How forged purchase orders and end-use certificates are detected in export compliance

Exporters do not prove a purchase order (PO) or end-use certificate is forged with one visual or technical test. Under U.S. Export Administration Regulations (EAR) guidance, they detect risk by comparing the documents with the whole transaction: the buyer’s business, item and quantity, destination, end user, shipping route, payment and behavior. An inconsistency is a red flag that requires questions and corroboration—not proof of fraud.

The practical sequence is to reconcile every document, assess whether the deal is commercially plausible, identify and screen all relevant parties, ask targeted follow-up questions, reassess the answers and stop or escalate when concerns remain.

What “forged” means in an export-compliance review

A PO or end-use certificate can be inaccurate for many reasons: a clerical error, an inexperienced buyer, a broker using outdated information or deliberate deception. U.S. Bureau of Industry and Security (BIS) guidance focuses on recognizing red flags and applying reasonable inquiry. It does not prescribe a forensic examination that authenticates signatures, letterhead, metadata, numbering sequences or scanned images.

That distinction matters. A document that contains a mismatch may be genuine but incomplete. Conversely, a document that looks professional may still conceal an unauthorized end user or destination. The compliance question is whether the exporter knows enough about the transaction to proceed lawfully under the EAR, not whether a page passes a document-authentication test.

The controlling material discussed here is U.S. BIS guidance under the EAR. The BIS Part 744 regulation text was reported as current in the eCFR on October 7, 2026. Licensing requirements, restricted-party rules and end-use controls vary by item, destination, end user and facts. Other jurisdictions use separate regimes.

The transaction-level review workflow

Use the following sequence as an internal review framework. It is an editorial synthesis of BIS risk and inquiry guidance, not a legally mandated forensic standard for every export.

  1. Collect the complete transaction record. Assemble the PO, end-use or end-user statement, quotations, invoices, licenses or license determinations, shipping instructions, payment details, correspondence and information supplied by distributors, brokers and freight forwarders.
  2. Reconcile the core facts. Compare the purchaser, ultimate consignee, intermediate consignee, end user, item description, technical specifications, quantity, destination and stated use across each document. Record differences rather than silently correcting them.
  3. Test commercial plausibility. Ask whether the goods and quantity fit the purchaser’s line of business, staff, facilities and claimed application. Consider whether the destination could support the item’s technical requirements and whether the delivery plan is credible.
  4. Identify every transaction party. Map the roles of the buyer, customer, end user, consignees, agents, distributors, freight forwarder, financing bank and any other intermediary. A party does not need to be the final recipient to create a compliance issue.
  5. Screen and investigate. Screen relevant parties against applicable restrictions, including the U.S. Consolidated Screening List where appropriate. Then ask focused questions about unexplained differences, end use, end user, destination, payment and shipping instructions.
  6. Reassess and decide. Evaluate the answers against all information already available. If concerns are resolved, retain the explanation and supporting evidence. If concerns remain, refrain from the transaction or submit relevant information to BIS in an appropriate form.

BIS states that, absent red flags or an express EAR requirement, an exporter generally has no affirmative duty to go behind a customer’s representations. Once red flags arise, however, the guidance says the exporter has a duty to check the suspicious circumstances and inquire.

What to compare across the PO, certificate and transaction

Comparison Question for the reviewer Why a mismatch matters
Business versus product capability Does the buyer’s ordinary business require or plausibly use the requested technology? An order inconsistent with the customer’s line of business is a BIS red flag.
Quantity versus plausible need Can the buyer explain the volume, production plan, inventory cycle or project that requires it? An unexplained quantity can indicate diversion or an undisclosed recipient, although it does not prove either.
End use versus item and customer profile Do the technical capabilities, facilities and personnel match the stated use? A sophisticated item claimed for an implausible application warrants inquiry.
Destination versus shipping plan Does the named destination match the consignee, route, delivery date and installation location? Vague dates, out-of-the-way destinations or late routing changes can signal evasion.
Named parties versus payment source Who pays, from which country and account, and why? Payment by an unlisted third country or business requires an explanation of the commercial relationship.
Normal service versus declined support Why does the customer reject routine installation, training or maintenance? Refusal can be a red flag when support would normally be necessary for safe or effective use.

These comparisons test coherence. They are not a scoring system and should not be treated as automatic denials.

Official red flags that should trigger questions

Buyer, business and product signals

  • The customer is reluctant to explain the intended end use.
  • The order does not fit the customer’s stated line of business or known capabilities.
  • The product’s sophistication is incompatible with the destination’s technical level or the buyer’s facilities.
  • The customer has little verifiable business background or appears unfamiliar with the product despite requesting it.
  • The quantity, specifications or urgency do not fit the stated project.

BIS illustrates the commercial-plausibility problem with an order for sophisticated lasers from a small bakery. The example is a prompt to investigate the transaction’s logic, not a rule that a small company can never lawfully buy advanced equipment.

Service, delivery and payment signals

  • The buyer refuses normal installation, training or maintenance.
  • Delivery dates are vague, repeatedly change or point to an unusual destination.
  • A last-minute shipping change conflicts with the customer’s prior history or the original end-use statement.
  • Cash is offered for an expensive item when financing or an ordinary corporate payment method was expected.
  • Payment arrives from an unlisted third-country business or account.

Intermediary and communications signals

  • The customer is reluctant to complete an end-user form or will not identify the ultimate user.
  • Corporate vehicles obscure ownership, control or the countries involved.
  • Personal email accounts are used for a transaction that purports to be corporate.
  • A broker, distributor or forwarder supplies inconsistent descriptions of the parties, route or use.

A March 2, 2023 interagency compliance note associates these intermediary and evasion indicators with elevated transaction risk. Each is a reason to obtain an explanation and corroborating information; none, alone, establishes that a PO or certificate is counterfeit.

How to verify an end-use certificate without treating it as proof

“Verification” in this context means corroborating the representation against independent transaction facts. It does not mean that BIS has prescribed a single authenticity test.

Confirm the parties and roles

Check that legal names, addresses, registration details and contact information are consistent across the certificate, PO, quotation, shipping documents and correspondence. Distinguish the purchaser from the ultimate consignee, intermediate consignee and end user. Ask why an intermediary appears and what authority it has.

Clarify the stated use

Request a plain-language description of the process, facility, project or product in which the item will be used. Ask for specifications, installation location, expected quantities and the person responsible for operation. The explanation should fit the item’s capabilities and the customer’s business, not merely repeat the wording on the certificate.

Validate destination and logistics

Compare the certificate’s destination with the requested Incoterm or delivery instruction, freight route, consignee address and installation site. Require an explanation for a new route, an out-of-the-way destination or a delivery date that is impossible for the stated project.

Explain payment and ownership

Identify the paying entity and its relationship to the buyer. Ask why a third-country company or personal account is paying, who owns the goods during transit and who bears the commercial risk. Preserve invoices, bank information supplied for compliance purposes and written explanations in the transaction file.

Recheck after the customer responds

Do not close the review merely because a customer sends a revised certificate. Compare the new version with prior documents, assess whether the explanation resolves every material discrepancy and determine whether the change itself creates a new red flag.

Party screening is part of document review

A certificate can name a legitimate buyer while concealing a restricted consignee or end user elsewhere in the chain. Identify and screen all known transaction parties against the lists and restrictions applicable to the transaction. BIS guidance for freight forwarders specifically recommends looking for red flags in documents and screening known parties against the Consolidated Screening List.

Screening is not a certificate-authentication service. A party’s unverified status, a screening hit that requires further resolution or an inability to complete a government end-use check does not, by itself, prove that a particular PO or certificate was forged. Resolve possible matches using the applicable list procedures, ownership information and transaction facts.

Questions to ask when paperwork looks suspicious

Use specific, neutral questions that can be answered with records. Broad demands such as “prove this is real” often produce another unsupported assertion.

  • Who will operate the item, at which physical site and for what process?
  • Why does the requested quantity match the stated production, research or service plan?
  • Why is the product appropriate for the buyer’s business and the destination’s technical environment?
  • Why do the PO, certificate, invoice and shipping instruction name different entities or addresses?
  • What is the relationship between the buyer, end user, payer and freight forwarder?
  • Why did the route, consignee, payment source or delivery date change after the order was placed?
  • Why is routine installation, training or maintenance being declined?
  • Can the customer provide incorporation, facility, project, purchase or technical records that support the explanation?

Document the question, the response, the evidence supplied and the reviewer’s conclusion. A written audit trail makes it possible to show how the exporter reached its decision without claiming certainty that the evidence cannot support.

When to stop or escalate

BIS’s guidance is direct: “However, when ‘red flags’ are raised in information that comes to your firm, you have a duty to check out the suspicious circumstances and inquire about the end-use, end-user, or ultimate country of destination.”

It continues: “If you continue to have reasons for concern after your inquiry, then you should either refrain from the transaction or submit all the relevant information to BIS in the form of an application for a license or in such other form as BIS may specify.”

In practice, unresolved concerns include a customer who will not identify the end user, contradictory explanations, a destination that changes without a credible reason, payment by an unexplained third party, or an item and quantity that remain commercially implausible after inquiry. Escalation should involve the exporter’s compliance and legal decision-makers and, where appropriate, BIS through the channel applicable to the matter. Do not ship while waiting for an explanation that has not arrived.

What common “forgery checks” can and cannot establish

Organizations may use internal controls such as calling a known corporate telephone number, confirming a signatory’s role, comparing a document with prior correspondence, checking whether an address is operational and preserving file metadata. Those can strengthen corroboration, but they are organizational practices, not forensic requirements established by the BIS guidance summarized here.

The reviewed official material does not provide a required method for detecting altered signatures, manipulated metadata, counterfeit letterhead, fabricated PO numbers or image-editing artifacts. A clean result from any such check cannot certify that the transaction is lawful, and a failed check cannot by itself prove fraud. Treat technical anomalies as additional questions and consider qualified forensic assistance only when your legal and compliance framework calls for it.

Responsibilities of exporters and freight forwarders

The exporter remains responsible for applying the EAR to its transaction. A freight forwarder can improve visibility by reviewing documents for red flags and screening known parties, but BIS guidance does not say that a forwarder authenticates every document or assumes the exporter’s entire compliance responsibility.

Exporters should define who collects the end-use statement, who resolves discrepancies, who performs screening, who approves release and who records the final decision. Contracts and operating procedures can allocate tasks, but they do not eliminate the need for the exporter to respond to red flags it knows or has reason to know about.

Worked examples: inconsistency is a trigger, not a verdict

Advanced equipment ordered by a small service company

A small bakery orders sophisticated lasers. The business profile and item capability do not align, so the exporter asks for the installation site, technical staff, project documents and ultimate user. If the bakery is acting as a documented reseller for a qualified manufacturer, the apparent mismatch may be resolved. If it cannot explain the order, the concern remains.

Unlisted payer and changed destination

The PO names a domestic distributor, but payment comes from an unrelated company in another country and the freight forwarder receives a last-minute instruction to deliver elsewhere. The exporter identifies the payer and new consignee, checks the ownership and route, asks why the change occurred and reassesses the end-use statement. The combination is serious because several transaction facts changed; it is still not automatic proof that either document is forged.

Refusal of normal installation

A buyer claims to need complex equipment but refuses the manufacturer’s ordinary installation and training. The exporter asks who will operate the system, where it will be installed and why support is unnecessary. An experienced in-house team may provide a credible explanation; evasive answers or a second unexplained destination may require the exporter to refrain.

Limits, records and jurisdiction

No named statistic or quantified detection rate has been established for forged POs or end-use certificates in the official material considered here. Do not represent a red-flag checklist as a fraud-detection accuracy percentage.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep the transaction record long enough to meet the retention rules that apply to the export and your compliance program. Preserve original documents, versions, correspondence, screening results, questions, answers, approvals and the reason for releasing, holding or declining the shipment. Apply the requirements for the relevant item, destination and parties; EAR guidance does not replace sanctions, customs, anti-bribery, financial or foreign export-control obligations.

A practical decision checklist

  • All parties and roles are identified, including the ultimate end user and consignee.
  • The PO, end-use certificate, invoice and shipping information agree on item, quantity, destination and use—or every difference has a documented explanation.
  • The buyer’s business, facilities and technical capability make the order plausible.
  • Payment source, ownership and delivery route are understood.
  • Known parties have been screened against applicable restrictions and possible matches resolved.
  • Red flags were answered with specific, supportable information.
  • The reviewer reassessed the entire transaction after follow-up.
  • Unresolved concerns were escalated or the transaction was stopped before shipment.

A coherent record supports a defensible decision. It does not turn a document into a government-certified original, and it does not excuse applying the EAR and other rules that govern the particular export.
