If your treatment at a game studio changes after you raise a concern, build a precise, private timeline immediately. Record what happened, when and where it happened, who was present, what you reported, how the employer responded, and each later change to your work. Keep only records you are authorized to retain, and separate firsthand facts from assumptions. That documentation can help an agency, lawyer, union representative, or internal investigator understand the sequence of events. It does not, by itself, prove unlawful retaliation: the applicable right, worker classification, jurisdiction, deadlines, and evidence of a connection all matter.
What documenting retaliation actually means
Workplace retaliation generally involves an employer taking a materially adverse action because a worker exercised a legally protected right. The U.S. Equal Employment Opportunity Commission (EEOC) describes an EEO retaliation claim through three elements: protected activity, a materially adverse action, and a causal connection between them. The agency’s 2016 guidance gives examples of evidence that may support an inference of causation, including close timing, statements suggesting a motive, comparative treatment, and evidence that the employer’s stated reason is false or inconsistent.

That framework is not a universal test for every workplace dispute. A blunt review, an unpopular production decision, or a personality conflict is not automatically unlawful retaliation. Your record should therefore let a decision-maker see the facts and chronology without requiring you to label every event as illegal.
Start by identifying the right and the decision-maker
Before choosing a reporting route, identify what right you may have exercised. Different laws cover different conduct, and coverage can change with your location, job status, employer, and the nature of the complaint.
| Situation | What may be protected | Important limits |
|---|---|---|
| Equal-employment complaint | Participating in an EEO investigation or proceeding, or reasonably opposing conduct made unlawful by an EEO law. | The EEOC says participation can remain protected even when the underlying allegation is unsuccessful or filed late. The precise statute and facts still control. |
| Pay or working-condition discussions | The National Labor Relations Board (NLRB) explains that covered employees may discuss wages and working conditions with coworkers under the National Labor Relations Act (NLRA). | The NLRA does not cover everyone. Supervisors and workers in statutory excluded categories may be outside its coverage, and the details of the discussion matter. |
| California labor-rights complaint | California workers are protected against retaliation for exercising labor rights, regardless of immigration status, under the Labor Commissioner’s guidance. | California rules are not nationwide rules. The Labor Commissioner states a one-year period for a retaliation complaint, but you should verify the current deadline and process. |
| Safety, wage-and-hour, or another workplace right | Potential protections and agencies depend on the specific right and jurisdiction. | Do not assume that an internal complaint, a refusal of an assignment, or a conversation with a coworker follows the same test as an EEO claim. |
Write down your work location, employer entity, job title, supervisor, employment dates, and whether you are an employee, contractor, manager, or supervisor. Those details can affect which agency has authority and whether a statute applies. If you work remotely across state or national borders, note where you performed the work and where the employer is based.

1. Open a dated private log
Start promptly after each relevant event. Use a personal account or notebook that you are permitted to use, not a company system that your employer can alter or access. Give every entry a date and, when known, a time and location. Do not backdate an entry. If you remember something later, add a new entry labelled with the date you remembered it and explain that it is a later recollection.

- Describe the event in chronological order.
- Name the people present and their roles.
- Quote exact words only when you remember them; otherwise identify the wording as an approximate recollection.
- Identify documents, messages, meetings, or recordings related to the event.
- Mark whether each fact comes from your own observation or from another person.
2. Describe the original concern precisely
Record what prompted you to speak up. For a harassment or discrimination concern, identify the conduct, dates, people involved, and the policy or process you used. For pay, hours, or scheduling, state the rate, hours, dates, and the discrepancy you observed. For a safety concern during a build, identify the task, hazard, instruction, and person notified. Avoid conclusions such as “they wanted to punish me” unless you attribute that statement to someone who actually said it.
3. Record when, how, and to whom you reported
Note whether you used a manager, human-resources channel, ethics hotline, union representative, government agency, or another route. Preserve the date, channel, recipient, subject line, meeting invitation, acknowledgment, and response when you are authorized to keep them. If the report was verbal, write a factual follow-up for yourself: who attended, what you said, what the recipient promised to do, and any deadline mentioned.
4. Keep lawful copies of relevant records
California Labor Commissioner guidance specifically identifies pay stubs, time sheets, performance evaluations, commendations, and personal notes as examples of records a worker may gather when documenting changed conditions. Keep copies only when you are authorized to retain them. Do not take confidential source code, unreleased builds, customer data, personnel files, security credentials, trade secrets, or other material merely because it appears on a device you use for work. The sources do not establish a blanket right to copy employer records.

Make a new entry when duties, schedule, pay, hours, access, performance assessments, reporting lines, project assignment, or employment status changes. California’s Labor Commissioner gives demotion and reductions in pay or hours as examples. Record the old condition, the new condition, the effective date, who announced it, the stated reason, and how the change affected your work. Keep ordinary comparison records, such as pay statements and schedules, rather than trying to recreate them months later.

6. Capture possible comparison evidence carefully
If another developer received different treatment, record the factual basis for the comparison: similar role, assignment, policy, date, and documented outcome. Do not speculate about another employee’s medical history, complaint, protected status, compensation, or private circumstances. Comparative evidence can help an investigator assess consistency, but it is not proof by itself and you may not have complete information.
7. Preserve the record without exposing it
Keep an orderly folder with dated filenames and a simple index. Store a backup in a personal location you control, subject to your employer’s confidentiality and device policies. Do not circulate allegations broadly, post confidential material publicly, or edit an original message in a way that obscures its history. If you need to correct an error, preserve the original and add a dated correction.
Evidence that can help show a connection
The following categories come from the EEOC’s retaliation guidance. They are leads for organizing facts, not a checklist that guarantees a legal claim.
| Evidence category | What to record | How to avoid overclaiming |
|---|---|---|
| Timing | Dates of the complaint, acknowledgment, investigation, and later schedule, assignment, evaluation, pay, or termination decision. | Close timing can raise a question, but it does not establish motive without context. |
| Statements | Exact or carefully qualified words by decision-makers about your report, cooperation, coworkers, or “troublemaking.” | Identify who spoke, when, where, and who heard it; do not convert a vague remark into a direct threat. |
| Comparative treatment | Documented differences between similarly situated workers or projects. | State only what you can verify and avoid revealing someone else’s private information. |
| Stated reason versus facts | The employer’s explanation and records that support or contradict it, such as prior evaluations or project milestones. | Show the inconsistency; let an investigator or adviser decide whether it is pretext. |

Harassment or discrimination during production
Record the conduct, location (for example, a studio, conference room, voice channel, or remote meeting), participants, witnesses, and the reporting path. Preserve the relevant meeting invitation or message if authorized. If your review score, access, assignment, or schedule changes afterward, document the change separately instead of assuming the reason.

- Please Note: To reach 10Gbps speed, keep the cable under 3.3 ft. For USB A Male to USB C adapters, try flipping the USB C connector. USB C Male to USB A adapters support bidirectional 10Gbps transfer within 3.3 ft
Pay, hours, and crunch scheduling
Keep pay statements, time records, approved schedules, and written instructions. Note when you raised an overtime, classification, or hours concern and whether the response changed your shifts, rate, duties, or access to work. A personal spreadsheet can summarize dates, but retain the underlying records and state whether hours are recorded contemporaneously or reconstructed.
Discussing compensation or working conditions
The NLRB says covered employees may discuss wages and working conditions with coworkers under the NLRA, and that some employer rules restricting those discussions may violate the Act. Record what the rule says, how it was communicated, who enforced it, and any resulting discipline. Confirm whether you are covered; supervisors and other excluded categories may not be.
Security, source code, and confidential information
A workplace complaint does not authorize copying a repository, build, customer list, personnel file, or credentials. Describe the issue in your log and preserve only records you may lawfully keep. If an investigator needs confidential material, ask how to provide it through an approved channel rather than transferring it to a personal account.
A practical format for each log entry
Use a consistent structure so another person can follow the timeline:

Choosing an internal or external reporting route
Use the route that matches the right involved and your location. An internal report may start an investigation, but it does not necessarily extend an external filing deadline. Ask the relevant agency or a qualified employment adviser about current deadlines before relying on an internal process.
| Question | Why it matters | What to confirm |
|---|---|---|
| What right was exercised? | EEO, wage/hour, safety, concerted activity, and other rights have different coverage and tests. | The statute, protected activity definition, and required elements. |
| Which agency has jurisdiction? | Agencies do not all investigate the same conduct or worker categories. | Employer location, work location, worker status, and agency intake rules. |
| What is the filing deadline? | Missing a deadline can end an otherwise viable route. | The current period, any prerequisite charge, and whether internal action changes it. |
| What can you safely retain? | Employer systems may contain confidential or proprietary material. | Device, recording, confidentiality, and document-handling rules. |
For California, the Labor Commissioner’s guidance says a retaliation complaint should be filed within one year of the retaliatory act. Treat that as California-specific information and verify the current deadline and filing process with the office; it is not a general deadline for every claim or location.

Common documentation mistakes and safer fixes
- Writing only conclusions: Replace “my boss retaliated” with the event, date, words, decision, and measurable change.
- Waiting until termination: Start when the concern or first change occurs, while details and ordinary records are available.
- Mixing hearsay with observation: Label what you saw, what you heard directly, and what another person told you.
- Taking everything from a company system: Keep authorized copies and describe inaccessible records without copying restricted material.
- Editing old entries silently: Preserve the original and add dated corrections.
- Assuming every negative event is protected retaliation: Identify the right exercised and the evidence connecting it to the action.
- Posting the dispute publicly: Avoid disclosing confidential information or making unsupported accusations; use an appropriate reporting channel.
When to seek help
Consider prompt advice from the agency with jurisdiction, a qualified employment lawyer, a worker center, or a union representative when discipline, demotion, reduced pay or hours, termination, a demand to sign a release, or a short filing deadline is involved. Bring a dated chronology, the records you are authorized to retain, your employment location and classification, and the exact policy or complaint channel used. Ask how to preserve evidence lawfully and whether contacting one agency affects another route.
Do not wait for certainty before checking a deadline. At the same time, do not describe an unverified theory as an established fact. A clear record gives the eventual decision-maker the chronology, source, and context needed to evaluate what happened.
What a strong record allows someone else to see
The finished file should answer five questions without relying on memory: What happened? When and where did it happen? Who knew about the concern and when? What changed afterward? Which records and witnesses can verify each point? Keep the narrative factual, preserve lawful evidence, and let the applicable agency or qualified adviser determine whether the facts meet a legal standard.
