How Data Centers Connect to the Electric Grid and What Permits They Need

A data center normally obtains electricity through its serving utility. Large requests—generally more than 20 megawatts (MW) in the Federal Energy Regulatory Commission’s (FERC) current large-load docket—can trigger utility and regional-grid studies, network upgrades, special service agreements and reliability conditions. Permits are separate: there is no single nationwide “data center permit.” Zoning, construction, air, water, stormwater, wastewater, waste and energy-facility approvals depend on the site, equipment and state or local jurisdiction.

What happens when a data center asks for grid service?

The connection process is a coordinated engineering and regulatory review, not a single application. The utility must determine whether it can serve the requested load safely, what equipment must be built, who pays for upgrades and which operating restrictions apply. In some regions, the regional transmission organization (RTO) or independent system operator (ISO) also participates.

1. Choose a site and identify the serving utility

Start by confirming which utility owns the distribution system and which entity controls the relevant transmission facilities. Available capacity, substation proximity, voltage level, transmission constraints and the utility’s queue rules can materially change a site’s feasibility. A parcel that appears to have ample land may not have deliverable electrical capacity.

Ask the utility for its large-load or economic-development contact, applicable tariff, service territory boundaries and data requirements. The federal sources discussing large-load connections address system-scale issues; they do not provide a universal site-selection checklist.

2. Submit a large-load service request

The request normally includes the requested MW, expected ramp-up, energization date, operating profile, power factor, redundancy design and whether the load can be curtailed. A phased campus should show each phase and the date it becomes operational rather than presenting only a final build-out number.

FERC’s RM26-4 proceeding generally describes a “large load” as demand above 20 MW and specifically identifies data centers among the customers affected by evolving rules. That figure is a working description for the federal proceeding, not a universal threshold that every utility uses for studies or permits.

3. Complete technical studies

The utility, and where applicable the RTO or ISO, evaluates thermal loading, voltage, short-circuit duty, transient and dynamic stability, protection coordination and contingency performance. Studies may identify a new substation, transformer, feeder, transmission line, protection equipment or telecommunications work.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Study methods, deposits, queue priority, deadlines and upgrade-allocation rules differ by region. FERC’s 2026 materials identify study speed, cost transparency, co-located generation, flexible service and pending requests as active policy questions. They do not create one nationally implemented process.

4. Negotiate service terms and upgrades

After studies, the customer and utility resolve the facilities to be built, construction responsibilities, financial security, milestone dates, operating limits and responsibility for network upgrades. The agreement may address outage coordination, power-quality requirements, telemetry, protection settings and the consequences of missing a construction milestone.

Cost treatment is site-specific. No reliable national average connection cost exists because the result depends on the requested load, available capacity, voltage level, upgrade scope and local tariff. Obtain a written utility estimate and identify which amounts are refundable deposits, customer-owned facilities, nonrefundable contributions or network costs allocated under the regional rules.

5. Build customer and utility infrastructure

Work can include a customer substation, medium- or high-voltage switchgear, feeders, transformers, transmission upgrades and the data center’s internal distribution system. Redundant campuses may require physically diverse feeds or separate substations, but the exact design is an engineering decision rather than a federal standard.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Construction approvals for these facilities are separate from the service agreement. A utility may own a line or substation while the customer must obtain local land-use, building, stormwater or environmental approvals for its own site work.

6. Commission service

Energization follows completion of the agreed facilities, inspections, protection testing, witness tests and satisfaction of the utility’s operating requirements. A precise nationwide schedule cannot be promised. Available capacity, study revisions, equipment lead times, land rights, environmental reviews and local approvals determine when each phase can take service.

Three regulatory processes that are often confused

Process What is connecting? Typical lead authority What it does not cover
Large-load electric service A customer’s demand, such as a data center campus Serving utility; RTO/ISO may study transmission effects It is not automatically a FERC permit to build a transmission line
Generator interconnection A generator exporting or paralleling power with the grid Utility and, for transmission-level facilities, the applicable RTO/ISO and FERC framework It does not approve a customer’s ordinary load request
Transmission-line siting A new or modified interstate transmission facility Usually state authorities; FERC has limited backstop authority for qualifying projects in a DOE-designated National Interest Electric Transmission Corridor and under statutory conditions It does not replace local permits or automatically provide data-center service

Keeping these tracks separate prevents a common mistake: assuming that a data center’s service request is itself a federal transmission-line application. They can intersect when serving the load requires a new line, but each project still follows its own approvals.

Which electrical-service arrangement is being considered?

Large-load customers may evaluate several arrangements. FERC’s current proceedings discuss these options as policy issues, not as universally available products. The utility and regional operator must confirm what is permitted in the relevant tariff.

Option Study and reliability questions Upgrade and cost questions Environmental and regulatory exposure
Ordinary utility grid service Full load-flow, contingency, protection and stability review at the applicable voltage Substation, feeder or transmission upgrades may be assigned under regional rules Utility construction and the customer’s site permits still apply
On-site or co-located generation Paralleling, protection, islanding, dispatch and export studies are added; generator interconnection is distinct from load service Fuel supply, interconnection equipment and any network upgrades require separate allocation Air, fuel, noise, water and energy-facility approvals can be required
Distribution-level service Lower-voltage equipment and feeder limits can govern; large requests may still affect the transmission system New feeders, transformers or substations may be needed Local construction and environmental reviews remain relevant
Transmission-level service More extensive regional reliability studies and operating coordination are likely High-voltage facilities and network upgrades can be substantial; cost rules are regional A qualifying new transmission project may trigger additional state and federal environmental review
Firm load Designed to serve the contracted demand except for defined outages or emergencies May require more network capability and firm-rights charges Does not eliminate ordinary environmental permits
Flexible or curtailable load Must define notice, duration, frequency and verification of curtailment Could reduce required upgrades or improve queue treatment where tariffs allow, but savings are not guaranteed Still requires permits for the physical facility and any generation

Do not assume that co-location, flexible service or a private generator avoids grid studies. Each arrangement must be accepted under the utility’s tariff and regional reliability rules.

Permits a data center may need

Permit names and thresholds vary by state, county, city and project design. The following categories are a due-diligence map, not a nationwide legal checklist. Confirm every item with the local authority having jurisdiction and the state agencies that regulate the site.

Land use, zoning and site approval

Local governments decide whether the parcel allows a data center, substations, cooling equipment, generators, fuel tanks and transmission easements. A project may need a conditional-use, special-use, site-plan or subdivision approval. Iowa’s environmental agency notes that land use, local ordinances and zoning approvals are handled by city or county authorities. Other jurisdictions use different names and review standards.

Building, electrical and fire approvals

Building permits, electrical permits, grading approvals and fire-code reviews commonly cover the structures and equipment. Confirm the adopted code edition, inspection sequence, emergency-access plan, battery rooms, fuel storage, fire suppression and occupancy classification with the local building and fire officials. The available federal and state examples do not establish one uniform national permit path.

Air permits for generators and other combustion equipment

Diesel or natural-gas backup generators, turbines and other combustion equipment can require air-quality review. Minnesota’s Pollution Control Agency reviews air pollution from emergency generators, while Missouri’s Department of Natural Resources states that an air permit may be required depending on potential emissions. The answer depends on engine ratings, fuel, hours of operation, emergency-only status, testing, total site emissions and state thresholds.

List every engine and operating scenario early. A “backup” label does not by itself guarantee an exemption, particularly when generators participate in demand response, operate for testing, or run as a principal or supplemental power source.

Water withdrawals, cooling and wastewater

Cooling towers, evaporative systems, make-up water, wells and process water can trigger water-appropriation or supply approvals. Blowdown, sanitary flows and other discharges may require wastewater permits, sewer-connection approvals or pretreatment agreements. Minnesota and Iowa identify water and wastewater requirements as conditional categories, not automatic permits for every facility.

Stormwater and land disturbance

Clearing, grading, roads, substations and utility corridors can bring construction-stormwater obligations. Coverage may depend on disturbed acreage, receiving waters and state rules. Prepare an erosion and sediment-control plan and confirm whether the project needs a construction stormwater permit before earthwork begins.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Waste and hazardous materials

Projects should verify requirements for used oil, solvents, batteries, electronic waste, construction debris, fuel storage and spill prevention. The exact programs and thresholds are jurisdiction-specific; include them in the environmental review rather than assuming that the building permit addresses them.

On-site generation and energy-facility approvals

California’s Energy Commission states that it does not permit data centers as facilities, but it has authority over certain associated generation and can review exemption or certification pathways. Even when an exemption is granted, the developer remains responsible for applicable local, state and federal permits for the generating plant. This illustrates why a data center and its power plant must be analyzed as related but distinct facilities.

Transmission-project environmental review

If serving the campus requires a qualifying new transmission facility, additional environmental review and federal coordination may apply. The Department of Energy’s Coordinated Interagency Transmission Authorizations and Permits (CITAP) program is designed for qualifying electric-transmission projects. It coordinates federal reviews but does not replace state or local approvals.

What changed in federal policy in 2025 and 2026?

FERC’s RM26-4 large-load proceeding

The proceeding began after a Department of Energy direction dated October 23, 2025, asking FERC to consider reforms for timely and orderly interconnection of large loads. The docket identifies data centers as potential participants and uses demand above 20 MW as its general description of a large load.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

June 18, 2026 show-cause orders

On June 18, 2026, FERC issued tailored show-cause orders to the six regional grid operators and their transmission owners. FERC asked them to justify existing tariffs or propose changes involving large-load processes, cost transparency, co-location, flexible service and related generation studies. These orders begin an evolving regulatory process; they are not a single nationwide service tariff or a guarantee that a pending project will receive capacity.

FERC’s fact sheet expressly preserved state authority: “nothing in today’s orders intrudes either on the authority of states to select, site, and permit generating resources or on the authority of state public utility commissions to set the rates, terms and conditions of retail sales of electricity.” State siting, environmental permitting and retail-rate regulation therefore remain central to a data center’s project plan.

How the CITAP two-year timeline should be interpreted

DOE describes CITAP as establishing the department as the lead agency to coordinate and accelerate federal environmental reviews and permitting for qualifying electric-transmission facilities. Its standard schedule is two years, beginning with publication of the Notice of Intent to prepare an environmental review document. DOE also says project-specific milestones depend on scope and location.

That two-year figure applies to the federal review schedule for a qualifying transmission project. It does not apply automatically to a data center’s customer interconnection, a distribution upgrade, a generator permit, local zoning or every state approval. Treat it as a transmission-planning benchmark, not an energization promise.

A practical permitting and interconnection work plan

  1. Map jurisdiction. Identify the serving utility, RTO or ISO, city and county planning offices, building and fire authorities, state environmental agencies and any state energy commission.
  2. Freeze the initial design basis. Document phased MW demand, voltage, redundancy, cooling method, generator inventory, fuels, water sources, discharge points and construction disturbance.
  3. Request a utility screening study. Ask for available capacity, voltage options, queue rules, deposits, study assumptions, required data and the process for phased load.
  4. Separate load and generation filings. File the customer-service request independently from any generator-interconnection, export or co-location request.
  5. Build a permit matrix. For each permit, record the agency, trigger, application package, public notice, prerequisite, expiration and construction hold point.
  6. Resolve upgrade responsibility in writing. Confirm ownership, cost allocation, financial security, milestone dates, outage coordination and what happens if the load changes.
  7. Sequence approvals with construction. Do not clear land, install generators or order energization-dependent equipment until required local and environmental approvals are identified.
  8. Plan commissioning evidence. Schedule inspections, emissions testing, protection tests, utility witness tests, stormwater closeout and operating-procedure approval.

Costs, schedules and common failure points

Official sources do not support a universal project cost or connection timeline. A site with spare substation capacity may move faster than one requiring a new high-voltage line, land rights and environmental review. Equipment procurement, transformer availability, queue position, changing load forecasts and local hearings can each become the critical path.

  • Assuming “20 MW” is a legal trigger everywhere: FERC uses it as a general docket description; utilities and states may use different thresholds.
  • Calling a service request an interconnection permit: Customer load service, generator interconnection and transmission siting are separate processes.
  • Treating a backup generator as permit-free: Emissions, fuel, testing and operating hours determine air and other approvals.
  • Using another state’s checklist: Minnesota, Iowa and California examples demonstrate categories, not nationwide requirements.
  • Promising the CITAP schedule: The two-year standard concerns qualifying transmission reviews, not every data-center connection.
  • Changing the load after studies: Higher MW, different ramp rates or added generation can require refreshed studies and revised agreements.

Grid-planning context for site decisions

DOE’s 2026 National Transmission Needs Study page reports that the majority of transmission congestion is concentrated in 5% of hours. That statistic describes system-wide planning conditions, not a data-center-specific reliability result or proof that a particular site has capacity. Use it as context while relying on the utility’s site studies for an actual project decision.

What the project team should verify before announcing a service date

  • The utility has accepted the load request and identified the governing tariff and study track.
  • The RTO or ISO has confirmed any transmission-level review, queue position and reliability requirements.
  • Required substations, feeders, transmission upgrades and customer equipment have owners, designs and funding.
  • Generator interconnection and export rights, if any, are documented separately from load service.
  • Local zoning, building, fire, stormwater and land-disturbance approvals are on the critical path.
  • Air, water, wastewater, waste and energy-facility permits match the final equipment and operating profile.
  • Any federal transmission review is demonstrably within CITAP’s qualifying scope rather than being assumed from the project’s size.
  • The energization date reflects completed studies, construction, inspections and operating agreements—not only a commercial target.

The reliable way to answer “Can this data center get power?” is therefore site-specific: identify the serving utility, submit a complete large-load request, complete the applicable regional studies, fund and build the required facilities, and obtain every local and state approval triggered by the design. Federal policy is changing, but no current FERC action eliminates that project-by-project analysis.
