If the Assembly is fragmented, a government may have to negotiate support or abstentions bill by bill. It can also use Article 49(3) to make a bill’s passage a question of its responsibility: the bill is treated as adopted unless the Assembly passes a motion of censure. If censure succeeds, the Prime Minister must tender the government’s resignation. A new election is possible, but it is a separate presidential decision governed by limits on dissolution.
How is France’s government formed?
The process starts with the President of the Republic. Under Article 8 of the Constitution of the Fifth Republic, the President appoints the Prime Minister. The Prime Minister then proposes the other members of the government, whom the President appoints. This gives the President a formal role in forming the executive, but it does not by itself ensure that the resulting government can govern effectively.

That depends in large part on the National Assembly. The government is responsible to Parliament under Articles 49 and 50, and the Assembly can bring it down through a motion of censure. In practical terms, a Prime Minister needs enough political support—or enough opposition members willing not to vote against the government—to keep it in office and make legislation possible. Appointment and political viability are therefore related but distinct: the President makes the appointment, while the Assembly’s response determines whether the government can survive.

Appointment is not the same as parliamentary backing
The Constitution does not make a prior investiture vote a condition for appointing a Prime Minister. That means the appointment can happen before the Assembly has formally endorsed the government’s programme. It does not mean the Assembly is irrelevant or that a Prime Minister can disregard its ability to censure the government.

Article 49(1) provides a route for the Prime Minister, after deliberation in the Council of Ministers, to engage the government’s responsibility on its programme or a general-policy statement. If the Assembly fails to endorse that programme or statement, Article 50 requires the Prime Minister to tender the government’s resignation to the President. The Constitution thus distinguishes the appointment itself from a subsequent test of political support.
What does a deadlocked National Assembly mean?
“Deadlock” is a political description, not a constitutional switch that automatically triggers an election or ends a government. It can describe an Assembly in which no government can count on a reliable majority for its proposals. The consequences are practical: passing legislation or budgets can become harder, and each major proposal may require fresh bargaining.
The composition of the Assembly can make a stable governing majority difficult, but no particular party arithmetic or current seat count is needed to understand the constitutional choices. The relevant question for a government is whether it can assemble enough votes for a proposal, persuade some members to abstain, or use a constitutional procedure that carries a risk of censure.

Political bargaining remains central
In a fragmented Assembly, a government may negotiate support for a particular bill, revise a proposal to attract more votes, or seek abstentions from members who would otherwise oppose it. These are political strategies, not outcomes guaranteed by the Constitution. A negotiated arrangement can be limited to one issue rather than a durable coalition, so support for one measure does not automatically establish support for every later bill.

When ordinary passage is uncertain, Article 49(3) is another route, but it changes the stakes. Rather than simply asking members to vote on a bill in the ordinary way, the government makes that bill’s passage an issue of its own responsibility. The Assembly then has the possibility of defeating the government through censure. This mechanism can move legislation forward without a conventional majority vote in favour, but it is not a guarantee that the government will survive.
What is Article 49(3)?
Article 49(3) allows the Prime Minister, after deliberation in the Council of Ministers, to engage the government’s responsibility on a bill. Under the constitutional procedure, the bill is treated as adopted unless the National Assembly adopts a motion of censure. The procedure links the bill’s fate to the government’s survival: members who want to stop the bill can seek to censure the government, while the government risks resignation if that challenge succeeds.
It is important not to reduce Article 49(3) to either “the bill automatically passes” or “the government automatically falls.” The bill is treated as adopted only if the Assembly does not adopt a motion of censure. If censure does succeed, the government faces the consequence set out in Article 50. The political calculation is therefore whether the government judges that it can withstand the censure risk more readily than it can win an ordinary vote on the bill.

On an ordinary bill, the immediate question is whether the proposal can obtain sufficient support to pass. Under Article 49(3), the government makes passage a matter of responsibility, and the relevant counter-move is a motion of censure. That can matter when a government lacks dependable support for a positive vote but believes opponents will not unite to pass censure.

Using Article 49(3) is consequently a constitutional procedure with a political cost, not a routine substitute for building support. It exposes the government to a vote that can end its tenure. Nor should it be read as a way to bypass the Assembly entirely: the Assembly’s censure power is the check built into the procedure.
What happens after a successful censure motion?
Article 50 sets out the consequence. When the National Assembly adopts a motion of censure, the Prime Minister must tender the government’s resignation to the President. The same requirement applies if the Assembly fails to endorse the government’s programme or general-policy statement under Article 49(1).
“When the National Assembly passes a resolution of no-confidence, or when it fails to endorse the Government programme or general policy statement, the Prime Minister shall tender the resignation of the Government to the President of the Republic.”

Tendering the resignation is the constitutional consequence for the government. It is not the same thing as dissolving the National Assembly. The President’s dissolution power is separate, and Article 50 does not require the President to call an election when a government resigns. A political crisis can therefore lead to a change of government without an immediate parliamentary election.
Recent examples show both possible outcomes
In December 2024, the National Assembly adopted a motion of censure after the government engaged its responsibility under Article 49(3) on the 2025 Social Security finance bill. The Prime Minister then tendered the government’s resignation under Article 50. This illustrates the risk built into the procedure: the Assembly’s censure succeeded, and the government was required to resign.
On 2 February 2026, the Assembly rejected two motions of censure after the government used Article 49(3) on the 2026 finance bill. The bill was considered adopted at final reading. This was the other possible outcome: censure did not pass, so the bill was treated as adopted under the procedure. These examples concern different bills and different votes; neither establishes a universal prediction about how a future Assembly will respond.

Can France’s President call a snap election?
Yes. Article 12 gives the President the power to dissolve the National Assembly, after consulting the Prime Minister and the presidents of both houses of Parliament. The consultation requirement is part of the procedure; dissolution is nevertheless a presidential power. The Senate is not dissolved when the National Assembly is.

There is also a timing limit: another dissolution is barred during the year following the election held after a dissolution. The restriction applies to a further dissolution in that period, not to the formation of a new government or the Assembly’s ability to consider legislation.
Dissolution is one possible political response to a deadlock, not an automatic result of a hung Assembly or a government’s resignation. The President may choose to use the power within Article 12’s rules, but the Constitution does not require an election whenever a government loses a vote or struggles to pass a bill.
How the main outcomes differ
| Situation | Immediate constitutional or political result | What it does not automatically mean |
|---|---|---|
| Ordinary negotiated passage | The government seeks support or abstentions for a proposal and tries to pass it through the usual parliamentary route. | Support for one bill does not guarantee a lasting majority or support for later proposals. |
| Article 49(3), without successful censure | The bill is treated as adopted under the procedure. | It does not mean that every use of the procedure is risk-free or that the government has a secure majority. |
| Successful motion of censure | The Prime Minister must tender the government’s resignation under Article 50. | It does not itself dissolve the National Assembly or require a new election. |
| Presidential dissolution | The National Assembly is dissolved and an election follows; Article 12’s consultation requirement applies. | The Senate is not dissolved, and another dissolution is barred for a year after the resulting election. |
A practical way to read a French political crisis
When a government faces opposition in a fragmented Assembly, separate three questions that are often blurred together in headlines:
- Who formed the government? The President appointed the Prime Minister, and the Prime Minister proposed the other ministers for presidential appointment.
- Can the government pass its business or survive a challenge? That depends on political support in the National Assembly, including the possibility of negotiation, ordinary votes, Article 49(3), and censure.
- Will there be a new election? That depends on a separate presidential decision to dissolve the National Assembly under Article 12, subject to consultation and the one-year restriction.
Keeping these questions separate avoids a common misunderstanding: difficulty passing legislation is not itself a dissolution, and a government’s resignation is not the same event as a parliamentary election. The constitutional system provides routes for the executive to be appointed, challenged and replaced, while leaving the decision to dissolve the Assembly in a distinct part of the Constitution.
