How do I move from the US to India? Start by mapping every traveler’s citizenship, U.S. immigration status, Indian ancestry and possible OCI eligibility, purpose of stay, expected duration, employment or study plans, and dependents. Then secure the correct Indian entry status, build separate U.S. and Indian tax calendars, confirm banking and remittance treatment with an authorized bank, and plan baggage and shipments under current customs rules.
A visa controls whether you may enter India and what activities you may perform. It does not decide whether you are a tax resident. U.S. citizenship or resident-alien status can preserve U.S. filing duties after departure, while India applies its own tax-year day-count tests. Treat immigration, tax, money, and household logistics as related but separate workstreams.

1. Build a household status matrix before booking travel
Do not assume one application or one tax answer covers an entire household. Create a row for each traveler and record the facts that change the available route.
| Question | Why it changes the plan |
|---|---|
| Which passport or passports does the person hold? | India’s visa and entry permissions are tied to nationality and the passport used for travel. |
| Is the person a U.S. citizen, green-card holder, or another U.S. immigration category? | U.S. tax filing and reporting obligations can continue after moving; green-card status also has separate immigration consequences. |
| Does the person have Indian ancestry or another possible OCI connection? | OCI is a distinct eligibility path, not an automatic entitlement based only on a family story or marriage. |
| How long will the person stay? | Duration affects visa validity, possible registration, and Indian tax-residence analysis. |
| Will the person work, study, conduct business, or retire? | Indian permissions are activity-specific. A route suitable for tourism is not necessarily suitable for employment. |
| Who are the dependents? | Spouses and children may need their own applications and supporting evidence; their tax residence may differ from the principal traveler’s. |
Keep copies of passports, prior Indian visas, U.S. immigration documents, marriage or birth records, Indian-origin evidence, employment letters, school records, and proof of address. A travel-document organizer is useful for keeping the physical originals and copies together, but it does not replace the official application requirements.

2. Choose the correct Indian entry route
A foreign national generally needs a valid passport plus an Indian visa, an eligible eVisa, or qualifying OCI status. Use India’s official visa portal and, where required, the Indian Mission with jurisdiction over the applicant’s U.S. residence. Read the visa grant itself for validity, entries, permitted activity, and conditions.
When an eVisa may be appropriate
The eVisa portal lists limited categories and conditions. It is not a general relocation permit. Most importantly, the government eVisa FAQ states that employment is not allowed on an eVisa. Do not enter on an eVisa intending to start a job, provide services for an Indian employer, or quietly change activities after arrival.
When employment requires a regular visa route
India’s regular visa provisions include an employment-visa category and supporting employment documentation. A person moving for a job should obtain the category that authorizes that work and confirm the current document list with the Indian Mission handling the U.S. place of residence. An offer letter alone does not prove that every immigration condition has been met; the employer, role, duration, and other evidence may matter.

Study, research, medical treatment, business activity, tourism, and accompanying-family situations can have different categories and restrictions. Each traveler should be assessed separately, even when everyone flies together. Never rely on an informal description such as “moving visa”; use the official category whose permitted purpose matches the actual plan.
Registration and visa conditions
The visa provisions state that registration is compulsory for a visa longer than 180 days, subject to the conditions and instructions applicable to the granted visa. Check the current official instruction and follow any reporting deadline or office direction printed with the visa. A long-validity visa is not permission to ignore registration, local reporting, or activity limits.
3. Check OCI separately from citizenship
People with Indian ancestry or qualifying family connections should review the Ministry of Home Affairs’ current OCI eligibility, exclusions, application procedure, and miscellaneous-services material. Eligibility depends on the current legal criteria and documentary proof. Being married to an Indian citizen, having an Indian-born ancestor, or having once held an Indian passport does not by itself establish eligibility.
What OCI provides—and what it does not
OCI is a long-term status for eligible people of Indian origin, but it is not Indian citizenship. An OCI holder does not receive an Indian passport and must travel internationally on the holder’s foreign passport. OCI also does not confer voting rights or eligibility for Indian government employment, and other restrictions and permissions apply to particular activities.

The U.S. State Department’s India information and the Ministry of Home Affairs should be read together with the current OCI grant and any later miscellaneous-service document. Keep the OCI record, foreign passport, and any required update acknowledgements available when traveling. If a passport is renewed or personal details change, check whether an OCI update or re-issuance action is required under the current procedure.
4. Separate U.S. tax filing from Indian tax residence
Leaving the United States does not automatically end U.S. tax obligations. U.S. citizens and U.S. resident aliens generally remain subject to U.S. income-tax rules on worldwide income while abroad. The filing, information-reporting, and payment consequences depend on the person’s status, income, accounts, investments, business interests, and transactions.
U.S. foreign earned income and housing provisions
The IRS says the foreign earned income exclusion and foreign housing provisions require a foreign tax home and satisfaction of a qualifying residence or physical-presence test. The tests are not automatic merely because someone rents a home in India or spends a year outside the United States. The IRS states: “You do not automatically acquire bona fide resident status merely by living in a foreign country or countries for one year.”
Keep a travel-day log, work-location records, pay statements, employment contracts, lease documents, and evidence showing where the tax home and ordinary residence were maintained. The physical-presence and bona-fide-residence routes have different requirements; do not claim an exclusion until the applicable test and filing period have been checked.
Foreign tax credit or deduction
Foreign income tax paid may potentially qualify for a U.S. foreign tax credit or deduction under U.S. rules. The choice, limitations, source of income, and interaction with excluded income can be complex. Preserve Indian tax challans, assessments, salary certificates, and exchange-rate records. Obtain advice before choosing a treatment if you have equity compensation, self-employment or business income, rental property, retirement accounts, trusts, or more than one tax residence.
India’s tax year and day-count tests
India determines residence under the rules applicable to the relevant tax year. The Income Tax Department describes a 182-day test and a 60-days-in-the-year plus 365-days-in-the-preceding-four-years test, with exceptions and modified thresholds for specified Indian citizens and people of Indian origin. A day count without the person’s status and exception analysis is not a complete answer.
For tax years before 1 April 2026, apply the relevant provisions of the Income-tax Act, 1961. The Income Tax Department says the Income Tax Act, 2025 applies to tax years beginning on or after 1 April 2026. Label every calendar calculation with the exact tax year, record arrival and departure dates, and account for travel during the year.

One person can have obligations in both countries
Visa permission, U.S. tax residence, and Indian tax residence are separate determinations. A person can hold a visitor or employment visa while becoming an Indian tax resident, and can remain a U.S. citizen or resident alien for U.S. tax purposes after becoming resident in India. Coordinating the two systems may require treaty and foreign-tax-credit analysis from a qualified professional.

Use a calendar rather than relying on memory. Add the following entries for each household member:
- U.S. federal filing and estimated-tax dates, plus any state filing or part-year-residence review.
- Every entry and exit date for India and other countries.
- Indian return, advance-tax, withholding, and employer-document dates that apply to the person’s status.
- Dates for exercising equity, receiving bonuses, selling investments, or transferring property.
- Deadlines for foreign-account, asset, or remittance reporting identified by a tax adviser or financial institution.
Save the source documents in a consistent folder: passports and entry stamps, visa or OCI records, employer certificates, brokerage statements, bank confirmations, remittance receipts, and evidence of tax paid. A clear audit trail is more useful than an approximate total reconstructed months later.
6. Confirm banking and transfers before moving money
Do not close U.S. accounts or send a large transfer until the relevant institutions confirm how the move changes account eligibility, residency declarations, permitted credits and debits, fees, exchange rates, and reporting. RBI and FEMA rules can differ by person and account status; one notification or a generic internet explanation is not a universal relocation plan.
Questions for an authorized Indian bank
- Which account type is available for this passport, visa or OCI status, and expected residence?
- Can salary, pension, investment proceeds, gifts, or sale proceeds be credited?
- What documentation is required to establish the source of funds?
- Which remittances may be received or sent, and what declarations are needed?
- How will currency conversion, transfer fees, correspondent-bank charges, and transaction limits be shown?
- What happens if the person later becomes non-resident or changes status?
Ask the U.S. bank and brokerage about address changes, withholding, account restrictions, international wires, and tax forms. Keep statements showing the sending account, beneficiary, date, currency, exchange rate, fees, and purpose. Do not describe a transfer as a gift, loan, salary, or investment unless that description is accurate and documented.

Separate airline baggage from a commercial household-goods shipment. Baggage is handled under traveler and airline procedures; a shipment may involve a carrier, customs broker, warehouse, insurance, and destination delivery.
Prepare an inventory
- List each box and its contents in plain language, including quantity, approximate age, and value.
- Identify high-value electronics, jewelry, medicines, artwork, collectibles, and items containing batteries or restricted materials.
- Photograph serial numbers and condition before packing.
- Keep a copy of the inventory with the passport and travel records, and give the mover the same version.
- Obtain written terms for packing, insurance exclusions, transit time, storage, destination handling, customs documentation, and delivery to the final address.
Check current Indian customs treatment
Review the Central Board of Indirect Taxes and Customs’ international-traveler resources and the current Baggage Rules guide before departure. Do not assume that all household effects enter duty free. Treatment can depend on the traveler’s category, item type, quantity, value, documentation, and whether goods arrive as accompanied baggage or cargo.

The CBIC ATITHI tool can support traveler declarations, but it is not a substitute for confirming shipment rules with customs or the carrier. Ask for a written explanation of any estimated duty, examination, storage, demurrage, or delivery charge before signing.
Items needing extra care
- Medicines: carry prescriptions and verify import and quantity rules before packing.
- Food and plants: check agricultural, animal, and quarantine restrictions; do not place unverified items in a mixed household box.
- Electronics: record serial numbers and check voltage, plugs, warranty geography, and battery-shipping limits.
- Documents and valuables: keep them in personal baggage, not an unaccompanied shipment.
8. Plan departure tasks in a controlled order
Once the route is known, complete tasks in an order that avoids making an irreversible move too early.

- Confirm status: verify every passport, visa or OCI application, supporting document, and travel-date constraint.
- Get tax advice: identify U.S. filing, state, Indian residence, equity, property, and account issues before selling or transferring assets.
- Notify institutions: update employers, banks, brokerages, insurers, schools, and healthcare providers with the correct future address and effective date.
- Arrange housing: secure a documented destination address and understand lease, deposit, utility, and local identification requirements.
- Book travel only after permission is clear: confirm passport validity, visa entries, transit requirements, and any airline document checks.
- Pack separately: create personal-baggage, carry-on-document, and shipment inventories.
- Preserve access: maintain secure access to U.S. accounts, two-factor authentication, password recovery, and copies of records.
9. Complete arrival requirements in India
The Bureau of Immigration portal says foreign nationals and OCI holders can submit an e-Arrival Card within 72 hours before arrival. The e-Arrival Card is arrival information; it is not a visa and does not replace the permission required for the trip. Check the official portal shortly before travel because procedures can change.
At arrival, retain copies of the passport bio page, visa or OCI record, entry confirmation, boarding pass, address, and shipment documents. If the visa requires registration or reporting, complete it within the stated period and keep the acknowledgement. Do not wait for an airline, landlord, or employer to infer that duty from your visa.
First-week records
- Photograph or scan entry records and immigration endorsements.
- Confirm that the employer, school, or sponsor has the documents required for its compliance files.
- Open or convert accounts only after the bank confirms the permitted status and documentation.
- Update the tax-day log with the actual arrival date.
- Check shipment tracking, customs requests, insurance notices, and delivery conditions.
10. Compare options using the same decision axes
There is no single best route for every U.S.-to-India move. Compare each option against the same questions.
| Decision area | Questions to answer |
|---|---|
| Visa or OCI | Is the person eligible? What purpose is permitted? How long and how many entries? Is work authorized? Is registration required? |
| Tax | Will U.S. citizenship or resident-alien status continue? Which U.S. exclusion or credit rules might apply? What Indian day count and tax-year law govern? |
| Money | Which account is permitted? What transactions are allowed? What are the fees, exchange rate, documentation, and reporting consequences? |
| Belongings | Should the item be carried or shipped? What are its value, customs, insurance, storage, and delivery risks? |
| Destination setup | Does the chosen city and housing meet the household’s work, schooling, healthcare, and transport needs? |
City selection, schooling, healthcare, and local transport are household- and city-specific decisions. Resolve them after identifying the destination and budget rather than treating a nationwide answer as reliable.

Using an eVisa for a job
Problem: employment is not permitted on an eVisa. Correction: stop and obtain the regular employment route and supporting documents before beginning work.
Best Value

- Comes with secure packaging
- Helpful in various ways
Assuming OCI equals citizenship
Problem: OCI does not provide an Indian passport, voting rights, or Indian government employment rights. Correction: carry the foreign passport and OCI record and check the activity-specific limits.
Stopping U.S. tax filings at departure
Problem: U.S. citizens and resident aliens generally retain U.S. tax obligations abroad. Correction: establish the filing calendar and gather foreign-income and foreign-tax records.
Using one Indian day-count rule for every year
Problem: thresholds have exceptions and the governing Act changes for tax years beginning on or after 1 April 2026. Correction: label the tax year, apply the person’s status and exceptions, and document every day in India.
Promising duty-free entry for all household goods
Problem: customs treatment depends on the current rules and the traveler and goods. Correction: check CBIC guidance and obtain written carrier or customs advice for the actual inventory.
Transferring money without a paper trail
Problem: banks and tax authorities may ask for source, purpose, account status, and tax records. Correction: confirm the route with an authorized bank and retain wire and exchange documentation.
12. A final pre-departure checklist
- Every traveler has a valid passport and the correct Indian visa or qualifying OCI status.
- No traveler intends to work under an eVisa.
- Visa validity, entries, registration, and activity conditions have been read from the grant.
- U.S. and Indian tax calendars use actual travel dates and the correct tax-year law.
- Foreign income, tax paid, account, investment, and remittance records are preserved.
- An authorized bank has confirmed account eligibility and transfer documentation.
- Baggage and shipment inventories are separate, insured, and supported by written terms.
- Restricted medicines, food, plants, batteries, and valuables have been checked individually.
- The e-Arrival Card requirement has been checked within the stated 72-hour window.
- Copies of identity, immigration, tax, banking, and shipment records are accessible offline.
The safest move is a coordinated one: match each person to the correct Indian permission, keep U.S. and Indian tax analysis distinct, confirm money movement with the institutions that will process it, and treat household goods as a customs decision rather than an assumption.
