should be kept in the form it was seized and not liquidated (i.e., converted to fiat currency or other cryptocurrency) until a final order of forfeiture is entered or an administrative forfeiture is final.” The policy recognizes limited situations for an interlocutory sale or pretrial conversion, requires consultation with the Money Laundering and Asset Recovery Section in the circumstances it specifies, and calls for special approval for certain alternative cryptocurrencies.

The reason is practical as well as legal. Bitcoin’s price can change substantially between seizure and final disposition. Converting too early could reduce the value available to a claimant if the property must be returned, or create an obligation for the government to make an owner whole. “Seized” therefore does not mean either “the government always holds it unchanged” or “the government sells it immediately”; the policy, court orders, and the asset’s circumstances determine what happens.

Notices, claims, and deadlines

Deadlines run from the government’s official notice, publication, claim filing, and court orders—not from a news report or a social-media post. The main timing rules are collected here so you can identify which document matters:

Situation General federal timing What controls
Administrative notice after seizure Written notice generally as soon as practicable and no later than 60 days after seizure, subject to statutory exceptions and limited waiver rules. The actual notice, the forfeiture statute, and any valid extension.
Administrative claim By the date printed in the notice. If direct notice was not received, the general publication-based deadline is 30 days after the final publication day. The notice and applicable law; the claim must identify the property and your interest and be sworn under penalty of perjury.
Government action after a qualifying administrative claim Generally 90 days to file a civil complaint, include the property in a criminal indictment, return it, or obtain a court extension. 18 U.S.C. § 983(a)(3), the court, and the facts of the filing.
Civil judicial forfeiture Notice should provide a claim deadline of at least 35 days after it is sent; an answer or Rule 12 motion is due no later than 21 days after the claim is filed under the policy manual’s described procedure. The complaint, service, Federal Rules of Civil Procedure, and court orders.

These are general rules, not a safe calculation for an individual case. A defective filing, a different statutory scheme, a delayed notice, or a court order can change the date. Preserve the envelope, email, publication information, wallet addresses, transaction records, and every attachment that came with the notice.

How to contest a federal Bitcoin seizure

If you believe you own the cryptocurrency or have another legally recognized interest, the immediate task is to identify the track and comply with the notice. A practical sequence is:

  1. Read the notice completely. Identify the seizing agency, asset description, case or seizure number, legal authority, method of filing, and exact deadline. Confirm whether it is an administrative notice, a civil complaint, a criminal indictment or sentencing notice, or a remission/mitigation opportunity.
  2. Protect the deadline. Do not wait for the government to contact you again. An administrative claim is not the same document as a remission petition, and an informal email may not satisfy the required form.
  3. Describe the specific property and your interest. Use the identifiers in the notice—such as wallet addresses, transaction hashes, account numbers, or the amount listed—and explain whether you claim ownership, possession, a security interest, or another legally recognized interest. Follow the oath and signature requirements.
  4. Keep proof of delivery. Use the filing method and address specified by the agency or court. Retain confirmation, copies, and timestamps.
  5. Obtain qualified legal advice promptly. Forfeiture law can involve parallel criminal exposure, privilege questions, tracing of funds, and strict procedural rules. A lawyer can determine standing, select the correct response, and assess whether a court filing is needed. If you cannot afford counsel, ask a local bar association or legal-aid organization about eligibility; no government or private referral is implied here.
  6. Monitor the next filing. After a valid administrative claim, check whether the government files the required civil or criminal pleading, seeks an extension, or returns the property. In a civil case, calendar the response deadline from service and the court’s order, not from the seizure date.

Do not move, conceal, or destroy related devices, records, seed phrases, or communications. Those actions can create separate legal problems and can undermine an ownership claim. Instead, preserve evidence and let counsel advise on privilege and disclosure.

What happens to victims?

When cryptocurrency is tied to fraud or another offense, federal law may permit compensation or restoration to eligible victims. That possibility comes after identification, seizure, and a final forfeiture or other authorized recovery. The amount and timing depend on what assets are actually forfeited, competing claims, tracing, and the governing victim-compensation procedure. A seizure announcement therefore does not mean a victim will be paid immediately or in full.

What a DOJ cryptocurrency case announcement proves

On June 18, 2025, DOJ announced a civil forfeiture complaint concerning more than $225.3 million in cryptocurrency allegedly connected to investment-fraud proceeds and money laundering. The figure describes the amount named in that complaint. It is not a general annual seizure statistic, and the allegations do not establish that the funds were finally forfeited. The release is available at justice.gov.

The example illustrates why the procedural label matters: a civil complaint starts a judicial case against property. The court still must resolve claims, defenses, and any competing interests before ownership is finally transferred.

Federal limits and state-law differences

This explanation is limited to federal practice described by DOJ materials. State agencies may use different statutes, notice systems, deadlines, custodians, and standards. Even within the federal system, the precise forfeiture statute, the location of the property, the type of wallet or account, and case-specific orders can alter the procedure. Use the official notice and docket for the controlling facts.

A quick decision checklist

  • Only a seizure announcement: treat it as temporary government control, not proof of final forfeiture.
  • Administrative notice received: identify the claim deadline and file a compliant, sworn claim if you intend to contest the forfeiture.
  • Civil complaint served: file the claim and then the required answer or Rule 12 response on the court’s schedule.
  • Criminal indictment or sentencing order: determine whether you are the defendant or a third-party claimant and watch for the ancillary proceeding.
  • No direct notice: check the publication record and do not assume the deadline starts when you first hear about the case.
  • Victim seeking repayment: ask about the applicable compensation process, recognizing that payment depends on assets finally forfeited and legally available for distribution.
