How Digital Cash Protects Privacy—and What Data Banks May Still Collect

Digital cash is not automatically private. Privacy depends on the system’s architecture, the laws governing it, and which participant can connect a payment to a real person. A proposed retail central bank digital currency (CBDC) could hide a user’s identity from a merchant or keep the central bank from directly seeing names, while an onboarding intermediary still verifies the customer and handles legally required anti-money-laundering checks. Ordinary bank deposits are already digital, but they are commercial-bank liabilities—not CBDC—and the bank or payment provider normally retains account and transaction information needed to operate the service and comply with law.

What “digital cash” means

The phrase covers two different things that should not be conflated.

Electronic money in a bank account

Most money people use electronically is a balance in a commercial-bank account. That balance is a claim on the bank. When you pay by card, online transfer or a banking app, the bank and payment network process the transaction and maintain records under their operational, fraud-prevention and legal obligations.

A retail central bank digital currency

A retail CBDC would be a digital liability of a central bank made available to the public. It would not simply be a new screen for an existing bank balance. The Federal Reserve’s 2022 paper describes a general-purpose CBDC as generating data about users’ financial transactions “in the same ways that commercial bank and nonbank money generates such data today.” It also says any CBDC would need to balance consumer privacy with transparency needed to deter crime. Those statements are policy analysis, not evidence that the United States has issued or approved a retail CBDC.

Why the distinction changes the privacy answer

A bank deposit, a CBDC wallet and a private payment app can have different operators, records and access rules. Asking whether “digital cash” is anonymous without naming the system therefore produces a misleading yes-or-no answer. The useful questions are: who checks identity, who sees each payment, who can link records to a person, how long data are kept, and under what law information can be disclosed?

Privacy is an architectural choice

The Bank for International Settlements (BIS) describes retail-CBDC design as a balance between a direct claim on the central bank and the benefits of using payment intermediaries. The following choices determine where privacy exists and where it does not.

Identity-based or token-based access

In an account-based model, access is tied to an identity system. A provider normally verifies the holder and associates activity with that account. A token-based model uses cryptographic credentials representing value; the token itself may not contain a person’s name. Neither label settles the issue. The surrounding wallet, exchange, recovery process, fraud controls and legal rules can still identify the user or connect transactions.

One-tier or intermediated operation

A central bank could operate customer-facing wallets directly, or private institutions could provide wallets, onboarding, support and compliance while the central bank operates settlement infrastructure. In an intermediated, or two-tier, design, the intermediary may hold the identity mapping and customer relationship even if the central bank receives only a limited or pseudonymised transaction record.

What counterparties can see

Privacy is specific to an observer. A merchant may need confirmation that a payment succeeded but not the payer’s full account history. A payment provider may see identity, amount, time and counterparties to execute and monitor the payment. A central bank may receive settlement information without a directly identifying name, depending on the design. A court or financial-intelligence authority may obtain information under applicable law.

Data minimisation and retention

The BIS notes that privacy protection is not only a cryptography problem. Rules can limit what payment applications collect, require deletion of old transaction data, and restrict reuse for unrelated purposes. Storing less data reduces the consequences of a breach, but retention periods and deletion rights must be defined by law and system policy rather than assumed.

What banks and payment providers may still collect

There is no universal list that applies to every bank, country or service. The provider generally needs enough information to open and service an account, authenticate the user, execute payments, prevent fraud, resolve disputes and meet legal obligations. Depending on the product and jurisdiction, records can include identity and contact details, account identifiers, payment instructions, amounts, timestamps, counterparties, device or authentication signals, and communications about suspicious activity. The exact fields and retention periods vary with the service, risk and law.

Customer due diligence and monitoring

For covered institutions in the United States, FinCEN’s customer-due-diligence guidance describes four broad duties:

  • Use procedures to identify and verify customers.
  • Understand the nature and purpose of a customer relationship to develop a risk profile.
  • Monitor activity to identify and report suspicious transactions.
  • Maintain or update customer information on a risk basis.

A 2026 FinCEN FAQ update provides relief from identifying and verifying legal-entity beneficial owners at each new account opening. It does not remove broader risk-based due diligence or suspicious-activity monitoring. This is a United States rule for covered institutions, not a global standard and not proof that every customer is monitored identically.

Why compliance and privacy can coexist

Privacy does not require that no one can ever access payment data. A system can limit routine visibility, separate identity records from settlement records, and permit access only to authorised parties for specified purposes. Anti-money-laundering and counter-terrorist-financing rules may nevertheless require institutions to collect, retain or share personal data. The legal basis, permitted recipients and oversight differ by jurisdiction.

How a proposed digital euro describes privacy

The European Central Bank (ECB) presents the digital euro as a project, not an already-issued currency. Its published design statements illustrate how privacy claims must be attributed and qualified.

Online payments

The ECB says intermediaries would access the personal data needed to comply with European Union law, including anti-money-laundering and counter-terrorist-financing obligations. It also says the Eurosystem would receive pseudonymised data and would not be able to directly link online payments to a person. “Pseudonymised” means direct identity fields are replaced by identifiers; it does not mean that nobody can identify the user. An intermediary may retain the mapping or other information that makes re-identification possible.

Offline payments

The ECB’s stated offline design aims for payment details to be known only to the payer and recipient. Offline capability raises separate questions: how value is secured on a device or card, how spending limits and double-spend protection work, what happens if a device is lost, and when records are reconciled after reconnection. The privacy statement describes the intended information flow, while final legislation and implementation determine the enforceable result.

Timeline and status

On the ECB project page accessed on 13 October 2026, possible first issuance was targeted for 2029 if necessary EU legislation is adopted in 2026. The ECB’s pilot FAQ described an operational pilot planned for the second half of 2027. Both are contingent plans that can change; neither means a digital euro is currently available for general use.

Compare cash, bank payments and CBDC proposals by asking six questions

Privacy axis Question to ask Why it matters
Identity at onboarding Who checks identity, and what information is retained? Onboarding can create a durable link between a person and a wallet or account.
Transaction visibility Can the merchant, provider, central bank or another operator see payer, payee, amount and time? Different participants may see different portions of the same payment.
Linkability Can records be linked to a named person directly or through an identity mapping? Pseudonymised records may still be linkable by a party holding additional data.
Offline capability Can payment occur without a network, and where are records stored before reconciliation? Offline privacy and recovery depend on device controls, limits and later synchronisation.
Compliance access What data may be accessed, retained or shared for AML/CFT and other legal duties? Privacy promises must be read alongside lawful disclosure and monitoring powers.
Governance Which laws, oversight bodies, access controls, retention limits and remedies apply? Technical design cannot substitute for enforceable rules and accountability.

What “anonymous” can and cannot mean

Use the word only after naming the observer and the transaction stage. A payment might conceal a customer’s name from a merchant while the wallet provider knows it. A central-bank dataset might be pseudonymised while an intermediary retains the identity mapping. Offline records might be visible to the two participants but not routinely uploaded with names. None of these examples establishes universal anonymity.

A practical privacy description should specify five elements: the party that can see data, the fields visible (identity, amount, time and counterparty), whether records can be linked later, the retention period, and the legal conditions for access. If a provider’s policy does not answer those questions, its use of “private” or “anonymous” is incomplete.

Evidence that privacy affects willingness to use CBDC

A 2023 BIS Working Paper reported a randomized online survey experiment with a nationally representative South Korean sample of more than 3,500 participants. In that experiment, privacy-protective CBDC design variations and information about privacy benefits increased willingness to use a CBDC by up to 60% when participants purchased privacy-sensitive products. The figure describes that sample and scenario; it is not a forecast that adoption of a live currency would rise by 60%.

United States and cross-border cautions

The Federal Reserve’s January 2022 discussion paper said it would not proceed with a US CBDC without clear executive-branch and Congressional support, ideally through specific authorizing legislation. That position should not be read as an issuance decision. Requirements also cannot be transferred automatically between jurisdictions: the BIS legal analysis emphasises that each jurisdiction may need its own legislative, regulatory and contractual framework. US FinCEN obligations do not define the rules for the euro area, and an ECB project description is not a worldwide standard.

A checklist for evaluating a digital-payment privacy claim

  1. Identify the instrument. Determine whether it is a commercial-bank deposit, a proposed CBDC, a card network product or another private service.
  2. Map the participants. List the merchant, wallet or bank, payment processor, central bank, telecommunications or device provider and any lawful authority.
  3. Trace each data field. Ask who receives identity, amount, time, location, device and counterparty information.
  4. Check linkage. Find out whether pseudonyms can be connected to an account holder through a separate database.
  5. Read retention and deletion rules. Look for storage duration, backups, fraud records and exceptions for legal holds.
  6. Review access conditions. Identify routine staff access, automated monitoring, suspicious-activity reporting and processes for lawful requests.
  7. Separate promises from status. For a proposed system, distinguish the institution’s stated design from enacted law, final specifications and real-world operation.

Common misunderstandings

“Digital means the central bank sees every purchase.”

Not necessarily. A design can keep the central bank from directly linking pseudonymised online data to a person, while an intermediary still sees information needed for onboarding and compliance. Visibility depends on the architecture and legal access rules.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“A CBDC is just my bank’s app balance.”

No. A bank balance is a commercial-bank liability; a retail CBDC would be a central-bank liability. The issuer, intermediary roles and records can therefore differ.

“Privacy means banks cannot monitor anything.”

Financial-crime rules can require customer identification, risk profiling, monitoring, recordkeeping and reports. Privacy controls aim to limit unnecessary or unauthorised access, not abolish lawful compliance.

“Pseudonymised means anonymous forever.”

Pseudonymisation removes direct identifiers from a dataset. A party with the mapping or additional data may still reconnect records to a person.
