How European businesses can evaluate AI platforms for data sovereignty and compliance

The safest way to evaluate an AI platform is to assess the entire service, not just its advertised hosting region. Define the intended use and data first, map prompts, files, outputs, logs, support access, backups and subprocessors, then verify GDPR contracts and transfer safeguards. Separately classify the use under the EU AI Act and compare sovereignty, security, resilience, portability and operating effort across the exact product and configuration you would buy.

An EU data centre can reduce exposure, but it does not by itself prove that a provider is independent of third-country law, prevents remote access, controls its supply chain, limits model training or meets your organisation’s legal duties.

What data sovereignty means for an AI purchase

Data sovereignty is the practical ability to know, control and legally govern data throughout an AI service’s lifecycle. That lifecycle includes the prompt a user types, files uploaded for analysis, generated output, safety and abuse records, account metadata, diagnostic telemetry, backups, disaster-recovery copies and support tickets. It also includes the people, companies and technical systems that can access those records.

Residency is only one control

“Hosted in the EU” normally describes a selected storage or processing region. It may not answer where support staff work, where monitoring systems run, where backups are replicated, which subprocessors handle content, or whether a parent company can receive a legally binding access request from outside the European Economic Area (EEA). Ask the provider to identify every processing location and every access path for the specific plan, model and region you intend to use.

Control and jurisdiction matter

Assess the contracting entity, governing law, ownership and management control, foreign-investment exposure, and the provider’s documented process for government requests. Encryption at rest, an EU region and a compliance badge are useful evidence, but none substitutes for a documented assessment of access, legal powers and technical safeguards.

Define the use case before comparing platforms

Platform obligations depend on context. A public marketing-draft assistant, an internal coding tool and a system that ranks job applicants have different privacy, security and AI Act implications.

Write a one-page use-case statement

  • State the business purpose and prohibited uses.
  • Name the users, affected individuals and business owners.
  • List the data classes: public, internal, confidential, personal, special-category, regulated or trade-secret information.
  • Describe whether the system only generates suggestions or makes, recommends or influences decisions about people.
  • Set success criteria, human-review points, retention limits and an exit plan.

Identify your legal and operational role

For each arrangement, determine whether your organisation is acting as an AI provider, deployer, importer, distributor or another actor. The answer can change when you fine-tune a model, place it in a product, substantially modify it or use it for a regulated purpose. A vendor’s statement that its service is “compliant” does not perform your classification or governance duties.

Map the complete information flow

Create a diagram and a data inventory before requesting prices. Record the destination, purpose, retention and access controls for every stage:

  1. Collection: identify who enters prompts and whether personal data is copied from business systems.
  2. Transmission: document client applications, APIs, gateways, encryption in transit and any intermediary service.
  3. Inference: confirm where the model runs, which model version is used and whether content is retained for safety, abuse monitoring or service improvement.
  4. Uploads and retrieval: map file stores, embeddings, vector databases, connectors and cached copies.
  5. Outputs: establish whether generated text, code or decisions are stored, exported or fed into another system.
  6. Operations: include administrator access, customer support, diagnostics, telemetry and incident investigation.
  7. Resilience: locate backups, replicas, failover regions and disaster-recovery providers.
  8. Deletion and exit: define deletion timing, backup expiry, export formats and the procedure for terminating accounts and subprocessors.

Require the supplier to confirm this map in writing. Marketing documentation often describes the normal path but omits support access, temporary caches or recovery copies.

Use a structured sovereignty scorecard

The European Commission’s Cloud Sovereignty Framework is a useful benchmark. It uses 48 criteria across eight categories and introduces a Sovereignty Effectiveness Assurance Level (SEAL) and an overall sovereignty score. It was created for EU institutional procurement, so a private company should adapt it to its risk rather than treat it as a mandatory certification or universal pass mark.

Category Questions to ask Evidence to request
Strategic autonomy and resilience Who owns and controls the provider? What happens after an outage, sanction, acquisition or regulatory change? Are credible alternatives available? Ownership information, continuity plan, concentration analysis, recovery objectives and tested exit plan.
Legal and jurisdictional Which entity contracts with you? Which law applies? Who can access content, and how are government requests handled? Contract, access-policy description, government-request procedure and transfer assessment where relevant.
Data and AI Are prompts, files or outputs used for model improvement? How are retention, deletion, evaluation data and model-version changes controlled? Product-specific data-use terms, retention schedule, deletion confirmation, training opt-out terms and change notices.
Operational Can you enforce least privilege, review administrator actions and receive timely incident notices? How are changes and subprocessors approved? Identity and role-control documentation, audit-log samples, incident terms, service-level commitments and change process.
Supply chain Which subprocessors, model providers, infrastructure operators and software components are involved? Can you reject or exit after a material change? Current subprocessor list, locations, roles, notification terms, dependency map and substitution or exit procedure.
Technological Can data, prompts, configurations and outputs be exported? Are APIs and formats documented? How difficult is a provider change? Export specification, API documentation, portability test, open-standard details and migration estimate.
Security and compliance How are data, keys, tenants and networks isolated? What independent assurance covers the exact service tier? Encryption design, key-management options, vulnerability process, penetration-test or assurance reports and scope statements.
Environmental sustainability Is energy, water, efficiency or emissions information material to your procurement policy? Provider methodology, reporting boundaries, improvement targets and data for the purchased service where available.

Score each criterion with a documented answer, evidence quality and residual risk. Mark “not established” when the provider has not supplied proof; do not convert silence into a pass.

Compare deployment choices without assuming a universal winner

Option Strengths Typical gaps and questions
EU-region service from a global provider Fast deployment, mature features and a defined European processing region. Parent-company jurisdiction, remote support, non-EU subprocessors, foreign-access exposure, training controls and backup locations still require verification.
EU-controlled service Potentially stronger control over ownership, personnel, contracting and jurisdiction. Check model provenance, resilience, scale, security evidence, support coverage and dependence on non-EU infrastructure or model suppliers.
Customer-managed or self-hosted deployment Greater control over network location, keys, identity, logging and retention. Your organisation assumes patching, model updates, abuse prevention, availability, incident response, hardware and specialist staffing.
Non-EU service with transfer safeguards May provide unique capability or economics when an appropriate legal and technical arrangement exists. Document the transfer mechanism, supplementary measures, access needs, government-request exposure, subprocessor chain and practical ability to suspend use.

Compare all four against the same use-case requirements. A technically sovereign deployment that cannot meet availability or security objectives may create more risk than a managed service with demonstrably stronger controls.

Complete the GDPR assessment

Check whether GDPR applies

GDPR applies to an EU-established company or branch processing personal data in its activities, regardless of where the processing occurs. It can also apply to organisations outside the EU that offer goods or services to people in the EU or monitor their behaviour. Small and medium-sized enterprises are not categorically exempt. Pseudonymised or encrypted data remains personal data when re-identification is possible; only irreversible anonymisation takes the data outside GDPR.

Verify the processor arrangement

When a platform processes personal data on your behalf, the contract or other legal act must require sufficient technical and organisational guarantees. Check that the data-processing agreement and instructions cover:

Review these terms against the actual product tier. A general corporate policy may not cover an API, an enterprise workspace, a beta model or a regional feature.

Assess international transfers separately

The EEA includes Iceland, Liechtenstein and Norway. Transfers outside the EEA require an appropriate safeguard, such as an adequacy decision, standard contractual clauses, binding corporate rules, certification, a code of conduct or a limited derogation. Identify the exporter, importer, destination, purpose and data categories, then document the applicable mechanism and any supplementary measures.

EDPB Recommendations 01/2020 specifically address cloud providers and other processors that need access to personal data in clear text. This means an EU storage location or encryption at rest may not resolve the transfer question when provider personnel or systems can access readable data. Your privacy or legal function should approve the current transfer assessment for the concrete service and access model.

Apply the AI Act risk framework

Use current dates, not a static checklist

The AI Act entered into force on 1 August 2024. The Commission’s overview states that it became generally applicable on 2 August 2026, with exceptions. Prohibited practices and AI-literacy obligations began on 2 February 2025; obligations for general-purpose AI (GPAI) models and governance provisions applied from 2 August 2025.

The 2026 AI Omnibus entered into force on 27 July 2026. The Commission’s 3 August 2026 overview extends rules for high-risk systems in specified sensitive areas—including biometrics, critical infrastructure, education, employment, migration, asylum and border control—to 2 December 2027, and certain high-risk AI embedded in regulated products to 2 August 2028. Transparency rules are listed as applying from August 2026. Confirm the current consolidated law and guidance before signing, because implementation details and classifications can change.

Request provider documentation

For the intended purpose and configuration, ask for information on capabilities and limitations, training and evaluation data, logs, human oversight, accuracy and robustness, cybersecurity, change management and incident reporting. Establish what the provider supplies and what your organisation must implement as deployer, including user instructions, monitoring, records, human review and escalation.

Do not assume that calling a tool a “general assistant” removes high-risk obligations. Classification follows the system’s use and function, not its marketing label.

Use the Commission’s sovereignty levels as a reference, not a private-sector mandate

The proposed Cloud and AI Development Act (CADA) describes four assurance levels for public bodies, selected through risk assessment:

  1. Level 1: processing and storage on infrastructure located in the Union.
  2. Level 2: provider independence from third countries and software supply-chain transparency.
  3. Level 3: EU ownership and control, with additional criteria such as personnel citizenship; the Commission says third-country providers may be recognised.
  4. Level 4: full software-supply-chain transparency and control, with no third-country interference.

The Cloud and AI Development Act defines cloud and AI sovereignty comprising four assurance levels, to be used by public sector bodies based on their risk assessments.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

CADA is a proposal, not a blanket binding requirement for private companies. Use its progression to explain why location alone is weaker than control, transparency and resistance to external interference, and verify its legal status before writing a procurement requirement around it.

Run an evidence-based procurement process

  1. Set non-negotiables: define forbidden data, required regions, transfer safeguards, key ownership, uptime, deletion time and acceptable residual risk.
  2. Issue the same questionnaire: require product, plan, model, region and configuration identifiers in every answer.
  3. Collect primary evidence: obtain contracts, subprocessor schedules, architecture diagrams, assurance reports, incident terms, export specifications and change notices.
  4. Test the controls: create a non-production workspace; verify role restrictions, logging, retention, deletion, export, model settings and support escalation.
  5. Record exceptions: assign each gap an owner, deadline, compensating control and decision-maker.
  6. Approve by risk tier: route sensitive, personal-data or high-impact uses to privacy, security, legal and AI-governance reviewers.
  7. Monitor after purchase: review subprocessor and model changes, incidents, access logs, transfer assessments, service performance and exit readiness at defined intervals.

Make trade-offs explicit with weighted scoring

Weight categories according to the use case rather than giving every question equal importance. For a low-risk internal drafting tool, usability and portability may dominate. For health, employment or government-related data, jurisdiction, access control, transfer safeguards and human oversight may be gating requirements.

Use a simple scale such as 0 for no evidence, 1 for a documented but weak control, 2 for independently supported control and 3 for independently tested control. Apply a “fail” rule for non-negotiables: a high score cannot compensate for an unacceptable transfer mechanism, prohibited use, missing deletion path or inability to control privileged access. Keep the evidence file with the signed decision so a later model, region or subprocessor change triggers reassessment.

Common evaluation mistakes and their fixes

  • Choosing by region selector: obtain the full processing and access map, including backups and support.
  • Treating certification as compliance: verify scope, dates, exclusions and whether the certificate covers your exact service tier.
  • Assuming opt-out means deletion: distinguish model-training settings from account retention, logs, caches and backups.
  • Ignoring subcontractors: review model, cloud, support, monitoring and security providers, not only the contracting brand.
  • Leaving portability until exit: run an export and restoration test before production use.
  • Delegating AI Act duties to the vendor: document your own role, intended purpose, human oversight and monitoring.
  • Overlooking operational burden: price staffing, patching, incident response, resilience and legal review for self-managed deployments.
  • Using stale legal dates: check the current Commission timeline and consolidated legislation whenever a procurement decision is renewed.

What a defensible decision record contains

Keep a concise file containing the use-case statement, data-flow map, GDPR role analysis, transfer assessment, AI Act classification, scorecard, evidence links or document references, test results, accepted risks, contract deviations, approval signatures and review date. State which facts are contractual commitments and which are provider assertions. Reopen the assessment when the model, processing region, subprocessor list, ownership, law, intended purpose or risk classification changes.

The result is not a generic label such as “sovereign” or “GDPR compliant.” It is a documented decision showing why this platform, in this configuration, can lawfully and securely perform this use case—and what controls remain your organisation’s responsibility.
